R. 10373</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260914">September 14, 2026</action-date><action-desc><sponsor name-id="S000185">Mr. Scott of Virginia</sponsor> (for himself, <cosponsor name-id="O000173">Ms. Omar</cosponsor>, and <cosponsor name-id="C001131">Mr. Casar</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to prohibit the garnishment of wages in relation to medical debt, and for other purposes.</official-title></form><legis-body id="H9750E929E252479FAF8448F27EFA542C" style="OLC"><section id="H428FC439A5164CBA87E6E98C6DD91EAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Workers' Wages from Medical Debt Act</short-title></quote>.</text></section><section id="HED715D53B7664D5F902D18005EFFE28E"><enum>2.</enum><header>Prohibition on wage garnishment for medical debts</header><subsection id="H49167EC59FC34394848ED7DBAA375D6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 7 the following:</text><quoted-block style="OLC" id="HDCC9C45BB30B4366A9A485CF62BB49EE" display-inline="no-display-inline"><section id="H4C2CFB8BDDED441FA9E6DD844417D0C7"><enum>8.</enum><header>Prohibition on wage garnishment for medical debts</header><subsection id="HA620713C29C940C9B1E5E99C04F4B468"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no wages of an employee may be subject to garnishment for the payment of any medical debt.</text></subsection><subsection id="H560811728FD94FD796977D0A419B9A8E"><enum>(b)</enum><header>Prohibition on courts and States</header><text display-inline="yes-display-inline">No court of the United States or any State, and no State (or officer or agency thereof), may make, execute, or enforce any order or process in violation of this section.</text></subsection><subsection id="H85355492AA0047239C0F4BFD5100C4AD"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCB575900D59B4609BC1CF5F6DAAF0D71"><enum>(1)</enum><header>Garnishment</header><text display-inline="yes-display-inline">The term <term>garnishment</term> means any legal or equitable procedure through which the wages of any individual are required to be withheld for payment of any medical debt.</text></paragraph><paragraph id="H7B909289B0B244A1BEC7107F8C8C3790"><enum>(2)</enum><header>Medical debt</header><text display-inline="yes-display-inline">.The term <term>medical debt</term> means a debt arising from the furnishing of items and services by a health care facility or health care provider (as defined in section 101(6) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(6)</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFF1C00727A5F4199AC801E0AA8D5E06F"><enum>(b)</enum><header>Conforming amendment</header><text>Section 10 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/210">29 U.S.C. 210</external-xref>) is repealed.</text></subsection><subsection id="HAD124507D4A2450E88E6B032B9FC9013"><enum>(c)</enum><header>Effective date</header><text>This Act shall take effect on the date that is 6 months after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
