For purposes of the preceding sentence, a change increases the amount of any air pollutant emitted by such source only if the maximum hourly emission rate of an air pollutant that is achievable by such source after the change is higher than the maximum hourly emission rate of such air pollutant that was achievable by such source during any hour in the 10-year period immediately preceding the change</quote>; and</text></paragraph><paragraph id="H9A075B1A17E04D86B98BAF032ADB1CA0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H6FBDD4E0D9254731A72142E0228574B3" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subparagraph id="H27EA29745257419F9D041C099F03042F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), the term <term>modification</term> does not include a change at a stationary source that is designed—</text><clause id="H3F9D869E67BD468891D8F016DE74AF31"><enum>(i)</enum><text>to reduce the amount of any air pollutant emitted by the source per unit of production; or</text></clause><clause id="HBFA16A2340BD4CBF8C9E93D206AB3159"><enum>(ii)</enum><text>to restore, maintain, or improve the reliability of operations at, or the safety of, the source,</text></clause><continuation-text continuation-text-level="subparagraph">except, with respect to either clause (i) or (ii), when the change would be a modification as defined in subparagraph (A) and the Administrator determines that the increase in the maximum achievable hourly emission rate of a pollutant from such change would cause an adverse effect on human health or the environment.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H5CA89ABB31884206A9E376F70C8618FF"><enum>3.</enum><header>Clarification of definition of construction and applicability of preconstruction requirements for prevention of significant deterioration</header><subsection id="H535401B2DFE7456991BDAE8CBEC0842C"><enum>(a)</enum><header>Applicability to construction activities</header><text display-inline="yes-display-inline">Section 165 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7475">42 U.S.C. 7475</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4B2055B21BC54B438D39AADA13E62EC6" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="HBDC86694EBEF4344A6FF93DF8F5C9947"><enum>(f)</enum><header>Applicability to construction</header><paragraph id="H4B739E7AAC744135836595529617B2F7"><enum>(1)</enum><header>In general</header><text>The requirements of subsection (a) that apply with respect to authorizing construction of a major emitting facility shall apply only with respect to construction that involves physical construction of the discrete parts of an emissions unit at a major emitting facility, regardless of whether the construction involves other physical on-site activities at the major emitting facility, including any such other physical on-site activity that—</text><subparagraph id="HCB8D6D81121F4EC08B7C3832E6CD3BB0"><enum>(A)</enum><text>may be costly;</text></subparagraph><subparagraph id="H23AB96C4CBD24F1E94ECC337632A542B"><enum>(B)</enum><text>may significantly alter the site;</text></subparagraph><subparagraph id="H4ACE05556CF84C6188E76D7130EF69D3"><enum>(C)</enum><text>is permanent in nature; or</text></subparagraph><subparagraph id="H49257A58EE4F4292BA1EF87EF726043E"><enum>(D)</enum><text>is to accommodate an installation to an emissions unit.</text></subparagraph></paragraph><paragraph id="H493873059BDA47FCAC172EC722196C72"><enum>(2)</enum><header>Definition of emissions unit</header><text display-inline="yes-display-inline">In this subsection, the term <quote>emissions unit</quote> means any part of a stationary source that emits, or has the potential to emit, any air pollutant that is regulated under this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA18231C70BE44644BF3AB921BF119B24"><enum>(b)</enum><header>Definition</header><text>Subparagraph (C) of section 169(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7479">42 U.S.C. 7479(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HF04FCD851CF44964836377869D8C28F9" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subparagraph id="H5BD0CD12007D4FBCB7D7A2E9F4820E80" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>construction</term>, when used in connection with a major emitting facility, includes a modification (as defined in section 111(a)) at such facility, except that for purposes of this subparagraph a modification does not include a change at a major emitting facility that does not result in a significant emissions increase, or a significant net emissions increase, in annual actual emissions at such facility.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HECB8F8DA8E034608830BD071FC5BD1BC"><enum>4.</enum><header>Clarification of definition of modifications and modified and applicability to construction for nonattainment areas</header><subsection id="H01A1069407BE4ECFB17B5983D8A4242B"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Paragraph (4) of section 171 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7501">42 U.S.C. 7501</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="HEC9A3A12D2C24F33AAA38BA1CD2CC18B" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H39155215778D44F3A04779B480E6AB19"><enum>(4)</enum><text display-inline="yes-display-inline">The terms <term>modifications</term> and <term>modified</term> mean a modification as defined in section 111(a)(4), except that such terms do not include a change at a major emitting facility that does not result in a significant emissions increase, or a significant net emissions increase, in annual actual emissions at such facility.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFE481A771C7E47018402EC6D7B17CDE5" display-inline="no-display-inline"><enum>(b)</enum><header>Applicability to construction</header><text display-inline="yes-display-inline">Section 172(c)(5) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7502">42 U.S.C. 7502(c)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H90603980266044A695DE4B9FF109594E" changed="added" reported-display-style="italic" committee-id="HIF00"><text>The construction for which a permit is required under this paragraph is construction that involves physical construction of the discrete parts of an emissions unit (as defined in section 165(f)(2)) at a major stationary source, regardless of whether the construction involves other physical on-site activities at the major stationary source, including any such other physical on-site activity that—</text><subparagraph id="H3C056C735F6743D8A9B1D9E6CEF00168" display-inline="no-display-inline"><enum>(A)</enum><text>may be costly;</text></subparagraph><subparagraph id="HFB5D54E0170F4F4B9B745D884C09F8BB"><enum>(B)</enum><text>may significantly alter the site;</text></subparagraph><subparagraph id="H02AF012D7E8D443EB8472E8D95358D4B"><enum>(C)</enum><text>is permanent in nature; or</text></subparagraph><subparagraph id="HB48497E0AB474215A08D75C7BE15901D"><enum>(D)</enum><text>is to accommodate an installation to an emissions unit.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H60FCDE25903D4C1F982C949DCB83F805"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline"> Nothing in this Act or the amendments made by this Act shall be construed to treat any change as a modification for purposes of any provision of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) if such change would not have been so treated as of the day before the date of enactment of this Act.</text></section></legis-body><endorsement display="yes"><action-date>April 28, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
