<section id="HF91CF98DEE9B475E9DBF6C495D2BDB45" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Community Consultation Act of 2026</short-title></quote>.</text></section> <section id="H03716A4D34A14EC69F5EEB210A9EDD56"><enum>2.</enum><header>Requirements for constructing immigration detention facilities</header> <subsection id="H82AAB5F0060C481CA47522CBE8D8E754"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Before beginning construction or entering into any contract, including for purchase or lease of an existing facility, for such construction on any facility for purposes of detaining any person under the immigration laws (as such term is defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)), the Secretary of Homeland Security shall—</text> 
<paragraph id="H97D85674C9B84FC09EB8102A3D379AC2"><enum>(1)</enum><text>consult with—</text> <subparagraph id="H5023666786C34301B43C507C0B3BD6DE"><enum>(A)</enum><text>local government and elected officials;</text></subparagraph> 
<subparagraph id="HC5E1388C5E4648A4BCB351B68141AE8D"><enum>(B)</enum><text display-inline="yes-display-inline">stakeholders, including—</text> <clause id="HA02ECE5F23D24562BD704A5E536F9197"><enum>(i)</enum><text display-inline="yes-display-inline">representatives from any local utility companies;</text></clause> 
<clause id="H4A9DB6E446584A1F9C0618DBAB3C77B2"><enum>(ii)</enum><text>community leaders;</text></clause> <clause id="H4FD34A6905E441C78F17FB976EF7EECA"><enum>(iii)</enum><text>business leaders; and</text></clause> 
<clause id="H83CF09C226CF44D09CDEE5B7518B8157"><enum>(iv)</enum><text>advocates;</text></clause></subparagraph> <subparagraph id="H67908D7157B646868A457358D293F9B5"><enum>(C)</enum><text>community members;</text></subparagraph> 
<subparagraph id="H126CB89FA6774062946D95A4CB2108CB"><enum>(D)</enum><text>local public health authorities; and</text></subparagraph> <subparagraph id="HF4108EAB34DE482BA242440B41D5CFE8"><enum>(E)</enum><text>emergency response services;</text> </subparagraph></paragraph> 
<paragraph id="H484787FF18FD4E99B76A2203C33C2DC3"><enum>(2)</enum><text>determine any impacts such facility may have on—</text> <subparagraph id="H85D39EF26FD04DA1BB27D37D75AF6F2B"><enum>(A)</enum><text>healthcare services;</text></subparagraph> 
<subparagraph id="H6B2B4525BC4C4A12ACCDD8A8F6FEBE53"><enum>(B)</enum><text>emergency services;</text></subparagraph> <subparagraph id="H724D73D754DA4012BF0BEC419A4D0411"><enum>(C)</enum><text>community health;</text></subparagraph> 
<subparagraph id="H8FB9E3FDE0DC49008BD661FF84E810D2"><enum>(D)</enum><text>local water and wastewater infrastructure, including impacts on water pressure and supply;</text></subparagraph> <subparagraph id="H254A26AA91454B909CE229CF06492388"><enum>(E)</enum><text>local electric power grids; and</text></subparagraph> 
<subparagraph id="H1526841EFA0F43B6BA190DF9C0B47A8B"><enum>(F)</enum><text>roads;</text></subparagraph></paragraph> <paragraph id="HBC7D576D2F5D4EB6BB09F5A10A9B4B30" display-inline="no-display-inline"><enum>(3)</enum><text>hold a public meeting about such construction to provide community members with an opportunity to meet with representatives from the Department of Homeland Security, U.S. Customs and Border Protection, and U.S. Immigration and Customs Enforcement;</text></paragraph> 
<paragraph id="H697912707BCD4FBEB8DA4B7318ECA457"><enum>(4)</enum><text display-inline="yes-display-inline">establish a 60-day period for public comment and review; and</text></paragraph> <paragraph id="H8EE40B41F3D24229A8CFFF497DB3F2D5"><enum>(5)</enum><text>respond to any such comments received during such period.</text></paragraph></subsection> 
<subsection id="H179FBC78A30D4D9B83162FDCC753202B"><enum>(b)</enum><header>Local government</header><text display-inline="yes-display-inline">If a local government of a municipality issues an ordinance, proclamation, moratorium, or any other official declaration prohibiting the construction of any facility for purposes of detaining any person under the immigration laws, the Secretary of Homeland Security may not construct such a facility in such municipality.</text></subsection> <subsection id="H725DA1EA266A4794B95086DEEC0C008E"><enum>(c)</enum><header>Contagious disease protocols</header><text>The Secretary of Homeland Security shall coordinate with local public health authorities to establish, in the event of a contagious disease outbreak within a facility detaining any person under the immigration laws, protocols for—</text> 
<paragraph id="HB925CC0F4A7843F19A1EA2C1308478EC"><enum>(1)</enum><text>treatment;</text></paragraph> <paragraph id="HB51D2EA480C440B18E29C751162B0583"><enum>(2)</enum><text>care;</text></paragraph> 
<paragraph id="H4AAF25021590431C84F2B99EFAC58E59"><enum>(3)</enum><text>containment;</text></paragraph> <paragraph id="H78416D98A8D64D5EA76D39DDD6AF7FFF"><enum>(4)</enum><text>prevention of further contagion; and</text></paragraph> 
<paragraph id="H6F42C6AD2FE242FCBC8E6F1A220F2451"><enum>(5)</enum><text>notifying the local community.</text></paragraph></subsection></section> <section id="H2196724F8C284B248304686F695BC007"><enum>3.</enum><header>Prohibitions on constructing immigration detention facilities</header> <subsection id="H995C59511F8D4A79926BCB48B2AC25A2"><enum>(a)</enum><header>Existing structures</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not retrofit, renovate, or reconstruct an existing structure for purposes of detaining any person under the immigration laws (as such term is defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) if such existing structure was not intended to house people, including a storage facility, warehouse, or commercial space.</text></subsection> 
<subsection id="H6951DD2A12DE4A15A99E7FFCD8269AD9"><enum>(b)</enum><header>Military installations</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not construct or operate any facility for purposes of detaining any person under the immigration laws on a United States military installation (as defined in section 2801 of title 10, United States Code).</text></subsection></section> </legis-body></bill>
