<section id="HEF6361AE939C4C4FA196EE1E938FAB38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Currency Options, Information, and Navigation Act</short-title></quote>.</text></section> <section id="HD43E378CC66A4E8CA150B29E476BC232"><enum>2.</enum><header>Digital asset educational resources and modules for small business concerns</header> <subsection id="H42F912903B694DA0B3CA4DC87AD864F1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text> 
<paragraph id="H36B01FE96F8D4B809459636368E7523A"><enum>(1)</enum><text>by redesignating section 49 as section 50; and</text></paragraph> <paragraph id="HB0A2BE08D5ED453291C7120B033CAD73"><enum>(2)</enum><text>by inserting after section 48 the following new section:</text>

<section id="H07C194DB48C7447E8EBDFD627A1526EB"><enum>49.</enum><header>Digital asset educational resources and modules for small business concerns</header> 
<subsection id="H47359A1FAE3D4C42BEB70D14EB44EF38"><enum>(a)</enum><header>In general</header><text>The Administrator shall—</text> <paragraph id="H44D5D793D3914F1C941BF1DDC71F1ECF"><enum>(1)</enum><text display-inline="yes-display-inline">establish and maintain educational resources and modules for small business concerns with information on digital assets; and</text></paragraph> 
<paragraph id="H3E0F3C909275459D943935311261248B"><enum>(2)</enum><text display-inline="yes-display-inline">make such educational resources and modules publicly available on an existing online learning platform of the Administration.</text></paragraph></subsection> <subsection id="H27BE8787907E45BA93231D6CE217778E"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The educational resources and modules established under subsection (a) shall include, to the extent practicable, information on—</text> 
<paragraph id="H3D0BBE6A8A294C2FB641DDF84AF21A3F"><enum>(1)</enum><text display-inline="yes-display-inline">the benefits and risks of using digital assets in the operations of small business concerns, including tax implications and security risks;</text></paragraph> <paragraph id="HDB24472C2F044BD29C001CF2310187B2"><enum>(2)</enum><text>avoidance of security risks associated with such use of digital assets;</text></paragraph> 
<paragraph id="HBD29C7E9ABF34BF6BA91550347359358"><enum>(3)</enum><text display-inline="yes-display-inline">deciding whether to use a third-party vendor to handle digital asset transactions, including evaluating fees and rates, processing and settlement times, compliance and risk, reporting requirements, and any additional features of a digital asset transaction;</text></paragraph> <paragraph id="H576D423930C64ACB92FCA5CD56C7B0FC"><enum>(4)</enum><text display-inline="yes-display-inline">methods used by digital asset payment gateways and resources for the use of such gateways by customers of such concerns, including supporting infrastructure necessary to facilitate transactions; and</text></paragraph> 
<paragraph id="H7B34D2CF58354A37B5331894B7BC4332"><enum>(5)</enum><text display-inline="yes-display-inline">the differences between types of digital assets, including stablecoins, and the unique risks associated with using digital assets.</text></paragraph></subsection> <subsection id="HFEFFA8B4E5E54ECB81026DC1EB621C33"><enum>(c)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent practicable, the Administrator shall ensure that the information contained in the educational resources and modules established under subsection (a) is factually accurate and current, including by consulting with—</text> 
<paragraph id="HB2527635021D4F8084F2EE0CD330A3D1" commented="no"><enum>(1)</enum><text>the Director of the National Institute of Standards and Technology;</text></paragraph> <paragraph id="HEC3297F3ED0D410B8E56BDF7FCE17843"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Commerce;</text></paragraph> 
<paragraph id="H11979BE3277448ACA1C36DDE040095F0"><enum>(3)</enum><text>Secretary of the Treasury;</text></paragraph> <paragraph id="H0B0E1F6820CF4008AD7FAF36CEABF9B3"><enum>(4)</enum><text display-inline="yes-display-inline">the Advisory Working Group established under subsection (d);</text></paragraph> 
<paragraph id="H0102B6B8A37342BE96F057BDA0B4B66F" commented="no"><enum>(5)</enum><text>the Board of Governors of the Federal Reserve System;</text></paragraph> <paragraph id="H4D74D4111138445B90D5BE3FD6E9CB73" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">the Comptroller of the Currency;</text></paragraph> 
<paragraph id="H02773782CB834A88AB49CA773B349D08" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">the Federal Deposit Insurance Corporation;</text></paragraph> <paragraph id="H8EE36A8C87F240FB84218157AC418A9E" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">the National Credit Union Administration Board;</text></paragraph> 
<paragraph id="H67C48FBFDEC148A7932B0A03A01BCBEC" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">the Securities and Exchange Commission;</text></paragraph> <paragraph id="HD908A55665D24A45B0254D845BCF0ECA" commented="no"><enum>(10)</enum><text display-inline="yes-display-inline">the Commodity Futures Trading Commission; and</text></paragraph> 
<paragraph id="H06A1E7EFA7794807BF45AE606D89B057"><enum>(11)</enum><text display-inline="yes-display-inline">the head of any other Federal agency, as determined by the Administrator.</text></paragraph></subsection> <subsection id="H2895B80EE6EA4153933D78E34A4515C4"><enum>(d)</enum><header>Advisory Working Group</header> <paragraph id="HCD4CDF13B8834D438E14BECBF9033A29"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a working group (in this subsection referred to as the <quote>Advisory Working Group</quote>) with which the Administrator shall consult on an ongoing basis regarding the information contained in the educational resources and modules established under subsection (a).</text></paragraph> 
<paragraph id="HCBAC89C03F4B40989831C12CB0444926" commented="no"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Advisory Working Group shall include the identification and recommendation of relevant information to the Administrator for inclusion in the educational resources and modules established under subsection (a).</text></paragraph> <paragraph id="HBB836A2E706347F0896568D7F4C9130F" commented="no"><enum>(3)</enum><header>Members</header><text display-inline="yes-display-inline">The Advisory Working Group shall be comprised of the following members, who shall be selected by the Administrator:</text> 
<subparagraph id="H31E787B2A27C4F9BA94196F8F2CC5557"><enum>(A)</enum><text display-inline="yes-display-inline">At least one individual representing the Financial Crimes Enforcement Network of the Department of the Treasury.</text></subparagraph> <subparagraph id="H1F60B883DA2C45B399BF65D1D8489BFE"><enum>(B)</enum><text display-inline="yes-display-inline">At least one individual who is a tax professional with expertise in digital asset taxation.</text></subparagraph> 
<subparagraph id="H4B02A7D9821D48AABE1480CACA5FE14A" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals with demonstrated expertise in digital assets, including—</text> <clause id="H43BD03D4154A42E0B628FCF2895E7459" commented="no"><enum>(i)</enum><text>not less than one individual from the private sector;</text></clause> 
<clause id="H3E8991252EB141FA8EAA41BDD3B17C8E"><enum>(ii)</enum><text display-inline="yes-display-inline">not less than one individual from academia;</text></clause> <clause id="H8277ACFD28774CF4BD2703DA9620126E" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">not less than one individual from an organization with demonstrated expertise in ensuring digital asset outputs are reliable, secure, transparent, and not used for illegal purposes; and</text> </clause> 
<clause id="HECB05D9B58D44BF9875E6D083E80894B" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">not less than one individual with demonstrated expertise in the creation of educational or professional development materials regarding digital assets.</text> </clause></subparagraph> <subparagraph id="H62A88855EA48445CAC3FD034DF0DE5EC" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Individuals with demonstrated expertise in outreach to small business concerns, including—</text> 
<clause id="HC928DA3D26AB420183A5EA6C37FF35AD" commented="no"><enum>(i)</enum><text>not less than one individual from each resource partner;</text></clause> <clause id="HA76703601CA345F69510C9B882B59705" commented="no"><enum>(ii)</enum><text>not less than one individual from a district office of the Administration; and</text></clause> 
<clause id="H5F817409A1A24EC5A8E5FAB9A1454DBC" commented="no"><enum>(iii)</enum><text>not less than one individual from an association representing small business concerns.</text></clause></subparagraph> <subparagraph id="H1592D2CD85DD475EACD44C6AB9257D5F" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">A financial services consumer advocate.</text></subparagraph> 
<subparagraph id="H6A034394EC3148D1B366C74E13C0D13D" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">An investor advocate for financial services.</text></subparagraph> <subparagraph id="H3706B6259F614A0D8CF4E23589F52115" commented="no"><enum>(G)</enum><text>An individual with demonstrated expertise on the ongoing risks arising from scams and fraudulent activity related to the use of digital assets.</text></subparagraph></paragraph> 
<paragraph id="H8D5E4F1166A848CBB6B1CE5ECA36862B" display-inline="no-display-inline"><enum>(4)</enum><header>Vacancies</header><text display-inline="yes-display-inline">Any vacancy in the Advisory Working Group shall be filled in the same manner as the original appointment.</text></paragraph> <paragraph id="H01C019C4A5DF4DB2BC860BA61B68835A"><enum>(5)</enum><header>Inapplicability of FACA</header><text display-inline="yes-display-inline">The requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code, shall not apply to the Advisory Working Group established under this paragraph.</text></paragraph></subsection>
<subsection id="HF396511389D941DF9C775EBB1573FBA8" commented="no"><enum>(e)</enum><header>Incorporation of information in educational resources and modules</header><text display-inline="yes-display-inline">In establishing and maintaining the educational resources and modules under subsection (a), the Administrator—</text> <paragraph id="H8D43F41DCA51416FAFF4FD82619466C1" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">shall consider relevant, existing information developed by resource partners, financial services consumer advocates, and investor advocates for financial services; and</text></paragraph> 
<paragraph id="H2DE2B9BB674D4348989FB430DBEFA079" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">may incorporate information described in subparagraph (A) into such educational resources and modules.</text></paragraph></subsection> <subsection id="H56A8AAA5B87248568B00E29D94AFCD74"><enum>(f)</enum><header>Resource partner involvement</header><text display-inline="yes-display-inline">The Administrator shall coordinate with resource partners to disseminate information to raise the awareness of small business concerns about availability of the educational resources and modules established under subsection (a).</text> </subsection> 
<subsection id="HA923D4A1D1D34609BBE12843F1C3A75E"><enum>(g)</enum><header>Manner</header><text display-inline="yes-display-inline">The Administrator shall ensure that the information in the educational resources and modules established under subsection (a)—</text> <paragraph id="H298C03A4827A4D67AB995C3CE25F7DC4"><enum>(1)</enum><text>is actionable and presented in a manner that is easily comprehensible by small business concerns; and</text></paragraph> 
<paragraph id="H8FB798CC963742B58A5AC13795917982" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">does not give preference to a digital asset model or tool developed by a specific entity or group of entities.</text> </paragraph></subsection> <subsection id="H8CDB917FF48549FC879C45E5E2BDCB25" display-inline="no-display-inline"><enum>(h)</enum><header>Digital asset defined</header><text display-inline="yes-display-inline">In this section, the term <term>digital asset</term> has the meaning given such term in section 2 of the GENIUS Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5901">12 U.S.C. 5901</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H39555F6BCBE44CD58F8971CE3C488B7F"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall establish the educational resources and modules required by section 49 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>), as added by this Act, not later than 180 days after the date of the enactment of this Act.</text></subsection></section> <section id="H756038C512A84016B6F8BC1028FB64B1"><enum>3.</enum><header>Compliance with CUTGO</header><text display-inline="no-display-inline">No additional amounts are authorized to carry out this Act or the amendments made by this Act.</text></section>
