<section id="H3BF47216AEC0455E8398A6C8D8F02DEC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Service Loan Forgiveness Inclusion Act of 2026</short-title></quote>.</text></section> <section id="H46F279A42F2B45B0A7CE01695F46ABB7"><enum>2.</enum><header>Qualifying payments</header> <subsection id="HFF281C074A424A95B6DEFB65C9CEBF00" commented="no"><enum>(a)</enum><header>In general</header><text>Section 455(m)(1)(A) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)(1)(A)</external-xref>) is amended—</text> 
<paragraph id="H74BE8C923DBF4E6888A8DCCD6973FD76" commented="no"><enum>(1)</enum><text>by amending clause (iii) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB04BA4D0FB7949F6AEE3F6134BC48DC1"> <clause id="HBB4FAB8A99CA4897923C9AF2A45A167A" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">monthly payments under a repayment plan under subsection (d)(1) or (g)—</text> 
<subclause id="HFA4E12CA06B24F07BD05B70C277FC94B" commented="no"><enum>(I)</enum><text>with respect to the first 60 monthly payments, without regard to the amount of such payment; and</text></subclause> <subclause id="HCBFF1121326746EC861108390C4A4AE0" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to each subsequent monthly payment, of not less than the monthly amount calculated under subsection (d)(1)(A), based on a 10-year repayment period;</text></subclause></clause><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB98358B3B28A414C885F293EC37E9ADE" commented="no"><enum>(2)</enum><text>in clause (iv), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="HA1C0E49832F8467B8F35ADD440C02B60" commented="no"><enum>(3)</enum><text>in clause (v), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></paragraph> 
<paragraph id="H5DC65CF553E3455D9749206791C04F3D" commented="no"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2AEB384A34A44D9C903B3E1C4558E3E1"> <clause id="HD01A562AC2004832BB7CF3D2C46D1DC1" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">monthly payments under the standard repayment plan under subsection (d)(7)(A)(i); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6584B7A846B94DBD85A8FE555DE96316" commented="no"><enum>(b)</enum><header>Suspended payments</header><text display-inline="yes-display-inline">Section 455(m)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)(3)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H70CC4B449DCD48DBA85A293A15E7878B" display-inline="no-display-inline"> <subparagraph id="H44337A89EDAA40A7ADAAFD70859C252C" commented="no"><enum>(C)</enum><header>Monthly payment</header><text display-inline="yes-display-inline">The term <term>monthly payment</term> includes a payment described in clauses (i) through (vi) of paragraph (1)(A) that would have been made by a borrower for a month during any period in which—</text> 
<clause id="H188F6B6685384F63A9B8A12AFEDB2DA9" commented="no"><enum>(i)</enum><text>repayment is suspended by reason of administrative forbearance; and</text></clause> <clause id="H31BD6A5BABCA428E9DC00E4C9B661360" commented="no"><enum>(ii)</enum><text>the borrower is employed in a public service job.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA0354ED669E4403294D2883BE03E3AEA"><enum>(c)</enum><header>Notification to borrowers; applicability</header> 
<paragraph id="HB97A83682DF04877A0692E60CADB43A6"><enum>(1)</enum><header>Notification</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Education shall—</text> <subparagraph id="H971CE139C65849959C13D61201241EE4"><enum>(A)</enum><text>inform each borrower of a loan made under part D of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C. 1087a et seq.</external-xref>) of—</text> 
<clause id="H5AD524B3C0DB4D18BCB8B1C2A53F8794" commented="no"><enum>(i)</enum><text>subclause (I) of section 455(m)(1)(A)(iii) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)(1)(A)(iii)</external-xref>), as added by this Act;</text></clause> <clause id="HE92CD5C9059E4D558AD41518F00B3512"><enum>(ii)</enum><text>subparagraph (C) of section 455(m)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)(3)</external-xref>), as added by this Act; and</text></clause> 
<clause id="HE0DDF513A2264A30B24817DF2B1D145C"><enum>(iii)</enum><text>the effect of such subclause and such subparagraph on loan cancellation under section 455(m) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)</external-xref>); and</text></clause></subparagraph> <subparagraph id="HE23496CEED214AECA97C8E4E98B60E76"><enum>(B)</enum><text>provide information to such borrowers on how to change repayment plans.</text></subparagraph></paragraph> 
<paragraph id="H1C3FAE6A299B4F7D8A1E546AFB6DBE5A" commented="no"><enum>(2)</enum><header>Applicability</header><text>The amendment made by subsection (a) with respect to payment amounts of the first 60 monthly payments under section 455(m) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)</external-xref>) shall apply to borrowers who, on or after the date of the enactment of this section, have made fewer than 120 monthly payments pursuant to such section.</text> </paragraph></subsection></section> </legis-body></bill>
