<section id="H28A51D40BF1D49CD8CC3265D9646E216" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Data Center NDAs Act</short-title></quote>.</text></section> 
<section id="H494DE51F34AB4A57B6904F7644164D73"><enum>2.</enum><header>Prohibition with respect to certain nondisclosure agreements related to data centers</header> 
<subsection id="HA8B6D0DAE7CE43449D9552C61AF08292"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A Member of Congress may not sign any nondisclosure agreement with any unit of State or local government or any private entity as a condition on receiving access to information with respect to the planning or development of a data center, including information with respect to planned or received investments, location planning, construction designs, or water or energy resource consumption.</text></subsection> <subsection id="HF05320BE2C994251873630B3A9B3F672"><enum>(b)</enum><header>Restriction on use of Federal funds</header><text display-inline="yes-display-inline">No funds appropriated or otherwise made available from the U.S. Treasury may be used to implement or enforce a nondisclosure agreement described in subsection (a).</text></subsection> 
<subsection id="HCE31356AD84F42ACB407104B985C2D42" display-inline="no-display-inline" commented="no"><enum>(c)</enum><header>Regulations</header><text>The Committee on Ethics of the House of Representatives and the Select Committee on Ethics of the Senate shall each promulgate such regulations as may be necessary and appropriate to carry out the prohibition under this section.</text></subsection> <subsection id="H83E3AD6C5B5B43ED8DD41FEC97155442"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H19FE8EB526754BF68233D7C68B41889C"><enum>(1)</enum><header>Data center</header><text display-inline="yes-display-inline">The term <term>data center</term> has the meaning given such term in section 453(a) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112(a)</external-xref>).</text></paragraph> <paragraph id="H36CED49D4C2E4D719FDDDEB075600E57"><enum>(2)</enum><header>Member of Congress</header><text display-inline="yes-display-inline">The term <term>Member of Congress</term> means a Senator or Representative in, or Delegate or Resident Commissioner to, the Congress.</text> </paragraph></subsection></section>
