which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to require institutions of higher education, as a condition of participating in programs under title IV of such Act, to ensure that no more than 20 percent of the student athletes on a varsity sports team of the institution are international students, and for other purposes.</official-title></form><legis-body id="HF3C4E71F2DA74C39B56017460FBC15F4" style="OLC"><section id="HD45878A2702841AAABAB5F53AB1C0481" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Training and Education for American Members in University Sports and Athletics Act</short-title></quote> or the <quote><short-title>TEAM USA Act</short-title></quote>.</text></section><section id="H29BED84F130D416B847565AEEAD6A1A2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H1FC1B258FCB448EF8284544F20026242"><enum>(1)</enum><text display-inline="yes-display-inline">Institutions of higher education receive and benefit from Federal financial assistance primarily to provide educational opportunities for American students.</text></paragraph><paragraph id="H07DE33836648496D953F30F053695924"><enum>(2)</enum><text>Participation in intercollegiate athletics provides significant educational, financial, leadership, and career opportunities for student athletes.</text></paragraph><paragraph id="H1E3DAD6329824FFFB9B5C96327A12666"><enum>(3)</enum><text>Increasing recruitment of international student athletes has reduced roster and scholarship opportunities for American student athletes at institutions receiving Federal financial assistance.</text></paragraph><paragraph id="HBF3FE843D42F4CAF85596C55BDCBB957"><enum>(4)</enum><text>This reduction has limited opportunities for American students to obtain athletic financial aid and the educational benefits associated with intercollegiate athletics.</text></paragraph><paragraph id="H94BABA8A27734077B58816F8E3C3ED07"><enum>(5)</enum><text>Intercollegiate athletics has historically served as an important development pathway for athletes representing the United States in Olympic and international competition, yet many National Collegiate Athletic Association-affiliated student athletes compete for nations other than the United States.</text></paragraph><paragraph id="H4ACBA6CF685244BB98F2F3510DC890FA"><enum>(6)</enum><text>Preserving the substantial majority of intercollegiate athletic opportunities for American student athletes while continuing to permit meaningful participation by international student athletes advances the educational purposes of the Higher Education Act of 1965.</text></paragraph></section><section id="H71D18C180C704256A76FD065240AECBF"><enum>3.</enum><header>Limitation on international student athlete participation in varsity sports</header><subsection id="H87614298154A4CB9BC94CF2EDD0C30E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE43C4969F7F8484FBDFA1D55CF0566AB"><paragraph id="H003FDD6E4FA34F06A28E385207488919"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H859BA98FED424BA7986AE3C2529C113B"><enum>(A)</enum><text>The institution will, with respect to each varsity sports team of the institution—</text><clause id="HA7DFACC6F698406CBBFE32A57C549A59" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that no more than 20 percent of the student athletes on the official roster of such varsity sports team are international student athletes, or, in the case of such a varsity sports team with fewer than 10 student athletes, no more than 1 international student athlete is on such roster; and</text></clause><clause id="HD623F06CE5BD48168151E7BC36CF97FB" indent="up1"><enum>(ii)</enum><text>annually report the percentage of student athletes that are international student athletes on the official roster of such team to the Secretary and the applicable athletic association.</text></clause></subparagraph><subparagraph id="H541625B9FD7A4912A1C242C716A8512E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph:</text><clause id="H050B0E6DF4CD4865B4432B90BEA3B0BF"><enum>(i)</enum><text display-inline="yes-display-inline">The term <term>athletic association</term> means any entity that—</text><subclause id="H47DAABFE7EB24591B8A663BB00D3143E"><enum>(I)</enum><text>sets common rules, standards, procedures, or guidelines for the administration and regulation of varsity sports teams or intercollegiate athletic competitions;</text></subclause><subclause id="HAE0F39C7436B4F4782D357A93DD6F78E"><enum>(II)</enum><text>is composed of 2 or more institutions or conferences located in more than 1 State; and</text></subclause><subclause id="HEF7E05208FB244B9AAA95F6CA34507EA"><enum>(III)</enum><text>does not include any entity affiliated with professional athletic competitions.</text></subclause></clause><clause id="HC62C2C9F650748339D6910F8ACCF4A04"><enum>(ii)</enum><text display-inline="yes-display-inline">The term <term>intercollegiate athletic competition</term> means any contest, game, meet, match, tournament, regatta, or other event in which varsity sports teams of more than 1 institution compete.</text></clause><clause id="H52ED1D44224F43A28A441BECDE7F95E3"><enum>(iii)</enum><text>The term <term>international student athlete</term> means a student enrolled at an institution who is on a varsity sports team of the institution and who—</text><subclause id="H924454FE1AB24FFB89BBC4325C27BF8F"> <enum>(I)</enum> <text display-inline="yes-display-inline">is not a United States national or an alien lawfully admitted for permanent residency (as such terms are defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)); or</text>
 </subclause><subclause id="H4FF805E9051441609F901DB2091A2135"><enum>(II)</enum><text>is receiving, or has received, a salary, scholarship, or other form of financial assistance related to the student’s athletic participation from an Olympic or Paralympic committee of a foreign country.</text></subclause></clause><clause id="HDBBF5E1EA9C04E078B19B476E5081E35"><enum>(iv)</enum><text display-inline="yes-display-inline">The term <term>varsity sports team</term> means an entity composed of an individual or group of individuals enrolled at an institution that is organized by such institution for the purpose of participation in intercollegiate athletic competitions.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9313E60BC360454A92C5FEF107BD2E25" commented="no"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on July 1, 2029, and shall apply with respect to academic year 2029–2030 and each succeeding academic year.</text></subsection></section></legis-body></bill>
