committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on February 27, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to clarify payment rules for manual wheelchairs under part B of the Medicare program.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H1F853CB834AA456C8E109A8778AA4F98"><section section-type="section-one" id="H58F88138619043C59BEC4124C1CE009B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Choices for Increased Mobility Act of 2026</short-title></quote>.</text></section><section id="H43817D7FA23F44DD94459B9010022A2C"><enum>2.</enum><header>Special rules related to treatment of certain manual wheelchairs under the Medicare program</header><text display-inline="no-display-inline">Section 1834(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB22C67B6C61D4C9EA7E01B5EF90FA7A2" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HBB80B3C947C143FB9D9B0A7C4FE1A440"><enum>(24)</enum><header>Special rules related to treatment of certain manual wheelchairs</header><subparagraph id="H1249E6FD904D405C8A81EA0212D2DB0D"><enum>(A)</enum><header>Requirement to establish separate HCPCS codes for certain manual wheelchairs</header><text>With respect to ultralightweight manual wheelchairs payable under this subsection furnished on or after January 1, 2028, the Secretary shall establish two or more HCPCS codes, as determined appropriate by the Secretary, for the base of such a wheelchair depending on the construction material used in such base (with 1 or more such codes for such a base with titanium or carbon fiber construction material and 1 or more such codes for such a base without such materials).</text></subparagraph><subparagraph id="HE33BB702A08946809E5C5FFBB4060ABF"><enum>(B)</enum><header>Payment and beneficiary protections</header><clause id="HF2CABDA9F02B468EA3DCE5FF5980DF81"><enum>(i)</enum><header>Payment</header><text>On or after January 1, 2028, in the case where an individual purchases or rents from a supplier an ultralightweight manual wheelchair that has titanium or carbon fiber construction material used in the base of such wheelchair, payment to the supplier shall be made in the frequency and amount as would otherwise be made under this subsection (as described in paragraph (1)(A)) for such wheelchair.</text></clause><clause id="H26EAF60027A94903AC60AB3AC077DA71"><enum>(ii)</enum><header>Beneficiary charges</header><text>The supplier may charge the individual the difference between the supplier's actual charge for such wheelchair and the payment amount described in clause (i) for such wheelchair.</text></clause><clause id="HA852DE3579B442C0BB32D6BA7C8A1A42"><enum>(iii)</enum><header>Beneficiary protections</header><text>In order to inform an individual of the individual’s potential financial liability under clause (ii), the Secretary may require a supplier to issue a notice to the individual (in a form and manner determined by the Secretary) prior to the purchase or rental of such ultralightweight manual wheelchair by such individual.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date>July 18, 2026</action-date><action-desc>Reported from the <committee-name added-display-style="italic" committee-id="HIF00" deleted-display-style="strikethrough">Committee on Energy and Commerce</committee-name> with an amendment</action-desc><action-date>July 18, 2026</action-date><action-desc>Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name> discharged;
