<section id="H4A77F3D07416403095BADE0C0BE074F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Pay for American Workers Act</short-title></quote>.</text></section> <section id="H1FC0D6B8D4A04ADB9FC3E960AA515EDD"><enum>2.</enum><header>Minimum wage increase</header> <subsection id="HEED6B03A8B9845A7A431DB2C5CF429A7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref>) is amended—</text> 
<paragraph id="HACC79009BB6B4233BEDC18C717F36E14"><enum>(1)</enum><text>in subsection (a), by striking paragraph (1) and inserting the following:</text> <quoted-block style="OLC" id="HE56042D9F2234F6B878CA140290B5C07" display-inline="no-display-inline"> <paragraph id="HA69B6BF7264244999C432EAA2D05DF46"><enum>(1)</enum><text display-inline="yes-display-inline">except as otherwise provided in this section, not less than—</text> 
<subparagraph id="H83815C521ED145558FF3B27C06FF6A6D"><enum>(A)</enum><text>$15.00 an hour, beginning on January 1, 2027;</text></subparagraph> <subparagraph id="HB96504113E574EEF9ADCFE8158F1F536"><enum>(B)</enum><text>$17.50 an hour, beginning on January 1, 2028;</text></subparagraph> 
<subparagraph id="HEFC5D24BFFD94702AD3DB5CE731CC7D7"><enum>(C)</enum><text>$20.00 an hour, beginning on January 1, 2029; and</text></subparagraph> <subparagraph id="H11126B0AFA17450BBD4B7055D2698F1E"><enum>(D)</enum><text>beginning on January 1, 2030, and annually thereafter, the amount determined by the Secretary under subsection (h).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB27049AE31A94AE0B9955289F497BD32"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H4246983348EC4CEABB1676E7BFD1B41F" display-inline="no-display-inline"> <subsection id="HB245E9941064469EA0F277EBD153DCE9"><enum>(h)</enum><header>Minimum wage based on the median wage</header> <paragraph id="HA67BE03D019D45978D7CF2D64E97C6C4"><enum>(1)</enum><header>In general</header><text>Prior to the date that a new minimum wage determined under subsection (a)(1)(D) is to take effect, the Secretary shall determine the minimum wage rate to be in effect under this subsection for each year described in subsection (a)(1)(D). The wage rate determined under this subsection for a year shall be—</text> 
<subparagraph id="HABF3DB046E444C808B9B0633AD325AA8"><enum>(A)</enum><text>not less than the amount in effect under subsection (a)(1) on the date of the determination;</text></subparagraph> <subparagraph id="H0812C75240594F33AF12D2596CD8C1D7"><enum>(B)</enum><text>increased from such amount by the annual percentage increase, if any, in the median hourly wage of all employees as determined by the Bureau of Labor Statistics;</text></subparagraph> 
<subparagraph id="HC8FF37BBEA694C8A9FFE7BA6C4D74931"><enum>(C)</enum><text>rounded to the nearest multiple of $0.05, if the amount determined under this subsection is not a multiple of $0.05.</text></subparagraph></paragraph> <paragraph id="HFA4597E726074D72BF87063C6FFB538D"><enum>(2)</enum><header>Annual percentage increase</header><text>In calculating the annual percentage increase in such median hourly wage, the Secretary, through the Bureau of Labor Statistics, shall determine the median hourly wage of all employees for the most recent year for which data are available and compare such median hourly wage with the median hourly wage determined for the preceding year.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
