<official-title display="yes">To require the Assistant Secretary of Commerce for Communications and Information to submit to Congress a plan for the Assistant Secretary to track the acceptance, processing, and disposal of certain Form 299s, and for other purposes.</official-title>

<section id="H2C617D5949264449AEC13DF2FEA8F578" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Broadband Deployment Tracking Act</short-title></quote>.</text></section> <section id="H9A08C4CCC14F4FCABEF95579484BD350"><enum>2.</enum><header>Plan for assistant secretary to track the acceptance, processing, and disposal of certain form 299s</header> <subsection id="HE360F7BFEAC34305B77BED305EC9576C"><enum>(a)</enum><header>Plan</header><text>Not later than 180 days after the date of the enactment of this Act, the Assistant Secretary shall submit to the appropriate congressional committees a plan containing a description of—</text>
<paragraph id="H12F818CE528242A0BDDFAB6A8DFA4472"><enum>(1)</enum><text>the process by which the Assistant Secretary proposes to—</text> <subparagraph id="HCA6F84BEE19E4E36B3F45E6D8A80D259"><enum>(A)</enum><text>track the acceptance, processing, and disposal of each Form 299 for communications use authorization;</text></subparagraph>
<subparagraph id="HFE40E3329FAD4D25A63649B3345243EC"><enum>(B)</enum><text>provide applicants additional transparency with respect to the status of the applicable Form 299 for communications use authorization; and</text></subparagraph> <subparagraph id="HEDE2F29CDF294F4091065164B2D9FE9B"><enum>(C)</enum><text>most expeditiously implement the plan; and</text></subparagraph></paragraph>
<paragraph id="H85DCB7805DC84820B1CCB95C36D78361"><enum>(2)</enum><text>any potential barriers to implementing the plan that are identified by the Assistant Secretary.</text></paragraph></subsection> <subsection id="HC3FA0F3DEBAC4EECBA88705EDBEF60DD"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H03A60190796540D19FD9D8A743DED069"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="H4A29208672C24AA7A90C54C5FB2E82E2"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph>
<subparagraph id="H4B479DA91CE04CB19CBFF7EB8BA6E642"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph> <paragraph id="HD483EB9DE462434AB5D718AEC93EFBDA"><enum>(2)</enum><header>Assistant secretary</header><text>The term <quote>Assistant Secretary</quote> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph>
<paragraph id="HA7399657B2534005876BE1CF14D1D70C"><enum>(3)</enum><header>Communications facility</header><text>The term <quote>communications facility</quote> has the meaning given the term communications facility installation in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph> <paragraph id="HDB0C99EDC9AD410F98096EFA166CB325"><enum>(4)</enum><header>Communications use</header><text>The term <quote>communications use</quote> means the placement and operation of a communications facility.</text></paragraph>
<paragraph id="H009C02B6E79E4EAA9B75833FFA8408C4"><enum>(5)</enum><header>Communications use authorization</header><text>The term <quote>communications use authorization</quote> means an easement, right-of-way, lease, license, or other authorization—</text> <subparagraph id="H7CAF0A66835B4AA69F983A60E8155E15"><enum>(A)</enum><text>provided by the Secretary of the Interior or the Secretary of Agriculture;</text></subparagraph>
<subparagraph id="HD5803199B2FB4F25A1907E1AC537487D"><enum>(B)</enum><text>to locate or modify a communications facility on covered land; and</text></subparagraph> <subparagraph id="H2C000BEB652F4CB3AADB4B49EDB5FDD8"><enum>(C)</enum><text>for the primary purpose of authorizing the occupancy and use of such covered land for communications use.</text></subparagraph></paragraph>
<paragraph id="H5BB3C27212854C15AA6CD02646C3CC3C"><enum>(6)</enum><header>Covered land</header><text>The term <quote>covered land</quote> means—</text> <subparagraph id="H1215FDA3181D409A96707A38224A6264"><enum>(A)</enum><text>public lands; and</text></subparagraph>
<subparagraph id="HE943AAE2944C431298A85B8C276CD437"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph> <paragraph id="H9D6F0F23EB244BF990F7A0380EA648B8"><enum>(7)</enum><header>Form 299</header><text>The term <quote>Form 299</quote> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>), or any successor form.</text></paragraph>
<paragraph id="HB8E3A712951B4A5B97928FA4130C3732"><enum>(8)</enum><header>National forest system</header><text>The term <quote>National Forest System</quote> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph> <paragraph id="HA5B3722B45B441CABCB38DE13ABF953F"><enum>(9)</enum><header>Public lands</header><text>The term <quote>public lands</quote> means land under the management of—</text>
<subparagraph id="H1ABEDA57F8A8486AA4E8C2F13576B05C"><enum>(A)</enum><text>the Bureau of Land Management;</text></subparagraph> <subparagraph id="H2F6F1D57FA624279B21F062607DE5649"><enum>(B)</enum><text>the National Park Service;</text></subparagraph>
<subparagraph id="H6914005F14184034A6DE848D416CB4A9"><enum>(C)</enum><text>the United States Fish and Wildlife Service; or</text></subparagraph> <subparagraph id="H9BADBD9F788F4461A58E25DD41F9C2D4"><enum>(D)</enum><text>the Bureau of Reclamation.</text></subparagraph></paragraph></subsection></section>
