<section section-type="section-one" id="H0DADAE1F10F344D3AE02A47F97BF4DEA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Materials Future Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H300BA090AB884897BF5C1149E94CE4DC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HAD38ADE7AAE343289CE8EA49053E8D6C"><enum>(1)</enum><header>Country of risk</header><text>The term <term>country of risk</term> has the meaning given the term in section 10114(a) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18912">42 U.S.C. 18912(a)</external-xref>).</text></paragraph> <paragraph id="H5DB926A005DD4FEFAA75060A72356871"><enum>(2)</enum><header>Critical material</header><text>The term <term>critical material</term> has the meaning given the term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5F1D5BB1B316499893A8CB36255AFCB4"><enum>(3)</enum><header>Domestic</header><text>The term <term>domestic</term> means facilities operating within the United States or within any territory or possession of the United States.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H072D3881A9BE45D281A558028154ACE1"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible project</header><text>The term <term>eligible project</term> means a project that refines and processes or recycles raw critical materials into purified forms suitable for first-use applications.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC4F10C51C6824B318EA7802954881C02"><enum>(5)</enum><header>Entity of concern</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H7E213531CD07477C994D004F2E3809F7"><enum>(A)</enum><header>In general</header><text>The term <term>entity of concern</term> has the meaning given the term in section 10114(a) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18912">42 U.S.C. 18912(a)</external-xref>); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1A7813AEFF2347638CF136FD00D0DEE4"><enum>(B)</enum><header>Inclusion</header><text>The term <term>entity of concern</term> includes an entity that the Secretary has determined, using a risk-based approach, is subject to the control or influence of a foreign nation whose strategic interests concerning critical materials does not align with the strategic interests of the United States.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF6C9C6646CA543B4A338D752928594C4"><enum>(6)</enum><header>Innovative financial tools</header><text>The term <term>innovative financial tools</term> means financial instruments to support demand-side economic mechanisms, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H5772A100638C48F7ABA1CB23730705B1"><enum>(A)</enum><text display-inline="yes-display-inline">pricing support mechanisms, such as contracts for difference and price floors, advanced market commitments, and forward contracts; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H448DFBCD60194A8D9581DC3CEBBE3D16"><enum>(B)</enum><text display-inline="yes-display-inline">other transactions that the Secretary may enter into under section 646 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7256">42 U.S.C. 7256</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0651582BF1B24A7CA5CF9E1CE51C3205"><enum>(7)</enum><header>Pilot program</header><text>The term <term>Pilot Program</term> means the Domestic Critical Material Processing Pilot Program established under section 4(a).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB07D3EE7871A4C6E8D86268467806437"><enum>(8)</enum><header>Reliable sources</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HA4040741A5A345BDAA9159277FEDA3C5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>reliable source</term> has the meaning given the term in section 12 of the Strategic and Critical Materials Stock Piling Act (<external-xref legal-doc="usc" parsable-cite="usc/50/98h-3">50 U.S.C. 98h–3</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4DCC1FA4AF9F432FB1F2886DA6AB27AC"><enum>(B)</enum><header>Inclusions</header><text>The term <term>reliable source</term> includes facilities owned by, controlled by, or subject to the jurisdiction of any country—</text>
<clause commented="no" display-inline="no-display-inline" id="H645C0A98A65044A88B0719A056622DBF"><enum>(i)</enum><text display-inline="yes-display-inline">with which the United States has a free trade agreement in effect; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD5A4D8516A404B8FAD997C0ADF9634B7"><enum>(ii)</enum><text>designated a major non-NATO ally under section 517 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2321k">22 U.S.C. 2321k</external-xref>).</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF1D7AE29A2BB4F4C842FE33EBFB08D66"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="HA8213AB0CE074482AC2FF54861806F0D"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H8C8DD232AFC04271AED32FD9F4E65EE4"><enum>(1)</enum><text>to support domestic critical material processing with innovative financial tools to reduce supply chain vulnerabilities and enhance energy and national security; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5062B0ADFF6A4696853CA1E26B320914"><enum>(2)</enum><text>to evaluate the effectiveness of innovative financial tools in supporting investment in and expanding domestic critical materials processing, including the impact of different support mechanisms on project development for various critical materials and fostering more liquid, transparent, and predictable markets for critical materials.</text></paragraph></section>
<section id="HD275E8BBD53A41D7AE7749397EECAAEA"><enum>4.</enum><header>Domestic critical material processing pilot program</header>
<subsection commented="no" display-inline="no-display-inline" id="HD46086FE551F47FEB13CC6E6FCF6CD13"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a pilot program, to be known as the <quote>Domestic Critical Material Processing Pilot Program</quote>, to support not fewer than 3 domestic critical material processing projects. </text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HE87F7BB0AB4448E392F33D5D15411CF3"><enum>(b)</enum><header>Objectives</header><text>The objectives of the Pilot Program are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H3D64642BA1B04055ACA4CE981C2266F5"><enum>(1)</enum><text>to provide financial stability and attract private investment in eligible domestic critical material processing projects;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE7ABEAFABB48400B8B8CB1DB2869584B"><enum>(2)</enum><text>to analyze how different financial tools influence critical material market dynamics and projects and the estimated level of financial support needed to secure reliable United States supply chains for various critical materials and support a sufficient domestic critical materials processing industry; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7BBC4B5CD1EF43468971F69595CE174C"><enum>(3)</enum><text>to reduce supply chain vulnerabilities and enhance energy security and national security.</text></paragraph></subsection> <subsection id="H83667089319040AA85B6A7C2CEC0AAB3"><enum>(c)</enum><header>Requirements</header> <paragraph commented="no" display-inline="no-display-inline" id="HF49FEE3458694034A2B0A441829D29AC"><enum>(1)</enum><header>Implementation</header> <subparagraph commented="no" display-inline="no-display-inline" id="H950580FE0AAA4ECE9768C9FF5DF13044"><enum>(A)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall issue regulations to implement the Pilot Program.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H5C262671403F46A28913B3F2F639B36F"><enum>(B)</enum><header>Other transaction authority</header><text display-inline="yes-display-inline">In carrying out the Pilot Program, the Secretary shall have the authority to enter into other transactions in the same manner and subject to the same terms and conditions as transactions that the Secretary may enter into under section 646 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7256">42 U.S.C. 7256</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB9D4621F2DED4027832EB78A5B3359D4"><enum>(C)</enum><header>Flexible hiring authority</header><text>The Secretary may appoint and fix the compensation of such temporary personnel as may be necessary to carry out and implement the Pilot Program, without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, governing appointments in competitive service and compensation of personnel.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAA88FBEB258E464089DD7F138E457009"><enum>(D)</enum><header>Consultation</header><text>The Secretary shall consult outside stakeholders and experts, including mining and critical material processing industry representatives, financial experts, and academic researchers, during development of the Pilot Program for purposes of improving the effectiveness and efficiency of the Pilot Program.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD552434CB4E643B4B00F1BF2B293A0BC"><enum>(2)</enum><header display-inline="yes-display-inline">Diversity</header> <subparagraph commented="no" display-inline="no-display-inline" id="HC261D084F4B74F0F8C95575AF3FDF462"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Pilot Program shall provide support for the processing of not fewer than 3 different critical materials in order to gain insight into the impact of innovative financial tools on different critical material markets.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2506BE52ACB14BF591CE65C0482FA250"><enum>(B)</enum><header>Limitation</header><text>Support provided under subparagraph (A) to a single critical material shall not exceed 50 percent of any funding provided to the Pilot Program under subsection (h).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB912335213134684873939A0D5E25974"><enum>(3)</enum><header>Sunset</header><text>The Pilot Program shall terminate on the date that is not later than 5 years after the date the Pilot Program is established under subsection (a).</text></paragraph></subsection>
<subsection id="HED521CF6C2B04646B4B13AEA5B64C30A"><enum>(d)</enum><header>Applications</header>
<paragraph commented="no" display-inline="no-display-inline" id="H647F02B705D64372B11793DC445126AD"><enum>(1)</enum><header>In general</header><text>Applications under the Pilot Program for eligible projects shall be submitted to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1543B94773B949CFA605B798D1D29794"><enum>(2)</enum><header>Eligibility criteria</header> <subparagraph commented="no" display-inline="no-display-inline" id="H92E47C42DA5447A1985A331F48076876"><enum>(A)</enum><header>In general</header><text>The Secretary shall review and select applications under the Pilot Program for eligible projects based on—</text>
<clause commented="no" display-inline="no-display-inline" id="H3534411F2C2E4BBBABF76F7689B86000"><enum>(i)</enum><text>the potential of the eligible project to enhance the economic, energy, and national security of the United States;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2BB98B9BB8EF49CFB501F78B25822315"><enum>(ii)</enum><text>the economic competitiveness of the eligible project; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="H19BB44E1D449469199C27C5C16647EDE"><enum>(iii)</enum><text display-inline="yes-display-inline">the economic and financial sustainability of the eligible project, using information such as—</text> <subclause commented="no" display-inline="no-display-inline" id="H4A6D30AB52A044D7843F16D176891551"><enum>(I)</enum><text display-inline="yes-display-inline">the potential for the applicant of the eligible project to secure an offtake agreement if the eligible project is selected; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H60A432F2AFCB4A749F5B761976916A9C"><enum>(II)</enum><text>an analysis of the estimated production costs of the eligible project and prevailing or anticipated market prices;</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H4235C9B81FF74D80950E70A2C5530409"><enum>(iv)</enum><text>the potential of the eligible project to mitigate risks associated with importing critical materials from entities of concern;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE4700A5CD9D64E8F871A7AE2FE0F9E1A"><enum>(v)</enum><text display-inline="yes-display-inline">the prioritization requirements described in subparagraph (B); and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H02D318E6A1864AC78BC267FA92D9D2C5"><enum>(vi)</enum><text>other factors, as determined by the Secretary, in coordination with the agencies described in subsection (e).</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H887B5BD1B33D40E6A4E0B3DAD8C177DB"><enum>(B)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting applications under the Pilot Program for eligible projects, the Secretary shall prioritize eligible projects—</text> <clause commented="no" display-inline="no-display-inline" id="H42841D0FEEF84C0B8A7F68AB50D3E27D"><enum>(i)</enum><text display-inline="yes-display-inline">that use feedstock from domestic or reliable sources, with higher priority given to eligible projects that have greater use of feedstock from domestic sources;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H3CE7E920CA474A18A9A06B9F130BEFEC"><enum>(ii)</enum><text display-inline="yes-display-inline">the selection of which would support the ability of the applicant to secure an offtake agreement with domestic or reliable sources; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H1E65D41FA6C645C2B842B4E1775811AB"><enum>(iii)</enum><text>that are the most economically competitive, as determined by the Secretary, based on factors including—</text>
<subclause commented="no" display-inline="no-display-inline" id="HD16C75CFE51E448D810EED7441C86203"><enum>(I)</enum><text display-inline="yes-display-inline">the potential for the applicant of the eligible project to secure an offtake agreement if selected; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HBA2854590E0D4667B639E1373FCBE6C2"><enum>(II)</enum><text display-inline="yes-display-inline">the difference between the estimated production costs of the eligible project and prevailing or anticipated market prices.</text></subclause></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAA2EAB08EE4349E18A2E0AA0CF217B73"><enum>(3)</enum><header>Timeline</header><text>The Secretary shall select applications under the Pilot Program for eligible projects not later than 1 year after the date of enactment of this Act.</text></paragraph></subsection> <subsection commented="no" id="H1103F64EB8704DE287B53B3ED7749184"><enum>(e)</enum><header>Coordination</header> <paragraph commented="no" display-inline="no-display-inline" id="HD2D31BAE10CB49029F952BA72804754A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure the efficient implementation and operation of the Pilot Program, the Secretary shall coordinate with—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H00D96D7587E24C55A4F9A4EFA3E4DE7B"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Commerce;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H822B275BA51F4C728CA0507AC9B46AE9"><enum>(B)</enum><text>the Secretary of Defense;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H16ED764DFC1D401BBFD0AB98E9D7C038"><enum>(C)</enum><text>the Secretary of the Interior;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2C9D621B379A49DDBA6D53F19806A7C1"><enum>(D)</enum><text>the Secretary of State;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H5183743F3BBA49458797C05252BC3EE1"><enum>(E)</enum><text>the Director of the United States Geological Survey; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC44AB0A678394532BCE713EF25D90FCB"><enum>(F)</enum><text display-inline="yes-display-inline">the United States Trade Representative; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9380C725B41045E4810025D5A9108E02"><enum>(G)</enum><text display-inline="yes-display-inline">the heads of other Federal departments and agencies, as determined by the Secretary.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4FA5AF11B387423996C571788F326AF0"><enum>(2)</enum><header>Security research and development</header><text>When selecting applications and determining the level of financial support for each project under the Pilot Program, the Secretary shall coordinate with the Secretary of Defense to incorporate insights from the Open Price Exploration for National Security research and development program of the Defense Advanced Research Projects Agency.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H721B19FDC9B24E738A2DF0C39BF406BD"><enum>(f)</enum><header>Study</header>
<paragraph commented="no" display-inline="no-display-inline" id="H5BA6CFED45DB4A7ABEE9EFDE5377D484"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the Pilot Program terminates under subsection (c)(3), the Secretary shall conduct and publish a study on—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4B08F57BF64B40FCA1096A2CABE562FD"><enum>(A)</enum><text display-inline="yes-display-inline">the impact of innovative financial tools on the critical materials sector and the relative cost-effectiveness of those tools in supporting domestic critical materials processing projects and developing more liquid, transparent, and predictable markets for critical materials;</text></subparagraph>
<subparagraph id="H239EC4B223914207A22C287DEC423671"><enum>(B)</enum><text>the estimated level of financial support needed to secure reliable United States supply chains for various critical materials and support a sufficient domestic critical materials processing industry; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HBEF05B8F2A4D4AFEAEE4E8DF4045A541"><enum>(C)</enum><text display-inline="yes-display-inline">the potential of critical material recycling to support the domestic critical materials market;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9318FB579BA24DB5873D0FDF8F7D1B78"><enum>(D)</enum><text>the effectiveness of the Pilot Program, including an evaluation of each eligible project supported by the Pilot Program; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB1D01B10FC2343BDB198BC087210246C"><enum>(E)</enum><text>whether the models of the Open Price Exploration for National Security research and development program of the Defense Advanced Research Projects Agency allowed the Pilot Program to better anticipate market trends, optimize resource allocation, and provide the appropriate level of support based on current and future critical material market needs.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0B090BAAE1D9431291BA748BD8457F5A"><enum>(2)</enum><header>Insights</header><text>The study under paragraph (1) shall include insights into concerns of private investors in different critical material markets and the impact of innovative financial tools on catalyzing final investment decisions.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H57933C7AD9684E2E8144018C94958D5C"><enum>(3)</enum><header>Stakeholder engagement</header><text>The study under paragraph (1) shall be carried out in consultation with relevant stakeholders, as determined by the Secretary, including mining and critical material processing industry representatives, financial experts, local governments hosting critical material processing projects, and academic researchers.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H642C72C5035641B18EE8CBB90309E44A"><enum>(4)</enum><header>DARPA OPEN program</header><text>The Secretary shall share the results of the study under paragraph (1) with the Open Price Exploration for National Security research and development program of the Defense Advanced Research Projects Agency to inform ongoing research and development of tools to support transparency in domestic critical materials markets.</text></paragraph></subsection> <subsection id="HC73AF4C6E1314E80895991E63A871846"><enum>(g)</enum><header>Report</header> <paragraph commented="no" display-inline="no-display-inline" id="H7E511E4284214CA6A704434E395BAEE3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall submit to the Committees on Energy and Natural Resources, Foreign Relations, and Armed Services of the Senate, and the Committees on Natural Resources, Energy and Commerce, and Armed Services of the House of Representatives, an annual report for each year that the Pilot Program is carried out.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H74DB8085B58F440393E010F3FE849D2E"><enum>(2)</enum><header>Contents</header><text>The report under paragraph (1) shall include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE80FE75532E64C7EAB4EF46661FC291D"><enum>(A)</enum><text display-inline="yes-display-inline">activities, expenditures, and outcomes of the Pilot Program;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H80B75C8D9F47446B8921523B3ABF89B8"><enum>(B)</enum><text>recommendations to Congress on the continuation or expansion of the Pilot Program; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0CB3329918D34676AC46306703DD9BE6"><enum>(C)</enum><text>recommendations for how the Federal Government should use innovative financial tools—</text>
<clause commented="no" display-inline="no-display-inline" id="H9B90E20EC61C4C1AA9694226A5B6346D"><enum>(i)</enum><text display-inline="yes-display-inline">to increase domestic critical materials processing capacity;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HACCE4D7EF42A4C6BB4925C5A90F6AA94"><enum>(ii)</enum><text>to strengthen domestic critical material supply chains by increasing United States processing capacity using domestic feedstock;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HB76CA16D463B4823A7B12AAF5892CC7B"><enum>(iii)</enum><text display-inline="yes-display-inline">to mitigate market volatility; </text></clause> <clause commented="no" display-inline="no-display-inline" id="HB20D5F0EB72A44EAA20665C8BC209832"><enum>(iv)</enum><text display-inline="yes-display-inline">to boost price transparency in critical materials markets; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="H6727AD52F9634B36A4B328B6AACA0D4F"><enum>(v)</enum><text display-inline="yes-display-inline">to leverage market indices in countries other than those designated as countries of risk; </text></clause> <clause commented="no" display-inline="no-display-inline" id="H17B9D1FF842544FEA7ACBFD4E02F653C"><enum>(vi)</enum><text display-inline="yes-display-inline">to ensure long-term adequate supplies of critical materials for the economy of the United States; and</text></clause>
<clause id="HCB4E0C57C939429EB12E4C8F78D93207"><enum>(vii)</enum><text>to increase the domestic recycling of critical materials.</text></clause></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H3B7E5B8F905242BA96EAB40E14B72776"><enum>(h)</enum><header>Funding</header> <paragraph commented="no" display-inline="no-display-inline" id="HC2406C10809E4D2088A1DA45B16BC2D4"><enum>(1)</enum><header display-inline="yes-display-inline">Financial mechanisms</header> <subparagraph commented="no" display-inline="no-display-inline" id="HE32017EE1DC54BBBB3248EA23DCB4881"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In establishing and carrying out the Pilot Program, the Secretary shall enter into agreements, including contracts, grants, and cooperative agreements, and other transactions, as determined by the Secretary, to enable the use of innovative financial tools to support domestic critical material processing projects.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD3F4A14956CC4152BDC1CF07D108FD90"><enum>(B)</enum><header>Authority</header><text>In carrying out subparagraph (A), the Secretary may use innovative financial tools, including price support such as contracts for differences, and leverage functions to develop and drive critical materials processing to entities that are not entities of concern, under such terms and conditions as the Secretary determines to be necessary or appropriate.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAE643195A9AF49F597827B250CD0B6ED"><enum>(2)</enum><header>Reinvestment of revenue</header> <subparagraph commented="no" display-inline="no-display-inline" id="H554703E6F0E04BD981CCC6F343A9F3B0"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Critical Materials Revolving Fund</quote> (referred to in this paragraph as the <quote>Fund</quote>).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H48D36076526541F8AE5CAA36BFBA7508"><enum>(B)</enum><header>Purposes</header><text display-inline="yes-display-inline">The Fund shall be available to the Secretary as a revolving fund—</text> <clause commented="no" display-inline="no-display-inline" id="H3BFCA590B8D143C987A0C36DD731B964"><enum>(i)</enum><text display-inline="yes-display-inline">to reinvest amounts generated from eligible projects into new critical materials processing projects under the Pilot Program; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE519E8F56B2146ADB7D7F30F636684CA"><enum>(ii)</enum><text>to further enhance the objectives of the Pilot Program.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H24861696D5D9476D847223F79C9229BE"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this Act $750,000,000, to remain available until expended.</text></paragraph></subsection></section>
