<section id="H6FF84A697F1F48F6B89CACFCB83A433E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Edgely Community Protection and Transparency Act</short-title></quote>.</text> </section> <section id="HA898DC97EE9B4972A8A998431E7B359F"><enum>2.</enum><header>Requirements for major Federal actions that involve the acquisition of private property</header><text display-inline="no-display-inline">Section 106(b)(1) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336">42 U.S.C. 4336(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H4BA2AD5252F143119C1169DA765F9A08"><enum>(1)</enum><text>by striking <quote>An agency shall issue</quote> and inserting the following:</text> <quoted-block style="OLC" id="HA82991C1091446B7B03582F033300B4E" display-inline="no-display-inline"> <subparagraph id="H41D8DFC7DEBB4D859037EC3F04F2119E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An agency shall issue</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H11DFCA370A024E9DAB17A65C67FB1EB6"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HA8E491918C874419981B1F0A52663871" display-inline="no-display-inline"> <subparagraph id="H0CDD1A7A0B4C42FF831A792FCF10D6BE"><enum>(B)</enum><header>Actions that involve the acquisition of private property</header><text display-inline="yes-display-inline">If an agency is required to prepare an environmental impact statement under this Act for a proposed agency action that involves the acquisition (including through the exercise of eminent domain) of private property, the agency shall—</text> 
<clause id="HEB407F72CC7746978FDACBA89FF1C248"><enum>(i)</enum><text>identify in the environmental impact statement an estimate of the acreage or other measure of private property anticipated to be acquired for the proposed agency action and each alternative to the proposed agency action analyzed in the environmental impact statement; and</text> </clause> <clause id="HAAED991D9DBB410F9CDBA9A82BA84853" display-inline="no-display-inline"><enum>(ii)</enum><text>if the environmental impact statement identifies a preferred alternative—</text> 
<subclause id="H7752C047131041F3BC40D3B1540F8E5B"><enum>(I)</enum><text display-inline="yes-display-inline">identify whether the preferred alternative results in the least amount of acquisition of private property compared to the proposed agency action and the other alternatives to the proposed agency action analyzed in the environmental impact statement; and</text></subclause> <subclause id="H9E7FB634D37A45D2BB248428DEF328AA"><enum>(II)</enum><text display-inline="yes-display-inline">include in the environmental impact statement an analysis of how public comments regarding the acquisition (including through the exercise of eminent domain) of private property were taken into account when identifying the preferred alternative.</text> </subclause></clause> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
