<section id="H7998B416484B49C4B23C97788726AF4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Affordability and Pricing Concessions Act</short-title></quote>.</text></section> <section id="H9C230BB51C72471EA5044D1CB99A5AA7"><enum>2.</enum><header>Rules for covered stadiums</header> <subsection id="HB2DE647DBF184F8F8AF950A3E7316E03"><enum>(a)</enum><header>Rules</header> <paragraph id="HA12E04B8233940C59249F54D6C14B485"><enum>(1)</enum><header>Requirements</header><text>A covered stadium shall—</text> 
<subparagraph id="H91A88AD179374E5F931233FE23E4E4D5"><enum>(A)</enum><text display-inline="yes-display-inline">for any commercial lease with respect to the covered stadium, to the extent possible, ensure that any contract for concessions services encourages a provider of concessions services to make available to small businesses concessions locations for lease or sublicense; and</text> </subparagraph> <subparagraph id="H947C281DE67D4602BBCABB1C8B9A9A35"><enum>(B)</enum><text>for any concessions sold or offered for sale at the covered stadium by an entity pursuant to a lease described in subparagraph (A), ensure the price of such concessions is not more than 7 percent higher than market rate.</text></subparagraph></paragraph> 
<paragraph id="HA58C78060953479AAE0D9393EC834634"><enum>(2)</enum><header>Prohibition</header> 
<subparagraph id="HC48326EB93E7475692C98ADE03EC202C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A covered stadium, with respect to a small business, may not charge a fee for the right to sell or offer for sale any concessions to a patron who attends an event at the covered stadium.</text> </subparagraph> <subparagraph id="H8BBC130FBB564461B0BB48EDB4836474"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) may be construed to prohibit any agreement with respect to—</text> 
<clause id="HE59649ABF96846BC8FE106432E2AF888"><enum>(i)</enum><text>the reimbursement of actual operating costs, utility charges, or equipment purchases or improvements; or</text></clause> <clause id="H41FCEAD2ED5E4954A0D608F94EBE4067"><enum>(ii)</enum><text>a commercial lease.</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H678D43572E4643C2B8220047920ABA85"><enum>(b)</enum><header>Enforcement</header> 
<paragraph id="HD963167CA1374464A29AFF5317EA3725"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of subsection (a) shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph> <paragraph id="H884135D8767949148B9CA88566A70952"><enum>(2)</enum><header>Powers of the Commission</header><text display-inline="yes-display-inline">The Commission shall enforce subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section, and any person who violates such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection> 
<subsection id="HE734D8A4064F4663B623BDFD0CD41E9B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HFA089907447D43078988E8139ACCF092"><enum>(1)</enum><header>Commercial lease</header><text display-inline="yes-display-inline">The term <term>commercial lease</term> means a lease, license, sublicense or other agreement for the purpose of renting a space to sell concessions.</text></paragraph> 
<paragraph id="H1B79B16BBB4648499E3AC0DA3EAC298D"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph> <paragraph id="HE733E59F47D548DE9D54B7C0294BD0A6" commented="no"><enum>(3)</enum><header>Concessions</header><text>The term <term>concessions</term> has the same meaning given the term <term>food</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></paragraph> 
<paragraph id="H486C58E4425E452AAEC9224607D9AA10"><enum>(4)</enum><header>Covered stadium</header><text>The term <term>covered stadium</term>—</text> <subparagraph id="H5045A52090BF45C4A036940ABA7F91EB"><enum>(A)</enum><text>means a venue that—</text> 
<clause id="H6758E99CC44B4341AD0295E4F0162F82"><enum>(i)</enum><text>receives public funding; and</text></clause> <clause id="H43B1DF7AB4CC408A87AD75C97A839954"><enum>(ii)</enum><text>has a capacity of at least 10,000 seats; and</text></clause></subparagraph> 
<subparagraph id="H645E11BF887D49C38D240F92C3C48C4D"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any venue at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></subparagraph></paragraph> <paragraph id="H54C0CFA0E98C4A24863EB7B4C7316F46"><enum>(5)</enum><header>Market rate</header><text display-inline="yes-display-inline">The term <term>market rate</term>, with respect to a good or service sold or offered for sale, means the price of a comparable good or service sold or offered for sale in the nearest metropolitan area (as determined by the Office of Management and Budget).</text> </paragraph> 
<paragraph id="H96F4BBA1BC7E466189D23E01199B4045"><enum>(6)</enum><header>Public funding</header><text display-inline="yes-display-inline">The term <term>public funding</term> includes the following:</text> <subparagraph id="H28A625B3FC3E4726955350875C107A6A"><enum>(A)</enum><text display-inline="yes-display-inline">A Federal grant.</text></subparagraph> 
<subparagraph id="H1DAAB3F3B9EC497ABB8985D5CBD25B46"><enum>(B)</enum><text>A Federal subsidy.</text></subparagraph> <subparagraph id="HD5C58D3148404F00ABAED556FDB92A32"><enum>(C)</enum><text>A tax exemption.</text></subparagraph> 
<subparagraph id="HC5BC79F5EA1849EC8EE7079D3CD56379"><enum>(D)</enum><text>A tax abatement.</text></subparagraph> <subparagraph id="HAED4D6FE60294F538C2A294C7AF55FEC"><enum>(E)</enum><text>A tax-exempt bond issuance.</text></subparagraph></paragraph> 
<paragraph id="HD908D355283244D19ECF7B746842A12B"><enum>(7)</enum><header>Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> has the meaning given the term <term>small business concern</term> in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></subsection> </section> </legis-body></bill>
