synthesis in interstate and foreign commerce, and for other purposes.</official-title></form><legis-body id="H93191665A43B4CB18546170DA33858EC" style="OLC"><section id="HB4B5FAC6CC0347EEB8C9233D6B5FB5BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biosecurity Modernization and Innovation Act</short-title></quote>.</text></section><section id="H980F1308AD3A4A16B06FC0FBC6EF3B8E"><enum>2.</enum><header>Requirements for covered entities with respect to high-risk sequences</header><subsection id="H9E204DCE154B440184F025F2AC4BE2B1"><enum>(a)</enum><header>In general</header><text>A covered entity shall establish a program of reasonable administrative and technical protocols to carry out, with respect to any nucleic acid sequence made available in interstate or foreign commerce by such covered entity, the following requirements:</text><paragraph id="H6E23487AE67140F2A1945C91D193C254"><enum>(1)</enum><text>Verify the identity of any buyer or prospective buyer of such a nucleic acid sequence, including with respect to any such nucleic acid sequence generated by a benchtop nucleic acid synthesizer.</text></paragraph><paragraph id="H348DD99CD38B43FD9CD95D6443652481"><enum>(2)</enum><text>Establish the purpose for which any such buyer or prospective buyer seeks to obtain any such nucleic acid sequence.</text></paragraph><paragraph id="HAB45D5F2B4DD45AE9350D15B77A2CBD8" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Identify whether such a nucleic acid sequence, including any such nucleic acid sequence generated by a benchtop nucleic acid synthesizer, is a covered sequence as determined by the Secretary under paragraph (1)(A) of subsection (e), and on the list established and made available under paragraph (1)(C) of such subsection.</text></paragraph><paragraph id="HC24BA5FD77944EB99791F6AFE421C94E"><enum>(4)</enum><text display-inline="yes-display-inline">Establish risk-based criteria for refusing the sale of a covered sequence to a buyer, prospective buyer, or any combination thereof, and document each instance of refusal by the covered entity in accordance with such criteria.</text></paragraph><paragraph id="H419EF389BD41411A844D0A2EF22F2245" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Provide timely notification to the Secretary if the covered entity has a reasonable belief that such a buyer or prospective buyer is likely to use a covered sequence in a manner that poses a high risk to the national security of the United States or to the security and safety of persons in the United States.</text></paragraph><paragraph id="H6BADB91175564A15BEAA407FB0C39418" commented="no"><enum>(6)</enum><text>Ensure regular independent assessment of compliance by the covered entity with paragraphs (1) through (5) and paragraph (7), including through adversarial testing, third-party certifications, independent internal or external audits, direct examination by the Secretary, or any combination thereof.</text></paragraph><paragraph id="HA850FF48E8E944F08FDF107072049CE8" commented="no"><enum>(7)</enum><text>Maintain records sufficient to demonstrate to the Secretary compliance with the requirements described in paragraphs (1) through (6) for a period of not less than 5 years, as practicable.</text></paragraph></subsection><subsection id="HF063ECD1676B48938ABA3B9910C969D8" display-inline="no-display-inline"><enum>(b)</enum><header>Guidance</header><paragraph id="H9C2AE8750C6E4FFF93F49ACA33C8B1D3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary, in consultation with relevant heads of other Federal departments, agencies, or offices, as appropriate, shall issue guidance that identifies the following:</text><subparagraph id="HB156FDC12BF1424E8FA19A8E1B5B3756" display-inline="no-display-inline"><enum>(A)</enum><text>Approaches, best practices, frameworks, and methods that may be implemented, alone or in combination, by a covered entity to satisfy the requirements under subsection (a).</text></subparagraph><subparagraph id="H537C125FCC4246B39890DE004175B891" commented="no"><enum>(B)</enum><text>How a covered entity may ensure regular independent assessment of compliance as described in paragraph (6) of such subsection.</text></subparagraph><subparagraph id="H9164FAF2E5554D4E926296E050ECE858"><enum>(C)</enum><text>What constitutes a timely notification under paragraph (5) of such subsection, including by when and in what manner a covered entity is required to provide such a notification to the Secretary.</text></subparagraph></paragraph><paragraph id="HD23CCECD1F834AC4AE283E9F504C2C88" commented="no"><enum>(2)</enum><header>Enforcement plan</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall issue guidance relating to the priorities of the Secretary for enforcing the requirements under subsection (a).</text></paragraph><paragraph id="H1FFA4DE84CEA46D28DD258BBDE164657" commented="no"><enum>(3)</enum><header>Process</header><text>Any guidance issued by the Secretary under paragraphs (1) and (2) shall be developed through a covered process.</text></paragraph><paragraph id="H5F4BA2E1033242D69173D4A090152B3A" commented="no"><enum>(4)</enum><header>No conferring of rights or binding effect</header><text display-inline="yes-display-inline">Any guidance issued by the Secretary under paragraphs (1) and (2) may not confer any rights on any person, State, or locality or bind the Secretary or any person recommended in such guidance.</text></paragraph></subsection><subsection id="H2B3BCF27BBBA47189A3126F3326D0DFA"><enum>(c)</enum><header>Notification, coordination, and direct examination</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish a means, using a covered process, for the Secretary to carry out the following:</text><paragraph id="HF547B7A17D43419D887626E0F0DE163B"><enum>(1)</enum><text display-inline="yes-display-inline">Accept a notification provided by a covered entity under paragraph (5) of subsection (a).</text></paragraph><paragraph id="H557C384C2A5B44418605FD5646F908C6" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Facilitate coordination with covered entities and stakeholders to identify a buyer, prospective buyer, or any combination thereof, that has split orders across two or more covered entities with the purpose of obtaining or synthesizing a covered sequence.</text></paragraph><paragraph id="H52CF3C148637424997E87A137F6D801F"><enum>(3)</enum><text display-inline="yes-display-inline">At the request of a covered entity, provide direct examination to carry out the requirement under paragraph (6) of such subsection.</text></paragraph></subsection><subsection id="HE1205B603D0143A7A03213C2906874B5" display-inline="no-display-inline"><enum>(d)</enum><header>Identification of approaches, best practices, frameworks, and methods</header><paragraph id="HB91062D0B5194464BE780D6E2884E2EE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall, in consultation with the relevant heads of other Federal departments, agencies, or offices, as appropriate, regularly consult with stakeholders, including persons from academia and the private sector, to identify the approaches, best practices, frameworks, and methods under subsection (b)(1)(A), including related to the following:</text><subparagraph id="H03DB44BF358E4E239FA6DAF5B4F37828" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Improving the accuracy, efficiency, and reliability of any administrative and technical protocols required under subsection (a), including with respect to the independent assessment requirement under paragraph (6) of such subsection.</text></subparagraph><subparagraph id="H5C25DB5B35BF41BF8CFDDEF154948BA1"><enum>(B)</enum><text display-inline="yes-display-inline">How a covered entity may offer an expedited review process to a previous buyer of such covered entity with respect to which the covered entity has carried out the requirements under paragraphs (1) and (2) of subsection (a).</text></subparagraph><subparagraph id="H7350698EEA08447EA60E55042691CEA0"><enum>(C)</enum><text display-inline="yes-display-inline">How the Secretary and any covered entity may identify nucleic acid sequences with a low potential for misuse.</text></subparagraph><subparagraph id="H484AE2ECBDAB479EB0ED8D1725FC3B07"><enum>(D)</enum><text display-inline="yes-display-inline">How the Secretary and any covered entity may identify nucleic acid sequences, including novel nucleic acid sequences, that may be used in a manner that would pose a high risk to the national security of the United States or to the security and safety of persons in the United States.</text></subparagraph><subparagraph id="H0987D3D80574430191087D65794B3296" commented="no"><enum>(E)</enum><text>Mitigate any risk related to misuse of benchtop nucleic acid synthesizers.</text></subparagraph></paragraph><paragraph id="HAE4D7E4880614EBDA9321FC30514B079" commented="no"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, and annually thereafter for 6 years, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report—</text><subparagraph id="H10819F722E354CD49DB512DE8C7CE556" commented="no"><enum>(A)</enum><text>developed through a covered process; and</text></subparagraph><subparagraph id="H96A772DD751D4674B17091F3F746F506" commented="no"><enum>(B)</enum><text>that includes information related to any approaches, best practices, frameworks, or methods identified under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="H6A7646A8156E43B59C9108C2FEF86C44" display-inline="no-display-inline" commented="no"><enum>(e)</enum><header>Report and recommendations</header><paragraph id="H1DAC93E3D6C0434C93B2AE6CF7A5C027" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, and every 2 years thereafter for 6 years, the Secretary shall publish on a publicly available website a report that includes the following:</text><subparagraph id="HDA226A9273C5406D8C962FFAB3A1C088" commented="no"><enum>(A)</enum><text>An assessment on the following:</text><clause id="H09818DE4661949C4B25238FA4BAA645A" commented="no"><enum>(i)</enum><text>The economic competitiveness of the United States with respect to biotechnology, including the manufacturing of nucleic acids.</text></clause><clause id="H1C22736695D743E59D6A61F5CFA1F7EE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">The ability of the Secretary, covered entities, and any other relevant entity to mitigate any national security risk related to covered sequences manufactured and sold in interstate or foreign commerce.</text></clause></subparagraph><subparagraph id="H3332D9FB76DC4F18ADA0A13EAD9F2B7B" commented="no"><enum>(B)</enum><text>Any legislative recommendation related to the following:</text><clause id="HDF6D7324BF3A4FC19A202207AE02A412" commented="no"><enum>(i)</enum><text>Advancing such competitiveness.</text></clause><clause id="H7E4C6CE0C63E4EF98EE22C36FDE8B968" commented="no"><enum>(ii)</enum><text>Mitigating any such national security risk.</text></clause></subparagraph></paragraph><paragraph id="HB9108AE689E344D9BA6263BD7CF2DDCC" commented="no"><enum>(2)</enum><header>Public consultation</header><text>In carrying out paragraph (1), the Secretary shall use a covered process.</text></paragraph><paragraph id="H0D62F988C0C149E6AF873D742B79BA54" commented="no"><enum>(3)</enum><header>Congressional notification</header><text>Prior to publishing a report under paragraph (1), the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate such report.</text></paragraph></subsection><subsection id="H4DBB4395BF7F441D8072EFEB68BD47C4" display-inline="no-display-inline" commented="no"><enum>(f)</enum><header>Covered sequence list</header><paragraph id="H27C3167D8EA34B0A82F567EE993B627D" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and regularly thereafter, the Secretary, in consultation with the relevant heads of other Federal departments, agencies, or offices, as appropriate, shall carry out the following:</text><subparagraph id="H5D6118204E794BCB848F8B941BECFD33" commented="no"><enum>(A)</enum><text>A determination of whether a nucleic acid sequence is a covered sequence.</text></subparagraph><subparagraph id="H9F003A3FB36D4036951DD68BF45395ED" commented="no"><enum>(B)</enum><text>If the Secretary makes a determination that a nucleic acid sequence is a covered sequence, make available to covered entities a statement that explains the basis for such determination, including any basis specified in paragraph (2), as applicable.</text></subparagraph><subparagraph id="H4E0E0D2A687648DDACE18FCE331963EA" commented="no"><enum>(C)</enum><text>Establish and make available to covered entities a list that includes any such covered sequence.</text></subparagraph><subparagraph id="H4A63D072F323467F8EDE0BA7B133C4AF"><enum>(D)</enum><text display-inline="yes-display-inline">Establish a procedure to make any such statement and such list available to stakeholders in a manner that does not pose an unacceptable risk to the national security of the United States or the security and safety of United States persons.</text></subparagraph></paragraph><paragraph id="H9189C18744344CE29D720AA9F30B649D" commented="no"><enum>(2)</enum><header>Basis</header><text>A determination under paragraph (1)(A) shall be based on one or more of the following:</text><subparagraph id="H66F648A2B6F5469BBA28219D7C84293A" commented="no"><enum>(A)</enum><text>An assessment by the head of any other Federal agency, including a relevant national security agency or public health agency.</text></subparagraph><subparagraph id="HF695B7700AE049748F78F89FC3F5C291" commented="no"><enum>(B)</enum><text>A submission by a member of the public or a covered entity under paragraph (3)(A).</text></subparagraph><subparagraph id="H0B1DE13E083D4FAF9EDD86E24CF7245D" commented="no"><enum>(C)</enum><text>A determination by the Secretary that a nucleic acid sequence poses an imminent or high likelihood of use in such a manner that it poses an unacceptable risk to the national security of the United States or the security and safety of United States persons.</text></subparagraph></paragraph><paragraph id="HF774DE23B94242AD8EBC147AFCAB7E9F" display-inline="no-display-inline" commented="no"><enum>(3)</enum><header>Updates</header><subparagraph id="HE97F544B20E94AE7BE6DC7A673B6B644"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall update, as the Secretary determines appropriate, any list established and made available to covered entities under subparagraph (C) of paragraph (1), and any statement or list made available to stakeholders pursuant to the procedure established under subparagraph (D) of such paragraph, including in response to a novel nucleic acid sequence.</text></subparagraph><subparagraph id="H74DB1DB38608491FA9DC604AFF0CCD1C" commented="no"><enum>(B)</enum><header>Submission process</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall, through a covered process, establish a process for the following:</text><clause id="H882AEBAEEAD0400F9E1225959076379F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">A member of the public to submit to the Secretary a recommendation related to adding a nucleic acid sequence to, removing a covered sequence from, or otherwise modifying any list established and made available to covered entities under subparagraph (C) of paragraph (1), and any statement or list made available to stakeholders pursuant to the procedure established under subparagraph (D) of such paragraph.</text></clause><clause id="H1ADEFF7B702144959A04FCF09CD29001" commented="no"><enum>(ii)</enum><text>A covered entity to carry out the following:</text><subclause id="H496E10F823664C49AEAA8D32017AC602" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">Submit to the Secretary a request for the Secretary to review the inclusion of a covered sequence in any list established and made available to covered entities under subparagraph (C) of paragraph (1), and any statement or list made available to stakeholders pursuant to the procedure established under subparagraph (D) of such paragraph, to remove the covered sequence from, or otherwise modify, such list or statement.</text></subclause><subclause id="H95F5F635B6B445FD8452B5CDF82D8B9D" commented="no"><enum>(II)</enum><text>Submit evidence to the Secretary related to such request.</text></subclause></clause></subparagraph><subparagraph id="H10FD1F6E94AA459998ABB24E367B8820" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Confidentiality</header><text>Any information related to a recommendation, request, or evidence submitted pursuant to the process established under subparagraph (B) shall be treated as a trade secret and commercial or financial information, and shall be exempt from disclosure, under section 552(b)(4) of title 5, United States Code.</text></subparagraph><subparagraph id="H949A06213E0F44D4A94D58E8945C0FC6" commented="no"><enum>(D)</enum><header>Option to request nondisclosure</header><text display-inline="yes-display-inline">In carrying out subparagraph (B), the Secretary shall offer any member of the public or covered entity that utilizes the process established under such subparagraph the ability to request that any information related to a recommendation, request, or evidence submitted pursuant to such process is not published or disclosed in any identifiable form, including any publication or disclosure of any such information that would allow the identity of the member of the public or covered entity to be reasonably inferred.</text></subparagraph></paragraph><paragraph id="HBF98F7D71030465FB3DACBA4D3D2F86E" commented="no"><enum>(4)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">With respect to any list established and made available to covered entities under subparagraph (C) of paragraph (1), and any statement or list made available to stakeholders pursuant to the procedure established under subparagraph (D) of such paragraph, the Secretary shall—</text><subparagraph id="HD7549465A3E54C47894352E33F11EB69" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">at least 5 days before establishing and making available such a list under such paragraph, or adding a nucleic acid sequence to, removing a covered sequence from, or otherwise modifying such list, submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate such list; and</text></subparagraph><subparagraph id="H1A8B33A39C8D41C281D55CD978763AE9" commented="no"><enum>(B)</enum><text>provide to such committees a briefing related to such list, upon request by such committees.</text></subparagraph></paragraph></subsection><subsection id="HF8B90C47CBB14902845831CB6D59E535"><enum>(g)</enum><header>Enforcement</header><paragraph id="HA233939133EC4D5A914CBFACCB63B423" commented="no"><enum>(1)</enum><header>Authority</header><text>The Secretary shall have the authority to carry out any of the following to enforce subsection (a):</text><subparagraph id="H95CE3A9FEBAB4603868C55644D88FB82" commented="no"><enum>(A)</enum><text>Require, inspect, and compel the provision of any physical and electronic records and any other information from such covered entity.</text></subparagraph><subparagraph id="HB6F6F37B4B5D4A30B001ABC13505DC05" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Administer oaths or affirmations and require any person to appear and testify or to appear and produce any such record or other information by subpoena.</text></subparagraph><subparagraph id="H300567F017C7408B884AAB76CFDC8D0D" commented="no"><enum>(C)</enum><text>Conduct investigations within the United States and outside the United States.</text></subparagraph></paragraph><paragraph id="H11FB56C6E74B446A9772172EF068E102" display-inline="no-display-inline"><enum>(2)</enum><header>Civil actions</header><subparagraph id="H4BE3F8C5AA764E70B70C748C542FA0D7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may commence a civil action against a covered entity for a violation of subsection (a) in any district court of the United States for appropriate relief, including—</text><clause id="HB205FEA2C1E945158D195C3E33A4EA9E"><enum>(i)</enum><text display-inline="yes-display-inline">the penalty described under subparagraph (B); or</text></clause><clause id="H3A5B3C0E7A034DAB98EB36F207C5F2F5"><enum>(ii)</enum><text>an injunction.</text></clause></subparagraph><subparagraph id="H3427D3D45F234867B85CB3275AD53E5F"><enum>(B)</enum><header>Penalty</header><text display-inline="yes-display-inline">The penalty for a violation of subsection (a) may not exceed $750,000 per violation (as adjusted on January 1 each year by the percentage increase, if applicable, in the consumer price index for all urban consumers published by the Bureau of Labor Statistics with respect to the 12-month period preceding the date of such adjustment).</text></subparagraph><subparagraph id="H0104BFAED7A6443EADEBB2304BA83D6B"><enum>(C)</enum><header>Right to cure</header><clause id="H5B01ABA1FDD24EFFA037402F6BE3F429"><enum>(i)</enum><header>In general</header><text>The Secretary may initiate a civil action under subparagraph (A) only if—</text><subclause id="HB07ABF4F66C34DBFB4925E2584208FF9"><enum>(I)</enum><text>the Secretary has provided to the relevant covered entity a written notice that describes the alleged violation and identifies the provision under subsection (a) related to such alleged violation; and</text></subclause><subclause id="H1DF4F7244E504537A0F791D9C8D096A0"><enum>(II)</enum><text>at least 30 days have passed since the date on which such written notice was so provided.</text></subclause></clause><clause id="HEC5A0279839E4735B110271C8947A68F"><enum>(ii)</enum><header>Effect of cure</header><text>If a covered entity that receives a written notice under clause (i)(I) cures the alleged violation described in such notice not later than 30 days after the date on which such covered entity was provided such notice, the Secretary shall consider the requirements under subsection (a) as satisfied with respect to such covered entity.</text></clause><clause id="H600DCD79F75F41A393DB927FF920AAA9"><enum>(iii)</enum><header>Failure to cure</header><text>After carrying out clause (i), the Secretary may initiate an action under subparagraph (A)—</text><subclause id="H2AB6B109D9EC4D6A884E3A7E3BAAF354"><enum>(I)</enum><text>if the relevant covered entity fails to cure the alleged violation described in the written notice provided pursuant to clause (i)(I); or</text></subclause><subclause id="HC9DFE6C8A24840B387061691464D04F0" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">if, after the curing the alleged violation as specified in clause (ii), the covered entity violates the relevant provision under subsection (a) again.</text></subclause></clause></subparagraph></paragraph><paragraph id="HAECACBE6C4C64FDBB0F17D8F53290B95"><enum>(3)</enum><header>Relation to guidance</header><text display-inline="yes-display-inline">The Secretary may not commence a civil action under paragraph (2) solely on the basis that a covered entity has carried out the requirements under subsection (a) in a manner that is inconsistent with any guidance issued under subsection (b)(1).</text></paragraph></subsection><subsection id="H5E21F6BCC75C4399A045C6851F9D67E8"><enum>(h)</enum><header>Relationship with other Federal guidelines and recommendations</header><text display-inline="yes-display-inline">The requirements in subsection (a) shall supersede any Federal guideline or recommendation related to the screening of nucleic acid sequences made available in interstate or foreign commerce if such guideline or recommendation is voluntary and in effect before the date of the enactment of this Act.</text></subsection><subsection id="HB5B5D9F1D69C47E8BD31E21AC0527A63"><enum>(i)</enum><header>Preemption</header><paragraph id="HE7E9C936B1D24F1FA6A4EA0FDDAAF539"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No State or political subdivision of a State may prescribe, maintain, or enforce any law, rule, regulation, requirement, standard, or other provision having the force and effect of law to the extent such law, rule, regulation, requirement, standard, or other provision is covered by a requirement under subsection (a).</text></paragraph><paragraph id="H136194874EC84BA2859747E58B8CF6E5" commented="no"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), nothing in this Act may be construed to preempt any law, rule, requirement, or regulation of a State, or political subdivision of a State, with respect to any of the following:</text><subparagraph id="H6B36A47618214A74BED20374E33DA7A6" commented="no"><enum>(A)</enum><text>Contract, tort, or product liability.</text></subparagraph><subparagraph id="HCA3323F5290240E9ACECBD25F1C0FB0D" commented="no"><enum>(B)</enum><text>Consumer protection, data privacy, or data security.</text></subparagraph><subparagraph id="HB3A7A11443964248BE08188F316C81DD" commented="no"><enum>(C)</enum><text>Any such generally applicable law, rule, requirement, or regulation of a State, or a political subdivision of a State, as it relates to public health.</text></subparagraph><subparagraph id="H17279097557541D0B93E10FECFB4D289" commented="no"><enum>(D)</enum><text>The procurement or use of nucleic acids or nucleic acid sequences by a State or a political subdivision of a State.</text></subparagraph></paragraph></subsection><subsection id="H4015FBDFBF3042C1A525D8852AB36104" commented="no"><enum>(j)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to prohibit a covered entity from synthesizing a nucleic acid sequence or prohibit a covered entity from producing equipment for synthesizing a nucleic acid, including a benchtop nucleic acid synthesizer.</text></subsection><subsection id="H16368AC90ECC484EBB0D7DD1A0A1CA27"><enum>(k)</enum><header>Effective date</header><text>The requirement under subsection (a) shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection><subsection id="HADC06BF0C354452DBD14F7FEEB913670"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7BF7F43C0E88484F9C314236EB92BB29" commented="no"><enum>(1)</enum><header>Benchtop nucleic acid synthesizer</header><text>The term <term>benchtop nucleic acid synthesizer</term> means a product, device, or integrated system in interstate or foreign commerce that is—</text><subparagraph id="HE5DEE53CE9FC4AA483E0370B7122FAF8" commented="no"><enum>(A)</enum><text>capable of generating de novo a nucleic acid sequence—</text><clause id="H9BE27A0ABBF0466EA0461D5F34885692" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">at the direction of an end user of such product, device, or system; or</text></clause><clause id="H0355A728DB1C412087CD9C37E61F5105" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">without requiring an end user of such product, device, or system to submit to another covered entity an order to perform the generation of such nucleic acid sequence; and</text></clause></subparagraph><subparagraph id="H7288A685A6E449FEA4338B762AF04423" commented="no"><enum>(B)</enum><text>intended for distribution to, or use by, end users other than the developer of the product, device, or system, regardless of the physical dimensions of such product, device, or system.</text></subparagraph></paragraph><paragraph id="H971DDB3389DB4047ABB043C5EB1A0171"><enum>(2)</enum><header>Covered entity</header><subparagraph id="HCCE6AA943582443F8DB88508DBD9F607"><enum>(A)</enum><header>In general</header><text>The term <term>covered entity</term> means a person operating in interstate or foreign commerce who—</text><clause id="HA3152D55E0FD4DC8BD00F32FA19A7D7D"><enum>(i)</enum><text>synthesizes and sells nucleic acids to a person in the United States or in a foreign country; or</text></clause><clause id="H814561E86E7B4B44AC56E0C2F3442ADB"><enum>(ii)</enum><text>produces, distributes, sells, or resells equipment for synthesizing nucleic acids, including a benchtop nucleic acid synthesizer, to persons in the United States or in a foreign country.</text></clause></subparagraph><subparagraph id="H107758B76CB54A0C82728D22587C9DD9"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) does not apply to the extent a person produces, distributes, sells, or resells synthetic acids within a commercial entity solely for the internal use of such commercial entity.</text></subparagraph></paragraph><paragraph id="HE1CAA12A5DE64DEDA27763012FEE5C7C" commented="no"><enum>(3)</enum><header>Covered process</header><text display-inline="yes-display-inline">The term <quote>covered process</quote> means, with respect to the implementation of a requirement under this section, a process by which the Secretary—</text><subparagraph id="H0FC46F9A6F2C4AAE8EEBC04A7675E1ED" commented="no"><enum>(A)</enum><text>publishes in the Federal Register a request for public feedback on the matters described in such provision;</text></subparagraph><subparagraph id="H93B69A0D252541E9ABC3A92D1E91AB68" commented="no"><enum>(B)</enum><text>provides the public with an opportunity to comment on the matters described in subparagraph (A) for a period of not less than 60 days;</text></subparagraph><subparagraph id="H2729C515CC664D6FA0E8116CB1C87457" commented="no"><enum>(C)</enum><text>ensures that public comments made under subparagraph (B) that are not marked confidential are available for public inspection; and</text></subparagraph><subparagraph id="H7D142D2AF1B845F890595AEB9AF1CCBC" commented="no"><enum>(D)</enum><text>demonstrates consideration of any such public comments with respect to such implementation.</text></subparagraph></paragraph><paragraph id="H3466880F5D6247248654576DCDF0E3CF" commented="no"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Office of the Secretary.</text></paragraph></subsection></section></legis-body></bill>
