Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

SEC. 2. Funding prohibition.

(a) In general.—No Federal funds may be used to provide covered housing assistance to an alien unlawfully present in the United States.

(b) Exceptions.—The prohibition described under subsection (a) shall not apply with respect to—

(1) the enforcement of the immigration laws (as such term is defined under section 101(a) of the Immigration and Nationality Act (8 U.S.C. 1101(a))); or

(2) the enforcement of any criminal laws.

(c) Requirements.—The head of each Federal agency shall take any action necessary to ensure compliance with subsection (a) and enforce any violation thereof, including—

(1) requiring any recipient of Federal funds to certify that any use of such funds will comply with subsection (a);

(2) monitoring compliance with subsection (a);

(3) civil penalties; or

(4) implementing a period of ineligibility for any recipient of Federal funds following a violation of subsection (a).

(d) Covered housing assistance.—In this section the term “covered housing assistance” includes—

(1) rental assistance, including—

(A) security deposits;

(B) initial rental payments;

(C) rental arrears;

(D) application fees; or

(E) any other cost associated with obtaining or maintaining rental housing.

(2) housing vouchers;

(3) mortgage assistance;

(4) utility assistance related to obtaining or maintaining housing;

(5) hotel or motel accommodations;

(6) emergency, temporary, transition, or permanent housing accommodations;

(7) stabilization services, including—

(A) searching for housing;

(B) housing placement;

(C) relocation;

(D) eviction prevention;

(E) landlord mediation;

(F) housing-retention assistance;

(G) housing counseling;

(H) case management services; or

(I) any other service with the primary purpose of helping an individual maintain housing; and

(8) any administrative or indirect costs related to providing the assistance described in paragraphs (1) through (8).
