which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require a covered tool to disclose when the covered tool provides sponsored content, and for other purposes.</official-title></form><legis-body id="H14E27E91923F405EA2FF1002B95B6B5B" style="OLC"><section id="H90E2933D55984E50930134B38B4BA9EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AI Advertising Disclosure Act</short-title></quote>.</text></section><section id="HCD5EAF5E87EC4F24BC14F3B8DAD24BDF"><enum>2.</enum><header>Disclosure requirements; prohibitions</header><subsection id="HF135483AEA3F478D95D6BF1B4A699494" display-inline="no-display-inline"><enum>(a)</enum><header>Mandatory disclosure requirements</header><paragraph id="H43FCFBB493414A058C85D94A4472EE4E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered entity shall disclose when the response of a covered tool—</text><subparagraph id="H456FAFA986A643D9803B9C01939855C9" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">mentions, recommends, presents, or favorably mentions a product, service, or entity pursuant to a commercial arrangement, regardless of whether the user explicitly requested a product recommendation;</text></subparagraph><subparagraph id="H29A7836A1F1745C0B359D83123B89C13" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">is general in nature and influenced by a commercial arrangement, including through a brand-specific mention, ranking, or omission embedded within advice, how-to, or informational response not framed as product queries;</text></subparagraph><subparagraph id="HA88C473403F24D24AA70D59EB72C094B"><enum>(C)</enum><text>is generated using a system prompt, retrieval-augmented generation source, or fine-tuning data that has been provided or funded by a third party under a commercial arrangement; or</text></subparagraph><subparagraph id="HF591F01C9F654A8E8230C3C6D1AE9CD6"><enum>(D)</enum><text>contains an affiliate link or referral code, whether embedded or appended.</text></subparagraph></paragraph><paragraph id="HD007A53FA1B9442BAC6B83E2EBF70231"><enum>(2)</enum><header>Forms of disclosure</header><text display-inline="yes-display-inline">A disclosure under paragraph (1) shall be as follows:</text><subparagraph id="HA90C1E34A16243798117FD2B2C9C6248"><enum>(A)</enum><text>Clear and conspicuous, visible without scrolling, in plain language, and provided with or before the display of relevant content.</text></subparagraph><subparagraph id="HA4FA05FA62D24561BD51290D2A2F2522"><enum>(B)</enum><text>Identify the specific nature of the relationship (such as a paid promotion, sponsored, or affiliate partnership).</text></subparagraph><subparagraph id="H8780B6A6BF7B4A4C9FC541EA15658B58"><enum>(C)</enum><text>Retained if the conversation is saved, exported, or shared.</text></subparagraph><subparagraph id="H514C2383D56B47748608B336BA1327E3"><enum>(D)</enum><text>Not obscured by design, color, font size, or placement.</text></subparagraph><subparagraph id="HFB079B121BE34DE6A7470C5EE1F2FD04"><enum>(E)</enum><text display-inline="yes-display-inline">With regard to a voice-based covered tool, delivered without any audio effect that reduces salience (such as a lower volume or pitch shift).</text></subparagraph></paragraph></subsection><subsection id="H7B5D6A5DC5A044F0A29C2D509DB4FFBD"><enum>(b)</enum><header>Prohibited practices</header><text display-inline="yes-display-inline">A covered entity may not allow a covered tool to do the following:</text><paragraph id="H6AE4086A8E994603BB6FFD81F60C17F8"><enum>(1)</enum><text>Instruct an AI system to deny being AI or be in a commercial relationship, when directly asked.</text></paragraph><paragraph id="H66452A2A1BBE4650B8A261D50EAA1820"><enum>(2)</enum><text>Use design patterns that obscure or minimize required disclosures.</text></paragraph><paragraph id="H81E73AD06D8E4089A96B319D9F3DDDA0"><enum>(3)</enum><text>Present sponsored content as the product of organic AI reasoning when the content is not.</text></paragraph></subsection><subsection id="HF1BCE65845F4470191814A41C4AE240D"><enum>(c)</enum><header>Operator obligations</header><paragraph id="H2938AE3657F54BC3AB1E5FB818356EA7"><enum>(1)</enum><header>Commercial arrangement registry required</header><text>A covered entity shall maintain an internal registry of each third-party commercial arrangement that influences AI-generated content, updated in real time.</text></paragraph><paragraph id="H176ABE7E9AB94080A60090CB7C703804"><enum>(2)</enum><header>Requirement to confirm commercial arrangement</header><text>A covered entity shall provide a user with the ability to ask, in a given session or conversation, whether any response the user received was subject to a commercial arrangement.</text></paragraph></subsection><subsection id="H708201A23A0346239F3495AC3370B881"><enum>(d)</enum><header>FTC rulemaking authority</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 3 years thereafter (to account for changes in AI technology), the Commission shall issue regulations, under section 553 of title 5, United States Code, as the Commission determines necessary to carry out the provisions of this Act.</text></subsection><subsection id="H38065151DF1142AAA46F901178BC5B54"><enum>(e)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H87D0D7B33EF746F4B815CAFAD6EA5D71"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="H5E52B0E80E5244BB899212A2A19089C1"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this section and any regulation promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="HBCF92214F3D94E69AA2FB097D85BFDD1" commented="no"><enum>(f)</enum><header>Actions by States</header><paragraph id="H4AC46A4591EE42F39C6ED6858154D4B2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State, or an official or agency of a State, has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by an act or practice in violation of this section or a regulation promulgated under this section, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in an appropriate State court or an appropriate district court of the United States to—</text><subparagraph id="HE88148665B9C4220ACA5DD37A7394C91" commented="no"><enum>(A)</enum><text>enjoin such act or practice;</text></subparagraph><subparagraph id="H9F8644592CB84F6DAC22DCFD7D17708B" commented="no"><enum>(B)</enum><text>enforce compliance with such subsection or such regulation;</text></subparagraph><subparagraph id="H0CD1A71B2BB949AAB8C189545F897FAF" commented="no"><enum>(C)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></subparagraph><subparagraph id="H6E46BDE2984243C194F568A36F2A11B2" commented="no"><enum>(D)</enum><text>obtain such other legal and equitable relief as the court may consider to be appropriate.</text></subparagraph></paragraph><paragraph id="H1EF4FF7E752B4568A5A1DDE2ED82EB45" commented="no"><enum>(2)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general, official, or agency of the State involved shall provide to the Federal Trade Commission a written notice of such action and a copy of the complaint for such action. If the attorney general, official, or agency determines that it is not feasible to provide the notice described in this paragraph before the filing of the action, the attorney general, official, or agency shall provide written notice of the action and a copy of the complaint to the Federal Trade Commission immediately upon the filing of the action.</text></paragraph><paragraph id="HB5D7B58B31CA4017A3B30184ED601071" commented="no"><enum>(3)</enum><header>Authority of Federal Trade Commission</header><subparagraph id="HF830B9E0ADF447758208C089402DEFE5"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (2) of an action under this subsection, the Federal Trade Commission shall have the right—</text><clause id="H9D61B761AD23480C85847952510BC1B8" commented="no"><enum>(i)</enum><text>to intervene in the action;</text></clause><clause id="HE1BAD9C71ACB45C5A5BC502A19A59B55"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></clause><clause id="H4101E818EFEF44AD9A00FD36B3D33968" commented="no"><enum>(iii)</enum><text>to file petitions for appeal.</text></clause></subparagraph><subparagraph id="H623F6CF370D74E13A69752913BD96D06" commented="no"><enum>(B)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Federal Trade Commission or the Attorney General of the United States has instituted a civil action for violation of subsection (a) or a regulation promulgated under such subsection (referred to in this subparagraph as the <quote>Federal action</quote>), no State attorney general, official, or agency may bring an action under this subsection during the pendency of the Federal action against any defendant named in the complaint in the Federal action for any violation of such subsection or regulation alleged in such complaint.</text></subparagraph></paragraph><paragraph id="H71645F17A0EE49C29B1173BF05FF5BE6" commented="no"><enum>(4)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this subsection, nothing in this section may be construed to prevent an attorney general, official, or agency of a State from exercising the powers conferred on the attorney general, official, or agency by the laws of such State to conduct investigations, administer oaths and affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text></paragraph></subsection><subsection id="HB37DE5AA269941D78CAC7D0221219FDC"><enum>(g)</enum><header>Private right of action</header><paragraph id="HC2968A752058482C96A438022F605B53"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person injured by an act or practice in violation of this section or a regulation promulgated under this section may bring in an appropriate State court or an appropriate district court of the United States—</text><subparagraph id="H8CEBAB71A72B40DDA4CB08CA49EA38C9"><enum>(A)</enum><text>an action to enjoin the violation;</text></subparagraph><subparagraph id="HBE11F5811C5E4F209A91BAF13D61C41C"><enum>(B)</enum><text>an action to recover damages for actual monetary loss from the violation, or to receive up to $1,000 in damages for each such violation, whichever is greater; or</text></subparagraph><subparagraph id="HE10BD0A4231243C68468E2A3DD20FB94"><enum>(C)</enum><text>both such actions.</text></subparagraph></paragraph><paragraph id="HDF323234DB5C4645AFE3F6C6C3ACB916" commented="no"><enum>(2)</enum><header>Willful or knowing violations</header><text display-inline="yes-display-inline">If the court finds that the defendant acted willfully or knowingly in committing a violation described in paragraph (1), the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under paragraph (1)(B).</text></paragraph><paragraph id="H6E9578BBDADB4B6C854489ABC3B8E824"><enum>(3)</enum><header>Costs and attorney’s fees</header><text display-inline="yes-display-inline">The court shall award to a prevailing plaintiff in an action under this subsection the costs of such action and reasonable attorney’s fees, as determined by the court.</text></paragraph><paragraph id="HCD2870C624784111879AF29802A3CED6"><enum>(4)</enum><header>Limitation</header><text>An action may be commenced under this subsection not later than 2 years after the date on which the person first discovered or had a reasonable opportunity to discover the violation.</text></paragraph><paragraph id="HA1D91C21E4EE45B3A5600B83951DD410"><enum>(5)</enum><header>Nonexclusive remedy</header><text>The remedy provided by this subsection shall be in addition to any other remedies available to the person.</text></paragraph></subsection><subsection id="H7B595AEB7716467385A1B500B3C32C8C"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC67D6CECCCC34A42AA09FB7F89649ABA" commented="no"><enum>(1)</enum><header>AI</header><text display-inline="yes-display-inline">The term <term>AI</term> has the meaning given that term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph id="HDAB0AF5E7AF14C0391B14AF7FBA99585"><enum>(2)</enum><header>AI chatbot</header><text display-inline="yes-display-inline">The term <term>AI chatbot</term> means any software system that uses a large language model or similar technology to generate conversational responses to user queries that is made available to the public.</text></paragraph><paragraph id="H65FF67B2CE634CEA85F60B07EA7463ED"><enum>(3)</enum><header>Commercial arrangement</header><text>The term <term>commercial arrangement</term> means an exchange of money, data, preferential access, or other consideration that influences the content of an AI-generated response.</text></paragraph><paragraph id="H9D9848D8D3444D3CA2E81FC9BCD34A74"><enum>(4)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any person, company, or organization that deploys or operates a covered tool for consumer-facing use with more than 50,000 monthly active users.</text></paragraph><paragraph id="HFFEF405FD79E4711AF2DDF913321CB07"><enum>(5)</enum><header>Covered tool</header><text display-inline="yes-display-inline">The term <term>covered tool</term>—</text><subparagraph id="H1F3DDEF95AEA4F35B05895AB6C11867E"> <enum>(A)</enum> <text>means an AI interactive computer service or software application that—</text>
                        <clause id="HDA52593038244BE6A97084DBFF812824">
                            <enum>(i)</enum>
 <text>generates responses that are not fully predetermined; and</text> </clause> <clause id="HFC764CC2D4FF47B58FF2B492F57FE6B4"> <enum>(ii)</enum> <text>accepts open-ended natural-language or multimodal user input and produces adaptive or context-responsive output; and</text>
                        </clause>
 </subparagraph><subparagraph id="H3BCC522D8B9840359610405ABDB8D7B4"><enum>(B)</enum><text display-inline="yes-display-inline">includes an AI chatbot and a generative search synthesis feature.</text></subparagraph></paragraph><paragraph id="HB287BE55D35947468792BDA48E98C3F4" commented="no"><enum>(6)</enum><header>Generative search synthesis feature</header><text>The term <term>generative search synthesis feature</term>—</text><subparagraph id="H6D22A05A707E456C8DA1A722124772C6" commented="no"><enum>(A)</enum><text>means any feature of an online search engine or information-retrieval service that uses a large language model or similar technology to produce, in response to a search by the user, a synthesized narrative answer, summary, or recommendation that is displayed to the user in lieu of, or more prominently than, the ranked list of hyperlinks to third-party sources that the service would otherwise return; and</text></subparagraph><subparagraph id="HA5E96E7C8AD6414DA35FFEA8FC3BBB08" commented="no"><enum>(B)</enum><text>includes any feature that generates the answer, summary, or recommendations described in subparagraph (A) automatically as part of a standard results page, regardless of whether the user separately requested a summary and whether source citations accompany the generated output.</text></subparagraph></paragraph><paragraph id="H499A2E1EEA454531AA4B6B25810F7BA2"><enum>(7)</enum><header>Sponsored content</header><text>The term <term>sponsored content</term> means an AI-generated response that—</text><subparagraph id="HF1041366CFAE48DA9004068FAE9A31EA"><enum>(A)</enum><text>mentions, recommends, or promotes a specific product, service, or entity; and</text></subparagraph><subparagraph id="H15FDFB26C5084FB6B77076F0FABB0824"><enum>(B)</enum><text>is produced in whole or in part due to a commercial arrangement between the covered entity and a third party.</text></subparagraph></paragraph><paragraph id="H6E7721D04E3B422C9081F9E2C2F76109" commented="no"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H42D617B905D04E8DB10E265D97298254" commented="no"><enum>(9)</enum><header>Voice-based covered tools</header><text>The term <term>voice-based covered tools</term> means a covered tool that delivers responses primarily through AI-generated speech.</text></paragraph></subsection><subsection id="HDB0AD3CCEAD241B7B10128232DE6D15C"><enum>(i)</enum><header>Relation to other laws</header><paragraph id="H89E76FAA65594F41AD337299B12FFC1F"><enum>(1)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the authority of the Commission, the Federal Communications Commission, or State consumer protection agencies.</text></paragraph><paragraph id="HF3352124DF0E4E649C5D7E73F46571F2" commented="no"><enum>(2)</enum><header>Preemption</header><text>This section does not preempt a State law that provides greater consumer protection related to a covered tool.</text></paragraph></subsection><subsection id="HA14378F0ED4641A2A0647CD688276CB6"><enum>(j)</enum><header>Effective date</header><text>This section shall take effect 12 months after the date of the enactment of this section.</text></subsection></section></legis-body></bill>
