<section id="HC4A34C94F9F84D75805A54557CE19392" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Removing Excess Additives and Limiting Sugar Act</short-title></quote> or the <quote><short-title>REAL Sugar Act</short-title></quote>.</text></section> <section id="H3065220F1C644A36A615E42F526DBA02"><enum>2.</enum><header>Prohibition on high fructose corn syrup in food</header> <subsection id="H2036F8196B7D401A8BCBF3B5C9799429"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 402 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H0780C4410918422DB999D6DA6ED8417A"><enum>(j)</enum><text display-inline="yes-display-inline">If it is a food intended for human consumption containing high fructose corn syrup.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDBD38DECF73F42379BC07E2A5478DB1C"><enum>(b)</enum><header>Delayed applicability</header><text>The amendment made by subsection (a) shall only apply to articles introduced or delivered for introduction into interstate commerce on or after the date that is 2 years after the date of enactment of this Act.</text></subsection></section> 
<section id="HD7BC39C4B9A64357979F23956C95B618"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report describing—</text> <paragraph id="H52A8320B4B7D48A99798C1DD5D8FE5A7"><enum>(1)</enum><text>the status of industry reformulation efforts to address the changes made by this Act;</text></paragraph> 
<paragraph id="H809F1D5F7DE3490D943D1CD815F64203"><enum>(2)</enum><text>the regulations implemented or changed by the Secretary to comply with this Act; and</text></paragraph> <paragraph id="H7A7439B7E18B4E35BA51FFD2064F39DB"><enum>(3)</enum><text>any recommendations for additional congressional action.</text> </paragraph></section>
