<section section-type="section-one" id="H52E7D090F0E84D38A8BF1FD5DAE64B06"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thirty-Two Hour Workweek Act</short-title></quote>.</text></section> <section id="H5AB033E15B624F14BCC33EB4DFA5DA3E"><enum>2.</enum><header>Fair Labor Standards Act</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text>
<paragraph id="H52D74D777A5449F78918D73104D70748"><enum>(1)</enum><text display-inline="yes-display-inline">in section 7 (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207</external-xref>)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H5029A83796D34A0AB21F037B6D60C670"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
<clause id="H9392E42FB50E4854885BAFC79E14578F"><enum>(i)</enum><text>in paragraph (1)—</text> <subclause id="H14D630EEBA904AFFA6018D0CB2A3A121"><enum>(I)</enum><text>by striking <quote>commerce, for a workweek longer than forty hours</quote> and all that follows through the period and inserting <quote>commerce—</quote>; and</text></subclause>
<subclause id="H0C5EF8606FE54181831D3968D3E56690"><enum>(II)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HBC368889664345D1AC8E35BA223D45D2"> <subparagraph id="H2A2C05B734DE49C1A3A4ED7594E55CCE" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-two hours unless such employee receives compensation for his employment in excess of such hours at a rate not less than one and one-half times the regular rate at which he is employed; or</text></subparagraph>
<subparagraph id="HB0A0911BFC4047C99FFC6D054C1A1D32" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">for a workday—</text> <clause id="H7C29A915674F48EE83C6DB865DCB044D"><enum>(i)</enum><text>longer than eight hours, but not longer than 12 hours, unless such employee receives compensation for his employment in excess of eight hours at a rate not less than one and one-half times the regular rate at which he is employed; or</text></clause>
<clause id="H883427A5F5EE41D0A4C376D466AACE9C"><enum>(ii)</enum><text display-inline="yes-display-inline">longer than twelve hours unless such employee receives compensation for his employment in excess of such hours at a rate not less than double the regular rate at which he is employed.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause> <clause id="H52523940A38A405497DFB81688E4A42A"><enum>(ii)</enum><text>in paragraph (2)—</text>
<subclause id="H4B6AF8C7557D48C4BEFF6FF9A0D49F7A"><enum>(I)</enum><text>in the matter that precedes subparagraph (A), by striking <quote>Fair Labor Standards Amendments of 1966</quote> and inserting <quote><short-title>Thirty-Two Hour Workweek Act</short-title></quote>; and</text></subclause> <subclause id="H22CEC66DB00F43B59994D0C4E668DA61"><enum>(II)</enum><text>by striking subparagraphs (A) through (C) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H8C0548ACDFF94CD1A223E63D87BA5699">
<subparagraph id="HEF5D7ED47C284D06AB4C9A96302819CC" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-eight hours during the 1-year period beginning not less than 180 days after the date of the enactment of the <short-title>Thirty-Two Hour Workweek Act</short-title>,</text></subparagraph> <subparagraph id="H8FE6C8F4A7014F56A38F08C7771C4AD9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-six hours during the second year after the first day of such period,</text></subparagraph>
<subparagraph id="HEC92A3B1DBD24C97A854B2D0FC517BCC" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-four hours during the third year after the first day of such period, or</text></subparagraph> <subparagraph id="H104788607F06488F8994F68ACA6CDA2E" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">for a workweek longer than thirty-two hours after the expiration of the third year after the first day of such period,</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause>
<clause id="H3592CC003102438494554607211C43BB"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB74D28F868B94DBE88B6499165DBDE50"> <paragraph commented="no" display-inline="no-display-inline" id="HAEE47F83F34B46C9ABD5BB03CBBA7BE8" indent="up1"><enum>(3)</enum><text>With respect to any employee described in paragraph (2) who in any workweek is brought within the purview of this subsection by the amendments made to this Act by the <short-title>Thirty-Two Hour Workweek Act</short-title>, the employer of such employee may not reduce the total workweek compensation rate, including the regular rate at which the employee is employed, or any other employee benefit due to the employee being brought within the purview of this subsection by such amendments.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFC05AA9F4BD5451B99BE8A35005096DE"><enum>(B)</enum><text>in subsection (l)—</text> <clause commented="no" display-inline="no-display-inline" id="H521ABDBA9B704FD19AE24D9A4C1B1431"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>No</quote> and inserting <quote>Except as provided in subsection (a)(2), no</quote>; and</text></clause>
<clause id="H359FDA3B9F434F64B5666C9F55FF4AF7"><enum>(ii)</enum><text>by striking <quote>forty</quote> and inserting <quote>thirty-two</quote>; and</text></clause></subparagraph></paragraph> <paragraph id="H7765B2EBBBF443E2910FC04945CB8C77"><enum>(2)</enum><text display-inline="yes-display-inline">in section 18(a) (<external-xref legal-doc="usc" parsable-cite="usc/29/218">29 U.S.C. 218(a)</external-xref>) by inserting <quote>or workday</quote> after <quote>workweek</quote> in each place it occurs.</text></paragraph></section>
