<section commented="no" display-inline="no-display-inline" section-type="section-one" id="H91214E15926D4C0DB68958FAC2EA66B9"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>North Dakota Trust Lands Completion Act of 2026</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H76F4807A848C484C86D3DE6E378F9CA8"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HE8F90FD3A880405CBFCD68B49EE66C5D"><enum>(1)</enum><header display-inline="yes-display-inline">North Dakota Enabling Act</header><text display-inline="yes-display-inline">The term <term>North Dakota Enabling Act</term> means the Act of February 22, 1889 (25 Stat. 676, chapter 180).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCC160613D5854403901613F3FD6B456D"><enum>(2)</enum><header display-inline="yes-display-inline">Reservation</header><text display-inline="yes-display-inline">The term <term>reservation</term> means any Indian reservation located wholly or partially within the State of North Dakota and recognized under United States treaty, Executive order, or Act of Congress. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4D6E4A47557143BBB14E09E4831ADC1C"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H97F036A9B9274BA4ADA22B54416574E7"><enum>(4)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State of North Dakota, acting through the North Dakota Board of University and School Lands and its agent, the Department of Trust Lands.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6A591223A397468B85A1B391BA0FD27C"><enum>(5)</enum><header display-inline="yes-display-inline">State land grant parcel</header><text display-inline="yes-display-inline">The term <term>State land grant parcel</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HDAB739A84DC44236BCB1B2D7418B49C9"><enum>(A)</enum><text display-inline="yes-display-inline">a parcel of land granted to the State of North Dakota by Congress—</text>
<clause commented="no" display-inline="no-display-inline" id="H4D027879C9BD477C9E76132FBAC0DB95"><enum>(i)</enum><text display-inline="yes-display-inline">on statehood; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H401FF7678C80490EAAC075B3130C943C"><enum>(ii)</enum><text display-inline="yes-display-inline">through a grant pursuant to the North Dakota Enabling Act; </text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4AF2E6B8D7734600AA91376C41EAA595"><enum>(B)</enum><text display-inline="yes-display-inline">a section of land numbered 16 or 36 granted to the State of North Dakota by Congress for school purposes;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF8B935CEA0BD42F38403AAF2C4DA7251"><enum>(C)</enum><text display-inline="yes-display-inline">a parcel of land selected by the State of North Dakota as indemnity for any section of land numbered 16 or 36; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCBEC0F76992549BA8FB9BAF8709D2A62"><enum>(D)</enum><text display-inline="yes-display-inline">a parcel of land other than a parcel of land described in subparagraph (A), (B), or (C) obtained by the State after statehood.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7E50096CAF334FD59A69B77009E3C412"><enum>(6)</enum><header display-inline="yes-display-inline">Unappropriated Federal land</header> <subparagraph commented="no" display-inline="no-display-inline" id="H716B120088FA423C8199E9CB67D20989"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>unappropriated Federal land</term> means public land administered by the Bureau of Land Management located within the State of North Dakota, including public land that is mineral in character.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFDC0961C8FA74C3EA524E08C6E2D0221"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>unappropriated Federal land</term> does not include—</text> <clause commented="no" display-inline="no-display-inline" id="HA2E668DAC9AB4016A0FEDD2763BBFD16"><enum>(i)</enum><text display-inline="yes-display-inline">land (including an interest in land) acquired by the Bureau of Land Management;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HBEA92659E616462FA8BC2F852445A2D5"><enum>(ii)</enum><text display-inline="yes-display-inline">any area of critical environmental concern established pursuant to section 202(c)(3) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)(3)</external-xref>); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HEF0732F6E6FB48A1B9A701FF6E581CFC"><enum>(iii)</enum><text display-inline="yes-display-inline">land that is—</text>
<subclause commented="no" display-inline="no-display-inline" id="H8DCD1E4BF6274D23B18FFFD6E87DE9C7"><enum>(I)</enum><text display-inline="yes-display-inline">withdrawn from—</text> <item commented="no" display-inline="no-display-inline" id="H9DB50CF4C17B43E9A9051CFE3D567F95"><enum>(aa)</enum><text display-inline="yes-display-inline">entry, appropriation, or disposal under the public land laws;</text></item>
<item commented="no" display-inline="no-display-inline" id="H01B8BE170E594BE388055C7E32BD0C8F"><enum>(bb)</enum><text display-inline="yes-display-inline">location, entry, and patent under the mining laws; or</text></item> <item commented="no" display-inline="no-display-inline" id="H32A2FB80C91940A5909C99C7D95582AD"><enum>(cc)</enum><text display-inline="yes-display-inline">disposition under all laws pertaining to mineral and geothermal leasing or mineral materials; </text></item></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H11C428F67B484721BDE2E5CCF4957AF4"><enum>(II)</enum><text display-inline="yes-display-inline">located within a component of the National Landscape Conservation System;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HC597AA635A524E4CB433D9891D8F7C70"><enum>(III)</enum><text display-inline="yes-display-inline">designated as a Research Natural Area;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HA060F47D0A7C4B889B574D8BFFFE20ED"><enum>(IV)</enum><text display-inline="yes-display-inline">located within any reservation;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H851166226E04491899A653EAC1D61DBB"><enum>(V)</enum><text display-inline="yes-display-inline">located within—</text>
<item commented="no" display-inline="no-display-inline" id="H48EF8A154CB54B67B1F3ADE4A3E29301"><enum>(aa)</enum><text display-inline="yes-display-inline">T. 147 N., R. 95 W.;</text></item> <item commented="no" display-inline="no-display-inline" id="H724C8DC54CF54EE5B57D799DCA116662"><enum>(bb)</enum><text display-inline="yes-display-inline">T. 148 N., R. 95 W.; </text></item>
<item commented="no" display-inline="no-display-inline" id="H5E8531549EDB4242B5C45B756118CE0B"><enum>(cc)</enum><text display-inline="yes-display-inline">T. 148 N., R. 96 W.; or </text></item> <item commented="no" display-inline="no-display-inline" id="H666FF6D496D647DCB4FE98328DC1383E"><enum>(dd)</enum><text display-inline="yes-display-inline">T. 149 N., R. 95 W.;</text></item></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H776E9980C321431F871D5145C9F97037"><enum>(VI)</enum><text display-inline="yes-display-inline">located within a United States military reservation; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H1CA63C9851364A7CB9537017608C49DD"><enum>(VII)</enum><text display-inline="yes-display-inline">designated by Congress or the President for conservation purposes. </text></subclause></clause></subparagraph></paragraph></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H09554C93C77F490FB3B4D44B7B13DA8A"><enum>3.</enum><header display-inline="yes-display-inline">Relinquishment and selection; conveyance</header>
<subsection commented="no" display-inline="no-display-inline" id="H55650DF6DEEA412D8320B4320D64E837"><enum>(a)</enum><header display-inline="yes-display-inline">Relinquishment and selection</header>
<paragraph commented="no" display-inline="no-display-inline" id="H2BB57AAA4AEB4B749BD5EF63855079CF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to valid existing rights, if the State elects to relinquish all right, title, and interest of the State in and to a State land grant parcel located wholly or partially within the boundaries of any reservation, the Secretary shall authorize the State to select in accordance with this Act 1 or more parcels of unappropriated Federal land of substantially equivalent value.</text></paragraph> <paragraph id="HBA3579006D1A4987BB2E7855DBB8667B"><enum>(2)</enum><header>Selection</header> <subparagraph id="H93B010FE9DDB4F8AB5F330376AF2C636"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to a mutual agreement between the State and the Secretary, the land exchange authorized under paragraph (1) may be carried out in a single phase or multiple phases. </text></subparagraph>
<subparagraph id="H99AEA5CC8ACF43A29560E07033368E98"><enum>(B)</enum><header>List</header><text display-inline="yes-display-inline">For each phase of the land exchange, the State shall provide to the Secretary a selection list in accordance with this Act, including all selected parcels of unappropriated Federal land of substantially equivalent value.</text></subparagraph> <subparagraph id="HE6D9CA80F05D43CC91602269D42C75A7"><enum>(C)</enum><header>Adjustments</header><text display-inline="yes-display-inline">Adjustments to parcels included in the selection list for each phase may be made as necessary, not later than 120 days of delivery of the list to the Secretary, to equalize the value of State land grant parcels and the overall value of the parcels of unappropriated Federal land selected.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8DEA55366ECB44EC9C13C2BECD052E37"><enum>(3)</enum><header display-inline="yes-display-inline">Approval</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the State makes a selection for each phase under paragraph (2), the Secretary shall approve or reject, in whole or in part, the selection for that phase.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1080F9EB5D5847D2A767811A260BAD68"><enum>(4)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Nothing in this subsection precludes the Secretary from conducting an environmental review of any parcel proposed for relinquishment under paragraph (1) if the Secretary determines that an environmental review is appropriate. </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H114F811BF0074A0AA2913CF08426A31E"><enum>(b)</enum><header display-inline="yes-display-inline">Conveyance</header>
<paragraph commented="no" display-inline="no-display-inline" id="HD89C63F5E59A4A7189C8DBA41158A076"><enum>(1)</enum><header display-inline="yes-display-inline">Conveyance by Secretary</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HECE2C192EC224FBC9BB7970FD5D94B31"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which the Secretary approves a State selection of unappropriated Federal land under subsection (a)(3), the Secretary shall initiate the actions necessary to convey to the State the unappropriated Federal land.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE65BCC188485426C8A8E071B8CF2D76D"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Conveyance of unappropriated Federal land by the Secretary under this Act—</text>
<clause commented="no" display-inline="no-display-inline" id="HDED76217CA684EC4A8BE687D93B07E2E"><enum>(i)</enum><text display-inline="yes-display-inline">shall be by patent or deed in a form acceptable to the State and the Secretary; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HA8B3C1891FA6404CBC1941F3FD1DD4EC"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be considered a sale, exchange, or conveyance for purposes of section 203, 205, 206, or 209 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>, 1715, 1716, 1719). </text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4D9A4F5207ED4525BC62746AF30CDC22"><enum>(2)</enum><header display-inline="yes-display-inline">Relinquishment and conveyance by State</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H1889A53C55434346B63531BA2ACFF1AF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As consideration for the conveyance of unappropriated Federal land under paragraph (1), on the date on which the unappropriated Federal land is conveyed to the State, the State shall concurrently relinquish and convey to the Secretary all right, title, and interest of the State in and to the State land grant parcel identified for relinquishment under subsection (a)(1).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE5B3E513AE784D5AB729B0A030360EB8"><enum>(B)</enum><header display-inline="yes-display-inline">Title</header><text display-inline="yes-display-inline">The State shall convey to the Secretary title, free of any financial claims, liabilities, or other financial encumbrances, to all parcels relinquished under subparagraph (A). </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H281AF6C4C572441786148FFA70367377"><enum>(C)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Relinquishment and conveyance by the State of a State land grant parcel under this Act shall not be considered an exchange or acquisition for purposes of section 205 or 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1715">43 U.S.C. 1715</external-xref>, 1716).</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HCC12D3D5BF8A4438AF3D64E232384AF2"><enum>(c)</enum><header display-inline="yes-display-inline">Succession to rights and obligations</header><text display-inline="yes-display-inline">Each party to which land is conveyed under this Act shall, to the fullest extent allowable under Federal and State law, succeed to the rights and obligations of the conveying party with respect to any lease, right-of-way, permit, or other valid existing right to which the land is subject.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H9014597D166A4F02A788F2D7BC84A1E6"><enum>(d)</enum><header display-inline="yes-display-inline">Management after relinquishment</header>
<paragraph commented="no" display-inline="no-display-inline" id="HF52732FE8E8B42928BDF0186A4329958"><enum>(1)</enum><header display-inline="yes-display-inline">Reservation</header><text display-inline="yes-display-inline">If a State land grant parcel relinquished by the State and conveyed to the Secretary under this Act is located wholly or partially within the boundaries of any reservation, on request of the applicable Indian Tribe, the portion of the State land grant parcel located within the boundaries of the reservation shall be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4C2AAC9B4577428CAF9B503F3EA07D83"><enum>(A)</enum><text display-inline="yes-display-inline">taken into trust by the Secretary on behalf of, and for the benefit of, the Indian Tribe on the date of the conveyance; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H78FDE64F34AF4DA395661E75225FAE64"><enum>(B)</enum><text display-inline="yes-display-inline">considered to be a part of the reservation of the Indian Tribe.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE5693A8FD6F64E428906AE7A98162D30"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation required</header><text display-inline="yes-display-inline">Prior to the conveyance of a State land grant parcel located wholly or partially within the boundaries of any reservation, the State and the Secretary shall consult with affected Indian Tribes, including the Indian Tribe the land of which is subject to conveyance in accordance with Executive Order 13175 (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> note; relating to consultation and coordination with Indian tribal governments) and other applicable laws. </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H29D03C98F51E4DE3BE10A6FECA5ACA0A"><enum>(e)</enum><header display-inline="yes-display-inline">Withdrawal</header>
<paragraph commented="no" display-inline="no-display-inline" id="HA6527BAB8DC94FF79402829593F789A9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to valid rights in existence on the date of enactment of this Act, all unappropriated Federal land selected by the State for conveyance under this Act, effective beginning on the date on which the State makes the selection for such Federal land and ending on the date described in paragraph (2), is withdrawn from all forms of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H9EAB2DE0BF6849C4964104FE22E7846F"><enum>(A)</enum><text display-inline="yes-display-inline">entry, appropriation, or disposal under the public land laws;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0E576E8849DF4E3E807CE62AD813ABAE"><enum>(B)</enum><text display-inline="yes-display-inline">location, entry, and patent under the mining laws; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H812D2E3161504579B220179F4549CBD1"><enum>(C)</enum><text display-inline="yes-display-inline">disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H79F0C6E1B63C4A9C8EEAB3F55254DE27"><enum>(2)</enum><header display-inline="yes-display-inline">Date described</header><text display-inline="yes-display-inline">The date referred to in paragraph (1) is the date on which, as applicable—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H26C8E09D342E4D03867A0F9393D0FAF1"><enum>(A)</enum><text display-inline="yes-display-inline">the unappropriated Federal land is conveyed by the Secretary to the State;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBEEBEF0B6BDC420D803E606A5024DFE9"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary rejects the selection under subsection (a)(3); or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC5A4FF42320F40209A49B7CF54421CCA"><enum>(C)</enum><text display-inline="yes-display-inline">the State withdraws the selection.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H2338CB08E1CC4197B359839336911EE3"><enum>4.</enum><header display-inline="yes-display-inline">Valuation</header>
<subsection commented="no" display-inline="no-display-inline" id="H03CC9B2BF10149469C689EF8E15A9927"><enum>(a)</enum><header display-inline="yes-display-inline">Equal value</header><text display-inline="yes-display-inline">With respect to a State land grant parcel conveyed under this Act in consideration for a parcel of unappropriated Federal land selected in accordance with this Act—</text> <paragraph commented="no" display-inline="no-display-inline" id="H70AD7EA5496345149A04D71EA2343392"><enum>(1)</enum><text display-inline="yes-display-inline">the overall value of the State land grant parcel and the overall value of the parcel of unappropriated Federal land shall be substantially equal; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4334BD5ECA3F4A4DAA0BB9FDAE56E037"><enum>(2)</enum><text display-inline="yes-display-inline">subject to subsection (c), if the overall value of the parcels is not equal, the party conveying the parcel of lesser value shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HFA21F1E700E6472B9305B60427EB4ACC"><enum>(A)</enum><text display-inline="yes-display-inline">equalize the value by the payment of funds to the other party; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1547FF6ADD3E45DAA5AFF835A661B8D9"><enum>(B)</enum><text display-inline="yes-display-inline">enter the imbalance in value on a ledger account in accordance with subsection (e).</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H4CDF3CED405E429ABA9531E0E0E672B5"><enum>(b)</enum><header display-inline="yes-display-inline">Appraisal required</header> <paragraph commented="no" display-inline="no-display-inline" id="H9FF9BAF0FC5F432598018E672FC6E75B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (d), the value of the unappropriated Federal land selected in accordance with this Act and the value of a State land grant parcel conveyed under this Act shall be determined by appraisals conducted by 1 or more independent appraisers selected jointly by the Secretary and the State.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF1F4BDF696FD4C8D8F3C6183D3446D52"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">An appraisal under paragraph (1) shall be completed in accordance with—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H77C06203F48B4DBFB78CDB34A779221B"><enum>(A)</enum><text display-inline="yes-display-inline">the Uniform Appraisal Standards for Federal Land Acquisitions; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H15522FEEFA48420C905B2DF44386D9CC"><enum>(B)</enum><text display-inline="yes-display-inline">subject to subsection (d)(1), the Uniform Standards for Professional Appraisal Practice. </text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H87E4CD8C94674D71913A53515801F691"><enum>(c)</enum><header display-inline="yes-display-inline">Equalization</header><text display-inline="yes-display-inline">With respect to a conveyance to the Secretary of a State land grant parcel of lesser value than the parcel of unappropriated Federal land to be conveyed to the State under this Act, the total value of the equalization payment described in subsection (a)(2)(A) or the ledger entry described in subsection (e), as applicable, may not exceed 25 percent of the total value of the parcel of unappropriated Federal land.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE7CA5B0BF48D4F879931FE8B39D71513"><enum>(d)</enum><header display-inline="yes-display-inline">Low value parcels</header>
<paragraph commented="no" display-inline="no-display-inline" id="HFAA04EBBF9124033A04086B914AA13AF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, with the consent of the State, may use mass appraisals, a summary appraisal, or a statement of value made by a qualified appraiser carried out in accordance with the Uniform Standards for Professional Appraisal Practice to determine the value of a State land grant parcel or a parcel of unappropriated Federal land to be conveyed under this Act instead of an appraisal that complies with the Uniform Appraisal Standards for Federal Land Acquisitions if the State and the Secretary agree that market value of the State land grant parcel or parcel of unappropriated Federal land, as applicable, is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H61504EB2DAD147388F71DBC607EB5E8E"><enum>(A)</enum><text display-inline="yes-display-inline">less than $500,000; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4592CC6853AD42C19388F0003D08B75B"><enum>(B)</enum><text display-inline="yes-display-inline">less than $500 per acre.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1A95793E842E4580A6DC1D367DCA7617"><enum>(2)</enum><header display-inline="yes-display-inline">Division</header><text display-inline="yes-display-inline">A State land grant parcel or a parcel of unappropriated Federal land may not be artificially divided in order to qualify for a summary appraisal, mass appraisal, or statement of value under paragraph (1).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H6329EB0C008441A594DC9324F23D30EB"><enum>(e)</enum><header display-inline="yes-display-inline">Ledger accounts</header>
<paragraph commented="no" display-inline="no-display-inline" id="HF38580EDFC70482CBAD7DB083A152BE5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to a State land grant parcel conveyed under this Act in consideration for a parcel of unappropriated Federal land, if the overall value of the parcels is not equal, the Secretary and the State may agree to use a ledger account to make equal the value.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4CE9F205432646C7A97E119131D6F02C"><enum>(2)</enum><header display-inline="yes-display-inline">Imbalances</header><text display-inline="yes-display-inline">A ledger account described in paragraph (1) shall reflect imbalances in value to be reconciled in a subsequent transaction.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8DD096B6E1EB4476845C6846A74CA735"><enum>(3)</enum><header display-inline="yes-display-inline">Account balancing</header><text display-inline="yes-display-inline">Each ledger account described in paragraph (1) shall be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HEEE5C8CFBF1145C0B0291E11AF4947FB"><enum>(A)</enum><text display-inline="yes-display-inline">balanced not later than 3 years after the date on which the ledger account is established; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7FF330007A8A4F88BAA2FBB040A5AD80"><enum>(B)</enum><text display-inline="yes-display-inline">closed not later than 5 years after the date of the last conveyance of land under this Act.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD7DA0FCFB05E4025BB7B875F4D1A5D97"><enum>(4)</enum><header display-inline="yes-display-inline">Costs</header> <subparagraph commented="no" display-inline="no-display-inline" id="HD997465258444592A213DC91104CD7C3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary or the State may assume costs or other responsibilities or requirements for conveying land under this Act that ordinarily are borne by the other party.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4A484BFC09D1420E96C1BD73F49B2D20"><enum>(B)</enum><header display-inline="yes-display-inline">Adjustment</header><text display-inline="yes-display-inline">If the Secretary or the State assume costs or other responsibilities under subparagraph (A), the Secretary or the State shall make adjustments to the value of the unappropriated Federal land conveyed to the State to compensate the Secretary or the State, as applicable, for assuming the costs or other responsibilities.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8E2036488CD4451280AC0A3B91014970"><enum>(5)</enum><header display-inline="yes-display-inline">Mineral land</header><text display-inline="yes-display-inline">If value is attributed to any parcel of unappropriated Federal land that has been selected by the State because of the presence of minerals under a lease entered into under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) that is in a producing or producible status, and the lease is to be conveyed under this Act, the value of the parcel shall be reduced by the amount that represents the likely Federal revenue sharing obligation under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) with the State, but the adjustment shall not be considered as reflecting a property right of the State.</text></paragraph>
<paragraph id="H9B41DE8789BE434896A32D2058EB820E"><enum>(6)</enum><header>Public inspection and notice</header>
<subparagraph id="H31F757D677D4444FA9758B7F8F328A4D"><enum>(A)</enum><header>Public inspection</header><text display-inline="yes-display-inline">Not later than 30 days before the date of any exchange of Federal land and non-Federal land under this act, all final appraisals and appraisal reviews for the land to be exchanged shall be available for public review at the office of the State Director of the Bureau of Land Management in the Montana-Dakotas State Office.</text></subparagraph> <subparagraph id="H6D46DACFA617496B924FD26E46830DE0"><enum>(B)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall make available on the public website of the Secretary, and the Secretary or the State, as applicable, shall publish in a newspaper of general circulation in North Dakota, a notice that the appraisals conducted under subsection (b) are available for public inspection.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H882ECD162CB048EB953EDA1224333967"><enum>5.</enum><header display-inline="yes-display-inline">Miscellaneous</header>
<subsection commented="no" display-inline="no-display-inline" id="HE56914D80B5C4CF9BC028848690AFB49"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Land or minerals conveyed under this Act shall be subject to all applicable Federal, State, and Tribal law.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H5E638A8D03F34A409356D5AD21AAE9F2"><enum>(b)</enum><header display-inline="yes-display-inline">Protection of Indian rights</header> <paragraph commented="no" display-inline="no-display-inline" id="H8861A804C66A46A2850D1A4F08E63F2D"><enum>(1)</enum><header display-inline="yes-display-inline">Treaty rights</header><text display-inline="yes-display-inline">Nothing in this Act modifies, limits, expands, or otherwise affects any treaty-reserved right or other right of any Indian Tribe recognized by any other means, including treaties or agreements with the United States, Executive orders, statutes, regulations, or case law.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC665ECF6F629439BA6369C395BCC762A"><enum>(2)</enum><header display-inline="yes-display-inline">Land or minerals held in trust</header><text display-inline="yes-display-inline">Nothing in this Act affects—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4E261B41F4B44C40B9950F690461D123"><enum>(A)</enum><text display-inline="yes-display-inline">land or minerals held in trust by the United States as of the date of enactment of this Act on behalf of, and for the benefit of, any Indian Tribe; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H08ED6DBA9C0C41FFA52BF475D5676B25"><enum>(B)</enum><text display-inline="yes-display-inline">any individual Indian allotment.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H1601B6CDE0D844A091A0B4320058C050"><enum>(c)</enum><header display-inline="yes-display-inline">Hazardous materials</header> <paragraph commented="no" display-inline="no-display-inline" id="H9CC5EB14649E45299D7B9531CE98D945"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary and the State shall make available for review and inspection any record relating to hazardous materials on land to be conveyed under this Act.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7ACE0DD098E444659903BC19066F941E"><enum>(2)</enum><header display-inline="yes-display-inline">Certification</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H7D4B2F83E81242C2ACF5037AC0967C7C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Prior to completing a conveyance of unappropriated Federal land under this Act, the Secretary shall complete an inspection and a hazardous materials certification of the land to be conveyed. </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7F82062678CC4476BDA3924FCAABDA53"><enum>(B)</enum><header display-inline="yes-display-inline">State land grant parcels</header><text display-inline="yes-display-inline">Prior to completing a conveyance of a State land grant parcel under this Act, the State shall complete an inspection and a hazardous materials certification of the land to be conveyed.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCC00E86CAF33476CB5AD53D3305E51D7"><enum>(d)</enum><header display-inline="yes-display-inline">Grazing permits</header>
<paragraph commented="no" display-inline="no-display-inline" id="H734A3AE69E204962A941E6E8031DB682"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If land conveyed under this Act is subject to a lease, permit, or contract for the grazing of domestic livestock in effect on the date of the conveyance, the Secretary or the State, as applicable, shall allow the grazing to continue for the remainder of the term of the lease, permit, or contract, subject to the related terms and conditions of the user agreements, including permitted stocking rates, grazing fee levels, access, and ownership and use of range improvements.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0F0416279E65451CAE2001431B7FF85F"><enum>(2)</enum><header display-inline="yes-display-inline">Cancellation</header> <subparagraph commented="no" display-inline="no-display-inline" id="H19EFE9F55C8B455BBEDF084081DFE24C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this Act prevents the Secretary or the State from canceling or modifying a grazing permit, lease, or contract if the land subject to the permit, lease, or contract is sold, conveyed, transferred, or leased for nongrazing purposes.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H127B19DF0A36488D922C5C20838CAC16"><enum>(B)</enum><header display-inline="yes-display-inline">Base properties</header><text display-inline="yes-display-inline">If land conveyed by the State under this Act is used by a grazing permittee or lessee to meet the base property requirements for a Federal grazing permit or lease, the land shall continue to qualify as a base property for the remaining term of the lease or permit and the term of any renewal or extension of the lease or permit.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H95506D9320174B749521AE3BF5A78DF4"><enum>(C)</enum><header display-inline="yes-display-inline">Range improvements</header><text display-inline="yes-display-inline">Nothing in this Act prohibits a holder of a grazing lease, permit, or contract from being compensated for range improvements pursuant to the terms of the lease, permit, or contract under existing Federal or State laws. </text></subparagraph></paragraph></subsection></section>
