<section id="HB3F70112EBC94502A842BE2E474E671E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovative Mitigation Partnerships for Asphalt and Concrete Technologies Act</short-title></quote> or the <quote><short-title>IMPACT Act</short-title></quote>.</text></section> <section id="HA55B6B55A50A4645A94CF801C399CFB6"><enum>2.</enum><header>Advanced cement, concrete, and asphalt production research program</header> <subsection id="HAC624495A28049F490FA7090AA1CE091"><enum>(a)</enum><header>Program</header><text display-inline="yes-display-inline">Part I of subtitle C of title V of division D of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H0872A735E22E43D3868A9C314BB6A0B6"><enum>40523.</enum><header>Advanced cement, concrete, and asphalt production research program</header> 
<subsection id="H6C201C1BA1C64B7FAD57127665BB8C8D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H25B96A2F91954471AD02B9927672CBDC"><enum>(1)</enum><header>Advanced production</header><text>The term <quote>advanced production</quote> means production of cement, concrete, or asphalt with one or more of the following improvements with respect to the production of commercially available cement, concrete, or asphalt:</text> 
<subparagraph id="H61D7B059C1414500A2E95F069F26BA22"><enum>(A)</enum><text>Improved cost-effectiveness.</text></subparagraph> <subparagraph id="HBE8C805223B0431DABFE0EF1ED2B2422"><enum>(B)</enum><text display-inline="yes-display-inline">Improved quality, durability, engineering performance, and resilience.</text></subparagraph> 
<subparagraph id="HE5EED78CC8C5413EB93EB02D0C5D3EDC"><enum>(C)</enum><text display-inline="yes-display-inline">Improved efficiency of resource consumption and material demand.</text></subparagraph></paragraph> <paragraph id="H83DF78533EE14DDBBB4EB4AA38C2352D" commented="no"><enum>(2)</enum><header>Alternative fuels</header><text>The term <quote>alternative fuels</quote> means any solid, liquid, or gaseous materials, or a combination thereof, used to replace or supplement any portion of fuels used in combustion or pyrolysis for low-emissions cement, concrete, or asphalt.</text></paragraph> 
<paragraph id="H904F1B19EA754783BE07CF49BD591D49"><enum>(3)</enum><header>Commercially available</header><text>The term <quote>commercially available</quote>, with respect to cement, concrete, and asphalt, means that the cement, concrete, or asphalt is—</text> <subparagraph id="HD0327A1D49734F2599F68DD403ED912D"><enum>(A)</enum><text>readily and widely available for purchase in the United States; and</text></subparagraph> 
<subparagraph id="HAE16A44176F94286835DE3106F6140BF"><enum>(B)</enum><text>produced using a production method of cement, concrete, or asphalt products, as applicable, that is widely in use.</text></subparagraph></paragraph> <paragraph id="H49E4EF47FAA943B5BA5CD0E208B2E23E"><enum>(4)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means any of the following:</text> 
<subparagraph id="HC40D6E9695244F1BB846B252611924AF"><enum>(A)</enum><text>An institution of higher education.</text></subparagraph> <subparagraph id="H052843CB565943CF9130FD26F324B468"><enum>(B)</enum><text>An appropriate State or Federal entity, including a federally funded research and development center of the Department.</text></subparagraph> 
<subparagraph id="H9ADFAC4B72264527A703AC8B9F9C0439"><enum>(C)</enum><text>A nonprofit research institution.</text></subparagraph> <subparagraph id="HCD23D2AEF4254E1986ABAAE7E864E043"><enum>(D)</enum><text>A private entity.</text></subparagraph> 
<subparagraph id="HDBDC1176E6B84D77AF7552E3AE73EF95"><enum>(E)</enum><text>Any other relevant entity the Secretary determines appropriate.</text></subparagraph> <subparagraph id="H6D249A3FAA404646913AF4CD4A2CDF8C"><enum>(F)</enum><text>A partnership or consortium of two or more entities described in subparagraphs (A) through (E).</text></subparagraph></paragraph> 
<paragraph id="H4A0D1BF3336848C7A21110DE0206CF39"><enum>(5)</enum><header>Engineering performance-based standard</header><text display-inline="yes-display-inline">The term <quote>engineering performance-based standard</quote> means an existing engineering standard with respect to which the requirements applicable to such standard are stated in terms of required results, with criteria for verifying compliance rather than specific composition, design, or procedure.</text></paragraph> <paragraph id="H1C92B6BF0CC4431EA0625D69D3CEAC4C"><enum>(6)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph> 
<paragraph id="H3D9CA8C1EEE34DB78C26DB046C403131" commented="no"><enum>(7)</enum><header>Low-emissions cement, concrete, and asphalt</header><text display-inline="yes-display-inline">The term <quote>low-emissions cement, concrete, and asphalt</quote> means cement, concrete, asphalt binder, or asphalt mixture that reduces, to the maximum extent practicable, greenhouse gas or directly-related copollutant emissions to levels below commercially available cement, concrete, or asphalt.</text></paragraph> <paragraph id="HB9299E7B90AF4744996AEA38DAE592F0" commented="no"><enum>(8)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <quote>rural area</quote> has the meaning given such term in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>).</text></paragraph></subsection> 
<subsection id="H89AE792906194075993D6AD56F7BB552"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary shall establish a program of research, development, demonstration, and commercial application of advanced tools, technologies, and methods for advanced production and use of low-emissions cement, concrete, and asphalt in order to accomplish the following:</text> <paragraph id="HF8CBC08520AE4CFA9F59D56A9CAA49B0"><enum>(1)</enum><text>Increase the technological and economic competitiveness of industry and production in the United States.</text></paragraph> 
<paragraph id="H7C495B8AA19248008127864191FC1F15"><enum>(2)</enum><text>Expand and increase the stability of supply chains through enhanced domestic production, nearshoring, and cooperation with allies.</text></paragraph> <paragraph id="HB996E6B6E8CC45E3A08FEA20AF594C5E"><enum>(3)</enum><text display-inline="yes-display-inline">Achieve measurable greenhouse gas or directly related copollutant emissions reductions in the production processes for cement, concrete, and asphalt products.</text></paragraph> 
<paragraph id="HB0A51F6B32D44A07A07C7FCD5AC7189A"><enum>(4)</enum><text>Create quality domestic jobs.</text></paragraph></subsection> <subsection id="H1850D641F4F843808A5EF8C2F0B6E3A8"><enum>(c)</enum><header>Requirements</header><text>In carrying out the program under subsection (b), the Secretary shall carry out the following:</text> 
<paragraph id="H43036D0BDE8546D0AEFDF3263AF11B14" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Coordinate with the programs and activities authorized under title VI of division Z of the Consolidated Appropriations Act, 2021 (relating to industrial and manufacturing technologies) and the amendments made by such title.</text></paragraph> <paragraph id="H43926F775FD54990AAF2131CA5586196"><enum>(2)</enum><text>Coordinate across all relevant program offices of the Department, including the Office of Science, the Advanced Research Projects Agency-Energy, the Office of Clean Energy Demonstrations, the Office of Energy Efficiency and Renewable Energy, the Office of Fossil Energy, the Office of Industrial Efficiency and Decarbonization, the Office of Manufacturing and Energy Supply Chains, and the Office of Nuclear Energy.</text></paragraph> 
<paragraph id="H70BFE0EA970047A69C0AD36C519EB832"><enum>(3)</enum><text>Leverage, to the extent practicable, the research infrastructure of the Department, including scientific computing user facilities, x-ray light sources, neutron scattering facilities, and nanoscale science research centers.</text></paragraph> <paragraph id="HAFA1A9BD50074FE29F9CD53719874159" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Conduct research, development, demonstration, and commercial application of the advanced production of low-emissions cement, concrete, and asphalt that have the potential to increase domestic production and employment in both advanced and commercially available processes.</text></paragraph></subsection> 
<subsection id="H7EA04669A2FE4685B89E3CEBFF60B693"><enum>(d)</enum><header>Strategic plan</header> 
<paragraph id="H65BFB1F6934A49CCA45995A244BA170A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the establishment of the program under subsection (b), the Secretary shall develop a 5-year strategic plan identifying research, development, demonstration, and commercial application goals for such program. The Secretary shall submit such plan to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text></paragraph> <paragraph id="H2C217A06AD984090A0389472C18E9A0C"><enum>(2)</enum><header>Contents</header><text>The strategic plan under paragraph (1) shall—</text> 
<subparagraph id="H1AB390A7D7D44190AD93BFF6708A0135" commented="no"><enum>(A)</enum><text>identify programs at the Department related to the advanced production of low-emissions cement, concrete, and asphalt that support the research, development, demonstration, and commercial application activities described in this section, and the demonstration projects under subsection (f);</text></subparagraph> <subparagraph id="HA9B3D0841DC7430D97A7376FD62DF422"><enum>(B)</enum><text>establish technological and programmatic goals to achieve the requirements specified in subsection (c); and</text></subparagraph> 
<subparagraph id="HDE0EBEDF4B9D4FD1A1CEA08829A82747" commented="no"><enum>(C)</enum><text>include timelines for the accomplishment of such goals developed under the plan.</text></subparagraph></paragraph> <paragraph id="H25381AC3FC2141F3A14A355CD56363A4"><enum>(3)</enum><header>Updates to plan</header><text>Not less than once every two years, the Secretary shall submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Energy and Natural Resources of the Senate an updated version of the strategic plan under paragraph (1).</text></paragraph></subsection> 
<subsection id="H79BF188885424DA49877CCA3EA045D37"><enum>(e)</enum><header>Focus areas</header><text>In carrying out the program under subsection (b), the Secretary shall focus on the following:</text> <paragraph id="H148F81233D7E4046B03057A677BEF75D"><enum>(1)</enum><text display-inline="yes-display-inline">Carbon capture technologies for low-emissions cement, concrete, and asphalt production processes, which may include the following:</text> 
<subparagraph id="H34955BF1874A4D04BDA2CA902B9A0131"><enum>(A)</enum><text>Oxycombustion and chemical looping technologies.</text></subparagraph> <subparagraph id="H95C2A7A72FF3463FBE48E3E99CB8B19C"><enum>(B)</enum><text>Precombustion technologies.</text></subparagraph> 
<subparagraph id="HB4A3D7948E09407096D58FF5741758E1"><enum>(C)</enum><text>Post combustion technologies.</text></subparagraph> <subparagraph id="H94B0E998B6EB4AD58112A0733EABF77C"><enum>(D)</enum><text>Direct carbon dioxide separation technologies.</text></subparagraph></paragraph> 
<paragraph id="H56F9B579D42D48618AFBB51BDCBADB14"><enum>(2)</enum><text display-inline="yes-display-inline">Materials, technologies, inputs, and processes that—</text> <subparagraph id="HB749722D410842CF9EC3DF9E08D8B0DA"><enum>(A)</enum><text display-inline="yes-display-inline">produce fewer greenhouse gas or directly related copollutant emissions during production, use, and end use of cement, concrete, and asphalt; or</text></subparagraph> 
<subparagraph id="H49656E5DA310419C9C26F1099175ED6E"><enum>(B)</enum><text display-inline="yes-display-inline">provide quality, durability, resilience, engineering, or other performance metrics equal to or greater than commercially available products.</text></subparagraph></paragraph> <paragraph id="HC2F53BBC5D0F4CF4AB5EB82F3D220267" commented="no"><enum>(3)</enum><text>Medium- and high-temperature heat-generation technologies used for the advanced production of low-emissions cement, concrete, and asphalt, which may include the following:</text> 
<subparagraph id="HE6F8C8CFBFF445F59377124FC150F951" commented="no"><enum>(A)</enum><text>Alternative fuels.</text></subparagraph> <subparagraph id="H05E4FACC73464481BDBE3C2FFE22B6FE" commented="no"><enum>(B)</enum><text>Renewable heat-generation and storage technology.</text></subparagraph> 
<subparagraph id="H9AE6C78E5DC24D1E8818BE5FD472F5BF" commented="no"><enum>(C)</enum><text>Electrification of heating processes.</text></subparagraph> <subparagraph id="H1A3059D07ED54FE1BAC32290FB2985AC" commented="no"><enum>(D)</enum><text>Other clean heat-generation technologies and sources.</text></subparagraph></paragraph> 
<paragraph id="H36CBCA1D8C4B457D980CBB255B24CF15"><enum>(4)</enum><text display-inline="yes-display-inline">Technologies and practices that increase the efficiency of energy use, natural resource consumption, or material demand, which may include the following:</text> <subparagraph id="HA6ADC9AC54F34ED998BFD17D9284622C"><enum>(A)</enum><text display-inline="yes-display-inline">Designing products that encourage reuse, refurbishment, remanufacturing, and recycling.</text></subparagraph> 
<subparagraph id="H99BDDBF7CFA54B1CAF251BE2E684E67B"><enum>(B)</enum><text display-inline="yes-display-inline">Minimizing waste, including waste heat, from low-emissions cement, concrete, and asphalt production processes, including through the reuse of waste as a resource in other industrial processes for mutual benefit.</text></subparagraph> <subparagraph id="H14E711B9E2C44F438B34EBAC4737480F"><enum>(C)</enum><text display-inline="yes-display-inline">Increasing the overall energy efficiency of low-emissions cement, concrete, and asphalt production processes, including through life cycle assessments.</text></subparagraph></paragraph> 
<paragraph id="HCDBD188265E743BD902407104DB83E5E"><enum>(5)</enum><text display-inline="yes-display-inline">Technologies and approaches to reduce greenhouse gas or directly related copollutant emissions from the advanced production of cement, concrete, and asphalt.</text></paragraph> <paragraph id="H827740E19E37432AB69FBE3BDD3FA426"><enum>(6)</enum><text>High-performance computing to develop advanced materials and production processes that may contribute to the focus areas described in paragraphs (1) through (5), including the following:</text> 
<subparagraph id="HE36AC1C29C2441AFBB10D1AFE985C143" commented="no"><enum>(A)</enum><text>Modeling, simulation, and optimization of the design of cost-effective and energy-efficient products and processes.</text></subparagraph> <subparagraph id="H1B9960847BC945BAA106DB2C60B2DA66"><enum>(B)</enum><text>The use of digital prototyping and additive production to enhance product design.</text></subparagraph></paragraph> 
<paragraph id="HAFFE6A472FC1439C87A435080DD6FD91"><enum>(7)</enum><text>Advanced sensor technologies and methods to monitor and quantify the performance of low-emissions cement, concrete, and asphalt materials at scale and under a variety of conditions.</text></paragraph> <paragraph id="H7B6BF75F231C4EBDBFD65F8CE9F519E6" commented="no"><enum>(8)</enum><text>Technologies that can be retrofitted at cement, concrete, and asphalt plants that represent the most common facility types in the United States and in other countries, with consideration for field validation of such retrofits.</text></paragraph> 
<paragraph id="H46D1B44CB3544983B6790A11E485CA08"><enum>(9)</enum><text>Best practices for data standardization and data sharing tools and technologies, in coordination with relevant Federal agencies.</text></paragraph> <paragraph id="HAA61037CC1EC44548BFB59483C625F99"><enum>(10)</enum><text display-inline="yes-display-inline">Fundamental research in chemistry and materials science to identify the following:</text> 
<subparagraph id="H9C8A83AB74EC42CD80251C15432215B8" commented="no"><enum>(A)</enum><text>Novel materials and alternative domestic feedstocks and processing operations for the advanced production of low-emissions cement, concrete, and asphalt.</text></subparagraph> <subparagraph id="HF0EBB22042964CB2A57161D30FE57273" commented="no"><enum>(B)</enum><text>Improved understanding by eligible entities of the mechanisms that determine the performance and durability of low-emissions cement, concrete, and asphalt over time.</text></subparagraph></paragraph></subsection> 
<subsection id="HA73D8E08A6BB4035B8D0FD59E3C5D6D0"><enum>(f)</enum><header>Demonstrations</header> 
<paragraph id="H1EC9CB7B0C174E53BDC00FA01F0AB37A" commented="no"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary, in carrying out the program under subsection (b), and in collaboration with the Secretary of Transportation, the Administrator of General Services, industry partners, institutions of higher education, and National Laboratories, shall support demonstrations of advanced production of low-emissions cement, concrete, and asphalt that uses either—</text> <subparagraph id="H55C71F021F32471C809C5FD77CAD6D2F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a single technology or practice; or</text></subparagraph> 
<subparagraph id="H417F9ED13808441CBC6FD72F9BF8B8E5" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a combination of multiple technologies or practices.</text></subparagraph></paragraph> <paragraph id="H9B3B542CDC5F40A79A1BB80ECC6E3462"><enum>(2)</enum><header>Selection requirements</header><text>In carrying out the demonstrations under paragraph (1), the Secretary shall select eligible entities to carry out demonstration projects and to the maximum extent practicable—</text> 
<subparagraph id="H4DC731F2138441B094112D5F8436682B" commented="no"><enum>(A)</enum><text>encourage regional diversity among eligible entities, including participation by entities located in rural areas;</text></subparagraph> <subparagraph id="H5122DB0917124708BEA762F374150465"><enum>(B)</enum><text>encourage technological diversity among eligible entities; and</text></subparagraph> 
<subparagraph id="HD9E56D1A53A04149A7D599E54175F9C0"><enum>(C)</enum><text>ensure that specific projects selected—</text> <clause id="HA79C16F4A993438AB3D55C7D61888228"><enum>(i)</enum><text>expand on the existing technology demonstration programs of the Department;</text></clause> 
<clause id="HAC5CFB4198354BC5966EA6BEDF705431" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">are based on the extent of greenhouse gas emissions reductions achieved; and</text></clause> <clause id="H61C4DDA167704BEF9B4F9CACA3CE02B1" commented="no"><enum>(iii)</enum><text>prioritize leveraging matching funds from non-Federal sources.</text></clause></subparagraph></paragraph> 
<paragraph id="H015C63BA29384CCDAF7736EC5F4C4C83"><enum>(3)</enum><header>Reports</header><text>The Secretary shall submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Energy and Natural Resources of the Senate—</text> <subparagraph id="H7B1D1A3CAAA8477EB513A12D84945103"><enum>(A)</enum><text>not less frequently than once every two years for the duration of the demonstrations under paragraph (1), a report describing the performance of such demonstrations; and</text></subparagraph> 
<subparagraph id="H1581C023DEE844CFB04973003E333AD2" commented="no"><enum>(B)</enum><text>if any such demonstration is terminated, an assessment of the success of, and education provided by, the measures carried out by such demonstration.</text></subparagraph></paragraph> <paragraph id="H292C44FDD10241CBAC3169E23EC1A29C"><enum>(4)</enum><header>Termination</header><text>The Secretary may terminate the demonstrations under paragraph (1) if the Secretary determines that sufficient low-emissions cement, concrete, and asphalt produced through advanced production are commercially available domestically at a price comparable to the price of cement, concrete, and asphalt produced through traditional methods of production.</text></paragraph></subsection> 
<subsection id="HF03F997EEA224436B4E708571F9F8E11"><enum>(g)</enum><header>Technical assistance program</header> 
<paragraph id="HF4345DB6CB584911AF69B4E86B527E31"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Transportation, the Secretary of Commerce (acting through the Director of the National Institute of Standards and Technology), the Administrator of General Services, the Administrator of the Environmental Protection Agency, and appropriate representatives of relevant standards development organizations, shall provide technical assistance to eligible entities to carry out an activity described in paragraph (2) to promote the commercial application of technologies for the production and use of low-emissions cement, concrete, and asphalt.</text></paragraph> <paragraph id="H2B34FDB844084D21A74F5C4CDE720E14"><enum>(2)</enum><header>Activities described</header><text>An activity referred to in paragraph (1) is any of the following:</text> 
<subparagraph id="HB19BBF8066EF4BF5A8C4EEEBDA21372B"><enum>(A)</enum><text display-inline="yes-display-inline">Efforts related to collecting data that could be used in the updating of local codes, specifications, and standards to engineering performance-based standards.</text></subparagraph> <subparagraph id="HF8C7CF33BC78440C8F0C6FB0D3F96922"><enum>(B)</enum><text>A lifecycle assessment of the final product.</text></subparagraph> 
<subparagraph id="HC7C6A301A4594311BB61B8F9FE4A9C2D"><enum>(C)</enum><text>An environmental impact comparison between different cements, concretes, and asphalts.</text></subparagraph> <subparagraph id="H70645D8AC5D443CCBF910CE5A27EE174"><enum>(D)</enum><text>A techno-economic assessment.</text></subparagraph> 
<subparagraph id="H5A95608564784DE086DA4BE6DAF59836"><enum>(E)</enum><text>An environmental permitting or other regulatory process.</text></subparagraph> <subparagraph id="H7C90101F93E54B51805F0507A03F314F"><enum>(F)</enum><text>An evaluation or testing activity.</text></subparagraph> 
<subparagraph id="HA7E9E91812034CE0AD73D8B41412F78A"><enum>(G)</enum><text>Any other activity that promotes the commercial application of technologies developed through the program under subsection (b).</text></subparagraph></paragraph> <paragraph id="H6CA48A782A904E33A8EAE9135600D1F8"><enum>(3)</enum><header>Applications</header><text>The Secretary shall seek applications for technical assistance under this subsection—</text> 
<subparagraph id="H687BAF7250F8403898171C6AC24091D7"><enum>(A)</enum><text>on a competitive basis; and</text></subparagraph> <subparagraph id="H6BCFB192FC1046F68F38EA503FB4AFA5"><enum>(B)</enum><text>on a periodic basis, but not less frequently than once every 12 months.</text></subparagraph></paragraph> 
<paragraph id="HCC8F8DBF2CD04A13B33236B3003EEC10"><enum>(4)</enum><header>Regional centers</header><text display-inline="yes-display-inline">The Secretary may designate or establish one or more regional centers to provide technical assistance to eligible entities to carry out the activity described in paragraph (2)(A).</text></paragraph></subsection> <subsection id="H0B5FDB28121C4C85AC315C6E7F9AC8BF"><enum>(h)</enum><header>Additional coordination</header> <paragraph id="HFE9DAB56BDF74E5E86642FA7DF78501A"><enum>(1)</enum><header>Manufacturing USA</header><text>In carrying out this section the Secretary shall consider the following:</text> 
<subparagraph id="H8E21436B6E0345ACB6F103E5400A2B2F"><enum>(A)</enum><text>Leveraging the resources of relevant existing Manufacturing USA Institutes described in section 34(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)</external-xref>).</text></subparagraph> <subparagraph id="H01019E16497A49D5A94CC3E7F4A6B82B"><enum>(B)</enum><text>Integrating program activities into a relevant existing Manufacturing USA Institute.</text></subparagraph> 
<subparagraph id="H5F3FE8C3812949F7B9366A7DD11C8384" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Awarding financial assistance, consistent with section 34(e) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(e)</external-xref>), to a person or group of persons to assist the person or group of persons in planning, establishing, or supporting a Manufacturing U.S.A. Institute focused on advanced production of low-emissions cement, concrete, and asphalt.</text></subparagraph></paragraph> <paragraph id="H02DDD04603BC4A86AA03A42A92A824BF"><enum>(2)</enum><header>Other Federal agencies</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall coordinate with other Federal agencies, including the Department of Defense, the Department of Transportation, and the National Institute of Standards and Technology, that are carrying out research and development initiatives to increase industrial competitiveness and achieve measurable greenhouse gas or directly related copollutant emissions reductions through the advanced production of cement, concrete, and asphalt.</text></paragraph></subsection> 
<subsection id="H66333D50C53A4EB09D2E542A641E4AF6"><enum>(i)</enum><header>Sunset</header><text>This section shall terminate seven years after the date of the enactment of this section.</text></subsection> <subsection id="HE8DD51335BE6440E9AD17622E31357E7"><enum>(j)</enum><header>Research security</header><text>The activities authorized under this section shall be applied in a manner consistent with subtitle D of title VI of the Research and Development, Competition, and Innovation Act (enacted as division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/19231">42 U.S.C. 19231 et seq.</external-xref>)).</text></subsection> 
<subsection id="H9E3FF8FB140F4C0EAFB4C7ADD067CF9E"><enum>(k)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to amend, alter, or affect the authorities of the Secretary to define, establish, or enforce new environmental industry standards for, or related to, cement, concrete, or asphalt.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H8CE4D116380C4788AB065A8DDCB4DDA4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Infrastructure Investment and Jobs Act is amended by inserting after the item relating to section 40522 the following new item:</text>
