which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit the use by certain State regulated electric utilities of certain data relating to the use of electric energy by electric consumers, and for other purposes.</official-title></form><legis-body id="HBFB2FF03A9504FB5816ADB02D0F95117" style="OLC"><section id="H882617E872444B898336FF4F40463306" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smart Meter Data Privacy Protection Act</short-title></quote>.</text></section><section id="H56B3E803AC47443CBCB1D7703B5A6611" commented="no"><enum>2.</enum><header>Privacy protections for personal consumption data</header><subsection id="H82E77C21A612470490D11D1DCF14EF05" commented="no"><enum>(a)</enum><header>Prohibition on use of personal consumption data</header><text display-inline="yes-display-inline">A covered utility may not use (including to license, sell, or otherwise monetize or use for commercial purposes) the personal consumption data of an electric consumer that the covered utility serves unless such use is for an authorized operational purpose.</text></subsection><subsection id="H3CBFDB5627F441AD890E479F0DCCC807" commented="no"><enum>(b)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Each covered utility shall, not later than 1 month after the end of each fiscal year of the covered utility, submit to the Federal Trade Commission a report on how the covered utility uses the personal consumption data of electric consumers that the covered utility serves, which shall include—</text><paragraph id="H5735208AE84A4B25A7336B1DB9568E0C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text>what type of personal consumption data the covered utility collected from electric consumers during such fiscal year;</text></paragraph><paragraph id="H90724209429340E08AE63513309D9590" commented="no"><enum>(2)</enum><text>how the covered utility used that personal consumption data; and</text></paragraph><paragraph id="H8998229DDFF34E239903A4288E9B66BF" commented="no"><enum>(3)</enum><text>with whom the covered utility shared that personal consumption data.</text></paragraph></subsection><subsection id="HFBB9F7A6F50348BFA58E3F22150C50C6" commented="no"><enum>(c)</enum><header>Payment for violations</header><paragraph id="H8A128A7166064080860B379E09368F21"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Federal Trade Commission determines that a covered utility used the personal consumption data of an electric consumer in violation of subsection (a), the covered utility shall credit the bill of that electric consumer in an amount that is 3 times the revenue attributable to such use.</text></paragraph><paragraph id="HA7ABB3D996C14459B433807E3E7DC199"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">In carrying out paragraph (1), a covered utility may not recover, from any electric consumer that the covered utility serves, the cost of any amount credited under such paragraph.</text></paragraph><paragraph id="HBE6CD50B3DF94C2BBB7D54014D0BC242" commented="no"><enum>(3)</enum><header>Consultation</header><text>In carrying out this subsection, the Federal Trade Commission may consult with the Federal Energy Regulatory Commission.</text></paragraph></subsection><subsection id="HB5710F72F1C8459982CC3136C0D092DF" commented="no"><enum>(d)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H103E32BEEFEF4CAD9E47C3B3A936EDA2" commented="no"><enum>(1)</enum><header>Unfair and deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section or a regulation promulgated under such section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="HF4F4E905FA39493F8F5A5B5DF19308CB" commented="no"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this section and the regulations promulgated under such section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates such section or a regulation promulgated under such section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="HF7E93ED634514A5C9D5976EE59C1BA31" commented="no"><enum>(e)</enum><header>Actions by States</header><paragraph id="HACB3CE22FC0F4293B0861E76B82F016A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by an act or practice in violation of this section, or a regulation promulgated under such section, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in an appropriate State court or an appropriate district court of the United States to—</text><subparagraph id="HC9C2E6FABC4F4BBEA69B97F3F63FAFD7" commented="no"><enum>(A)</enum><text>enjoin such act or practice;</text></subparagraph><subparagraph id="H9BA196B7A3C844B5A5CBA6D56D143685" commented="no"><enum>(B)</enum><text>enforce compliance with such section or such regulation;</text></subparagraph><subparagraph id="HD4AFF6DC88334AF7A5D0CE3695B73B93" commented="no"><enum>(C)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></subparagraph><subparagraph id="H6005795AD809485385E5808D9D55496F" commented="no"><enum>(D)</enum><text>obtain such other legal and equitable relief as the court may consider to be appropriate.</text></subparagraph></paragraph><paragraph id="H92C8FA9060EE49ECA1707B57EBEB17B6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general of the State involved shall provide to the Federal Trade Commission a written notice of such action and a copy of the complaint for such action. If the attorney general determines that it is not feasible to provide the notice described in this paragraph before the filing of the action, the attorney general shall provide written notice of the action and a copy of the complaint to the Federal Trade Commission immediately upon the filing of the action.</text></paragraph><paragraph id="H4D672732437D4D68B43536CB1013A962" commented="no"><enum>(3)</enum><header>Authority of Federal Trade Commission</header><subparagraph id="H9DE84877C4904E3693B1E86239C9D149"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (2) of an action under this subsection, the Federal Trade Commission shall have the right—</text><clause id="H06091989E38F48AA8DF56FFF980A21E6" commented="no"><enum>(i)</enum><text>to intervene in the action;</text></clause><clause id="HD0A6FB2EE9284CA3B4AE1A1DB7D88391"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></clause><clause id="H50203867C72F4CE192C542507481F9B5" commented="no"><enum>(iii)</enum><text>to file petitions for appeal.</text></clause></subparagraph><subparagraph id="H0C4444370FAD4B7D9A25DA473ED96101" commented="no"><enum>(B)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Federal Trade Commission or the Attorney General of the United States has instituted a civil action for violation of this section or a regulation promulgated under such section (referred to in this subparagraph as the <quote>Federal action</quote>), no State attorney general may bring an action under this subsection during the pendency of the Federal action against any defendant named in the complaint in the Federal action for any violation of such section or regulation alleged in such complaint.</text></subparagraph></paragraph><paragraph id="H6042E81F79444067A6621F645654982D" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this subsection, nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of such State to conduct investigations, administer oaths and affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text></paragraph></subsection><subsection id="H179CB1E48E8640E0A215693DAFEF04C7" commented="no"><enum>(f)</enum><header>Data security and retention</header><text display-inline="yes-display-inline">The Federal Trade Commission shall establish reasonable security and retention standards for any personal consumption data used for an authorized operational purpose.</text></subsection><subsection id="HB270AD1C859E49D094B7462A258415C8" commented="no"><enum>(g)</enum><header>Preemption</header><text>This Act establishes a Federal baseline and does not preempt State laws providing stronger privacy protections for personal consumption data.</text></subsection><subsection id="H67719185989D47D3A7BE84C6653CD26A" commented="no"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H831662B81C144CC5871D2DAF785C3E75"><enum>(1)</enum><header>Authorized operational purposes</header><text display-inline="yes-display-inline">The term <term>authorized operational purposes</term> means billing, outage management, electric grid reliability, regulatory compliance, and electric consumer-authorized demand response programs.</text></paragraph><paragraph id="H5CC1B8DA43E14555AF329C19C2EFD35A" commented="no"><enum>(2)</enum><header>Covered utility</header><text display-inline="yes-display-inline">The term <term>covered utility</term> means a State regulated electric utility (as such term is defined in section 3 of the Public Utility Regulatory Policies Act of 1978 (16 U.S.C. 21 2602)) that is not wholly owned by United States persons.</text></paragraph><paragraph id="H2456BF9FAF3642BC84E5DCF546051934" commented="no"><enum>(3)</enum><header>Electric consumer</header><text display-inline="yes-display-inline">The term <term>electric consumer</term> has the meaning given such term in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>).</text></paragraph><paragraph id="H416674E5618141509E6FA177C3556D80" commented="no"><enum>(4)</enum><header>Personal consumption data</header><text display-inline="yes-display-inline">The term <term>personal consumption data</term> means data collected by a smart meter.</text></paragraph><paragraph id="H1A9E537903C34C2FB2A4B5376AF43881" commented="no"><enum>(5)</enum><header>Smart meter</header><text display-inline="yes-display-inline">The term <term>smart meter</term> means a digital device that records the use of electric energy by an electric consumer in near real time and automatically communicates that data to a covered utility.</text></paragraph></subsection></section></legis-body></bill>
