<section id="HA9201E3E8AAA45E89E7C7761C6CDD9D2" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom to Home Distill Act</short-title></quote>.</text></section> 
<section commented="no" id="H2F318FDC3D9A4471B6A73AF70D6120B8"><enum>2.</enum><header>Exemption of home distillery establishments from taxation and other requirements</header> 
<subsection commented="no" id="HC406CCC45D6741DCA37D97B7F56882E0"><enum>(a)</enum><header>Exemption from tax</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5001">Section 5001</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="H61D61E276F2541679099F00B679AD96F" commented="no"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e), and</text></paragraph> 
<paragraph id="H5FC2D11DAC9046468BBC658429437874" commented="no"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HA0395C1566CC4D0C949BFEC1104A369B" style="OLC"> <subsection commented="no" id="HD8D456F813E3422C9BBD84535C765C14"><enum>(d)</enum><header>Exemption for distilled spirits produced at home distillery establishments</header><text>Subject to regulations prescribed by the Secretary, the tax imposed by subsection (a) shall not apply to distilled spirits produced at a home distillery establishment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" id="H22044A783E4F4ACAA300465BCCC7CC6A"><enum>(b)</enum><header>Definition of home distillery establishment; clarification of related definitions</header> 
<paragraph id="HDC2097A2149E440490E1EE217C95B616"><enum>(1)</enum><header>Definition of home distillery establishment</header><text display-inline="yes-display-inline">Section 5002(a) of such Code is amended by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H57A3C97D79934F679E1396643DB421D6" style="OLC"> <paragraph commented="no" id="H43E71CC7727F48EDA86EF4D02DA1CB16"><enum>(16)</enum><header>Home distillery establishment</header> <subparagraph commented="no" id="H7DFD96EC52A4448A90C066D010D0870F"><enum>(A)</enum><header>In general</header><text>The term <term>home distillery establishment</term> means an establishment that—</text> 
<clause commented="no" id="HC52B277C38314C0F8195A6CE573B00EC"><enum>(i)</enum><text>is located in the dwelling house of the owner of such establishment, or in any shed, yard, or inclosure connected with such dwelling house, and</text></clause> <clause commented="no" id="H15AB86A26E3E4D9292D802172998B9EA"><enum>(ii)</enum><text>produces distilled spirits solely for personal or family use by the owner of such establishment.</text></clause></subparagraph> 
<subparagraph commented="no" id="H04BEF3CDBFA945E29C8446634E6DBE38"><enum>(B)</enum><header>Personal or family use</header> 
<clause commented="no" id="H47ACBD149F4E4227B702881A6F88E8E7"><enum>(i)</enum><header>In general</header><text>A home distillery establishment shall be treated as producing distilled spirits solely for personal or family use if—</text> <subclause commented="no" id="H6DE88F99635A48EDB05FB58D1AB9CD2A"><enum>(I)</enum><text>such establishment produces no more than—</text> 
<item commented="no" id="H9D681B386D454EFB954AEC83650CA266"><enum>(aa)</enum><text>in the case of a household with only 1 adult, 10 proof gallons of distilled spirits per calendar year, or</text></item> <item commented="no" id="HBADDD78167564CD98B9931DF36EABBA0"><enum>(bb)</enum><text>in the case of a household with 2 or more adults, 20 proof gallons of distilled spirits per calendar year, and</text></item></subclause> 
<subclause commented="no" id="H0870B91015634CED953BC8D870A3BA16"><enum>(II)</enum><text>no distilled spirits produced by such establishment are sold to any person, or transferred to any person for sale by such person.</text></subclause></clause> <clause commented="no" id="HFFD00B7BB7CD45319891E144EDF90B49"><enum>(ii)</enum><header>Adult</header><text>For purposes of this paragraph, the term <term>adult</term> means an individual who has attained 21 years of age, or the minimum age (if any) established by law applicable in the locality in which the household is situated at which distilled spirits may be sold to individuals, whichever is greater.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H188A65041C3B439BADA3E7BBD5892BA2"><enum>(2)</enum><header>Clarification of related definitions</header> 
<subparagraph id="H7856E6F386DB488AA9BA3F029A30DFCA"><enum>(A)</enum><header>Definition of distilled spirits plant</header><text display-inline="yes-display-inline">Section 5002(a)(1) of such Code is amended by adding at the end the following new sentence: <quote>Such term shall not include any home distillery establishment.</quote>.</text></subparagraph> <subparagraph id="H78812FEE479E4B1EB5F3414353C889EC"><enum>(B)</enum><header>Definition of distiller</header><text>Section 5002(a)(4) of such Code is amended by adding at the end the following new flush sentence:</text> 
<quoted-block style="OLC" id="HE31EE857F0EE4DD1B0F671757EEC7ADC" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Such term shall not include any person who produces only distilled spirits exempt from tax under section 5001(d).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H2D4E5702DBD54A0F82C368A1037650B8"><enum>(c)</enum><header>Exemption from notice requirements related to stills</header><text>Section 5101(a) of such Code is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HDE9494002CAA4B5495D667C535B6FA8C" display-inline="no-display-inline"> <paragraph id="HC0B06F41A55241BBBC1EE0502B26FC75"><enum>(3)</enum><header>Exemption for stills used to produce distilled spirits at home distillery establishments</header><text display-inline="yes-display-inline">Any requirements prescribed by the Secretary under paragraph (1) or (2) shall not apply with respect to any still, boiler, or other vessel manufactured or set up exclusively for the purpose of distilling at a home distillery establishment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1F414F4319FD45E1ACDA722C3B0D1C4B"><enum>(d)</enum><header>Limitation on sales of stills for home distillery establishments</header> 
<paragraph id="HCDC9CCC70A234EF087C7ABCBC38CED9B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5101 of such Code, as amended by subsection (c), is amended—</text> <subparagraph id="H4C66CBE1393A454B83844B323F426510"><enum>(A)</enum><text>by redesignating subsection (b) as subsection (c), and</text></subparagraph> 
<subparagraph id="H90BF72C69F174A9BADA50E97935241E9"><enum>(B)</enum><text>by inserting after subsection (a) the following new subsection:</text> <quoted-block style="OLC" id="H69CB88D0B67F4F2DBB8D1D1CBA212839" display-inline="no-display-inline"> <subsection id="HD88E48F639B94FEDBA908D676A5543D0"><enum>(b)</enum><header>Limitation on sales of stills for home distillery establishments</header><text display-inline="yes-display-inline">The Secretary shall, pursuant to regulations, require that no still, boiler, or other vessel may be sold or transferred to any person who intends to use such still, boiler, or vessel solely as part of a home distillery establishment, unless such still, boiler, or vessel has—</text> 
<paragraph id="HC7D448602F614435A5B2B73F570966BC"><enum>(1)</enum><text>a pressure release valve,</text></paragraph> <paragraph id="H7B925D50602549F6902BB2218F7E1BB4"><enum>(2)</enum><text>a vacuum relief valve, and</text></paragraph> 
<paragraph id="HA4A0555155BD459B93470436684D1399"><enum>(3)</enum><text>a capacity of not greater than 50 gallons.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H78F781EE432C4C0D85BF695E8B15C9D2"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The heading of section 5101 of such Code is amended by striking <quote><header-in-text level="section" style="OLC">set up of still</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">set up of still; limitation on certain sales of stills</header-in-text></quote>.</text></paragraph></subsection> 
<subsection id="HAC68D6B9A8CF4DB8A3E2913B0BDF0A53"><enum>(e)</enum><header>Exemption from stills registration requirement</header><text>Section 5179(a) of such Code is amended by inserting <quote>stills or distilling apparatus set up in a home distillery establishment and</quote> after <quote>except that</quote>.</text></subsection> <subsection id="HD70AD98619AF41DF80BC70D9A46B3798" commented="no"><enum>(f)</enum><header>Nonapplication of prohibition on production or use of distilling materials in certain locations</header><text>Section 5222(a)(2)(C) of such Code is amended by striking <quote>section 5042 or 5053(e)</quote> and inserting <quote>section 5001(d), 5042, or 5053(e)</quote>.</text> </subsection> 
<subsection commented="no" id="HBC31CA92F3004857BFCCB2352B1BF098"><enum>(g)</enum><header>No criminal penalty for distilling in home distillery establishment</header><text>Section 5601(a)(6) of such Code is amended by inserting <quote>or in the case of a home distillery establishment</quote> after <quote>section 5178(a)(1)(C)</quote>.</text></subsection> <subsection commented="no" id="H01B0F1A96D4B49A2B0A8496585E60D47"><enum>(h)</enum><header>Effective date</header><text>The amendments made by this section shall apply to distilled spirits produced, and stills, boilers, and other vessels sold, after December 31, 2026.</text></subsection></section>
