<official-title display="yes">To amend the Federal Power Act with respect to the coordination of Federal authorizations for transmission facilities, and for other purposes.</official-title>

<section id="H3493140E3BCC40AE930B78D7C92EBFA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Certainty in Litigation for Electric Asset Reliability (CLEAR) Act of 2026</short-title></quote>.</text></section> <section id="H2F0F37BB909549ABA361F1880A264FC8"> <enum>2.</enum> <header>Coordination of federal authorizations for transmission facilities</header> <text display-inline="no-display-inline">Section 216(h) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(h)</external-xref>) is amended—</text>
      <paragraph id="HEE3F220E255D49E280498069AC7A06FB">
        <enum>(1)</enum>
 <text>in paragraph (1), by striking <quote>to site a transmission facility</quote> each place it appears and inserting <quote>to site and construct a transmission facility</quote>;</text>
      </paragraph>
      <paragraph id="H097A2EBCA607457AA1938BA304EB8FD9">
        <enum>(2)</enum>
 <text>in paragraph (2), by inserting <quote>, except that the Commission shall act as the lead agency in the case of a facility to be permitted under subsection (b)</quote> before the period at the end; and</text>

        <enum>(3)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="H1EFD38F063CE4926A725F5F889B55C47" style="OLC"> <paragraph id="HE183E642053A442789BAB02A9E86AFF3"> <enum>(10)</enum> <header>Publication</header> <text>The head of each Federal agency with authority to issue a Federal authorization shall publish in the Federal Register each final agency action relating to a Federal authorization.</text>
          </paragraph>
          <paragraph id="H1F5ED4C1C0204353A5B7129F9E470B36">
            <enum>(11)</enum>
            <header>Consolidated record</header>
 <text>To the extent practicable for each transmission facility for which a Federal authorization is required, the Secretary shall consolidate all records relating to review and permit decisions for all Federal authorizations for the transmission facility into a single joint record of decision.</text>

            <enum>(12)</enum>
            <header>Rehearing and judicial review</header>
 <text>With respect to any transmission facility the Federal authorization and review process for which is coordinated under this subsection—</text>
            <subparagraph id="H713BB1D26BEF44C789B278DC3A71E08C">
              <enum>(A)</enum>
 <text>each approval of a Federal authorization for the transmission facility shall be deemed to be an order issued by the Commission for purposes of section 313;</text>
            </subparagraph>
            <subparagraph id="H84A586EA188E47C09EDB9E2D649122C6">
              <enum>(B)</enum>
 <text>such section shall be applied by substituting <quote>the lead agency under section 216(h)</quote> for <quote>the Commission</quote> each place it appears; and</text>
            </subparagraph>
            <subparagraph id="H9F172728B10F4A87B47CE89422E05D0B">
              <enum>(C)</enum>
 <text>notwithstanding any other provision of law providing for rehearing or judicial review of an approval of a Federal authorization, a person may obtain rehearing and judicial review of such an approval only under such section 313.</text>
            </subparagraph>
