<section id="H9294CB895AB74AE682D1D466603FC42E" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Not In My Barn Yard Act</short-title></quote>.</text></section>
<section id="HFF6A614405804A01959139CAFE83FC4F"><enum>2.</enum><header>Prohibition on exercise of eminent domain over agricultural land</header> 
<subsection id="HD71760B17BF74DC09524A891E6EC1F9C"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Federal Government may not exercise eminent domain over any agricultural land if a feasible alternative to the public use for which the Government seeks to exercise eminent domain is available.</text> </subsection> <subsection id="H823246EFEF444109862ACB6DFA8C8E02"><enum>(b)</enum><header>Application to pending exercises of eminent domain</header><text display-inline="yes-display-inline">The prohibition under subsection (a) shall not apply with respect to any exercise of eminent domain that commenced before the date of enactment of this Act.</text></subsection> 
<subsection id="HB1AE2614A0C744078DDCA77C9E182952"><enum>(c)</enum><header>Agricultural land defined</header><text display-inline="yes-display-inline">The term <quote>agricultural land</quote>—</text> <paragraph id="H3B5ADB0812944CB493874D6D525117D9"><enum>(1)</enum><text>means land in the United States that is used, as of the date on which the Government seeks to exercise eminent domain, or has been used during the previous 5-year period, for farming, ranching, forestry production, or timber production; and</text></paragraph> 
<paragraph id="H44C3F9654EFD471692FB76531D088C3F"><enum>(2)</enum><text>does not include land not exceeding ten acres in the aggregate, if the annual gross receipts from the sale of the farm, ranch, forestry, or timber products produced thereon do not exceed $1,000.</text></paragraph></subsection></section> </legis-body></bill>
