<section id="HEFEBABDB7CAD44FE90ACAC0BE34D35CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Greeley Land Exchange Act</short-title></quote>.</text></section> <section id="HEC0AD2374BF5415F95BBD46607A5CC6E"><enum>2.</enum><header>Land exchange between City of Greeley, Colorado, and the Forest Service</header> <subsection id="HFC854D9DC52B4CE5973310559DAE3E09"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HA657B6CDA629477797F52DDE0128BFB4"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the city of Greeley, Colorado.</text></paragraph> <paragraph id="H125A53D8454242EF90BEBEEC9AC0B781"><enum>(2)</enum><header>Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means the approximately 78 acres of National Forest System land administered by the Forest Service and generally depicted as <quote>USFS Property</quote> on the Map.</text></paragraph> 
<paragraph id="H152F91BE3C294295B51747F7C90C30CC"><enum>(3)</enum><header>Map</header><text>The term <term>Map</term> means the map titled <quote>Greeley Land Exchange Act</quote> and dated May 3, 2026.</text></paragraph> <paragraph id="H2F4232C776FC4354BA208ECB01C8B172"><enum>(4)</enum><header>Non-Federal land</header><text>The term <term>non-Federal land</term> means—</text> 
<subparagraph id="H134FF3E42CF34D91B78A7ED509294C1F"><enum>(A)</enum><text>the approximately 40 acres of land owned by the City and generally depicted as <quote>City of Greeley, Water Utilities Property</quote> on the Map; and</text></subparagraph> <subparagraph id="HA3F9C9AEC2344E82B9461C51EE25AD23"><enum>(B)</enum><text>excludes all water rights owned by the City. </text></subparagraph></paragraph> 
<paragraph id="H331DC1F04B994D00BBB2CD57B7882A26"><enum>(5)</enum><header>Seaman reservoir trail</header><text>The term <term>Seaman Reservoir Trail</term> means—</text> <subparagraph id="HC8B0A9406B5D4FE0B59D55D77577E830"><enum>(A)</enum><text>the road labeled <quote>Seaman Reservoir Trl</quote> on the Map; and</text></subparagraph> 
<subparagraph id="H97520D2EA62549FC8D932BE77C7F4570"><enum>(B)</enum><text>as of the date of the enactment of this Act, referred to as <quote>Seaman Road #547</quote> in the Forest Service database.</text></subparagraph></paragraph> <paragraph id="HC628323C63A44283A218684AE492F27D"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph> 
<paragraph id="HEF1CFF4B64B64AEA8F0A83AFE79115CA"><enum>(7)</enum><header>Wintersteen trail</header><text>The term <term>Wintersteen Trail</term> means the unnumbered, non-system road generally depicted on the Map that branches from the Seaman Reservoir Road and provides access to the southwest corner of Seaman Reservoir.</text></paragraph> </subsection> <subsection id="H0288D84FDC5B48C08DAF8DBFA2D32C14"><enum>(b)</enum><header>Exchange of land</header><text>Subject to subsection (c), if the City offers to convey to the United States all right, title, and interest of the City in and to the non-Federal land, excluding all water rights owned by the City, the Secretary shall, not later than 3 years after the date on which the Secretary receives the offer, or such later date as the Secretary and the City mutually agree, simultaneously—</text> 
<paragraph id="H5073633D1A3C4A808E1A920DE53571BD"><enum>(1)</enum><text>convey to the City all right, title, and interest of the United States in and to the Federal land and excepting and reserving to the United States—</text> <subparagraph id="H710BD40A1F2C4082A2FCA79D16C62B68"><enum>(A)</enum><text>a perpetual, non-exclusive easement for public nonmotorized access over the Seaman Reservoir Trail and the Wintersteen Trail to adjacent National Forest System land that is consistent with the nature and extent of public access in effect on the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H771F4EC0A66048B38381AE997D696D43"><enum>(B)</enum><text>a perpetual, nonexclusive easement for motorized and nonmotorized access by the United States and its agents for administrative, emergency, inspection, maintenance, repair, reconstruction, and resource-management purposes; and</text></subparagraph></paragraph> <paragraph id="H0F9BF844E3AA4A088018DC362E660A2B"><enum>(2)</enum><text>accept from the City all right, title, and interest of the City in and to the non-Federal land, excluding all water rights owned by the City.</text></paragraph></subsection> 
<subsection id="H3CE8930D9F3D4C65BF4C3881DB9027BA"><enum>(c)</enum><header>Requirements</header><text>The exchange under subsection (b) shall be—</text> <paragraph id="H775D3148C7A34F02A2D0017EB83608B2"><enum>(1)</enum><text>conditioned on title approval for the non-Federal land, excluding all water rights owned by the City, conveyed under subsection (d)(3) by the Secretary in accordance with subsection (e);</text></paragraph> 
<paragraph id="HA9A972038CED497DAB978F5B02D51BC4"><enum>(2)</enum><text>conditioned on equalization of value in accordance with subsection (d) if, under the appraisals conducted in accordance with this section, it is determined that the value of the Federal land exceeds the value of lands to be conveyed by the City;</text></paragraph> <paragraph id="HDA6FE5625D164B41999A567BD7A75187"><enum>(3)</enum><text>conditioned on the satisfactory completion, for each parcel to be conveyed to the United States, of a Phase I Environmental Site Assessment that is provided by the City and acceptable to the Secretary;</text></paragraph> 
<paragraph id="H74631762BEDB4789BDA832E625A2677F"><enum>(4)</enum><text>subject to valid existing rights; and</text></paragraph> <paragraph id="H13A36C27B204494480B111B05CE7D816"><enum>(5)</enum><text>subject to any other terms and conditions, including reservations, covenants, restrictions, and easements, that the Secretary determines appropriate.</text></paragraph></subsection> 
<subsection id="H05B19EDA2BB24595A9560F8594D74A10"><enum>(d)</enum><header>Equal value and cash equalization</header> 
<paragraph id="HDABBA697374948D98F094F341EFAC97D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the exchange under subsection (b) shall be for equal value, with any difference in value equalized by the conveyance of additional land under paragraph (3), a cash payment under paragraph (4), or a combination thereof.</text></paragraph> <paragraph id="H3E68DDF8E4AB4CF38F0FF2AB654473E9"><enum>(2)</enum><header>Waiver for surplus value of non-federal land</header><text>Notwithstanding any other provision of law, if the appraised value of the non-Federal land to be conveyed to the United States exceeds the appraised value of the Federal land, a cash equalization payment by the United States to the City is hereby waived and the amount of such waived payment shall be considered a donation by the City to the United States for all purposes of law.</text></paragraph> 
<paragraph id="HE9602E327AEE4B548B9C2CAC8D56BC14"><enum>(3)</enum><header>Optional additional acreage conveyance by city</header> 
<subparagraph id="H1151687BA9D145FE930B374D544251CC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), if the appraised value of the Federal land exceeds the appraised value of the non-Federal land, the City may, subject to agreement by the Secretary, convey to the United States additional land owned by the City that the Secretary determines is suitable for addition to and administration as part of the National Forest System, for the purpose of equalizing appraised values, exclusive of any water rights.</text></subparagraph> <subparagraph id="HD13F41328A64450F8DD572DCC6DC5A37"><enum>(B)</enum><header>Acreage limit</header><text>The total acreage of additional land conveyed under subparagraph (A) may not exceed 40 acres.</text></subparagraph> 
<subparagraph id="HA1420E8D0D2E473FBF38A84E191D1F40"><enum>(C)</enum><header>Appraisal; title</header><text>Any additional land conveyed under this paragraph shall be appraised in accordance with subsection (e), and be acceptable in title and condition to the Secretary. All water rights held by the City will be expressly reserved from conveyance.</text></subparagraph></paragraph> <paragraph id="H8824E6CDE198490CA3C716FB1397AE3B"><enum>(4)</enum><header>Cash equalization payment by city</header><text>In accordance with section 206(b) of the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>), if the difference between the appraised value of the Federal land and the sum of the appraised value of the non-Federal land plus the appraised value of additional land conveyed to the United States under paragraph (3) is greater than zero, the City shall pay the Secretary a cash payment equal to such difference.</text></paragraph></subsection> 
<subsection id="H20337E458D82457E80309C54CDDB5DAB"><enum>(e)</enum><header>Appraisals</header> 
<paragraph id="H069A266B45EF437EBBE199E8E3D68579"><enum>(1)</enum><header>In general</header><text>The value of the land to be exchanged under this section shall be determined by appraisals conducted by an independent and qualified appraiser mutually agreed to by the Secretary and the City. Each appraisal shall be reviewed and approved by the Secretary.</text></paragraph> <paragraph id="H7EF8FAFA72834F578B1D309368328314"><enum>(2)</enum><header>Appraisal standards</header><text>The Secretary shall complete appraisals of the land to be exchanged under this section in accordance with Forest Service policy and—</text> 
<subparagraph id="H0701F1EAF1C64764BE483E1F5FE8382C"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph> <subparagraph id="HFC0ED92F41F64065B0C250E9AF1482D3"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph></subsection> 
<subsection id="H2B7FFFD5A73F4068AB75A4FF0934FBCC"><enum>(f)</enum><header>Format</header><text>Title to lands owned by the City and conveyed to the United States under this section shall be approved in accordance with section 3111 of title 40, United States Code.</text></subsection> <subsection id="HA6183744570E406AA455AB11E61B84D2"><enum>(g)</enum><header>Management of acquired land</header> <paragraph id="H7F96502F56054E069ED07A94B60F9081"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), any lands or interests in lands acquired by the United States under this section shall become part of the Roosevelt National Forest and shall be managed in accordance with the laws and regulations applicable to National Forest System.</text></paragraph> 
<paragraph id="H50D010927D8946428B2D0DD8D8B7CCAB"><enum>(2)</enum><header>Cache la poudre wilderness</header><text>Any land or interest in land acquired by the United States under this section that is within the boundary of the Cache la Poudre Wilderness shall—</text> <subparagraph id="H949F1AA081CF4236B38845FC81A58AFB"><enum>(A)</enum><text>become part of the Cache la Poudre Wilderness; and</text></subparagraph> 
<subparagraph id="H8749F26993424FE49152CF92AEC990CD"><enum>(B)</enum><text>be managed in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and any other applicable law.</text></subparagraph></paragraph> <paragraph id="HE411D8CD68B54C7F885423006E8F32E6"><enum>(3)</enum><header>Cache la poudre wild and scenic river</header><text>Any land or interest in land acquired by the United States under this section that is within the boundary of the Cache la Poudre Wild and Scenic River shall—</text> 
<subparagraph id="H135B6C77C7A240809BC809AF5EA94789"><enum>(A)</enum><text>become part of the Cache la Poudre Wild and Scenic River; and</text></subparagraph> <subparagraph id="HA0A61AA4D1AB4C3BA809DC78B4D76F6E"><enum>(B)</enum><text>be managed in accordance with the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>) and any other applicable law.</text></subparagraph></paragraph></subsection> 
<subsection id="H021731D2765A4ACC88254CF768610170"><enum>(h)</enum><header>Survey</header> 
<paragraph id="HE8F6773962F74BA2861C71B03F125EBC"><enum>(1)</enum><header>In general</header><text>The exact acreages and legal descriptions of the Federal land and the non-Federal land to be exchanged under subsection (b), and any additional lands conveyed under subsection (d)(3), and each easement reserved under subparagraphs (A) and (B) of subsection (b)(1) shall be determined by surveys satisfactory to the Secretary.</text></paragraph> <paragraph id="H1C3FDD4702524CA391D33D859A524BC8"><enum>(2)</enum><header>Costs of survey</header><text>The City shall bear all costs associated with each survey under paragraph (1).</text></paragraph></subsection> 
<subsection id="H17F5CE40F81D48F08D09BCE7AD9D8714"><enum>(i)</enum><header>Map and legal descriptions</header> 
<paragraph id="H7DE88A6C3FC84F5BBF6B139EBF0AD97B"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of the enactment of this Act, the Secretary shall finalize the Map and the legal descriptions of all lands to be conveyed under this section, including any additional lands conveyed under subsection (d)(3) and the easements reserved under subsection (b)(1).</text></paragraph> <paragraph id="H7294BE6299D5454DBE758E0E5F4500BB"><enum>(2)</enum><header>Controlling document</header><text>With respect to lands to be conveyed under this section, if there is a discrepancy between a Map and a legal description, the Map shall control.</text></paragraph> 
<paragraph id="H3C5C5128CF7548999FA29D163B9607B1"><enum>(3)</enum><header>Corrections</header><text>The Secretary and the City, by mutual agreement, may correct any minor errors in the Map, or the legal descriptions, including with respect to the boundaries of the Federal land and the non-Federal land.</text></paragraph> <paragraph id="H86B3E3CE77E14356BB74410C25AA6F3C"><enum>(4)</enum><header>Map on file</header><text>The Map, and the legal descriptions of all lands to be conveyed under this section, including any additional lands conveyed under subsection (d)(3), shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text></paragraph></subsection> 
<subsection id="HE2BBF628B5CA4CE480FD8A001DFCEBB5"><enum>(j)</enum><header>Costs</header><text>As a condition for the exchange under subsection (b), the City shall pay all costs associated with the exchange, including costs for—</text> <paragraph id="H6F9EC107565B4F1ABCB486564C913744"><enum>(1)</enum><text>appraisals and appraisal review;</text></paragraph> 
<paragraph id="H1675F8CDE10C4552BB92CE16B4B0094C"><enum>(2)</enum><text>surveys and preparation of legal descriptions;</text></paragraph> <paragraph id="H59FAD590C80A4C84B4A2FE08D2D303F0"><enum>(3)</enum><text>mineral examinations;</text></paragraph> 
<paragraph id="H224BD4B014644B17A0D087AFF393C7D6"><enum>(4)</enum><text>title searches, title insurance, and title-curative work;</text></paragraph> <paragraph id="H9D6FEC1228BF4F2FAC50521B05E31E3D"><enum>(5)</enum><text>attorneys fees and recording fees;</text></paragraph> 
<paragraph id="H3DC95B15725247A6A489B5824EA7ED01"><enum>(6)</enum><text>environmental assessments and resource surveys required under Federal law or regulation; and</text></paragraph> <paragraph id="HE23564B586304E919BFEF3A78FD18D9A"><enum>(7)</enum><text>escrow, recording, and other closing expenses.</text></paragraph></subsection> 
<subsection id="H122ADF24E9764F57A7B6BA9A4EA6DB32"><enum>(k)</enum><header>Applicable law</header><text>Except as otherwise expressly provided in this section, the Secretary shall carry out the exchange under this section in accordance with section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>) and subpart A of part 254 of title 36, Code of Federal Regulations.</text></subsection></section> </legis-body></bill>
