To prohibit the preemption of State or local land-use, zoning, siting, or permitting authority for data centers on non-Federal land, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
This Act may be cited as the “Protecting Local Control of Data Centers Act”.
SEC. 2. No preemption of State or local land-use, zoning, siting, or permitting authority for data centers.
Notwithstanding any other provision of law, the head of a Federal agency may not override, bypass, or displace State or local land-use, zoning, siting, or permitting authority for data centers located on non-Federal land, or condition the receipt of Federal funds for such data centers on a State or local government relinquishing or limiting such authority.
