<section id="H40689CDD61A144F3AA9A78B95B0F47B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Protections for Children with Food Allergies Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="HBA1683F2F8F644A2B3635D225D501C92"><enum>2.</enum><header>Food allergy training completion requirement</header><text display-inline="no-display-inline">Section 7(g)(2)(B) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(g)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="HB89F9EF27E5F4CBCB994DAC19CE8D85E"><enum>(1)</enum><text>in clause (iii), by amending subclause (II) to read as follows:</text> <quoted-block style="OLC" id="H1169E29437FE4CC1B1D6804CE26897D1" display-inline="no-display-inline"> <subclause id="H16D480DF530C457A8CCED5FF621E250B"><enum>(II)</enum><text display-inline="yes-display-inline">food allergies, including information on best practices—</text> 
<item id="H607D778379C148758D0DB0808463BF35"><enum>(aa)</enum><text>to prevent, recognize, and respond to food-related allergic reactions, including through the administration of epinephrine in FDA-approved delivery systems in the case of a severe allergic reaction such as anaphylaxis;</text></item> <item id="H5F4B9CC3AE514D90ACF2BD6155996F9B"><enum>(bb)</enum><text>for communicating food allergen information in school menus, food products, and recipes;</text></item> 
<item id="H0F4AC7E48E4B4AB2ADF40E0110FBA287"><enum>(cc)</enum><text>to avoid cross-contact; and</text></item> <item id="HACD7CE2CD29C4745A8301B7F758F746C"><enum>(dd)</enum><text>regarding appropriate food substitutions for children with food allergies;</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC79C0A4958CA4154B7DAF7823EE826DF"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H94C4B6CA633D42ECAC1244F6ADD4898E" display-inline="no-display-inline"> <clause id="H173430CC02E44295B16EC0E67EBDD1AD" commented="no"><enum>(iv)</enum><header>Methods for inclusion</header><text>The training required under this subparagraph shall be provided, as the Secretary determines to be necessary, in—</text> 
<subclause id="H50C6F17E351A427CA5551253CF11B893" commented="no"><enum>(I)</enum><text>relevant languages other than English, for individuals with limited English proficiency; and</text></subclause> <subclause id="H4943A1B246354D64BFDFB4316A158414" commented="no"><enum>(II)</enum><text>relevant alternative formats, for individuals with disabilities (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></subclause></clause> 
<clause id="H40CF241020F54000BA741B8FEB9D9366" commented="no"><enum>(v)</enum><header>Availability to other personnel</header><text>The Secretary shall make the training provided under this subparagraph available to personnel under child nutrition programs not covered under this subsection, including personnel under—</text> <subclause id="H8A5476D628764F53A13B8C15CDCE1591" commented="no"><enum>(I)</enum><text>the special milk program under section 3;</text></subclause> 
<subclause id="H7B0DA7DB70A746DD9D92E3D1067A6EC6" commented="no"><enum>(II)</enum><text>the summer food service program for children under section 13 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>); and</text></subclause> <subclause id="H6998721185AC45F1BDBC67757D464E6A" commented="no"><enum>(III)</enum><text>the child and adult care food program under section 17 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>).</text></subclause></clause> 
<clause id="H3F879C653F7A4A52A3DE64D19863AFCA" commented="no"><enum>(vi)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subparagraph $1,000,000 for each of fiscal years 2027 through 2031.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H3BCEAE92BD3641A487A5671E7BA31896"><enum>3.</enum><header>Activities to support WIC-eligible individuals impacted by food allergies</header><text display-inline="no-display-inline">Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text> 
<paragraph id="HD5E083909D464A048F0FA8A7D41DF375"><enum>(1)</enum><text>by redesignating subsections (l) through (s) as subsections (m) through (t), respectively;</text></paragraph> <paragraph id="HBD16C5BAB75B4CA6A681136B34E64BB8"><enum>(2)</enum><text>by inserting after subsection (k) the following:</text>

<subsection id="H50BF2D8F5EB34A52BDC4B6CBF868EB26"><enum>(l)</enum><header>Activities To support WIC–Eligible individuals impacted by food allergies</header> 
<paragraph id="H894798E19A8B44ED92719E8B277DD1F0"><enum>(1)</enum><header>In general</header><text>In accordance with subsection (e), the Secretary shall—</text> <subparagraph id="H33D9FD8FBB1C4DF6AA706BC3996B3E69"><enum>(A)</enum><text>submit to the Secretary of Health and Human Services for comment proposed nutrition education materials for use under subsection (e), which shall—</text> 
<clause id="H9022C7AE770C4284919266187F36746D"><enum>(i)</enum><text>incorporate evidence-based findings from the United States Dietary Guidelines for Americans relating to food allergies and potentially allergenic foods; and</text></clause> <clause id="HBEB367B62864457B9DC40E9FBE1C6AE5"><enum>(ii)</enum><text>include nutrition education materials for—</text> 
<subclause id="H7A9C7A2C62C14D9FB9CEEC7B5C8EB06F"><enum>(I)</enum><text>individuals with food allergies during pregnancy and in the postpartum period;</text></subclause> <subclause id="H059823C6C0C94DEFB5C86A7EA0617208"><enum>(II)</enum><text>infants impacted by prenatal food allergy exposure; and</text></subclause> 
<subclause id="HBEE065AE27134B878113098FADE1948C"><enum>(III)</enum><text>children with food allergies; and</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H52A2895CE9C54CD4891F99FF80D8236C"><enum>(B)</enum><text>after submitting the materials in accordance with subparagraph (A), publish and disseminate the materials for use under subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H7A2D839394A14143B499823F3EB0F1C7"><enum>(2)</enum><header>Requirements for inclusion</header> 
<subparagraph id="H8A2C8C65DE6B46C3A9A507C4A0145A69"><enum>(A)</enum><header>In general</header><text>The nutrition education materials under paragraph (1) shall be provided, as the Secretary determines to be necessary, in—</text> <clause id="H04246F9374764927BE7109055F3833B0"><enum>(i)</enum><text>relevant languages other than English for individuals with limited English proficiency; and</text></clause> 
<clause id="HB5C719706F0F4F6EBAA44DE37A7F92F7"><enum>(ii)</enum><text>relevant alternative formats for individuals with disabilities (as defined in section 3 of the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></clause></subparagraph> <subparagraph id="H8E1FBB54996F45A0BF247B180A30CE5E"><enum>(B)</enum><header>Outreach</header><text>In carrying out this paragraph, the Secretary shall conduct outreach to individuals who are, or may be—</text> 
<clause id="HBC53CD61E28047A4A827B6BC5FA211AA"><enum>(i)</enum><text>eligible to participate in—</text> <subclause commented="no" id="H0C05ED35A90D46D79A60E0BF1DB811E9"><enum>(I)</enum><text>the program under this section; or</text></subclause> 
<subclause commented="no" id="H4941C40A87B240F0967FC429B59C3EE1"><enum>(II)</enum><text>a training program of a State agency under subsection (e)(2); and</text></subclause></clause> <clause id="H2ACA033DFF514E82BBC7CC6F5F146C79"><enum>(ii)</enum><text>impacted by food allergies.</text></clause></subparagraph></paragraph> 
<paragraph id="H11B91B419FEA4053844A30357890675F"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $1,000,000 for fiscal year 2027.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H51C6A8B658F04B68A6C083F3867E7036"><enum>(3)</enum><text>in subsection (q) (as redesignated by paragraph (1))—</text> 
<subparagraph id="HD606DE1191874F2AB4A260632D67E082"><enum>(A)</enum><text>in paragraph (1), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0B532B0ED36D47C6AA5A7D1283C17F78"><enum>(B)</enum><text>in paragraph (2)(B), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>; and</text></subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" commented="no" id="HAC38815D5CDD4128A5DF15B09516533C"><enum>(4)</enum><text>in paragraph (5) of subsection (t) (as redesignated by paragraph (1)), by striking <quote>subsection (r)</quote> and inserting <quote>subsection (s)</quote>.</text></paragraph></section> </legis-body></bill>
