<section id="H0706F2EBC19546FEB73B2B14EA97E418" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mail Theft and Postal Key Crime Prevention Act of 2026</short-title></quote>.</text></section> <section id="HB253F20AA4ED48929691F57685C04801"><enum>2.</enum><header>Findings; sense of congress</header> <subsection id="H86318D89A85548BD8FED00ADCA7F08E4"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H3475388EF5904D9CBD8E0DF67AA1EAE0"><enum>(1)</enum><text>Mail theft, including theft involving collection boxes and cluster mailbox units, has increased in communities across the United States.</text></paragraph> <paragraph id="HB1DD8C95F4DF4C5E8998F0D8DC6F1A95"><enum>(2)</enum><text>Organized criminal groups increasingly engage in schemes involving stolen mail, postal keys, counterfeit postal access devices, identity theft, check fraud, bank fraud, and related financial crimes.</text></paragraph> 
<paragraph id="H439CE24CCD224BAB8AF5FD6F53B5A33F"><enum>(3)</enum><text>Theft, robbery, duplication, and unlawful possession of postal keys and arrow keys pose significant risks to the security and integrity of the United States mail system.</text></paragraph> <paragraph id="H218F373CDAAF48F6905AF5802F95A021"><enum>(4)</enum><text>Mail theft and related fraud offenses impose substantial financial and emotional harm on consumers, small businesses, financial institutions, and postal employees.</text></paragraph> 
<paragraph id="H118A3E2A1FB64CB196FAE08479D4F0DE"><enum>(5)</enum><text>Effective investigation and prosecution of organized mail theft schemes requires coordinated efforts among Federal, State, and local law enforcement agencies.</text></paragraph> <paragraph id="H810A7C9C08F54160946B96C7AAFA1C78"><enum>(6)</enum><text>Enhanced coordination among prosecutors and law enforcement agencies will improve the ability of the Department of Justice to investigate and prosecute organized mail theft and related fraud offenses.</text></paragraph></subsection> 
<subsection id="HFE90A32DA93B4061A1B64E19493C9421"><enum>(b)</enum><header>Sense of congress</header><text>It is the sense of Congress that—</text> <paragraph id="HB9A6C1BE5BF743859006CD1EEDD1E286"><enum>(1)</enum><text>organized mail theft and related financial crimes are serious Federal offenses that threaten public confidence in the United States mail system;</text></paragraph> 
<paragraph id="H6FB4B45AE72F4C14A257CEE0ECAC2369"><enum>(2)</enum><text>the Department of Justice should prioritize investigation and prosecution of organized mail theft schemes, including offenses involving postal keys, arrow keys, identity theft, check fraud, and bank fraud;</text></paragraph> <paragraph id="HD169DBA36FD3461882964DD2D65E6467"><enum>(3)</enum><text>coordination among United States Attorneys’ Offices, the United States Postal Inspection Service, and other Federal, State, and local law enforcement agencies is essential to combating organized mail theft; and</text></paragraph> 
<paragraph id="H77DEBC1E430340C39EC06DD9BA9D5E29"><enum>(4)</enum><text>Federal sentencing policy should appropriately reflect the seriousness of offenses involving stolen or counterfeit postal access devices and organized mail theft schemes.</text></paragraph></subsection></section> <section id="H347FC9B125D54C9E92FA9AFC515D7A2F"><enum>3.</enum><header>Coordination of prosecution of mail theft offenses</header> <subsection id="HC2A2BFA8C4804F02B3963B7BD0914A26"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/35">Chapter 35</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<section id="HC308F951856C4FAEB61576601688367A"><enum>551.</enum><header>Mail theft coordinator</header>
<subsection id="H559ED46C143D4C24B98C9EB656F00D8D"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">The Attorney General shall, in consultation with the United States attorney for the district, designate in each judicial district an assistant United States attorney to serve as the Mail Theft Coordinator for the district.</text></subsection> <subsection id="HACA9E1D29E3B405B91E906F4446E602D"><enum>(b)</enum><header>Primary responsibilities</header><text>A mail theft coordinator shall have the primary responsibility for coordinating and supervising the investigation and prosecution of offenses involving—</text> 
<paragraph id="HD1A4A6D44F374963A9609C522ACB0789"><enum>(1)</enum><text>theft or unlawful possession of postal keys or locks under section 1704 of title 18;</text></paragraph> <paragraph id="H572E7DE4D1C9470E9C6EEEE4C1F4DB42"><enum>(2)</enum><text>theft or receipt of stolen mail matter under section 1708 of title 18;</text></paragraph> 
<paragraph id="H8A395AB9099F44F89DF34BB391417250"><enum>(3)</enum><text>organized schemes involving mail theft, identity theft, check fraud, bank fraud, or access device fraud facilitated through stolen mail; and</text></paragraph> <paragraph id="H45BEEBF79A2D4EC9AD5B989DBF7259A9"><enum>(4)</enum><text>related conspiracy or fraud offense arising from conduct described in paragraphs (1) through (3).</text></paragraph></subsection>
<subsection id="H7DC8F4B05D4543F4B60984DB5CCC91AB"><enum>(c)</enum><header>Coordination</header><text>In carrying out the responsibilities described in subsection (b), each mail theft coordinator shall coordinate, as appropriate, with—</text> <paragraph id="HB28D8F32982E4001816B6B8BAEA757D7"><enum>(1)</enum><text>the United States Postal Inspection Service;</text></paragraph> 
<paragraph id="HE9682598A67341C1BA2B91FC0AD8C61A"><enum>(2)</enum><text>the Federal Bureau of Investigation;</text></paragraph> <paragraph id="HB29EFBD933A54DA88F9A0088B07995A4"><enum>(3)</enum><text>the Department of Homeland Security;</text></paragraph> 
<paragraph id="H686905DBC34240D4991FAB73B7499DE0"><enum>(4)</enum><text>the Department of the Treasury;</text></paragraph> <paragraph id="H83E99E8FFC24424C9E2F48A389274118"><enum>(5)</enum><text>State and local law enforcement agencies; and</text></paragraph> 
<paragraph id="H5674EAF46A87406AAE528FACE65DC7DD"><enum>(6)</enum><text>other relevant Federal agencies.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HBB42C4320F6E4EBBB4A79E72AA40BACA"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/35">chapter 35</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<toc-entry level="section">551. Mail theft coordinator.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="H40385D3A476B421899FBF9E0A240F2A2"><enum>4.</enum><header>Report on organized mail theft</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter for 5 years, the Attorney General shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report regarding organized mail theft and related fraud offenses, including—</text> <paragraph id="H6178362CA0624573A444F4C60D207848"><enum>(1)</enum><text>trends in mail theft offenses;</text></paragraph> 
<paragraph id="H9425514F737E4FFAAFC0A62574D756CF"><enum>(2)</enum><text>the number and type of prosecutions brought under sections 1704 and 1708 of title 18, United States Code, and related fraud statutes;</text></paragraph> <paragraph id="H64ECA281A1254B68B50092FC7F5659AE"><enum>(3)</enum><text>coordination efforts among Federal, State, and local law enforcement agencies;</text></paragraph> 
<paragraph id="H37328977ABF94DA18A84B7DD2FF1CFEB"><enum>(4)</enum><text>trends involving theft, robbery, manufacture, duplication, or trafficking of postal keys, arrow keys, or counterfeit postal access devices; and</text></paragraph> <paragraph id="HB4B96EBD76514B58BF98B795FEF48A16"><enum>(5)</enum><text>recommendations for improving prevention, investigation, and prosecution of organized mail theft offenses.</text></paragraph></section> 
<section id="HD46C147134AF473BB643A3DB048D16CE"><enum>5.</enum><header>Sentencing guidelines with respect to mail theft offenses</header><text display-inline="no-display-inline">Not later than May 1 of the first calendar year beginning after the date of enactment of this Act, the United States Sentencing Commission shall review and amend the Federal sentencing guidelines and policy statements promulgated pursuant to section 994 of title 28, United States Code, to ensure that the guidelines provide appropriate sentencing enhancements for offenses involving—</text> <paragraph id="H0DCFF82CB46246168060480F08CB8BE5"><enum>(1)</enum><text>the theft, robbery, possession, duplication, manufacture, or trafficking of postal keys, arrow keys, or counterfeit postal access devices;</text></paragraph> 
<paragraph id="H93373C74829541B5AF3D78407687F6C6"><enum>(2)</enum><text>organized or large-scale mail theft schemes;</text></paragraph> <paragraph id="HD53455808F5743B4A991253AB27C24C6"><enum>(3)</enum><text>offenses involving identity theft, check fraud, bank fraud, or access device fraud facilitated through stolen mail;</text></paragraph> 
<paragraph id="H75F7256E321F49118DE8598F11E9667E"><enum>(4)</enum><text>offenses involving violence, threats, or robbery targeting employees or contractors of the United States Postal Service; and</text></paragraph> <paragraph id="H53274273894542868F175A849444B8BA"><enum>(5)</enum><text>offenses involving theft of mail affecting multiple victims or substantial financial loss.</text></paragraph></section> 
<section id="H2ACE3129E8B447CCAAA2DC630CA999E7"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to limit any authority otherwise available to the Department of Justice, the United States Postal Inspection Service, or any other Federal law enforcement agency.</text></section> </legis-body></bill>
