which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit covered platforms from processing personal data with respect to covered minors without obtaining the verifiable consent of a parent of the covered minor, and for other purposes.</official-title></form><legis-body id="H9B98A2D37F0E41B0AEB3047E5B11A9C5" style="OLC"><section id="HA3F00A6D295441E8B5FF1F14302A6E51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Governing Underage Access and Requiring Data Consent In All Networks Act</short-title></quote> or the <quote><short-title>GUARDIAN Act</short-title></quote>.</text></section><section id="H5B9E421601824D60B39AF1F3D36B7376"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H8965285C33E44057B17855965BFC819F"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H4239FA53E0424EF48F77689A26AA8821"><enum>(2)</enum><header>Covered platform</header><text>The term <term>covered platform</term> means a platform that is a website, software, application, or electronic service connected to the internet that meets the following requirements:</text><subparagraph id="H1CDE31A58FC7428F8E8B7829EBC9BF1D"><enum>(A)</enum><text>Is publicly available for use by consumers.</text></subparagraph><subparagraph id="HAED2CE8B3F5D40B89AB8D431C945821F"><enum>(B)</enum><text>Enables the creation of a username or user identifier—</text><clause id="H337E35CD68EB40028C17FCE45753BE3C"><enum>(i)</enum><text>that is searchable on the platform by other users through a function made available by the platform; and</text></clause><clause id="HFC4A105ECA4F4B138FEA39698CE240B5"><enum>(ii)</enum><text>that can be followed by or is similarly accessible to other users of the platform.</text></clause></subparagraph><subparagraph id="HF84FAC7F0BF9471BA1B78C59F0E07EF8"><enum>(C)</enum><text>As the primary purpose of the platform, facilitates the sharing and access to user-generated content through text, images, video, audio, or any other interactive medium.</text></subparagraph><subparagraph id="H5F4E8C632F2D4DF59255EFB3233ED369"><enum>(D)</enum><text>Uses a design feature to promote user engagement on the platform.</text></subparagraph><subparagraph id="H1915C296B1994265A55F3DC84DC8B2D7"><enum>(E)</enum><text>Uses the personal information of the user to advertise, market, or make content recommendations.</text></subparagraph></paragraph><paragraph id="H1E7A824BE37B4781BAFADDA49AED2E03"><enum>(3)</enum><header>Covered minor</header><subparagraph id="H5BD47FFD9D604502B66612984DE16BA1"><enum>(A)</enum><text>The term <term>covered minor</term> means a user who the provider of a covered online platform knows or should have known is under the age of 16.</text></subparagraph><subparagraph id="HC62CD37983BC4F5DA80C26A6D2D3C3FF"><enum>(B)</enum><text>Notwithstanding subparagraph (A), an individual who is under the age of 16 and is emancipated from a parent is not a covered minor.</text></subparagraph></paragraph><paragraph id="H42096C24317A4A6CBCE76116DB964613"><enum>(4)</enum><header>Design feature</header><text>The term <term>design feature</term>—</text><subparagraph id="HCD2AB70F9F2E4A43839480C799D7AB2E"><enum>(A)</enum><text>means any feature or component of a covered platform that encourages an increase in or increases the frequency of use or time spent by a user who is a covered minor with respect to such covered platform; and</text></subparagraph><subparagraph id="HBFACA6B952944B909AF2779C267B6D93"><enum>(B)</enum><text>includes—</text><clause id="H73ACCFFAAD864D58915245D0856715AF"><enum>(i)</enum><text>infinite scrolling or auto play;</text></clause><clause id="H1E543FB80B8348B7ACB3BB62D3C538CE"><enum>(ii)</enum><text>rewards or incentives based on frequency of use or time spent;</text></clause><clause id="HBA28D46682804BAE884B9F4CB30828F3"><enum>(iii)</enum><text>notifications and push alerts;</text></clause><clause id="H045536435AF14BA5A51B3AFCCF4EE839"><enum>(iv)</enum><text>badges or other visual award symbols based on frequency of use or time spent;</text></clause><clause id="H4C805AD9D54542C1B1D45A6C43F81F7D"><enum>(v)</enum><text>appearance altering filters; and</text></clause><clause id="H87D464C422BE44A89A4967AB6AD81F06"><enum>(vi)</enum><text>personalized recommendation systems.</text></clause></subparagraph></paragraph><paragraph id="H822A779A9EFB46D3863DA0BCE7D6BFB5"><enum>(5)</enum><header>Fully automated system</header><text>The term <term>fully automated system</term> means an algorithm the final outputs of which are, once computed, displayed directly to a covered minor without review or alteration by a covered platform.</text></paragraph><paragraph id="HFCF606EFB8004B9C8E6B0C82E014876D"><enum>(6)</enum><header>Parent</header><text>The term <term>parent</term>, with respect to a minor, means an adult with the legal right to make decisions on behalf of the minor, including any of the following:</text><subparagraph id="HA9144682BF1148889E844B7FD63EAEB9"><enum>(A)</enum><text>A natural parent.</text></subparagraph><subparagraph id="H81CC7776813A4408BD4CCBCA1E2FE927"><enum>(B)</enum><text>An adoptive parent.</text></subparagraph><subparagraph id="HC53C3C29B55E4B09AA697DD523DD97D9"><enum>(C)</enum><text>A legal guardian.</text></subparagraph><subparagraph id="HA2E33A4A570140E4A80354E5A3A203DA"><enum>(D)</enum><text>An individual with legal custody over the minor.</text></subparagraph></paragraph><paragraph id="H7A8C8D68AA01490F8F0F091BFAE2104D"><enum>(7)</enum><header>Personal data</header><text>The term <term>personal data</term> has the meaning given the term <term>personal information</term> in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph><paragraph id="H60E54960D32845FDBBD6C9CE70DA9A38"><enum>(8)</enum><header>Personalized recommendation system</header><text>The term <term>personalized recommendation system</term>—</text><subparagraph id="H2A535E791E134E7CB5005FBD359CB732"><enum>(A)</enum><text>means a fully automated system used to suggest, promote, or rank content, including other users, hashtags, and posts, based on the personal data of a user; and</text></subparagraph><subparagraph id="H09FE812F962D46ABBAA79076F5CD4463"><enum>(B)</enum><text>does not include a fully automated system that suggests, promotes, or ranks content based solely on the language, city or town, or age of a user.</text></subparagraph></paragraph><paragraph id="H0484319BB2694B7981286FF6DB088FCE"><enum>(9)</enum><header>Process</header><text>The term <term>process</term> means any operation or set of operations performed, whether by manual or automated means, on personal data or on sets of personal data, such as the collection, use, storage, disclosure, analysis, deletion, or modification of personal data.</text></paragraph><paragraph id="H103B757FFA4B4590AE51A8F787DC406A"><enum>(10)</enum><header>User</header><text>The term <term>user</term> means, with respect to a covered platform, an individual who creates or maintains an account or profile on the covered platform.</text></paragraph><paragraph id="H73BC80740ACE4ED7AE7841D258155CEB"><enum>(11)</enum><header>Verifiable consent</header><text>The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology) by the provider of a covered platform, including a request for authorization for future collection, use, and disclosure described in the notice, to ensure that a parent of a covered minor—</text><subparagraph id="HF61FF4FECCD941189E5A4DCD047219A2"><enum>(A)</enum><text>receives direct notice of the collection, use, maintenance, disclosure, and other relevant processing practices of the provider of a covered platform with respect to personal data; and</text></subparagraph><subparagraph id="H964DBE05B7FB4269AF690095A93C639E"><enum>(B)</enum><text>before the personal data of the covered minor is collected, freely and unambiguously authorizes—</text><clause id="H460706DF5E1C45B28E60198C59CF6408"><enum>(i)</enum><text>the collection, use, maintenance, disclosure, and other relevant processing practices, as applicable, of the personal data; and</text></clause><clause id="H792E771B30EB41CC83696B036CE4B31C"><enum>(ii)</enum><text>any subsequent use of the personal data.</text></clause></subparagraph></paragraph></section><section id="H5D50288355ED4B4995CA8940564FDFC8"><enum>3.</enum><header>Parental consent requirement</header><subsection id="HC4EEA781DFDA4F9BAAB43B348C2E799B"><enum>(a)</enum><header>Prohibition</header><text>A provider of a covered platform may not process the personal data of a covered minor without obtaining the verifiable consent of a parent of the covered minor.</text></subsection><subsection id="HD6B2DC0000B64929B60EFC9292CB683C"><enum>(b)</enum><header>Age determination</header><text>Notwithstanding subsection (a), a provider of a covered platform may process the personal data of a covered minor if—</text><paragraph id="H3C2B53E097C343E08C168DAFD7F55A98"><enum>(1)</enum><text>the provider of the covered platform processes such personal data for the sole purpose of determining the age of a user;</text></paragraph><paragraph id="HB5C5E95616184249A372442B5F847215"><enum>(2)</enum><text>the provider of the covered platform does not retain such personal data any longer than the period strictly necessary to determine the age of the user and deletes such personal data promptly upon determining the age of the user;</text></paragraph><paragraph id="H85E7572FC0D1489FA565FC99723708FA"><enum>(3)</enum><text>prior to processing any personal data for the purpose of determining the age of the user, the provider of the covered platform provides the user with clear and conspicuous notice that such personal data is processed for determining the age of the user;</text></paragraph><paragraph id="H0C9F4641D5834760BE43AAE50ABED946"><enum>(4)</enum><text>the provider of the covered platform employs reasonable administrative, technical, and physical data security practices to protect the confidentiality, integrity, and accessibility of personal data processed for determining the age of the user and such security practices are appropriate to the volume, sensitivity, and nature of such personal data;</text></paragraph><paragraph id="HC16E49FCD32F439EBC1A6356BACD6A54"><enum>(5)</enum><text>the provider of the covered platform reasonably determines that any product, service, method, or third party used for determining the age of the user is likely to provide reasonably accurate results as to the age of the user; and</text></paragraph><paragraph id="H10BC6F8789F34289978FB5C21DF8D880"><enum>(6)</enum><text>in the case that the provider of the covered platform discloses such personal data to a third party to determine the age of the user, the provider of the covered platform takes reasonable steps to determine the third party is capable of maintaining the confidentiality, integrity, and accessibility of such personal data, including by obtaining written assurances that such third party will employ reasonable administrative, technical, and physical data security practices to do so, will not process such personal data for any purpose other than determining the age of the user, and will delete the personal data promptly after determining the age of the user.</text></paragraph></subsection><subsection id="H74DBBAFDBE46430A97CECB2B02A6DEB8" commented="no"><enum>(c)</enum><header>Written confirmation</header><text>Upon obtaining verifiable consent from a parent of a covered minor, the provider of a covered platform shall provide the parent of such covered minor with written or electronic confirmation of the consent and a description of the account and data practices to which it applies.</text></subsection><subsection id="H6D79A5D7F0C04EA6AC000A2F3530A806"><enum>(d)</enum><header>Withdrawal of parental consent</header><paragraph id="H275A82736CD7488CB8555A79803BCB52"><enum>(1)</enum><header>In general</header><text>A parent may withdraw consent for a covered minor at any time through a method that is at least as easy to use as the method by which consent was granted.</text></paragraph><paragraph id="H48F583666988461191BB1ACBF22E6FA5"><enum>(2)</enum><header>Termination required</header><text>Not later than 10 days after withdrawal, the provider of a covered platform shall terminate the covered minor’s account and comply with the deletion obligations of section 5.</text></paragraph></subsection><subsection id="H1AD2A0DBFBBA4E8DB8E3F90224F15060"><enum>(e)</enum><header>Re-Consent</header><text>A provider of a covered platform shall obtain renewed verifiable parental consent upon a material change to the covered platform’s design features or data practices the covered minor’s transition across an age band, if a tiered structure is adopted every 24 months.</text></subsection></section><section id="HF7EE9FFAB1154E63BDB208BA12D34FAF"><enum>4.</enum><header>Right to cure</header><text display-inline="no-display-inline">A provider of a covered platform may not be held liable for a violation of section 3(a) if, within five days of identifying or being notified that a user is a covered minor, the provider—</text><paragraph id="H9293D898D0354E6EA01C4D373B59920E"><enum>(1)</enum><text>promptly deletes all personal data about the covered minor that is processed in connection with the account of the user; or</text></paragraph><paragraph id="H184C027ED0DA4523BE2D29E907059051"><enum>(2)</enum><text>the provider obtains the verifiable consent of a parent of the covered minor.</text></paragraph></section><section id="HA92D6294CB844402B42D539B469DF9CB"><enum>5.</enum><header>Data deletion and portability</header><subsection id="H949B5DF7B0F84B24A433D0429CDA8B46" commented="no"><enum>(a)</enum><header>In general</header><text>Upon termination of a covered minor’s account under this Act, the provider of a covered platform shall delete the personal data of the covered minor, except data the provider of a covered platform is required by law to retain.</text></subsection><subsection id="H65F6E9D9F5DD4FB8971AE20ACD05DD56" commented="no"><enum>(b)</enum><header>Graduation</header><paragraph id="H57DE2813EA244D8F8C4F4F3760C655E4" commented="no"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the provider of a covered platform may not retain the personal data associated with an account of a covered minor after the date on which the covered minor attains the age of 16.</text></paragraph><paragraph id="HF94CB2F5A5A14384811E4C9D59A00E9F" commented="no"><enum>(2)</enum><header>Parental consent</header><text>Paragraph (1) shall not apply if a parent of a covered minor submits to the provider of a covered platform a request to retain the personal data associated with the account of the covered minor after the covered minor attains the age of 16.</text></paragraph></subsection><subsection id="H722FD86910E34A8AA56E27623282EA37" commented="no"><enum>(c)</enum><header>Availability</header><text>The operator shall, for a period of not fewer than 90 days before deletion pursuant to subsection (a) or subsection (b), make available to the parent a means to download the covered minor’s personal data in a portable, machine-readable format.</text></subsection></section><section id="HB5780E916F80429C8C7853C1B2237B91"><enum>6.</enum><header>Rule of construction</header><subsection id="H6A4E7DD84E3B4BF08A5E2F0F935F0BFA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to impose liability on a provider of a covered platform on the basis of—</text><paragraph id="H6B134BD4D0014B818FD257286958592E"><enum>(1)</enum><text>the viewpoint, subject matter, or content of any user-generated content or of the covered platform; or</text></paragraph><paragraph id="HF385A1A4ED8E452282A1DAEC788324F1"><enum>(2)</enum><text>a covered minor’s or provider of a covered platform’s access to, or dissemination of, any particular category of speech.</text></paragraph></subsection><subsection id="HC3769B388C7E40A5A88DF592289B53F5"><enum>(b)</enum><header>Coverage</header><text>Coverage under this Act is determined solely by reference to the structural and design characteristics enumerated in paragraph (4) of section 2.</text></subsection></section><section id="H5B44A9F153A34999ABFCC55CE0E1285E" commented="no"><enum>7.</enum><header>Enforcement</header><subsection id="H78FF81B98E1C4CB59A22463B3129F665" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H298DE65C1A3A44BC92ECF1FBCBF6DF1D" commented="no"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act or a regulation promulgated under this Act shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="HCDEE4C000C8B4C25B7229C2C49FF51D2" commented="no"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this Act and the regulations promulgated under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="H23319A6E8F3441909B916BB9CE20BE61" commented="no"><enum>(b)</enum><header>Actions by States</header><paragraph id="H9E7D83B165F6452B961BAA145AC85A9A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State, or an official or agency of a State, has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by an act or practice in violation of this Act or a regulation promulgated under this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in an appropriate State court or an appropriate district court of the United States to—</text><subparagraph id="H9ADF0812A20C406AAA6F150E0D995B97" commented="no"><enum>(A)</enum><text>enjoin such act or practice;</text></subparagraph><subparagraph id="H29A7DAA62E9E46BC955933B9E58DE6F8" commented="no"><enum>(B)</enum><text>enforce compliance with this Act or such regulation;</text></subparagraph><subparagraph id="H8B66D582DCEE4EDB8D8B4D5553BF7382" commented="no"><enum>(C)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></subparagraph><subparagraph id="H30E8E5AF99C64DE381754B61B39B462E" commented="no"><enum>(D)</enum><text>obtain such other legal and equitable relief as the court may consider to be appropriate.</text></subparagraph></paragraph><paragraph id="H9D3EE21D41AB4488B803AACFD9363DCB" commented="no"><enum>(2)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general of the State involved shall provide to the Federal Trade Commission a written notice of such action and a copy of the complaint for such action. If the attorney general determines that it is not feasible to provide the notice described in this paragraph before the filing of the action, the attorney general shall provide written notice of the action and a copy of the complaint to the Federal Trade Commission immediately upon the filing of the action.</text></paragraph><paragraph id="H4B58076E14E7450CB8802B4A8FF3A687" commented="no"><enum>(3)</enum><header>Authority of Federal Trade Commission</header><subparagraph id="HE591335DAED643E4A512DBF87023F485" commented="no"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (2) of an action under this subsection, the Federal Trade Commission shall have the right—</text><clause id="HBBD91AE4541C4D7FAEEB5C800B489885" commented="no"><enum>(i)</enum><text>to intervene in the action;</text></clause><clause id="HF0BE792653CA400681F90950B05ADA91" commented="no"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></clause><clause id="H77489DFAC17A4F0FB041EDFBC64470B3" commented="no"><enum>(iii)</enum><text>to file petitions for appeal.</text></clause></subparagraph><subparagraph id="HDCC4AEC2572042369E89916F937DCF8D" commented="no"><enum>(B)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Federal Trade Commission or the Attorney General of the United States has instituted a civil action for violation of this Act or a regulation promulgated under this Act (referred to in this subparagraph as the <quote>Federal action</quote>), no State attorney general may bring an action under this subsection during the pendency of the Federal action against any defendant named in the complaint in the Federal action for any violation of this Act or regulation alleged in such complaint.</text></subparagraph></paragraph><paragraph id="HD022076713C44A19BC1EC7341525D0AA" commented="no"><enum>(4)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this subsection, nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of such State to conduct investigations, administer oaths and affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text></paragraph></subsection></section><section id="H8FF10ED16B294B0682A4D94DD7B384E3"><enum>8.</enum><header>Relationship to State laws</header><subsection id="HA2C81A5FCE4941139F87D592C51D2FB7"><enum>(a)</enum><header>In general</header><text>The provisions of this Act shall preempt any law, rule, requirement, or regulation of a State, or a political subdivision of a State, only to the extent that such law, rule, requirement, or regulation conflicts with a provision of this Act.</text></subsection><subsection id="H500965A7466B434BA6DAE9A767345907"><enum>(b)</enum><header>Exception</header><text>Notwithstanding subsection (a), nothing in this Act may be construed—</text><paragraph id="HF928B7DDA5ED48319FA13373AF98A639"><enum>(1)</enum><text>to preempt any law, rule, requirement, or regulation of a State, or political subdivision of a State, with respect to contract, tort, or product liability; or</text></paragraph><paragraph id="H371643213BE94426843FA4DCC238D80A"><enum>(2)</enum><text>to prohibit a State, or a political subdivision of a State, from enacting or enforcing any law, rule, requirement, or regulation that provides greater protection to minors than the protection provided by the provisions of this Act.</text></paragraph></subsection></section><section id="H4F0E971A8FBB4CC3B138807B4E898A39"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the date that is 18 months after the date of the enactment of this Act.</text></section></legis-body></bill>
