<section id="H507B9524D0534EB39950FCD6C9D2796A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Predator Dumping Act</short-title></quote>.</text></section> <section id="HDE8ECCCC1B3F409FB6A8A7C97C3827AF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="HC2213EEB4D8B4F13B31B8D884228FBBD"><enum>(1)</enum><header>County governing district</header><text>The term <quote>county governing district</quote> means any ward, district, or geographic area represented by a member of the governing body of a county.</text></paragraph> <paragraph id="H98A3EB62B6684B77B73148DCF2A48172"><enum>(2)</enum><header>County subdivision</header><text>The term <quote>county subdivision</quote> means a subdivision of a county, as delineated by the Bureau of the Census for purposes of the most recent decennial census, including any minor civil division or census county division so delineated, or, in the case of a county not so subdivided, the county itself.</text></paragraph>
<paragraph id="H718D82BB89994806996BBAB0D6629BD5"><enum>(3)</enum><header>Covered individual</header><text>The term <quote>covered individual</quote> means an individual who has been conditionally released to a residence in the community, pursuant to the law of a covered State, following civil commitment as a sexually violent predator, sexually dangerous person, or comparable designation under such law.</text></paragraph> <paragraph id="H57D746E73D8B42FF8AB7284ED89691D1"><enum>(4)</enum><header>Covered state</header><text>The term <quote>covered State</quote> means a State that has in effect a statute providing for the civil commitment, and subsequent conditional release, of sexually violent predators.</text></paragraph></section>
<section id="HC1A8C2C8B45B49E3A7F385C65576E26F"><enum>3.</enum><header>National placement framework</header>
<subsection id="H800D1587C4194A95822F8CF40B27FC06"><enum>(a)</enum><header>In general</header><text>Each covered State shall establish and enforce a placement framework for covered individuals that satisfies the following requirements:</text> <paragraph id="HE5F5ACB213404B6396F3DEA20AA4F3E4"><enum>(1)</enum><header>Distance requirement</header><text>A covered individual may not be placed at a residence located within a 10-mile radius of the residence of any other covered individual, at the same time;</text></paragraph>
<paragraph id="H7887AE4F667C4B4381A3ACB17DCFB152">
                    <enum>(2)</enum>
                    <header>Sequential placement</header>
 <text>A covered State may not place a covered individual in a county subdivision if there is any other county subdivision within the same county that currently contains a fewer number of covered individuals; and</text>
                </paragraph>
<paragraph id="H901CAC6540A349AFAC6AA96B03458115"><enum>(3)</enum><header>Large county cap</header><text>In a county with a total population exceeding 1,000,000, a covered State may not place a covered individual in a county subdivision or county governing district if such placement would result in that subdivision or district containing more than 25 percent of the total covered individuals placed within that county.</text></paragraph></subsection></section> <section id="HD0CB440570D14C0A8BC6D2B9F667D747"><enum>4.</enum><header>Department of justice study and best practices</header> <subsection id="H89F9A9D97E644FE2802A933A795DDFFE"><enum>(a)</enum><header>Study</header><text>Not later than 60 days after the date of enactment of this Act, the Attorney General shall initiate a comprehensive study on the geographic placement of covered individuals within covered States upon their conditional release.</text></subsection>
<subsection id="H9967A6D10E6A486E8068856B656F502E"><enum>(b)</enum><header>Matters included</header><text>The study conducted under subsection (a) shall examine—</text> <paragraph id="H5880A361DDDC481AA4EA7E44AF6B2168"><enum>(1)</enum><text>the demographic and geographic distribution of placed covered individuals;</text></paragraph>
<paragraph id="H58928107BC0C4F82B5F47A1564E0B58B"><enum>(2)</enum><text>the extent to which certain county subdivisions, particularly rural communities or specific regions such as the Antelope Valley in California, bear a disproportionate burden of placements; and</text></paragraph> <paragraph id="HCCFBA546B8FE4A3488824DF7766CA505"><enum>(3)</enum><text>the systemic factors that lead to the repeated placement or concentration of covered individuals in specific county subdivisions.</text></paragraph></subsection>
<subsection id="HE025DB35DB0B4E6FBA3E4EF5B7FEB243"><enum>(c)</enum><header>Best practices and promulgation</header><text>Not later than 1 year after the date of enactment of this Act, the Attorney General shall—</text> <paragraph id="HDBE5A03AD72347EE83F5814783BB349C"><enum>(1)</enum><text>compile best practices for the equitable geographic distribution of covered individuals to prevent the disproportionate concentration of such individuals in any single county subdivision; and</text></paragraph>
<paragraph id="H2563A06069734DF088777484C2CBD840">
          <enum>(2)</enum>
 <text>promulgate and distribute these best practices to the relevant State agencies of all States.</text>
        </paragraph></subsection></section>
<section id="H4F20D63C39A348D6A0B8F257DDCE35B4"><enum>5.</enum><header>Svp best practices implementation grant program</header>
<subsection id="H742F9DC52BDF40C4B743B5F1FBD47921"><enum>(a)</enum><header>Authorization of grants</header><text>The Attorney General is authorized to award grants to States to assist in the implementation and administration of the best practices compiled and promulgated by the Attorney General under section 4(c).</text></subsection> <subsection id="H4BA57DC1CD944A59B92A8C7EC8F8AAB5"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, a State shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require, including a certification that the State is actively adopting and integrating the equitable geographic distribution best practices described in section 4(c).</text></subsection>
<subsection id="H1C5EFCDD5B5447DC883B19A6EBD6B51E">
        <enum>(c)</enum>
        <header>Use of funds</header>
 <text>A State receiving a grant under this section shall use the grant funds to implement, monitor, and enforce State-level policies that align with the best practices promulgated under section 4(c), and for other related administrative or operational costs as determined appropriate by the State.</text>
      </subsection>
<subsection id="HADAF0CE33671438F804B52D0D05453FA"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General to carry out this section such sums as may be necessary.</text></subsection></section> </legis-body> </bill>
