<section id="H3CF56F130AC94704A9BEC5504143860C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flock-Off Act</short-title></quote>.</text> </section> <section id="HD26367BB18874237B6A1F0669F6ADC56"><enum>2.</enum><header>Prohibition on use of Federal funds for covered camera systems and associated components</header> <subsection id="H568B1454A4654A8081F172E6FBE6C60F"><enum>(a)</enum><header>Prohibition</header> <paragraph id="H5AF7E387B7F84BEA8DB2D2D53C49A391"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, no Federal funds may be obligated or expended, directly or indirectly, by the head of any Government agency or by any recipient or subrecipient of Federal funds (including any State, local, or Tribal government) to do any of the following:</text> 
<subparagraph id="HBDE4C374DF2447DF955A8D0E713601ED"><enum>(A)</enum><text>Purchase, lease, acquire, install, deploy, maintain, repair, replace, upgrade, or operate a covered camera system or any associated component.</text></subparagraph> <subparagraph id="H6B7B5040381A456E9FF970ABD75B0791"><enum>(B)</enum><text>Enter into, renew, extend, modify, administer, or make a payment under any contract, subscription, license, memorandum of understanding, data-sharing agreement, cooperative agreement, or other similar arrangement for any of the following:</text> 
<clause id="H3299997B13F445FB9715CFF00F5319E1"><enum>(i)</enum><text display-inline="yes-display-inline">The installation, maintenance, operation, or management of a covered camera system or any associated component.</text></clause> <clause id="H8061C8FDEA5847D680CEF4504961FF62"><enum>(ii)</enum><text>Access to—</text> 
<subclause id="HE7ED2055EFB1406F836F440AB92F9EBA"><enum>(I)</enum><text display-inline="yes-display-inline">a covered camera system or any associated component; or</text></subclause> <subclause id="HB2D981FCBDDF43BB80568FB5E95E6033"><enum>(II)</enum><text display-inline="yes-display-inline">any data collected, generated, processed, retained, transmitted, or otherwise made available through a covered camera system or any associated component.</text></subclause></clause> 
<clause id="H4A98CA3590F245C5AD0A9CDD7BCE2FFF"><enum>(iii)</enum><text display-inline="yes-display-inline">Hardware, software, cloud storage, network connectivity, technical support, data analysis, system integration, or any other product or service used in connection with a covered camera system or any associated component.</text></clause></subparagraph> <subparagraph id="H1E6793E0C8D24E61BC6AF401E1ACAEBC"><enum>(C)</enum><text>Reimburse, subsidize, offset, or otherwise financially support, in whole or in part, an expenditure with respect to an action or arrangement described in subparagraph (A) or (B), respectively.</text></subparagraph> </paragraph> 
<paragraph id="H08BA9015825F473AB4A7EDA0CB36ADE3"><enum>(2)</enum><header>Existing covered camera systems and associated components</header> 
<subparagraph id="H4BB4A050C7274DDAA5A16D060792B218"><enum>(A)</enum><header>Government agencies</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the head of each Government agency shall decommission and remove any covered camera system and any associated component purchased, leased, installed, deployed, maintained, or operated, in whole or in part, with Federal funds.</text></subparagraph> <subparagraph id="H7058040056FF4A6D996D7C4E82314C44" commented="no"><enum>(B)</enum><header>Recipients and subrecipients</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, as a condition of continuing to receive Federal funds under the relevant Federal program, each recipient and subrecipient shall—</text> 
<clause id="HBEA01568C4F5437AA6DCD50F58BACF7F" commented="no"><enum>(i)</enum><text>cease operating any covered camera system and any associated component that the recipient or subrecipient has operated, in whole or in part, using Federal funds that the recipient or subrecipient received under a Federal program; and</text></clause> <clause id="H1A4A778988874E4C9194462FF185416D" commented="no"><enum>(ii)</enum><text>terminate, or decline to renew or extend, any arrangement described in paragraph (1)(B) to which the recipient or subrecipient is a party that is funded, in whole or in part, under such Federal program.</text></clause></subparagraph> 
<subparagraph id="H45211B7978C745628568D29A4D51BEB1" commented="no"><enum>(C)</enum><header>Recovery of Federal funds</header><text display-inline="yes-display-inline">If a recipient or subrecipient obligates or expends Federal funds that the recipient or subrecipient received under a Federal program in violation of paragraph (1), the head of the Government agency that provided such Federal funds to the recipient or subrecipient shall withhold further Federal funds under such Federal program from the recipient or subrecipient until the recipient or subrecipient reimburses the Treasury of the United States for the full amount of Federal funds obligated or expended in violation of such paragraph.</text> </subparagraph></paragraph></subsection> <subsection id="H6D361F1FD20F4F6EB91824F523CA5D94"><enum>(b)</enum><header>Exceptions</header> <paragraph id="HAF0EA428651348038E38722340D2C0EB"><enum>(1)</enum><header>Border exception</header><text>Subsection (a) does not apply to any covered camera system or any associated component that—</text> 
<subparagraph id="H3067EBFA7EC24A6AB12102AB33605D0E"><enum>(A)</enum><text display-inline="yes-display-inline">is installed and operated within 1 mile of the northern border or the southern border;</text> </subparagraph> <subparagraph id="H443BBC1BA4804EA1B493DA0643E1C28C"><enum>(B)</enum><text>is owned or operated by U.S. Customs and Border Protection or by another Federal law enforcement agency or local law enforcement authority pursuant to a written agreement with U.S. Customs and Border Protection; and</text></subparagraph> 
<subparagraph id="HEB75446CAA01494E9F4B89E4749421FD"><enum>(C)</enum><text>is used primarily for border security or for the detection or interdiction of unlawful entry, human trafficking, drug trafficking, alien smuggling, or transnational criminal activity.</text></subparagraph></paragraph> <paragraph id="H32DFE6A436D8468FA629E8878957CD64"><enum>(2)</enum><header>Tolling exception</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), funds made available under section 104(b) of title 23, United States Code, may be used for any covered camera system or associated component if—</text> 
<subparagraph id="H435375BD02A54E1D952D4992117AE5BA"><enum>(A)</enum><text>the only purpose of such use is to collect, administer, or enforce a toll; and</text></subparagraph> <subparagraph id="H338EC49703ED41FBB08F5F4C96F9B238"><enum>(B)</enum><text>any data collected from such use is used, accessed, retained, queried, disclosed, or shared only for such purpose.</text> </subparagraph></paragraph></subsection> 
<subsection id="H73163417E3724AB2A338D28B8C94F919"><enum>(c)</enum><header>Definitions</header> 
<paragraph id="H3D7F35C77297429F8F8DE9786892BC9A" commented="no"><enum>(1)</enum><header>Associated component</header><text display-inline="yes-display-inline">The term <term>associated component</term>, with respect to a covered camera system, includes any hardware, software, algorithm, database, communications network, cloud-based service, or data analysis platform of, or used in connection with, such covered camera system to collect, store, process, analyze, compare, query, match, transmit, share, or retrieve data collected or generated by such covered camera system, including biometric data.</text> </paragraph> <paragraph id="HD2714EC196AA480B816B06BCB06C2338"><enum>(2)</enum><header>Biometric data</header><text display-inline="yes-display-inline">The term <term>biometric data</term> means any data derived from human physiological, biological, or behavioral characteristics that may be used, alone or in combination with other data, to establish or verify the identity of an individual, including any of the following data:</text> 
<subparagraph id="HC9C5095EA64A4C60A05C1253D300979B"><enum>(A)</enum><text>A facial image.</text></subparagraph> <subparagraph id="HD955C46E53ED4DD8B1EAF6BA1DA82845"><enum>(B)</enum><text>A voiceprint.</text></subparagraph> 
<subparagraph id="H702535DC071A4D75B93FBE4B8EB92078"><enum>(C)</enum><text>A fingerprint.</text></subparagraph> <subparagraph id="HE3F0A57A57514CE0B625B0C4A035025A"><enum>(D)</enum><text>An iris or a retinal scan.</text></subparagraph> 
<subparagraph id="HE2427C764E704611B9BBDF915AE133F2"><enum>(E)</enum><text>Gait pattern.</text></subparagraph></paragraph> <paragraph id="H57B26085B6654D289856654FE08B1C67"><enum>(3)</enum><header>Covered camera system</header><text display-inline="yes-display-inline">The term <term>covered camera system</term> means any fixed, mobile, or portable photographic, video, optical, infrared, biometric, or other electronic device that—</text> 
<subparagraph id="H1A6A811783A249479BAEF1503884A468"><enum>(A)</enum><text display-inline="yes-display-inline">automatically captures and processes an image or a recording of a motor vehicle or a license plate of a motor vehicle using machine learning or other automated image-processing technology to—</text> <clause id="H464A85FB4E004D049BBB37A64E48573B"><enum>(i)</enum><text display-inline="yes-display-inline">extract license plate numbers, motor vehicle characteristics, or other information from such image or recording;</text></clause> 
<clause id="H75A039A7471349C982A75EA57E644A98"><enum>(ii)</enum><text display-inline="yes-display-inline">convert such information into computer-readable data; and</text></clause> <clause id="H8E851FBADF19435099BB97CFC84DACA3"><enum>(iii)</enum><text display-inline="yes-display-inline">transmit such image, recording, or information to a remote or cloud-based system for storage, analysis, retrieval, or sharing; or</text></clause></subparagraph> 
<subparagraph id="HABCA369257154EF6A9E2675B62AE2301"><enum>(B)</enum><text display-inline="yes-display-inline">automatically captures and processes an image or a recording of an individual using machine learning or other automated image processing technology to—</text> <clause id="H6C50CEA81ADD415FBFD171894BDE82A8"><enum>(i)</enum><text display-inline="yes-display-inline">extract biometric data of such individual from such image or recording;</text></clause> 
<clause id="H964A008CA3654C1AA02129B707AAEC88"><enum>(ii)</enum><text display-inline="yes-display-inline">convert such biometric data into computer-readable data; and</text></clause> <clause id="H0EA4C5F6447C4072BB432F82CF103BE9"><enum>(iii)</enum><text display-inline="yes-display-inline">transmit such image, recording, or biometric data to a remote or cloud-based system for storage, analysis, retrieval, or sharing.</text></clause></subparagraph></paragraph> 
<paragraph id="H8D85F6E6DCCC4C1A9822136F9D1E4B12"><enum>(4)</enum><header>Federal program; recipient; subrecipient</header><text display-inline="yes-display-inline">The terms <quote>Federal program</quote>, <quote>recipient</quote>; and <quote>subrecipient</quote> have the meaning given such terms in section 200.1 of title 2, Code of Federal Regulations.</text></paragraph> <paragraph id="H49758F96AD00419B9ADAD57D586EB776"><enum>(5)</enum><header>Government agency</header><text>The term <term>Government agency</term> has the meaning given that term in section 4 of the United States Information and Educational Exchange Act of 1948 (<external-xref legal-doc="usc" parsable-cite="usc/22/1433">22 U.S.C. 1433</external-xref>).</text></paragraph> 
<paragraph id="H7D418E0F59B6438EB7819AD51ECA8A7B"><enum>(6)</enum><header>Local law enforcement authority</header><text>The term <term>local law enforcement authority</term> has the meaning given that term in section 921(a) of title 18, United States Code.</text></paragraph> <paragraph id="H0BC3B94A1ACF4E6EBD4891F5B0ECB6AF"><enum>(7)</enum><header>Northern border; southern border</header><text display-inline="yes-display-inline">The terms <term>northern border</term> and <term>southern border</term> have the meaning given such terms in section 602 of the Border Infrastructure and Technology Modernization Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1401">6 U.S.C. 1401</external-xref>).</text> </paragraph></subsection></section>
