Russell National School Lunch Act to authorize the Secretary of Agriculture to make grants to certain institutions of higher education to provide free meals to low-income students, and for other purposes.</official-title></form><legis-body id="HDEA0EC9873C4465E9404775BDC191CF8" style="OLC"> 
<section id="H4F27D28EDFA34427AF982382B61220AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food for Thought Act of 2026</short-title></quote>.</text></section> <section id="HD2B15A74D6D849A083FA997650DE9F79"><enum>2.</enum><header>Free meals for low-income college students</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) is amended by inserting before subsection (b) the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HBCA5BF9547A74621ADCE56451A1562D0"> 
<subsection id="HC5CE1A4085BE4B179DD32DA3FC5EE5D0"><enum>(a)</enum><header>Free meals for low-income college students</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H57B552E371834E908160217D19F77479"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="HCBE99B9786B24F5FBFF4ECCE17AF55CA" commented="no"><enum>(A)</enum><header>Community college</header><text>The term <term>community college</term> means—</text> 
<clause id="H10353CFEE18F4268B972CE6F5A91B79B"><enum>(i)</enum><text>a public institution of higher education at which the highest degree that is predominantly awarded to students is an associate degree, including Tribal Colleges or Universities receiving grants under section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>) that offer a 2-year program for completion of such degree and State public institutions of higher education that offer such a 2-year program; and</text></clause> <clause id="HEB5AAB258A1D488C8C6B9F3F567843D2"><enum>(ii)</enum><text>a public postsecondary vocational institution (as defined in section 102(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>)).</text></clause></subparagraph> 
<subparagraph id="HDE0A5DFF43634A269948007DD86D3BC6"><enum>(B)</enum><header>Eligible entity</header> 
<clause commented="no" display-inline="no-display-inline" id="H1B0A73D5551448EFB489EDFE03073A94"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text> <subclause id="HF2AF8EC5E6A44AEC8669ABC8599BFFCF" commented="no"><enum>(I)</enum><text>an eligible institution of higher education that has an on-campus meal program;</text></subclause> 
<subclause id="HD77F68840B944589956AC5EAE0AA9F5B" commented="no"><enum>(II)</enum><text>an institutionally operated food service, contracted prepared-meal provider, mobile meal distribution, food hub, food pantry, food hall, or community-based meal partnership, as determined by the Secretary; or</text></subclause> <subclause id="HF120237CE33A44A09308FAB65D293E19" commented="no"><enum>(III)</enum><text>a consortium of eligible institutions of higher education, of which at least 1 eligible institution of higher education—</text> 
<item commented="no" display-inline="no-display-inline" id="HFA2BDF4943504E86805AED4E2345ECB8"><enum>(aa)</enum><text display-inline="yes-display-inline">has an on-campus meal program; and</text></item> <item commented="no" display-inline="no-display-inline" id="H1403285BA6244AF7B96BAF800763D505"><enum>(bb)</enum><text display-inline="yes-display-inline">is geographically accessible to the students of each eligible institution of higher education in the consortium that does not have an on-campus meal program.</text></item></subclause></clause> 
<clause id="H26DE6EC8AF5B49CFA875C251E0F685A3" commented="no"><enum>(ii)</enum><header>Geographic accessibility</header><text>For purposes of clause (i)(III)(bb), geographic accessibility shall be based on the location of, the availability of public transit to, and the meal service hours of each eligible institution of higher education within the consortium.</text></clause></subparagraph> <subparagraph id="HBAE3C2B6AA2D4BB7974E1C9EF352B79B"><enum>(C)</enum><header>Eligible institution of higher education</header><text>The term <term>eligible institution of higher education</term> means an institution of higher education (as defined in sections 101 and 102(a)(1)(B) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002(a)(1)(B))), including a minority-serving institution, in which at least 20 percent of the undergraduate students enrolled are eligible to receive a Federal Pell Grant under subpart 1 of part A of title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H3E3A4B4DB96B4D40994B48DCA29C680B"><enum>(D)</enum><header>Historically black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9C07C24D7D8E42E08A74C089A82A234E"><enum>(E)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution described in paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></subparagraph> 
<subparagraph id="H98C2DB20EDBD4C8D8C4F1F05D4594E82"><enum>(F)</enum><header>On-campus meal program</header><text>The term <term>on-campus meal program</term> means a meal program on the campus of an eligible institution of higher education that is provided through an institutionally owned or operated food service or 1 or more third-party food service vendors.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H43B6A88006B144D79E488248954F4502"><enum>(G)</enum><header>Program</header><text>The term <quote>program</quote> means the program established under paragraph (2)(A).</text></subparagraph> 
<subparagraph id="H61ABC78C0478428E94A355C8EAF398C8"><enum>(H)</enum><header>Tribal college or university</header><text>The term <term>Tribal college or university</term> means a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>) that is chartered by the governing body of the applicable Indian Tribe or by the Federal Government.</text></subparagraph></paragraph> <paragraph id="H05A0C71DCD7B447D8B51539C2B079D8F"><enum>(2)</enum><header>Establishment</header> <subparagraph id="H2DE29B48B12F4FBA9F19900EFDB430DF"><enum>(A)</enum><header>In general</header><text>The Secretary, acting through the Administrator of the Food and Nutrition Service, shall establish a program under which the Secretary shall award grants, on a competitive basis, to eligible institutions of higher education to provide free meals, including snacks, to low-income students.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB7D827E3973A4DF8B3DEC04455596A60"><enum>(B)</enum><header>Duration of grant</header><text display-inline="yes-display-inline">The duration of a grant awarded under the program shall not exceed 2 years.</text></subparagraph></paragraph> <paragraph id="H372CB717BEBB4E168DEFD3FF849417DD"><enum>(3)</enum><header>Application</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text> 
<subparagraph id="HA2D322C8297746DD89FE0B73F19B4B84"><enum>(A)</enum><text>a plan for identifying and conducting outreach to low-income students; and</text></subparagraph> <subparagraph id="H8823BF7653194AC986F4D3E804042584"><enum>(B)</enum><text>an assurance that the eligible entity will—</text> 
<clause id="HFB5E01D0B86F4F54BAEC3968D7D3B8FF"><enum>(i)</enum><text>conduct outreach to students with respect to the program, encourage student participation in the program, and inform students of—</text> <subclause id="H6D7BDBFDD7CF4A92943F7C1382809C48"><enum>(I)</enum><text>their potential eligibility for participation in other Federal, State, and local benefit and support programs, including means-tested Federal benefits programs, such as the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); and</text></subclause> 
<subclause id="HAF7A580245804F81A3010C1D66856201"><enum>(II)</enum><text>the processes for obtaining more information, confirming eligibility, and accessing benefits under those programs;</text></subclause></clause> <clause id="H53E77A944E224AADAFB229FA3FA6CE0E"><enum>(ii)</enum><text>evaluate institutional policies relating to the purchase of meal plans under on-campus meal programs and whether those policies create barriers to enrollment and persistence for low-income students;</text></clause> 
<clause id="HC332C354AA984058A663B6E06065D182"><enum>(iii)</enum><text>identify ways to mitigate any barriers under institutional policies that are found, through the evaluation described in clause (ii), to create barriers described in that clause; and</text></clause> <clause id="H86F5745504844A409F1B5E3B8E43795B"><enum>(iv)</enum><text>in the case of an eligible entity that is a consortium of eligible institutions of higher education that includes 1 or more eligible institutions of higher education that do not have an on-campus meal program, provide an explanation with respect to how the eligible entity will ensure that low-income students attending those institutions of higher education that do not have an on-campus meal program will be notified of available free meals provided under the program and available transportation options to be able to easily access those free meals.</text></clause></subparagraph></paragraph> 
<paragraph id="HCE2BB2912A2846DABFA05B63A127EFAD"><enum>(4)</enum><header>Award administration</header> 
<subparagraph id="HB6E629148CC24840ACE476CC9D0F1EB8"><enum>(A)</enum><header>In general</header><text>In awarding grants under the program, the Secretary shall ensure that the eligible entities receiving grants reflect—</text> <clause id="HCA862FB1CD2A4F0183F30BFFC5C939A9"><enum>(i)</enum><text>varying student body size;</text></clause> 
<clause id="H3A73E4F4181D4DEDB9B19B85EA44632C"><enum>(ii)</enum><text>part-time and full-time student enrollment;</text></clause> <clause id="HCCFA5BA5B34A4FD2A783ED8AC572A5BE"><enum>(iii)</enum><text>diverse geographic locations and regional costs of living, including urban, rural, or suburban campuses; and</text></clause> 
<clause id="H9239D996A59F465485D3EA8EEF6DBDFE"><enum>(iv)</enum><text>diverse residential character, including race, ethnicity, and socioeconomic status.</text></clause></subparagraph> <subparagraph id="HF5568B95D1034FFEABE25562E3BCF24E"><enum>(B)</enum><header>Priority</header><text>In awarding grants under the program, the Secretary may give priority to eligible entities—</text> 
<clause id="HD38D65C4639E4F85AFC80518DC6C535E"><enum>(i)</enum><text>with prepared food infrastructure or that can identify an outside source of support to develop that infrastructure;</text></clause> <clause id="HCEF4337520B0409B8E19928A50D9A2C9"><enum>(ii)</enum><text>that are community colleges, historically Black colleges and universities, Tribal colleges and universities, Hispanic-serving institutions (as defined in section 502(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>)), or other minority-serving institutions or consortia of minority-serving institutions; or</text></clause> 
<clause id="HB7B08D0C715844CBA236727660ACE939"><enum>(iii)</enum><text>that are located within proximity of a school that elects to receive special assistance payments under section 11(a)(1)(F).</text></clause></subparagraph></paragraph> <paragraph id="H12CE1545180541918895A86C91A7B4DA"><enum>(5)</enum><header>Use of funds</header> <subparagraph id="H0C1C8DE682ED4389801FA7F574B2690E"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives a grant under the program shall use the grant—</text> 
<clause id="HEFB7CBA48FE8462DA2478848C6E3D690" commented="no"><enum>(i)</enum><text>to establish a program to provide free meals, including snacks, to low-income students, subject to the condition that the eligible entity shall provide not fewer than 1 and not more than 10 free meals per week per student;</text></clause> <clause id="HCE6D94398E71447AB635A056AA3E3A43"><enum>(ii)</enum><text>to conduct outreach to students to encourage participation in the program;</text></clause> 
<clause id="H41CE8478F6084A29BAD1CA266E1AFD42"><enum>(iii)</enum><text>to prepare meals to be provided for free under the program;</text></clause> <clause id="H21080C0198B149E79E68257E48A75CC6"><enum>(iv)</enum><text>to purchase meals from vendors to be provided for free under the program;</text></clause> 
<clause id="H264427FA007E4E878D02B627F36B7F4A"><enum>(v)</enum><text>to provide information to students regarding potential eligibility for assistance under Federal, State, and local benefit and support programs and the processes for obtaining more information, as described in paragraph (3)(B)(i);</text></clause> <clause commented="no" display-inline="no-display-inline" id="H1AE6AA7D141948038C4D7D769FD7F99B"><enum>(vi)</enum><text display-inline="yes-display-inline">to conduct evaluations of institutional policies described in paragraph (3)(B)(ii);</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H235628EBA5494D8B97BE45F4BCF17B46"><enum>(vii)</enum><text>to identify ways to mitigate barriers described in paragraph (3)(B)(iii); and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H21D188E6729146ABBF14920D1548FDD2"><enum>(viii)</enum><text>to provide an explanation described in paragraph (3)(B)(iv).</text></clause></subparagraph> 
<subparagraph id="H8FF43ADA0D10419A8AE6ED18C16F7155"><enum>(B)</enum><header>Priority</header><text>In selecting low-income students to participate in the program established by the eligible entity under subparagraph (A)(i), an eligible entity shall give priority to low-income students who—</text> <clause id="H75DB43BEE0EB4C09A3EC571E18493E4E"><enum>(i)</enum><text>receive a Federal Pell Grant under subpart 1 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>);</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H393C507FF7C744A696980F8D429CA3AA"><enum>(ii)</enum><text>indicate that they are experiencing or at risk of experiencing food insecurity, housing insecurity, homelessness, or other insecurity with respect to basic needs; or</text></clause> <clause id="H6ADAEB830B874C50B0641F5BAC2EE678"><enum>(iii)</enum><text>participate in a State or federally financed work-study program during the regular school year, as determined by the eligible institution of higher education.</text></clause></subparagraph> 
<subparagraph id="H641822072FF74678B81C461B0B714466"><enum>(C)</enum><header>Limitation on purchase of equipment</header><text>An eligible entity that receives a grant under the program may use not more than 20 percent of the grant to purchase equipment.</text></subparagraph> <subparagraph id="H39E4D2ACC4B641C994BD0EC1B4A3CA1F"><enum>(D)</enum><header>Eligibility for SNAP</header><text>Receipt of a meal under the program shall not be considered for the purposes of determining eligibility for the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H31FC02C963CE4DA59288058A26944D89"><enum>(6)</enum><header>Requirement</header><text>Meals served by an eligible entity using a grant under the program shall meet the nutritional requirements developed under paragraph (9)(C).</text></paragraph> <paragraph id="HBEACB52FDF8D469BAFE425CD260AB5C2"><enum>(7)</enum><header>Report</header><text>Each eligible entity that receives a grant under the program shall, not later than 1 year after the end of the grant term, submit to the Secretary a report containing—</text> 
<subparagraph id="H5C89D1E7B8234C2F8866D7E915F99FBF"><enum>(A)</enum><text>a description of the prevalence of food insecurity among students enrolled in the eligible entity;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB1362A65671142DB891602193372C009"><enum>(B)</enum><text display-inline="yes-display-inline">an evaluation of the use of the grant funds by the eligible entity, including—</text> 
<clause commented="no" display-inline="no-display-inline" id="HBCE7118E91414A029DD192BF16ABD19C"><enum>(i)</enum><text display-inline="yes-display-inline">in addressing challenges with food insecurity; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HAA9BAFC87A3845C6A425590E40D3A114"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the degree completion rates of students served by the eligible entity; and</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCF97E71498F84C22832A28CFDC68F844"><enum>(C)</enum><text display-inline="yes-display-inline">information on the population of students served by the grant funds, disaggregated by—</text> <clause id="H0DE6399882BD40B2972FA311A9CD7401"><enum>(i)</enum><text>part-time or full-time status;</text></clause> 
<clause id="H9F83812524BE41BCA1EAA215DB1539EF"><enum>(ii)</enum><text>eligibility to receive the Federal Pell Grant under subpart 1 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>);</text></clause> <clause id="H99145F970A0946ABBB4F0BADE561AFD9"><enum>(iii)</enum><text>estimates of eligibility to receive benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); and</text></clause> 
<clause id="HC2E71DA2E2A94D179C8F8AD76EDDDB02"><enum>(iv)</enum><text>dependency status.</text></clause></subparagraph></paragraph> <paragraph id="HC9B83828F3E54D17ACD4C2F625A881C1"><enum>(8)</enum><header>Duties of the Secretary</header> <subparagraph id="HCD9A6DE19B9643988FD4C370BAB7CE59"><enum>(A)</enum><header>Consultation</header><text>In carrying out the program, the Secretary shall consult with eligible entities and State social service agencies.</text></subparagraph> 
<subparagraph id="H247666C2FFF94AB2868E3CD408FA7EC5"><enum>(B)</enum><header>Technical assistance</header> 
<clause commented="no" display-inline="no-display-inline" id="H3EC0830043054FB58764BAC0074BBFBC"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of the <short-title>Food for Thought Act of 2026</short-title>, the Secretary, acting through the Administrator of the Food and Nutrition Service, and the Secretary of Education shall enter into a memorandum of understanding that—</text> <subclause id="HCFB9EB10B4104452A732864479D7BB07"><enum>(I)</enum><text>authorizes the regular sharing of Department of Education data and resources to assist with identifying eligible institutions of higher education and low-income students;</text></subclause> 
<subclause id="HB79A04D99F1747B3A16CFC548C58D546"><enum>(II)</enum><text>contains a plan to assist State social services agencies and State higher education agencies in improving outreach to students eligible to enroll in the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); and</text></subclause> <subclause id="H7A27017BD0294743A711ECE17D3F59AC"><enum>(III)</enum><text>requires the development of an annual plan for the Administrator of the Food and Nutrition Service and the Secretary of Education to provide technical assistance, as applicable, to eligible entities—</text> 
<item commented="no" display-inline="no-display-inline" id="H598B20DCEDD84B75BA404E33FF70754E"><enum>(aa)</enum><text display-inline="yes-display-inline">to develop prepared-meal infrastructure;</text></item> <item id="HE0A3D7185665450CA4587A691A47B384"><enum>(bb)</enum><text>to carry out the activities described in paragraph (5)(A), including training the employees of the eligible entity to carry out those activities; and</text></item> 
<item id="H3349B222F49D45DF904EA9EFC04681BC"><enum>(cc)</enum><text>to develop outreach to students who are likely to be eligible for benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></item></subclause></clause> <clause id="H66364C4B98644A9B93BA40042E29235C"><enum>(ii)</enum><header>Data privacy</header><text>Data sharing pursuant to the memorandum of understanding under clause (i) shall—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HC3EF140372C948B49879C21BD41F66FD"><enum>(I)</enum><text display-inline="yes-display-inline">comply with all applicable Federal privacy protections, including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>); and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H105FDEF7C07B4438ACF0075FF1989F3B"><enum>(II)</enum><text>be used only for the purpose of assisting eligible institutions of higher education in conducting outreach to low-income students.</text></subclause></clause></subparagraph> 
<subparagraph id="H35EA408E222D4A298F8CDE4529F9AB50"><enum>(C)</enum><header>Nutritional requirements</header><text>Not later than 120 days after the date of enactment of the <short-title>Food for Thought Act of 2026</short-title>, the Secretary shall develop nutritional requirements for meals served pursuant to grants under the program that are consistent with the goals of the most recent Dietary Guidelines for Americans published under section 301 of the National Nutrition Monitoring and Related Research Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5341">7 U.S.C. 5341</external-xref>).</text></subparagraph> <subparagraph id="H2E2ECEC704C24B64B50136020BE994F1"><enum>(D)</enum><header>Report</header> <clause id="HAF5D1BB9E4F84B51960A1A75547246B1"><enum>(i)</enum><header>In general</header><text>The Secretary shall submit to Congress—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H1FED47E3F679421DAE00D582F33114C3"><enum>(I)</enum><text>not later than 2 years after the date of enactment of the <short-title>Food for Thought Act of 2026</short-title>, a report evaluating the program, including—</text> <item id="HE8A0887B7C0B47AAA67105B8203EC980"><enum>(aa)</enum><text>how the program addressed food insecurity; and</text></item> 
<item commented="no" display-inline="no-display-inline" id="H8BC3EB450B4847469DA82F7B2E9845D5"><enum>(bb)</enum><text display-inline="yes-display-inline">recommendations with respect to expanding the program; and</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="HA6F273140FEF48A887DA7919A85E619E"><enum>(II)</enum><text>not later than 4 years after the date of enactment of the <short-title>Food for Thought Act of 2026</short-title>, a report on the effect of the program on retention and completion rates for low-income students served by the program.</text></subclause></clause> 
<clause id="H66691736F335407188838CBC5D6C19AA"><enum>(ii)</enum><header>Disaggregation</header><text>Information contained in the reports submitted under clause (i) shall be disaggregated, where possible, by—</text> <subclause id="HD695E278526844708C0D3CC0429C7E32"><enum>(I)</enum><text>sectors and types of institutions of higher education, including whether an institution of higher education is a minority-serving institution;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H376A07BC581842D59CA002F1EC9858C2"><enum>(II)</enum><text>the number of eligible students who—</text> <item id="H740AC09293BC472CAF650BD7080E4813"><enum>(aa)</enum><text>are part-time, half-time, or full-time;</text></item> 
<item id="HF1AE62950BF34B16BD1F9B581D055D1A"><enum>(bb)</enum><text>are eligible to receive the Federal Pell Grant under subpart 1 of part A of title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>);</text></item> <item id="H1625DCAC050E42CD8A5079EDAF23FD4A"><enum>(cc)</enum><text>are eligible to receive benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>);</text></item> 
<item id="H1BDDF5A2C55646BBBB6C6D6625E554A2"><enum>(dd)</enum><text>have indicated that the student or a member of the family of the student previously received benefits under—</text> <subitem commented="no" display-inline="no-display-inline" id="HB5C573A0EBC049B9A790ADD5FF2DB7BC"><enum>(AA)</enum><text display-inline="yes-display-inline">the program described in item (cc); or </text></subitem> 
<subitem commented="no" display-inline="no-display-inline" id="H0ED6E55D9456403192D55E99FFE7A7D6"><enum>(BB)</enum><text display-inline="yes-display-inline">the temporary assistance for needy families program established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></subitem></item> <item id="HE54EAC7E6D5E486D88472342F1B2FCA6" commented="no"><enum>(ee)</enum> <subitem commented="no" display-inline="yes-display-inline" id="H472653BC88474445A6FFE74A1A98CAC7"><enum>(AA)</enum><text>reside in an institution or boarding house; or </text></subitem> 
<subitem commented="no" display-inline="no-display-inline" id="HE8648482769D4A5789FAFC830E4B48AB" indent="up1"><enum>(BB)</enum><text>live with other individuals and pay compensation to those individuals for meals; and</text></subitem></item> <item id="HEB700A52727449D4A224C073C514EC89"><enum>(ff)</enum><text>are first-generation college students; and</text></item></subclause> 
<subclause id="H4EDFB68079D641819E74E3CDD4CD1532"><enum>(III)</enum><text>whether an institution of higher education has an open admissions policy.</text></subclause></clause></subparagraph></paragraph> <paragraph id="HC94253E52BA543849F0E00790AD39B1E"><enum>(9)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection such sums as are necessary for each of fiscal years 2027 through 2032.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB15F6AE78D6A4A8EA6D3295C1356755B"><enum>3.</enum><header>Amendment to the Higher Education Act of 1965</header><text display-inline="no-display-inline">Section 480(i) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(i)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB09677E5801F48B2B48683608805D47F"> <paragraph id="H54CFD734E46B4F6194CC473C497C1DF5"><enum>(6)</enum><text>Notwithstanding paragraph (1), benefits received under subsection (a) of section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) shall not be treated as other financial assistance for purposes of section 471(3).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
