<official-title display="yes">To repeal section 338 of the Tariff Act of 1930 and nullify certain Presidential proclamations imposing a tariff or other duty pursuant to such section, and for other purposes.</official-title>

<section id="H1A47295183D14FBF9461A19CA888E2EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banning Antiquated Duties and Delivering Equitable American Levies (BAD DEAL) Act of 2026</short-title></quote>.</text></section> <section id="H1129BA60138F45E2B78C334C9554BD00"><enum>2.</enum><header>Repeal of authorities relating to trade discrimination by foreign countries; nullification of certain Presidential proclamations</header> <subsection id="H8FF4108FA9084446AE995D5083B45214"><enum>(a)</enum><header>In general</header><text>Section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>) is hereby repealed and any Presidential proclamation promulgated in whole or in part pursuant to such section shall have no force or effect.</text></subsection>
<subsection id="H3CE4570CB15D4B4588D5AED9B50BACD4"><enum>(b)</enum><header>Retroactive application</header><text>The President shall take such actions as may be necessary to provide for the refund of each tariff or other duty imposed and collected before, on, or after the date of the enactment of this Act by reason of the implementation of a Presidential proclamation or other action promulgated in whole or in part pursuant to section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>).</text></subsection></section> </legis-body> </bill>
