<official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of the 25th anniversary of the September 11, 2001, terrorist attacks on the United States and to support programs at the National September 11 Memorial and Museum at the World Trade Center.</official-title>

<section id="HEA28A977A2A949D2AE0D48CFA4E0FD05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>25th Anniversary of 9/11 Commemorative Coin Act</short-title></quote>.</text></section> <section id="HCD6542BE34B44E8F9C8C16A454E9DB2B" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HADED32889C104065A80BCE6DE9E08029"><enum>(1)</enum><text display-inline="yes-display-inline">On September 11, 2001, the United States suffered the deadliest terrorist attacks on United States soil (referred to in this section as <quote>the attacks</quote>).</text></paragraph> <paragraph id="HB4973AF6A7E94508A1B3CD6CB1328E88"><enum>(2)</enum><text display-inline="yes-display-inline">2,977 people were killed during the attacks, marking the single worst foreign attack on United States soil since Pearl Harbor in 1941.</text></paragraph> 
<paragraph id="H50CE916212954898A3C008038738BC0F"><enum>(3)</enum><text display-inline="yes-display-inline">In New York City, 2 planes hit the Twin Towers during the attacks, causing both 110-story towers to collapse in less than 2 hours, as well as destroying 5 other buildings in the World Trade Center complex, leaving a death toll of 2,753 people, including all passengers and crew members of American Airlines Flight 11 and all passengers and crew members of United Airlines Flight 175.</text></paragraph> <paragraph id="H31A391533F204973A53D18EB36138979"><enum>(4)</enum><text>During the attacks, American Airlines Flight 77 struck the side of the Pentagon, killing 184 passengers, crew members, and personnel.</text></paragraph> 
<paragraph id="HDC9E05975454443480B342137A663F5F"><enum>(5)</enum><text>In Pennsylvania, during the attacks, United Airlines Flight 93 crashed near Shanksville, killing all 40 passengers and crew members.</text></paragraph> <paragraph id="H6E739F83FD2045E28D24DC320530717D"><enum>(6)</enum><text display-inline="yes-display-inline">The attacks took the lives of 441 first responders in New York, specifically 343 firefighters from the New York City Fire Department, 37 officers from the Port Authority Police Department, 23 officers from the New York City Police Department, and 38 individuals from other agencies.</text></paragraph> 
<paragraph id="HC2536EC9E1AE4E2CACF79201D81F6909"><enum>(7)</enum><text>The collapse of the towers following the attacks created massive dust clouds that left hundreds of densely populated city blocks covered with harmful contaminants, exposing first responders, local workers, residents, and students.</text></paragraph> <paragraph id="H966C155616FE4F3FB9BC07230CB240AD"><enum>(8)</enum><text display-inline="yes-display-inline">More than 2 decades after these horrific terrorist attacks took place, the ongoing physical and mental health impacts continue to deeply affect tens of thousands of individuals across the country who were in lower Manhattan and the surrounding area following the attacks, as well as those from around the country who participated in the rescue, recovery, and relief efforts, due to their exposure to the dust, smoke, and debris. Thousands of others have died due to illnesses and injuries relating to the attacks.</text></paragraph> 
<paragraph id="H760020FAF6A546B7B7A9A4B065EC1853"><enum>(9)</enum><text display-inline="yes-display-inline">The National September 11 Memorial and Museum at the World Trade Center is continuously dedicated to remembering, reflecting, and educating for many generations to come so that the story of September 11, 2001, is never forgotten.</text></paragraph> <paragraph id="H0CF722E98ED24D39B7EF95551C0DFDA4"><enum>(10)</enum><text display-inline="yes-display-inline">The National September 11 Memorial and Museum at the World Trade Center is committed to supporting family members, survivors, rescue and recovery workers, and military personnel who were affected by the attacks by providing services, education, and programming.</text></paragraph></section> 
<section id="H3EBF5101D73A4B2E96978BE5A2A014BB"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H069355B5EF084692AF44BE0BD556381E"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (referred to in this Act as the <quote>Secretary</quote>) shall mint and issue the following coins in commemoration of the 25th anniversary of the September 11, 2001, terrorist attacks on the United States and the establishment of the National September 11 Memorial and Museum at the World Trade Center:</text> <paragraph id="H5487390ADCAF4C2BAEFFB44D893B35CC"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 50,000 $5 coins, each of which shall—</text> 
<subparagraph id="HCBCC65E00A3B47208AF33CD920C3C082"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> <subparagraph id="H9F55F949641244E5A33318C8C7369F77"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="HF80525AFEAAF4EFDA3CD424F64E97598"><enum>(C)</enum><text>contain not less than 90 percent gold.</text></subparagraph></paragraph> <paragraph id="H957A3A54024B4D478C7D0081D68EE656"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 400,000 $1 coins, each of which shall—</text> 
<subparagraph id="H460219EC027E48068576E251C5463EB9"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> <subparagraph id="HB57141832E0544CDB22EE18329E05F7D"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="HBFDD66DE51544B49A350407B61B86D69"><enum>(C)</enum><text>contain not less than 90 percent silver.</text></subparagraph></paragraph></subsection> <subsection id="H27DEAA25FC364C95980A2DBD8FCB3862"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection> 
<subsection id="H110877298C2444C3802A7B9DC7341852"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> <section id="HC5E478F5E44340419F253E9E786773AB"><enum>4.</enum><header>Design of coins</header> <subsection id="H3F6ADF83EAAD4742B064B296AB440BA8"><enum>(a)</enum><header>Design requirements</header> <paragraph id="HD3851D0FBC874277A902E66DBBF58459"><enum>(1)</enum><header>In general</header><text>The designs of the coins minted under this Act shall be emblematic of the courage, sacrifice, and strength of those individuals who perished in the terrorist attacks of September 11, 2001, the bravery of those who risked their lives to save others that day, and the endurance, resilience, and hope of those who survived. At least 1 such coin shall bear the inscription <quote>Never Forget</quote>.</text></paragraph> 
<paragraph id="HDEEFBE13FD554B8CB6DD04403CAFFCD1"><enum>(2)</enum><header>Designs and inscriptions</header><text>On each coin minted under this Act, there shall be—</text> <subparagraph id="HB9A225B2827E47C8BC42C769E9EBDC29"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="H9E49CF5DB8684280A80A9B922C959313"><enum>(B)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>; and</text></subparagraph> <subparagraph id="HD40323829F7F4A1AAF7C0E6FB6F1937B"><enum>(C)</enum><text display-inline="yes-display-inline">an inscription or other design element referencing the 25th Anniversary.</text></subparagraph></paragraph></subsection> 
<subsection id="HEFE8F76759504FA59E360A764D757A74"><enum>(b)</enum><header>Selection</header><text>The designs for the coins minted under this Act shall be—</text> <paragraph id="HB382B53A6760442186F58567619CBD75"><enum>(1)</enum><text>selected by the Secretary, after consultation with—</text> 
<subparagraph id="H28484919C38143F9B991D542DB36414F"><enum>(A)</enum><text>the National September 11 Memorial and Museum at the World Trade Center; and</text></subparagraph> <subparagraph id="H0EEADE89B6DB4F11A78BC9194382E87D"><enum>(B)</enum><text>the Commission of Fine Arts; and</text></subparagraph></paragraph> 
<paragraph id="H67D480979365417F8B38E6C9307A5B85"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> <section id="HE9CC41CB3EC443488B7AB8761D24B936"><enum>5.</enum><header>Issuance of coins</header> <subsection id="H69C6DEF32031495393B0F8C7BC54AF6E"><enum>(a)</enum><header>Quality of coins</header><text>The coins minted under this Act may be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="HEFFD566CBB7248F0A454D5438D1211B0"><enum>(b)</enum><header>Sense of congress</header><text>It is the sense of Congress that the coins minted under this Act should be struck at the United States Mint at West Point, New York, to the greatest extent possible.</text></subsection> <subsection id="H38C2259E8F3649479612958B3A64CE12"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2028.</text></subsection></section> 
<section id="HD5748D5B66AE4F71BD5800BB0B4C8052"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="HAF63DCE149B5439D898B83881CF9C969"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at the price equal to the sum of—</text> <paragraph id="H190950B13CB24EB4AEF57B252F655420"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="HA88C4D86ADB849B6B0FC82C2E02643B1"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to the coins; and</text></paragraph> <paragraph id="H7A08F5AA838B4CD781213EECAF6F2855"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H48DBE3B93C6743ACB129712E33CD6FE5"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> <subsection id="H998F3D271F424590B95480BF37C1A4AA"><enum>(c)</enum><header>Prepaid orders</header> <paragraph id="HD3BB4935AFBB415B9A34816F9FA3570F"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of the coins.</text></paragraph> 
<paragraph id="HB73842C9D3174B7D81EA316CCFC296B2"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> <section id="H8561FA2ECF47415E8BEB5524FE489B16"><enum>7.</enum><header>Surcharges</header> <subsection id="H3C3406AE4820479A9990294CB32E35CF"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge of—</text> 
<paragraph id="H77D69C8BC19D46A3B1F0211767AB1E37"><enum>(1)</enum><text>$35 per coin for the $5 gold coin; and</text></paragraph> <paragraph id="H387EC0556088478E8909AB38634F71E4"><enum>(2)</enum><text>$10 per coin for the $1 silver coin.</text></paragraph></subsection> 
<subsection id="H416FD9A0B46D4F6C8F662AF63D9DB4A6"><enum>(b)</enum><header>Distribution</header><text>Subject to section 5134(f)(1) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the National September 11 Memorial and Museum at the World Trade Center to support the operations and maintenance of the National September 11 Memorial and Museum at the World Trade Center.</text></subsection> <subsection id="HB9FCBB3AA0834D6EAE95FB00CF50330B"><enum>(c)</enum><header>Audits</header><text>The National September 11 Memorial and Museum at the World Trade Center shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection> 
<subsection id="HBB2B255E80D0451DA1CB388AD5E31D2F" commented="no"><enum>(d)</enum><header>Limitation</header> 
<paragraph id="H605FF21271734508A25AB3AF10CF1A0B"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of that issuance, the issuance of that coin would result in the number of commemorative coin programs issued during that year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code.</text></paragraph> <paragraph id="H530833B2F4F44935BC4E3A53384AFF0E"><enum>(2)</enum><header>Guidance</header><text>The Secretary may issue guidance to carry out this subsection.</text></paragraph></subsection></section> 
<section id="HF85D1EC64E69430FB41FC8560979AF67"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text> <paragraph id="H36698FB421AE41BFBB1E43ED6B7B1000"><enum>(1)</enum><text>minting and issuing coins under this Act result in no net cost to the Federal Government; and</text></paragraph> 
<paragraph id="HB4D094D247DE40EEB408938904724B31"><enum>(2)</enum><text>no funds, including applicable surcharges, are disbursed to any recipient designated in section 7(b) until the total cost of designing and issuing all of the coins authorized by this Act, including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping, is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section> </legis-body> <attestation><attestation-group><attestation-date date="20260520" chamber="House">Passed the House of Representatives May 20, 2026.</attestation-date><attestor display="no">Kevin F.
