the Committee on Education and Workforce

A BILL
To amend the General Education Provisions Act to require certain local
educational agencies to notify parents before distributing or
disseminating information about abortion or abortion-related services
to students, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``School Health and Instructional
Environment Limits and Disclosure Act'' or the ``SHIELD Act''.
SEC. 2. RESTRICTIONS ON DISTRIBUTING INFORMATION ABOUT ABORTION AT
SCHOOLS.
Section 445(c) of the General Education Provisions Act (20 U.S.C.
1232h(c)) is amended--
(1) in paragraph (2)(C), by adding at the end the
following:
``(iv) Activities involving the
distribution or dissemination of information
about abortion or abortion-related services to
students.'';
(2) by redesignating paragraphs (5) and (6) as paragraphs
(6) and (7), respectively;
(3) by inserting after paragraph (4) the following:
``(5) Prohibition on certain organizations distributing
abortion-related information.--A local educational agency that
receives funds under any applicable program may not allow any
organization that provides abortions (or a subsidiary of such
an organization), including an abortion service provider, to
distribute or disseminate information about abortion or
abortion-related services to students on school grounds or a
virtual platform of the local educational agency (including
sharing or reposting such information on behalf of such outside
organization on social media).''; and
(4) in paragraph (7), as so redesignated, by adding at the
end the following:
``(H) Abortion-related service.--The term
`abortion-related service' means any medical, surgical,
or support care directly related to terminating the
pregnancy of a woman.''.
