R. 10319</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260908">September 8, 2026</action-date><action-desc><sponsor name-id="M000194">Ms. Mace</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to provide for requirements sensitive Government positions relating to gender dysphoria, and for other purposes.</official-title></form><legis-body id="H17D0C2F3CC14402D85ADB09C13551C05" style="OLC"><section id="HB1E311C6B9E44A678EB7041281022DF0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gender Delusion Disqualification Act</short-title></quote>.</text></section><section id="H61E6CFD3D2D74371B77D46FB1500C112"><enum>2.</enum><header>Updating standards surrounding Federal hiring considerations relating to gender dysphoria</header><subsection id="HC5492D0A4B184FC59656485D0D662A50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/73">Chapter 73</external-xref> of title 5, United States Code, is amended by inserting at the end the following:</text><quoted-block style="USC" id="H41A36652B33A402CBDC76A5CD7E4B941" display-inline="no-display-inline"><subchapter id="H3E93A3013E4B41639AA8AD3FE4896267"><enum>VIII</enum><header>Additional Requirement for Covered Positions Facing Mental Health Standards </header><section id="H226570C66E7C4C2892D673D1036EDD75"><enum>7381.</enum><header>Additional requirement for covered positions facing mental health standards</header><subsection id="H1C02A4C5E8B143E191E7F6D78429116E"><enum>(a)</enum><text display-inline="yes-display-inline">In this subchapter, the term—</text><paragraph id="HE9D9D79C7C9D41D0AE0AAC9C54B76D9A"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>covered position</quote> means a position within an executive agency for which the employing agency has established, by regulation or agency policy, any mental health standards as a condition of appointment or continued service;</text></paragraph><paragraph id="H4F9DC917713748C18A6625D1F816B2FB"><enum>(2)</enum><text display-inline="yes-display-inline"><quote>covered certification</quote> means a license, certificate, or other credential issued by an executive agency to an individual where Federal law or regulation requires issuance or renewal of such credential on the individual meeting specified mental health standards; and</text></paragraph><paragraph id="H7FD6FDB869C14914967399DA39E0A162"><enum>(3)</enum><text><quote>mental health standards</quote> means criteria used to assess whether a diagnosed mental health condition renders an individual unable to safely or effectively perform the duties of a covered position, as established through agency regulation, medical evaluation protocols, or Government-wide personnel suitability standards.</text></paragraph></subsection><subsection id="H53B4162FED6B423EA9835C616E928EC6"><enum>(b)</enum><text>Any individual in a covered position shall satisfy all mental health standards required for such position and may not occupy such position if such individual has been diagnosed with gender dysphoria.</text></subsection><subsection id="HA304E9EF2B6846F29490AA3B83B347F1"><enum>(c)</enum><text>Any individual holding a covered certification shall satisfy all mental health standards required for issuance or renewal of such certification and may not be granted or hold such a certificate if such individual is diagnosed with gender dysphoria.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB20166B7FF464EF280376FE31BB5835B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for such chapter is amended by inserting at the end the following:</text><quoted-block style="USC" id="H8C5393E22B164ADD854A8702AAF64A55" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry idref="H3E93A3013E4B41639AA8AD3FE4896267" level="subchapter">Subchapter VIII—Additional Requirement for Covered Positions Facing Mental Health Standards </toc-entry><toc-entry idref="H226570C66E7C4C2892D673D1036EDD75" level="section">7381. Additional requirement for covered positions facing mental health standards.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEA5925AD9C6D42B4853E642731A44C1A"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the head of each executive agency shall issue such regulations as are necessary to carry out section 7381 of title 5, United States Code, as added by subsection (b) of this Act, to covered positions, and positions requiring covered certification, as defined in such section, within the agencies jurisdiction. </text></subsection><subsection id="H0DF39A40BB8744E09B239333DE6241DC"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this Act or the amendments made by this Act shall be construed to impose additional standards on executive branch employees who are not in a covered position.</text></subsection></section></legis-body></bill>
