which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Commerce to promote trusted quantum supply chains and the commercial leadership of the United States with respect to quantum technology, and for other purposes.</official-title></form><legis-body id="HF7C7AF941A0444519162BB3E6B3CF618" style="OLC"><section id="HA0C3E2C4CCA04D339BC1B915F3A27A6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Quantum Competitiveness Act</short-title></quote>.</text></section><section id="H6B5663523B264AF1B9792790C81CCE2F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF244FF5C7B744C3DA4774D1C6D15939C"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> has the meaning given that term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HB3FDAEAEF56244B2BCC5052C644434B1"><enum>(2)</enum><header>Covered nation</header><text display-inline="yes-display-inline">The term <quote>covered nation</quote> has the meaning given that term in section 4872(f) of title 10, United States Code.</text></paragraph><paragraph id="H04E7D452851D4C93871E81596124172E"><enum>(3)</enum><header>Critical component</header><text display-inline="yes-display-inline">The term <quote>critical component</quote> means any commodity, material, product, hardware, software, or input in foreign or interstate commerce relating to quantum technology necessary for—</text><subparagraph id="H96226B0678AC4DE394EC72AFCF468D91" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">commercial manufacturing, establishment, deployment, use, or scaling of quantum technology; or</text></subparagraph><subparagraph id="H8C0C3BB2F1AB4D4997F9946220DBDC76" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the commercial leadership of the United States in the commercial establishment and deployment of quantum technology.</text></subparagraph></paragraph><paragraph id="H2C853029BA8C45A6812170EF4F17A685"><enum>(4)</enum><header>Quantum information science</header><text>The term <quote>quantum information science</quote> means the use of the law of quantum physics for the storage, transmission, manipulation, computing, or measurement of information.</text></paragraph><paragraph id="HBF4F6120B762461EA6DD2D1CE6278BDC"><enum>(5)</enum><header>Quantum technology</header><text>The term <quote>quantum technology</quote> means the application of quantum information science in interstate or foreign commerce.</text></paragraph><paragraph id="H29BD1830484F4454A72E2CCD307EC998"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph><paragraph id="HC301B987F0F3428F956EBB265C7F2E1F"><enum>(7)</enum><header>Trusted foreign partner</header><text display-inline="yes-display-inline">The term <quote>trusted foreign partner</quote> means—</text><subparagraph id="HA5074AC3CC59453D9CE10C45FF6367C3"><enum>(A)</enum><text>the European Union; or</text></subparagraph><subparagraph id="H1488A97007CC4FA1AC6EA0230EEE8575"><enum>(B)</enum><text>a foreign country that—</text><clause id="HD031D244C4F24F23864FEF6A04825F32"><enum>(i)</enum><text>is not a covered nation; and</text></clause><clause id="H143796B506CD472F8FF19AE4B51B1D1B"><enum>(ii)</enum><text>is a member of—</text><subclause id="H590FFFF777A540B8AFA631C25B2E9AD7" commented="no"><enum>(I)</enum><text>the North Atlantic Treaty Organization;</text></subclause><subclause id="HDAFBF8ED9D9D4C1CB98B49D8F6B69AF5" commented="no"><enum>(II)</enum><text>the European Union; or</text></subclause><subclause id="HD0F003892BD94EDF86B8494F2F2C32C5" commented="no"><enum>(III)</enum><text>the Organisation for Economic Co-operation and Development.</text></subclause></clause></subparagraph></paragraph><paragraph id="HCA85897AEBD1429AA94D45A0014785B0"><enum>(8)</enum><header>Trusted quantum supply chain</header><text display-inline="yes-display-inline">The term <quote>trusted quantum supply chain</quote>, with respect to quantum technology, means the sourcing of any critical component from the United States or a trusted supplier, whether in interstate or foreign commerce.</text></paragraph><paragraph id="H138E7C9D15AC423EAD5389B99241FCEC"><enum>(9)</enum><header>Trusted supplier</header><text display-inline="yes-display-inline">The term <quote>trusted supplier</quote> means an entity that—</text><subparagraph id="H05471A2C826F4DC4894AD6E0F07BFB83" display-inline="no-display-inline"><enum>(A)</enum><text>is domiciled in the United States or in a trusted foreign partner;</text></subparagraph><subparagraph id="HE9B73DB93A614749A687B18226AB3F86"><enum>(B)</enum><text>is headquartered in the United States or in a trusted foreign partner;</text></subparagraph><subparagraph id="H522E6F53B72A4A678EB21BC6A3A3C9EE"><enum>(C)</enum><text display-inline="yes-display-inline">has the principal place of business of the entity in the United States or in a trusted foreign partner; and</text></subparagraph><subparagraph id="HF7C18BBDC672457B838BB5096C554FF0"><enum>(D)</enum><text>is organized under the laws of the United States or in a trusted foreign partner.</text></subparagraph></paragraph></section><section id="H257456E62A024CDF9C5E2424C381C6FB"><enum>3.</enum><header>Promoting commercial leadership on quantum technology and trusted quantum supply chains</header><text display-inline="no-display-inline">The Secretary shall carry out the following:</text><paragraph id="H2B970F2A238049FDBD3E1715F8B4FA39"><enum>(1)</enum><text>Serve as the principal advisor to the President for policy related to the following:</text><subparagraph id="H53807DC1AB084D97BE9D9B81DEA808B9"><enum>(A)</enum><text>The commercial manufacturing, establishment, deployment, use, and scaling of quantum technology.</text></subparagraph><subparagraph id="H1664FA9FF71C4EC88830906BDF2764A9" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The supply of any critical component, including with respect to the availability of any such component.</text></subparagraph><subparagraph id="HF4856BF533C845BCA688480E2F1B4C6D"><enum>(C)</enum><text>The establishment, maintenance, and resiliency of any trusted quantum supply chain.</text></subparagraph></paragraph><paragraph id="H2A008DDC41444B76B6D4AE675B996A08"><enum>(2)</enum><text>Carry out any action as appropriate to support the commercial leadership of the United States with respect to quantum technology and any critical component, including the following:</text><subparagraph id="H993B64D80E2744BAA93A85739D334C5F"><enum>(A)</enum><text display-inline="yes-display-inline">Supporting the commercial manufacturing, establishment, deployment, use, or scaling of quantum technology.</text></subparagraph><subparagraph id="H2C1736D9DF93439099D2F232B1DAD8A4"><enum>(B)</enum><text>Promoting investment by private sector entities in the commercial manufacturing, establishment, deployment, use, or scaling of quantum technology in the United States.</text></subparagraph><subparagraph id="H50E4D32A973C4FA5BB93E38FC0FD0443"><enum>(C)</enum><text>Entering into an agreement with any of the following:</text><clause id="HD15540892625450991A2F4B6EDA6D625"><enum>(i)</enum><text>A trusted supplier.</text></clause><clause id="HF81AF55AAB4F4B138698715509B8220A"><enum>(ii)</enum><text>A trusted foreign partner.</text></clause><clause id="H8125CD615B0D48A2B1BCD8EA61A16122"><enum>(iii)</enum><text>An agency.</text></clause><clause id="H48409F9C74E34BD1952107B1950AA457"><enum>(iv)</enum><text>A State, or agency thereof.</text></clause><clause id="H7FE835C640674D099E93FE7955771E93"><enum>(v)</enum><text>Any other entity as the Secretary determines appropriate.</text></clause></subparagraph></paragraph><paragraph id="HB00064323842498DAF8646ED5B28A783"><enum>(3)</enum><text>In carrying out paragraphs (1) and (2), consult with stakeholders as the Secretary determines appropriate, including with individuals and private sector entities with expertise in the commercial manufacturing, establishment, deployment, use, or scaling of quantum technology.</text></paragraph></section><section id="H809B7FADD86D45F3A9EEFFBBC32C7A57"><enum>4.</enum><header>Additional requirements relating to establishment, maintenance, and resiliency of any trusted quantum supply chain</header><subsection id="HD1E589B5D10F4978B94638AF7AF1FB1D"><enum>(a)</enum><header>In general</header><text>In carrying out section 3(1)(C), the Secretary shall carry out the following:</text><paragraph id="HA2DFE587296842E2A6A9160CAE994062"><enum>(1)</enum><text>Use any authority of the Secretary or direct any program of the Department of Commerce, as the Secretary determines appropriate, to promote the establishment, maintenance, and resiliency of a trusted quantum supply chain.</text></paragraph><paragraph id="H5837E8DB6F12425D86CEAE39AC544495"><enum>(2)</enum><text display-inline="yes-display-inline">Identify barriers to investment in a trusted quantum supply chain and take appropriate action to address any such barrier.</text></paragraph><paragraph id="H4E6362E818ED4519B970F79D5DDAE64A" commented="no"><enum>(3)</enum><text>Establish a method and means for the Secretary to—</text><subparagraph id="H6D44640B45424214A433AAE36A6BD059"><enum>(A)</enum><text display-inline="yes-display-inline">identify critical components and assess the availability of such critical components, including any critical component imported from and manufactured in a covered nation or manufactured by a trusted supplier; and</text></subparagraph><subparagraph id="H816BC695D61F4354B5A32712769206B5" commented="no"><enum>(B)</enum><text>assess, manage, and reduce any risk related to the acquisition of a critical component provided or supplied by a covered nation.</text></subparagraph></paragraph><paragraph id="H30D173E1212B4228AAB477F42E7D5B0B" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Assess, manage, and reduce any risk related to the supply of a critical component provided by a covered nation, in coordination with the following:</text><subparagraph id="HE1703F876DAE40DB8D91B554A611CFDA" commented="no"><enum>(A)</enum><text>Any relevant trusted foreign partner.</text></subparagraph><subparagraph id="H4EB9E36CBC46469486D0AE26F3ECAF11" commented="no"><enum>(B)</enum><text>Any relevant trusted supplier.</text></subparagraph><subparagraph id="H35ECC0EF9B7E4877AB07FCDEA7F76E7D" commented="no"><enum>(C)</enum><text>Any relevant agency.</text></subparagraph></paragraph></subsection><subsection id="H828E8CF709F24E6EA38996AEA922FBE4"><enum>(b)</enum><header>National strategy</header><paragraph id="H23C27359594249CE867D62F205BA9D41"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, and every 3 years thereafter, the Secretary shall establish and publish on a publicly available website a report that includes the following:</text><subparagraph id="H244D0947FB1B48CBA833F03C4E11266B"><enum>(A)</enum><text>A description of the following:</text><clause id="HE48CC4B5395D415D9BDD2F1ABC21809E" commented="no"><enum>(i)</enum><text>Any action carried out by the Secretary pursuant to subsection (a) and section 3(2).</text></clause><clause id="H35C21FCC41234202AB2F3DC52A8F3140"><enum>(ii)</enum><text>Any emerging risk or long-term trend related to the economic competitiveness of the United States with respect to the following:</text><subclause id="HCA611D9E1EBB4998818986991AB1C08F"><enum>(I)</enum><text>Quantum technology.</text></subclause><subclause id="H67E801B1309F4FC492A2C4C6A3F4E992"><enum>(II)</enum><text>Any critical component.</text></subclause><subclause id="HC114F05E23334D66B95917396684D38A"><enum>(III)</enum><text>Any trusted quantum supply chain.</text></subclause></clause></subparagraph><subparagraph id="H9F518C507970453EADECC16F7AF46031"><enum>(B)</enum><text>A comprehensive strategy to advance—</text><clause id="H01EF65FE23C34AD48A5DDF42CD40DBB1"><enum>(i)</enum><text>the commercial leadership of the United States in quantum technology and any critical component; and</text></clause><clause id="HAD12D62221C54F4F957BC0BECBB7BD5E"><enum>(ii)</enum><text>the establishment, maintenance, and resiliency of a trusted quantum supply chain.</text></clause></subparagraph><subparagraph id="H8B68EFB308C54967BF0177DF622D5803"><enum>(C)</enum><text display-inline="yes-display-inline">Any recommendation by the Secretary for additional legislation (including an Act of Congress), other action by the Federal Government or any State government, or activity by the private sector to strengthen the economic competitiveness of the United States with respect to quantum technology and a trusted quantum supply chain.</text></subparagraph></paragraph><paragraph id="H72CA7E1A603949458336C50C39DFBC38"><enum>(2)</enum><header>Public consultation</header><text display-inline="yes-display-inline">In establishing and publishing a report pursuant to paragraph (1), the Secretary shall consult with stakeholders as the Secretary determines appropriate, including with individuals and private sector entities with expertise in the commercial manufacturing, establishment, deployment, use, or scaling of quantum technology.</text></paragraph></subsection><subsection id="HC981E2548AB040589DE12D56CD55B958"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to require—</text><paragraph id="HDB4F94760FCB4982B7E3524B48923C46"><enum>(1)</enum><text>a private sector entity to—</text><subparagraph id="HE3C81D115D774158B5529AF8B9811D4B"><enum>(A)</enum><text>share information with the Secretary; or</text></subparagraph><subparagraph id="H28B002917C314231A5E05A9114B3D658"><enum>(B)</enum><text>implement any measure or recommendation established by the Secretary; or</text></subparagraph></paragraph><paragraph id="HB3BFA5EECC9C493283A110836A1C105B"><enum>(2)</enum><text>the Secretary to disclose confidential business information or trade secrets.</text></paragraph></subsection></section></legis-body></bill>
