To amend title 10, United States Code, to include certain prior active duty as a regular member of an Armed Force for reduced eligibility age for retirement as a member of the reserve components.

To amend title 10, United States Code, to include certain prior active duty as a regular member of an Armed Force for reduced eligibility age for retirement as a member of the reserve components.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. Inclusion of certain prior active duty as a regular member of an Armed Force for reduced eligibility age for retirement as a member of the reserve components.
(a) In general.—Section 12731(f)(2) of title 10, United States Code, is amended—
(1) in subparagraph (A), by striking “as a member of the Ready Reserve”; and
(2) in subparagraph (B), by adding at the end the following new clause:
“(v) Service on active duty described in this subparagraph is also service on active duty as a regular member.”.
(b) Retroactive applicability.—The amendments made by subsection (a) shall apply to qualifying service on active duty performed after January 28, 2008.
