which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to limit the enforcement of foreign censorship judgments, and for other purposes.</official-title></form><legis-body id="H3905FD9417E1420693B53D186B96A191" style="OLC"><section id="HE404F1C2EF9045F8A543E640D9291F64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteeing Rights Against Novel International Tyranny and Extortion Act</short-title></quote> or the <quote><short-title>GRANITE Act</short-title></quote>.</text></section><section id="H8860859AA05546719293DE67B2F59D04"><enum>2.</enum><header>Limitation on enforcement of foreign censorship judgments</header><subsection id="H0FD0CE40971540769FE0F96651140C9E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/181">Chapter 181</external-xref> of title 28, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HB2EF8CF6FD18442A8E26B1315ECF25ED" display-inline="no-display-inline"><section id="H051628502C574E408E2EE949C1D8745D"><enum>4106.</enum><header>Limitation on enforcement of foreign censorship judgments</header><subsection id="H2401620BF3504358BC7BAEC774596F59"><enum>(a)</enum><header>Limitation on enforcement</header><text display-inline="yes-display-inline">Notwithstanding any other provision of Federal or State law, a domestic court shall not recognize or enforce a foreign judgment, or a fine, order, or demand issued by a foreign court or a foreign state, enforcing a foreign censorship law. </text></subsection><subsection id="H191121470FCE4268A4B67ED14ED1391B"><enum>(b)</enum><header>Right of action</header><text display-inline="yes-display-inline">A United States person against whom a foreign judgment described in subsection (a) is entered, or upon whom a judgment, fine, order, or demand described in subsection (a) is served or purportedly served, may bring an action in an appropriate district court of the United States seeking declaratory relief that such judgment, fine, order, or demand is unenforceable under subsection (a). </text></subsection><subsection id="H8C30C9ACF22D48E8A0197BA35E9A2282"><enum>(c)</enum><header>Definition</header><text>In this section:</text><paragraph id="H417E3DCF62234A33B4FA7F517DFCF3C3"><enum>(1)</enum><text>The term <term>foreign censorship law</term> means any law of a foreign state that—</text><subparagraph id="H26F77DE03DC9498EB4F7CC78DA9223C9"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H670AE67E720A4C2887C19FC9E8FF818B"><enum>(i)</enum><text>has the primary purpose or substantial effect of restricting or penalizing expression, expressive conduct, or expressive association; </text></clause><clause id="HCF8F6BBA365B4D9DB883E70DAA3F6BDD"><enum>(ii)</enum><text>targets expression, expressive conduct, or expressive association based on its content, viewpoint, or speaker identity; or</text></clause><clause id="HBEBB7571196943A9AA4DC46CB70F11E4"><enum>(iii)</enum><text>compels disclosure that would reasonably chill that expression, expressive conduct, or expressive association; and</text></clause></subparagraph><subparagraph id="H3BDEB12E35534DCABB90ACC647AAEB19"><enum>(B)</enum><text>would conflict with the protections of the First Amendment of the United States Constitution if recognized in the United States.</text></subparagraph></paragraph><paragraph id="HDAF3FFFB19944D6A9B771B605C32C335"><enum>(2)</enum><text>The term <term>foreign state</term> has the meaning given such term in section 1603. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD28148454FD2446F8096C603A2065D64"><enum>(b)</enum><header>No sovereign immunity</header><text>Section 1605(a) of title 28, United States Code, is amended—</text><paragraph id="H604F0BB8B14D4238A568E65898AA119B"><enum>(1)</enum><text>in paragraph (5), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HE445960CBC334890866AA5EC402FD585"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H05D4A8234AEE499EA6C6859295FC3468"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H451341B95CEF48728A9385CD275EAE81" display-inline="no-display-inline"><paragraph id="H360753B7F7214ED2AB93462E8A95C286"><enum>(7)</enum><text display-inline="yes-display-inline">under section 4106. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H17A961A2ED4545679FF64377C4C6434C"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/181">Chapter 181</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/4105">section 4105</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDDFFDDDA0AD8406AAC9C0CDE8B3B31C0"><toc regeneration="no-regeneration"><toc-entry level="section">4106.
