<section id="H65C80CAC31CF458890F3E92369D4BB7A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Civil Rights Attorney’s Fees Act of 2026</short-title></quote>.</text></section> 
<section id="HA432F0559C674CDE81B4205030063F10"><enum>2.</enum><header>Attorney’s Fees</header><text display-inline="no-display-inline">Section 722 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="traditional" id="H3420C6143DCC428C8A82985199CD188E" display-inline="no-display-inline"> <subsection id="HF41F26B496A24769A6CB0D8277D01CED"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of subsection (b), a party is considered prevailing if it has obtained relief through—</text> 
<paragraph id="H2F2851CCB7124ACB8CB56E9BAE50A9D9"><enum>(1)</enum><text>a judicial order, including any order that conclusively resolves a claim by granting enduring relief on the merits that alters the legal relationship between the parties, or a preliminary injunction or temporary restraining order that materially alters the relationship between the parties and is not reversed and regardless of any subsequent vacatur of the order on mootness grounds;</text></paragraph> <paragraph id="HCE2E11040A554B68AFA302C253B7E26A"><enum>(2)</enum><text>an enforceable written agreement or consent decree; or</text></paragraph> 
<paragraph id="H9B7668F819984768A941306E8E2D1B90"><enum>(3)</enum><text display-inline="yes-display-inline">a voluntary or unilateral change in position by the defendant, or government office, agency, or official, that renders the action or proceeding moot, deprives the party of standing, or that substantially grants the relief sought by the party.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H2E815EF41B694EA2AD08883762F34886"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date of the enactment of this Act and shall apply to any case that is—</text> 
<paragraph id="HE3DCC6FBD4A64538B0E2163B4A3C0A43"><enum>(1)</enum><text>pending on such date of enactment; or</text></paragraph> <paragraph id="H481635129D88450F84A239E25CBB3DCE"><enum>(2)</enum><text>commenced on or after such date of enactment.</text> </paragraph></section>
