R. 10250</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260903">September 3, 2026</action-date><action-desc><sponsor name-id="B000740">Mrs. Bice</sponsor> (for herself and <cosponsor name-id="W000809">Mr. Womack</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles 41 and 10, United States Code, to prohibit a requirement or preference for the use of union labor for Federal contracts.</official-title></form><legis-body id="H9D9B258F3EC945EBADE715BAB3704EEE" style="OLC"><section id="H6F0CE2122B3B40A9A1C4A98D3FA98EA2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Preference Act</short-title></quote>.</text></section><section id="H72BD40FB03C049FBA290B2333EBB8795"><enum>2.</enum><header>Federal contracting prohibition for executive agencies to require or give a preference for union labor</header><subsection id="HAA99BE0E635840F7918F1716994B3CA1"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/47">Chapter 47</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HDBFA090498104D58A2C23F071C90066B" display-inline="no-display-inline"><section id="H719F256B173C49A6AB143A6413F99E9D"><enum>4715.</enum><header>Prohibition on requirement or preference for the use of union labor</header><text display-inline="no-display-inline">The head of an executive agency may not require or give preference to an offeror on the basis of whether the offeror will use workers subject to a collective bargaining agreement.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF52B1846284C4D90869C76CAA4DDE5F3"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/47">chapter 47</external-xref> of title 41, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="HD29D32C6621E4CD1B478B268B72D6D77" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="item">Sec. 4715. Prohibition on requirement or preference for the use of union labor.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H59662ABF0B244234BC0F9F56F91D1EAE" commented="no"><enum>3.</enum><header>Defense contracting requirement to use union labor</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/243">Chapter 243</external-xref> of title 10, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H72E37786B67343A6A37878957F531F7F" display-inline="no-display-inline"><section id="HC84C3A06F33B4FD0BBDE357C81D0F0FA" commented="no"><enum>3345.</enum><header>Requirement to use union labor</header><text display-inline="no-display-inline">The Secretary of Defense may not require or give preference to an offeror for a contract on the basis of whether the offeror will use workers subject to a collective bargaining agreement.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
