<section id="H2B71211CAA6B49A6BCAAD6D090E804E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Elders from Wire Fraud Act</short-title></quote>.</text></section> <section id="H46165BFD50B74B6DB374521702FD816B"><enum>2.</enum><header>Duties of covered financial institutions</header> <subsection id="HF52AC2120E484488A511FD89FE5F8CD3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 303 of the Economic Growth, Regulatory Relief, and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/3423">12 U.S.C. 3423</external-xref>) is amended—</text> 
<paragraph id="H7764B588995D4027B17986DDFF470538"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="HB8338B676DC24F19A4D2D6AA1CC1000E"><enum>(A)</enum><text>in subparagraph (Q), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H2795BB2D25344B20922B011F564A996E"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (R), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="HAAD5BCCEF759476EBCB62BB44F22CFAE"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2E1EFABD600D4CFDAEC084F0853CE014" display-inline="no-display-inline"> 
<subparagraph id="H36F4180B3FD94B08BFAE0492B24E22CB"><enum>(S)</enum><text display-inline="yes-display-inline">the term <quote>covered individual</quote> means a person who is immune from suit under paragraph (2).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H3C6F71BF0EF14AEB9516D0C157BEB54C"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H87B17B8B25DE45B8A13F121CFB37BCAB"><enum>(A)</enum><text>in paragraph (1), by striking <quote>a covered financial institution may</quote> and inserting <quote>a covered financial institution shall</quote>; and</text></subparagraph> <subparagraph id="HD9214882211F46F3A6BDF9CB55981349"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>the covered financial institution may</quote> and inserting <quote>the covered financial institution shall</quote>;</text></subparagraph></paragraph> 
<paragraph id="HDCB2D09695D44786BE1F476117C89DDB">
                    <enum>(3)</enum>
 <text>by redesignating subsection (c) as subsection (f); and</text> </paragraph> <paragraph id="HFFBC54C6AF274B638CA5606ED47009DB"><enum>(4)</enum><text>by inserting after subsection (b) the following:</text>

<subsection id="HF87EA1DA429842D5AED993B76371FA67"><enum>(c)</enum><header>Duties of covered financial institutions</header> 
<paragraph id="H9C9BBF2EF1034218B738468F798D8DF6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a covered individual suspects exploitation of a senior citizen, such covered individual shall report such suspected exploitation to a covered agency not later than 5 days after such individual initially suspects such exploitation.</text> </paragraph> <paragraph id="H686FCBA872594867825B92D72D6630BF"><enum>(2)</enum><header>Report contents</header><text>When a covered individual reports suspected exploitation under paragraph (2), such covered individual shall include the following information:</text> 
<subparagraph id="H28E6228F15C9410295F57E0D7EDA3176"><enum>(A)</enum><text>The name, age, and address of the senior citizen to which the suspected exploitation relates;</text></subparagraph> <subparagraph id="HF339C2DE9C364206B13398008CF5DBF0"><enum>(B)</enum><text>The name and address, if known, of any guardian or next of kin of such senior citizen;</text></subparagraph> 
<subparagraph id="HBF4B13C9390E4DC4AADAC5012550AA72"><enum>(C)</enum><text display-inline="yes-display-inline">The name and address of the covered financial institution, registered representative, investment adviser representative, or insurance producer that employs the individual;</text></subparagraph> <subparagraph id="HDB9D21506E7C42578F89CCC7F5BD23E7"> <enum>(D)</enum> <text>Contact information for the covered individual;</text>
                                </subparagraph> 
<subparagraph id="HEE571BA9C93E4833B60A296467993B52">
                                    <enum>(E)</enum>
 <text>The nature of the suspected financial exploitation; and</text>
                                </subparagraph> 
<subparagraph id="H8C1262F9097F4280BDC6B670876F736B"><enum>(F)</enum><text>Any specific comments, observations, or other information that directly relate to the suspected financial exploitation that the individuals believes will assist the covered agency in investigating the suspected exploitation.</text></subparagraph></paragraph> <paragraph id="HAE3901121E3B4EE08123FAEB8AF021E8"><enum>(3)</enum><header>Hold on transaction</header> <subparagraph id="H1087BEDA2B034117A909F2EFBDDE04C4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a covered individual suspects exploitation of a senior citizen, the covered financial institution for which such covered person works shall place a hold on a proposed transaction for not more than 30 business days to determine the legitimacy of the proposed transaction.</text></subparagraph> 
<subparagraph id="H54049D2785CD43129B0109A03056C07C"><enum>(B)</enum><header>Report required</header><text display-inline="yes-display-inline">If a covered financial institution places a hold a proposed transaction under subparagraph (A), the covered person who suspected exploitation shall report such suspected exploitation to a covered agency, as required under paragraph (2), not later than 1 business day after the covered financial institution places a hold on such proposed transaction.</text></subparagraph> <subparagraph id="HF28B862EFDBB479F982DEC0A740D43D3"><enum>(C)</enum><header>Trusted contact</header><text>If a covered financial institution places a hold on a proposed transaction under subparagraph (A), such covered financial institution shall, not later than 1 day after placing such hold, notify a trusted contact identified by the owner of the account or a third party such covered financial institution has determined is reasonably associated with the holder of the account, if available and appropriate and not suspected of the fraud, as determined by such covered financial institution the following information:</text> 
<clause id="H45116834C8F140AB8C9841BC82ED9532"><enum>(i)</enum><text>An identification of the account and transaction to which the hold relates.</text></clause> <clause id="H63BFC66459474AFAA8327251D92A2BAB"><enum>(ii)</enum><text>The reason the covered financial institution placed a hold on the proposed transaction.</text></clause> 
<clause id="HAAB47F6AE6394BEAA5C90834F1466079"><enum>(iii)</enum><text>Contact information for the covered financial institution.</text></clause></subparagraph> <subparagraph id="H5B7A1671DA8B48189CAA4D78DC8E4FB3" commented="no"><enum>(D)</enum><header>Exception</header><text display-inline="yes-display-inline">A covered financial institution may extend the hold placed on a transaction under subparagraph (A) for 2 subsequent 30-day periods after the end of the period described in subparagraph (A) if the legitimacy of the transaction has not been determined by such covered financial institution.</text> </subparagraph></paragraph> 
<paragraph id="H064B6B55F1C042D788DBFE48E41401D9"><enum>(4)</enum><header>Access to records</header><text display-inline="yes-display-inline">A covered financial institution that receives a request for records relating to suspected exploitation from a covered agency shall provide such records to such covered agency not later than 2 business days after the date on which such request was received.</text></paragraph> </subsection> <subsection id="H9C047510229A4D09871AE207BA208249"><enum>(d)</enum><header>Permitted sharing of information with reasonably associated persons</header> <paragraph id="H268B00A06B3140139F9A636017461EFC"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law a covered individual may provide information to a person that such covered individual determines is reasonably associated with a senior citizen with respect to whom the covered individual suspects exploitation unless the covered individual has reason to believe that the person reasonably associated with the senior citizen is knowingly engaged in or facilitating the suspected exploitation.</text></paragraph> 
<paragraph id="HE58D225531A347238BC86DDF353D6AAC"><enum>(2)</enum><header>Permitted disclosure</header><text display-inline="yes-display-inline">Unless the person determined to be reasonably associated with a senior citizen under paragraph (1) is an authorized agent or fiduciary of the senior citizen, the covered person may only share the following information with the person that there is reasonable cause to suspect that the senior citizen may be a victim or target of exploitation and the nature of such suspected exploitation.</text></paragraph></subsection> <subsection id="HE15C4E71C7AC46F2ACB3C4226E284084"><enum>(e)</enum><header>Safe harbor</header><text display-inline="yes-display-inline">A covered financial institution shall not be liable to any person—</text> 
<paragraph id="H9A134953F14545FFA4CF44BE0CE7BD8B"><enum>(1)</enum><text>for refusing or delaying a disbursement or transaction in good faith and in compliance with this section; or</text></paragraph> <paragraph id="H4680C73B2DA948DDB22DC9821B24CCE6"><enum>(2)</enum><text>for disclosing information to a trusted contact, adult protective services, or an appropriate law enforcement authority in compliance with this section.</text></paragraph></subsection> 
<subsection id="H7326B6DE8279471DA1E741052AC292E7">
              <enum>(f)</enum>
              <header>Non-Preemption</header>
 <text display-inline="yes-display-inline">Subsections (c), (d), and (e) do not annul, alter, or affect, or exempt any person subject to the provisions of such subsection from complying with the laws of any State with respect to consumer protection, except to the extent that those laws are inconsistent with any provision of this subchapter, and then only to the extent of the inconsistency. For purposes of this section, a State law is not inconsistent with this subchapter if the protection such law affords any consumer is greater than the protection provided by this subchapter.</text>
            </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HABEDF9C58D424108B507203877BFB3F6"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect 180 days after the date of the enactment of this section.</text></subsection></section> </legis-body></bill>
