<section id="HABB7E026A31540CB9946AE249022FD23" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Halt Abusive Internet Lawsuits Act of 2026</short-title></quote>.</text></section> <section id="H72E4A8176E4647AEA0397FBE4379C85D"><enum>2.</enum><header>Applicability of certain laws to collection, processing, or disclosure of information or communications for a commercial purpose</header> <subsection id="H869B97B401A644B3B77417E9791D1E78"><enum>(a)</enum><header>Applicability</header> <paragraph id="HB16CF1047BAE4934A7C336D46AF8A0A7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The collection, processing, or disclosure of information or communications for a commercial purpose shall give rise to no claim or enforcement action under Federal or State law with respect to pen registers, wiretapping, trap and trace, or eavesdropping, including chapter 1.5 of the Penal Code of California (commonly known as the <quote>California Invasion of Privacy Act</quote>).</text></paragraph> 
<paragraph id="H582489AB73AA46D3BB3101707F6BA95F"><enum>(2)</enum><header>Expiration of certain claims and actions</header><text>Any such claim or enforcement action in progress as of the date of the enactment of this Act may not be maintained, adjudicated, or arbitrated after such date.</text></paragraph></subsection> <subsection id="H3B5C4C499EF04B6791DD667A7C5A1D81"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HB1A58594829741E5B2E558A668DF95BA"><enum>(1)</enum><header>Commercial purpose</header><text>The term <quote>commercial purpose</quote> includes the use of digital commerce for—</text> <subparagraph id="HF3CBEFF089E743DDA61D37D7AAA29E32"><enum>(A)</enum><text>the operations of a business or a service provider or contractor to a business;</text></subparagraph> 
<subparagraph id="H2B27190F29D64C0F840CEF34ECA62BEA"><enum>(B)</enum><text>marketing or advertising;</text></subparagraph> <subparagraph id="H5453E10D925B4C2A883257E48A4CCAB4"><enum>(C)</enum><text>prompting, receiving, or responding to consumer input;</text></subparagraph> 
<subparagraph id="H766CA85A08194A528FFCB48B0A2B0D54"><enum>(D)</enum><text>facilitating the sale or purchase of goods or services; or</text></subparagraph> <subparagraph id="H9E2D3E33CF4A4E899D819A34895E6368"><enum>(E)</enum><text>any commercial or business purpose as defined under law or regulation of a State in which the collection, processing, or disclosure of information occurs.</text></subparagraph></paragraph> 
<paragraph id="H103B8E68B69E439E82C595A35E4BF654"><enum>(2)</enum><header>Digital commerce</header><text>The term <quote>digital commerce</quote> means the promotion, sale, purchase, delivery, or support of products or services through connected digital networks and tools, including through the use of cookies, pixels, session replay, chatbots, tags, and analytics.</text></paragraph> </subsection></section> </legis-body></bill>
