<section id="H32703828347D4580AC531DF2202CA432" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Automotive National and Economic Security Act of 2026</short-title></quote>.</text> </section> <section id="H39BBE0C997474755802F8F9E0F7259CB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H8731390647044817AC5F1C0B996F1550"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="H38D43F4466BC4E43B29D1D1A62677B87"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H125ECFB60E0243C8B00E5905582BD227"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph> <paragraph id="H333F65335AA143B690AB1C948625D518"><enum>(2)</enum><header>Automated driving system</header><text>The term <term>automated driving system</term>—</text> 
<subparagraph id="HA0C825BF5D324E829E1E196F54096833"><enum>(A)</enum><text>means the hardware and software that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether such system is limited to a specific operational design domain; and</text></subparagraph> <subparagraph id="HB63E942E39624FE2AB7E1A455D66C087"><enum>(B)</enum><text>includes only a system that meets the definition of Level 3, Level 4, or Level 5 automation.</text></subparagraph></paragraph> 
<paragraph id="HE1452D09BC424DF0899A2B0DDA9D039B"><enum>(3)</enum><header>Controlled by a foreign adversary</header><text>The term <term>controlled by a foreign adversary</term> means, with respect to a manufacturer, that such manufacturer is a foreign person that—</text> <subparagraph id="HA87052F08B1043628C2C0B19DBCA2C1D"><enum>(A)</enum><text>is domiciled in a foreign adversary;</text></subparagraph> 
<subparagraph id="HDC677B6A8FF14E3CBBF65AB6344D3553"><enum>(B)</enum><text>is headquartered in a foreign adversary;</text></subparagraph> <subparagraph id="H6FF74F12762A45FBBD3B799EF46C7616"><enum>(C)</enum><text>has a principal place of business in a foreign adversary;</text></subparagraph> 
<subparagraph id="H49EDE246917B4E898865185EABDC9A8E"><enum>(D)</enum><text>is organized under the laws of a foreign adversary; or</text></subparagraph> <subparagraph id="H2542068866CF47919D86B98EFB3F4024"><enum>(E)</enum><text>derives at least 50 percent of annual revenue in a foreign adversary.</text></subparagraph></paragraph> 
<paragraph id="H858D21F0951245FC8A7591AF49B36F0B"><enum>(4)</enum><header>Covered activity</header><text display-inline="yes-display-inline">The term <term>covered activity</term> means any of the following commercial arrangements or agreements related to the manufacture of motor vehicles, covered hardware, or covered software with respect to which at least 1 party is a foreign adversary or a manufacturer controlled by a foreign adversary:</text> <subparagraph id="HFDF7C6EC9A4544F29ADD79B127976FA8"><enum>(A)</enum><text>Any ownership interest, direct or indirect, in a manufacturer.</text></subparagraph> 
<subparagraph id="H86AA89AEFFC54D61B5A2E77E33CDE917"><enum>(B)</enum><text>Any commercial partnership, including a joint venture, subsidiary, or contract manufacturing agreement.</text></subparagraph> <subparagraph id="H20E06A6B389046C1954B92094DCB2DD0"><enum>(C)</enum><text>Any technology sharing agreement, including a research and development partnership or a licensing agreement.</text></subparagraph> 
<subparagraph id="HDC6313A9926042D2972ABBAC003FF987"><enum>(D)</enum><text display-inline="yes-display-inline">Any investment by a manufacturer in a motor vehicle manufacturer or vehicle equipment manufacturer controlled by a foreign adversary.</text></subparagraph> </paragraph> <paragraph id="H7DC91FFF974643E4B0A042F982AC476A"><enum>(5)</enum><header>Covered hardware</header><text>The term <term>covered hardware</term> means—</text> 
<subparagraph id="H447580EA52AB47B28EF5E205411ECE0A"><enum>(A)</enum><text>software-enabled or programmable components that—</text> <clause id="HA3DE82922C1E4EFB900D3414291ADBF5"><enum>(i)</enum><text>are installed or designed to be installed in or on a motor vehicle;</text></clause> 
<clause id="H3608E73BC022457B95728BD09551337A"><enum>(ii)</enum><text>are directly connected to systems in or on a motor vehicle that directly enable the transmission, receipt, conversion, or processing of radio frequency communications at a frequency over 450 megahertz; and</text></clause> <clause id="H4474159A22F247CEA1365EFCD924E182"><enum>(iii)</enum><text>directly or as a part of an item, enables the connectivity functions of such systems; or</text></clause></subparagraph> 
<subparagraph id="H1D6190BB631D45CA8EFF49C6FFD145AE"><enum>(B)</enum><text>electronic systems integrated into an electric vehicle battery that directly enable or control the monitoring, management, security, or external communication of battery performance or operation, including any transmitter or interface component that performs such functions.</text></subparagraph></paragraph> <paragraph id="HFA411298FAAF4BEAAEF4CB237CA35C4B"><enum>(6)</enum><header>Covered software</header><text>The term <term>covered software</term> means a software-based component, including any application, middleware, system software, and any machine-learning model or other artificial intelligence component, that is installed in or on a motor vehicle, or designed to be installed in or on a motor vehicle, and that is executed by the primary processing unit or units of an item that directly enables, at the vehicle level, the functioning of covered hardware or an automated driving system.</text></paragraph> 
<paragraph id="HE0C7208B3B8C4D90997FC8C735BFE509"><enum>(7)</enum><header>Critical and emerging technology</header><text>The term <term>critical and emerging technology</term> means any of the following:</text> <subparagraph id="HFB5EDDE735C54C6594952FDC116BF487"><enum>(A)</enum><text>Advanced computing.</text></subparagraph> 
<subparagraph id="H3E7FA8E5D41C45C59C91831F582D0AE1"><enum>(B)</enum><text>Advanced engineering materials.</text></subparagraph> <subparagraph id="H4DFCB2824CCB4EEAA1720F3DB0530750"><enum>(C)</enum><text>Advanced and networked sensing and signature management.</text></subparagraph> 
<subparagraph id="H491F9B35B0C146AB86A8B48645B5B1D3"><enum>(D)</enum><text>Advanced manufacturing.</text></subparagraph> <subparagraph id="HBEBCC330D8F54964804A94B7FB5A9269"><enum>(E)</enum><text>Artificial intelligence.</text></subparagraph> 
<subparagraph id="HB6B2F507816A4D9DA8F0ACDFE5879525"><enum>(F)</enum><text>Clean energy generation and storage.</text></subparagraph> <subparagraph id="HC680A091AF72470994E4989C01E8D27A"><enum>(G)</enum><text>Data privacy, data security, and cybersecurity technology.</text></subparagraph> 
<subparagraph id="HA4EF79C8E23E4EF7B0A003F58270EB2F"><enum>(H)</enum><text>Highly automated, autonomous, and uncrewed Systems (UxS) and robotics.</text></subparagraph> <subparagraph id="HDC27A6FA47104AA0B6C27B1F0D076762"><enum>(I)</enum><text>Human-machine interfaces.</text></subparagraph> 
<subparagraph id="H7B16F081A286471188B667E3CDD2C10C"><enum>(J)</enum><text>Integrated communication and networking technology.</text></subparagraph> <subparagraph id="H8A10E38E933B4B36B1FD08747BAD4166"><enum>(K)</enum><text>Positioning, navigation, and timing (PNT) technology.</text></subparagraph> 
<subparagraph id="H57D32EFA043B4313A5CC9E959569AF0E"><enum>(L)</enum><text>Quantum information and enabling technology.</text></subparagraph> <subparagraph id="H435FE94A4203470E816D54AF0685F25C"><enum>(M)</enum><text display-inline="yes-display-inline">Semiconductors and microelectronics.</text></subparagraph> </paragraph> 
<paragraph id="HAA72DD30069546A6AE83F7F616086164"><enum>(8)</enum><header>Foreign adversary</header><text>The term <term>foreign adversary</term> has the meaning given the term <term>covered nation</term> in section 4872(f) of title 10, United States Code.</text></paragraph> <paragraph id="H34C3E67BCB8143848E74115BD1E4D450"><enum>(9)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means any person in the United States that manufactures, assembles, or imports a passenger motor vehicle, including a passenger motor vehicle that includes covered hardware or covered software.</text> </paragraph> 
<paragraph id="H95FE1BF07D284E328BDE7B3FE9E55404"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Department of Commerce (acting through the Office of the Secretary of Commerce).</text></paragraph> </section> <section id="H1AB78A2253D540BFB286AB4716B5C62C"><enum>3.</enum><header>Study on foreign adversaries and the American automotive industry</header> <subsection id="H9BC35CEC3A4842578E7F7312A25FD87B"><enum>(a)</enum><header>Study required</header><text>The Secretary shall conduct a study on covered activity by manufacturers.</text></subsection> 
<subsection id="H6683D84E859A458192E69F0DF2E99A7E"><enum>(b)</enum><header>Elements</header><text>In conducting the study required by subsection (a), the Secretary shall assess the following:</text> <paragraph id="HA6E2A9FD2CAE45B383112C115D78635C"><enum>(1)</enum><text>The engagement of each manufacturer in any covered activity.</text></paragraph> 
<paragraph id="H37487B8453DD454F85F5E5BED68094A7"><enum>(2)</enum><text>With respect to any covered activity described in paragraph (2):</text> <subparagraph id="H5A6D5E4E68F641ED914952E0711DF206"><enum>(A)</enum><text>Any adverse impact to the national security, economic competitiveness, or intellectual property protection of the United States resulting from such covered activity.</text></subparagraph> 
<subparagraph id="HB0D30A308F4444B3819E574936D4079B"><enum>(B)</enum><text display-inline="yes-display-inline">Any involvement by an entity controlled by a foreign adversary that is a State-directed investment vehicle, including any military, political party, State-owned enterprise, sovereign wealth fund, or government-controlled investment vehicle.</text></subparagraph> <subparagraph id="H3F41339FE8624228AC3CFEA4E4EFACC0"><enum>(C)</enum><text>Any transfer of technology relating to critical and emerging technology to any entity described in subparagraph (B) or a manufacturer controlled by a foreign adversary.</text></subparagraph> 
<subparagraph id="H80F95EB06D364E0BAF0B8CA3B773B879" commented="no"><enum>(D)</enum><text>Any operations or employees of the manufacturer in a foreign adversary relating to such covered activity.</text> </subparagraph></paragraph></subsection> <subsection id="HBF7F6D6376794BE9B7F19DDF8FD59B08"><enum>(c)</enum><header>Consultation</header><text>In conducting the study required by subsection (a), the Secretary shall consult with the head of any relevant agency as determined by the Secretary.</text></subsection> 
<subsection id="HDCE7D54564F94C24B18B13F8D780EE83"><enum>(d)</enum><header>Submission; publication</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall—</text> <paragraph id="HBE616891B04C47FFBDB7BB3398CBEC27"><enum>(1)</enum><text>submit to the appropriate congressional committees a report on the study required by subsection (a); and</text></paragraph> 
<paragraph id="H5278FCCDED4248188FAA7B43CD03FB27"><enum>(2)</enum><text display-inline="yes-display-inline">publish an unclassified report on a website of the Department of Commerce, except that the Secretary may not disclose confidential business information, trade secrets, or information the disclosure of which would reasonably be expected to harm the national security of the United States.</text></paragraph></subsection></section> </legis-body></bill>
