<section id="HC218F7F778994CB3B3795514447880C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Janie Wynn Protecting Elders from Financial Exploitation Act</short-title></quote>.</text></section> <section id="H0E333D8C459D4174BB916202F3338A71"><enum>2.</enum><header>Prevention of senior citizen financial exploitation</header> <subsection id="H72BBF763B4E640129EFC59FB557FB260"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Bureau of Consumer Financial Protection, in consultation with the Secretary of the Treasury and the Director of the Financial Crimes Enforcement Network, shall issue a final rule requiring—</text> 
<paragraph id="HB25404D3B0E34403AE57BD0617710295"><enum>(1)</enum><text>any card issuer that issues a pre-approved credit card to a senior citizen to provide fraud alerts for such credit card upon activation to—</text> <subparagraph id="HF638440D55FE484EB9245E4741ECC2FB"><enum>(A)</enum><text>the cardholder; and</text></subparagraph> 
<subparagraph id="H9F098AE238B94D0E818172C32E8A08F9"><enum>(B)</enum><text>except as provided in subsection (b), an individual selected by the cardholder who is at least 25 years old and—</text> <clause id="HD24FFB54E59342A6A2207FB4668CCF43"><enum>(i)</enum><text>is a relative or spouse of the cardholder; or</text></clause> 
<clause id="HF19BFEBE064A454AB102332F1DC21164"><enum>(ii)</enum><text>has provided a description to the card issuer of the nature of their relationship with the cardholder; and</text></clause></subparagraph></paragraph> <paragraph id="H6D530869C0CF42A1BA2BBE8F99C331F8"><enum>(2)</enum><text display-inline="yes-display-inline">each depository institution and credit union to provide training to employees who perform fraud detection services on how to identify account activity that is indicative of financial exploitation of a senior citizen and notify any senior citizen that possesses an account with the depository institution or credit union within 24 hours of any such account activity occurring in such account, including—</text> 
<subparagraph id="HDD80BCCDC64549A5A129957C6454BF2E"><enum>(A)</enum><text>the irregular use of—</text> <clause id="H637CB62677474E9986B41CE815C92644"><enum>(i)</enum><text>an automated teller machine;</text></clause> 
<clause id="H63A30E5712E5432A829C70AD1356EFF8"><enum>(ii)</enum><text>a credit card;</text></clause> <clause id="H159C27375A084D1B92D64CAA49A1307D"><enum>(iii)</enum><text>an online banking service; or</text></clause> 
<clause id="HF4218562B6CE46F2B4E9C08C234BED68"><enum>(iv)</enum><text display-inline="yes-display-inline">a wire transfer;</text></clause></subparagraph> <subparagraph id="H8A5F13347411456882CD012337869026"><enum>(B)</enum><text>an irregular cash withdrawal;</text></subparagraph> 
<subparagraph id="H36142B0F19874ABBA43778A0CB8CBDFE"><enum>(C)</enum><text>an irregular credit card charge;</text></subparagraph> <subparagraph id="H625F15C3143141D3BCA36AB8522C6D75"><enum>(D)</enum><text>the absence of a regularly occurring deposit;</text></subparagraph> 
<subparagraph id="H0269258E0FAA46529EE55902DB93AA7F"><enum>(E)</enum><text>account activity in a previously inactive account;</text></subparagraph> <subparagraph id="HDAA03550E34C435EA302EB886E135ED5"><enum>(F)</enum><text>the addition of an authorized user to an account;</text></subparagraph> 
<subparagraph id="HDDC926CE858A4FCABE46DD91FA0AD346"><enum>(G)</enum><text>a change of address associated with an account;</text></subparagraph> <subparagraph id="HFA05B4EC6F9D4FAB963CF5EA36F16E8E"><enum>(H)</enum><text display-inline="yes-display-inline">an inability to cover a charged payment due to insufficient funds in an account;</text></subparagraph> 
<subparagraph id="HB2D123C4A0A3409CB62F98CA7903A3F0"><enum>(I)</enum><text>a request for a credit limit increase;</text></subparagraph> <subparagraph id="HB70383CF27904D239E9F893D47305387"><enum>(J)</enum><text>a charged payment for the purchase of gift cards or prepaid debit cards in an aggregate amount greater than $100;</text></subparagraph> 
<subparagraph id="HB90A8B4CD3D94F30BE6E20126BCEB615"><enum>(K)</enum><text display-inline="yes-display-inline">an electronic payment from an account through the Automated Clearing House network to a recipient with no history of prior payment from such account; and</text></subparagraph> <subparagraph id="H3723F5F021F14A43B0EAD01AA98E64F8"><enum>(L)</enum><text display-inline="yes-display-inline">a gap in the check number of checks cashed from an account.</text></subparagraph></paragraph></subsection> 
<subsection id="HCE9F14C8AFCE4EB897407E0345ABF778"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The Director of the Bureau of Consumer Financial Protection shall include in the rule required under subsection (a) a waiver of the requirements of paragraph (1)(B) of such subsection if—</text> <paragraph id="H2A3E1A2B41AA4C7AB7F71710D210A8D6"><enum>(1)</enum><text>the cardholder signs a waiver acknowledging an increased risk of financial exploitation; and</text></paragraph> 
<paragraph id="H010C7625F13B438C839144F3779E9820"><enum>(2)</enum><text>the card issuer retains a copy of such waiver until at least 5 years after the date that the pre-approved credit card is deactivated.</text></paragraph></subsection> <subsection id="HB3CF96B670C14FCFA14AE5EE23E64BF2"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="HA70EA7C497334FD1AB3A164095059F0B"><enum>(1)</enum><header>Cardholder; card issuer</header><text display-inline="yes-display-inline">The terms <term>cardholder</term> and <term>card issuer</term> have the meanings given such terms, respectively, in section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>).</text></paragraph> <paragraph id="HC98BCFB6836F43FDABA50998CD1EFA9E"><enum>(2)</enum><header>Credit union</header><text display-inline="yes-display-inline">The term <term>credit union</term> means a Federal credit union, a State credit union, or a State-chartered credit union (as such terms are defined, respectively, in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>)).</text></paragraph> 
<paragraph id="HBA008BBDBC4E4EF9BC067EBD39C94DA5"><enum>(3)</enum><header>Depository institution</header><text>The term <term>depository institution</term> has the meaning given such term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>).</text></paragraph> <paragraph id="H1EE26A205E944DFDB20DF5D1D5986C7E"><enum>(4)</enum><header>Exploitation; senior citizen</header><text>The terms <term>exploitation</term> and <term>senior citizen</term> have the meanings given such terms, respectively, in section 303 of the Economic Growth, Regulatory Relief, and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/3423">12 U.S.C. 3423</external-xref>).</text></paragraph> 
<paragraph id="HD81F81F655244740A378B7781696500D"><enum>(5)</enum><header>Fraud alert</header><text display-inline="yes-display-inline">The term <term>fraud alert</term> means a notice provided by a card issuer to an individual of suspected fraudulent activity connected to a credit card associated with such individual and managed by such card issuer that—</text> <subparagraph id="HEE1D7180094B4C1796C10269ECCBF143"><enum>(A)</enum><text display-inline="yes-display-inline">is communicated by means of a phone call, email, or text message;</text></subparagraph> 
<subparagraph id="H5665E8ACB2EC4A36B778775B7399B872"><enum>(B)</enum><text display-inline="yes-display-inline">describes the suspected fraudulent activity in sufficient detail to alert the individual of such activity, including account activity that is indicative of financial exploitation of a senior citizen; and</text></subparagraph> <subparagraph id="H59341967A775410EB004B02F3E45B41F"><enum>(C)</enum><text>includes information on how to communicate with the card issuer regarding the suspected fraudulent activity at any time of the day and on any day of the week.</text></subparagraph></paragraph> 
<paragraph id="H3E630FE73C724F1A9E05FBC65DA473A4"><enum>(6)</enum><header>Pre-approved credit card</header><text>The term <term>pre-approved credit card</term> means a credit card issued as a result of the acceptance of an offer extended to an individual to apply for such credit card based on a determination by the card issuer that such individual likely satisfied the qualifications for obtaining such credit card, including an offer extended to an individual to apply for such credit card that grants elevated or priority consideration for approval to the individual.</text></paragraph></subsection></section> </legis-body></bill>
