<section id="HDFB93BA635344E3B9D01B9EFB0324BE9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Radiation Exposure Compensation Reauthorization Act of 2026</short-title></quote>.</text></section> <section id="HB21E268038B345FE94FB1DBD88B4697C"><enum>2.</enum><header>Claims related to atmospheric testing</header><text display-inline="no-display-inline">Section 4 of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended—</text> 
<paragraph id="HB7A5CEEFF0F04089BB6E3A40D7A652CB"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HD3503B5263544BEC98A64E17EAAF1AC8"><enum>(A)</enum><text>in paragraph (1)(A)(i)—</text> 
<clause id="H97ED4542576B4B1E8FB5E168D8662638"><enum>(i)</enum><text display-inline="yes-display-inline">in subclause (I), by striking <quote>1962</quote> in each place it appears and inserting <quote>1992</quote>;</text></clause> <clause id="H1C8EFA29A87A4EF59EE6C7CA596F86BB"><enum>(ii)</enum><text>in subclause (III)—</text> 
<subclause id="H125E404CC9EF41B69AE3664B63335AFF"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>1962</quote> in each place it appears and inserting <quote>1992</quote>; and</text></subclause> <subclause id="HA5A64AAC706B4A1A8B83E68BE5FDB6B8"><enum>(II)</enum><text>by striking <quote>or</quote> at the end;</text></subclause></clause> 
<clause id="H4D3AD93261E949A4A0EE0D7AE24285A0"><enum>(iii)</enum><text>by striking subclause (IV); and</text></clause> <clause id="H214A7AD4692C4BE8B12E9C6FD7AA2B20"> <enum>(iv)</enum> <text>by inserting after subclause (III) the following:</text>

                                <enum>(IV)</enum>
 <text>was physically present in an affected area—</text> <item id="H067B0F38F3E944DCA898E3E9A3B8E2B0" commented="no"> <enum>(aa)</enum> <text>for a period of at least 1 year during the period beginning on July 1, 1946, and ending on November 6, 1992; or</text>
                                </item>
                                <item id="H92F608F1948B44C7A9B1E48B67C28079">
                                    <enum>(bb)</enum>
 <text>for the period beginning on April 25, 1962, and ending on November 6, 1962; or</text>
                                </item>
                            </subclause>
                            <subclause id="HF24167CA1E1643A49DD36B1DBE6DAACB">
                                <enum>(V)</enum>
 <text>participated—</text> <item id="H5CD66726996743D6A5B2F4F75DAE6255"> <enum>(aa)</enum> <text>onsite in a test involving the atmospheric detonation of a nuclear device; or</text>
                                </item>
                                <item id="H3D9A4EDEF4334B8CB8B5C312EBE2D9C3">
                                    <enum>(bb)</enum>
 <text>onsite in the radiological cleanup of Enewetak Atoll during the period beginning on January 1, 1977, and ending on December 31, 1980; or</text>
                                </item>
                                <item id="H2E935335E1A94E3E9E6C9E88EA2CBAE6">
                                    <enum>(cc)</enum>
 <text>onsite in the response effort following the collision of a United States Air Force B–52 bomber and refueling aircraft that caused the release of four thermonuclear weapons in the vicinity of Palomares, Spain, during the period beginning January 17, 1966, and ending March 31, 1967; or</text>
                                </item>
                                <item id="H53DBF0B14BD94F6AA4376D79E1E1184A">
                                    <enum>(dd)</enum>
 <text>onsite in the response effort following the on-board fire and crash of a United States Air Force B–52 bomber that caused the release of four thermonuclear weapons in the vicinity of Thule Air Force Base, Greenland, during the period beginning January 21, 1968, and ending September 25, 1968;</text>
                                </item>
                            </subclause>
                            <subclause id="HB8C92EB4F1C94F52969B6CABB70E3FCE" display-inline="no-display-inline">
                                <enum>(VI)</enum>
 <text>is a member of the petitioner cohort; and</text> </subclause> <after-quoted-block>; and</after-quoted-block> </quoted-block> </clause></subparagraph> <subparagraph id="H958F2FE25B3740F395AFFBA3A715127A"><enum>(B)</enum><text>in paragraph (2)—</text> 
<clause id="H4175C78927EC45E3B8DA0A316C7A9C39"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>1962</quote> each place it appears and inserting <quote>1992</quote>;</text></clause> <clause id="H0AE2741B1B6C49F08233B864CA3D117F"><enum>(ii)</enum><text>in subparagraph (C)—</text>

<subsection id="HAC73406AAAE74F10ACA14915EC33DD44"><enum>(a)</enum><header>Downwinder claims</header><text>Section 4(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended—</text> <paragraph id="HF626C549744C4C9BBE6C9FFD46AE5EE3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by striking <quote>$100,000</quote> and inserting <quote>$150,000 in addition to the total amount of compensation for which the individual is eligible under paragraph (5)</quote>;</text></paragraph>

<paragraph id="H88F4C097E2C64972AB19D7B5C9CD1D61"><enum>(5)</enum><header>Medical benefits</header><text>An individual receiving a payment under this section shall be eligible to receive, upon submission of contemporaneous written medical records, reports, or billing statements created by or at the direction of a licensed medical professional who provided contemporaneous medical care to the claimant, additional compensation in the amount of all documented out-of-pocket medical expenses incurred as a result of the specified disease suffered by that claimant, such as any medical expenses not covered, paid for, or reimbursed through—</text> <subparagraph id="H47CEC844E3CE4668859E7E57008E2418"><enum>(A)</enum><text>any public or private health insurance;</text></subparagraph> 
<subparagraph id="H90A2FB8D8CDF47E58E1FE4AAB308812A"><enum>(B)</enum><text>any employee health insurance;</text></subparagraph> <subparagraph id="H1C01DE743A144C23A8F3AF91FB96CF13"><enum>(C)</enum><text>any workers’ compensation program; or</text></subparagraph> 
<subparagraph id="H5EBE1636ABF146039A5FAB1536EBE3C3"><enum>(D)</enum><text>any other public, private, or employee health program or benefit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H1CBC1396986E4588BD4EC97383C9B918"><enum>(b)</enum><header>Manhattan project waste claims</header><text>Section 5A of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/425">Public Law 101–425</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended in subsection (b)(1) by striking <quote>in an amount that is the greater of $50,000 or the total amount of compensation for which the individual is eligible under paragraph (2).</quote> and inserting <quote>$150,000 in addition to the total amount of compensation for which the individual is eligible under paragraph (2).</quote>.</text> </subsection> 
<subsection id="HB8EB2A1EB7564C28A39E496417025486"><enum>(c)</enum><header>Manhattan project waste claims payments to beneficiaries of deceased individuals</header><text>Section 5A of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/425">Public Law 101–425</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended in subsection (c) by striking <quote>$25,000</quote> in each instance it appears and inserting <quote>$150,000</quote>.</text></subsection></section> <section id="H9DDD1338A6924B7AAB2EF5660AA2064B"><enum>5.</enum><header>Affidavits</header><text display-inline="no-display-inline">Section 6(b) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended by adding at the end the following:</text>

<paragraph id="H0CF1C63064C44FFA80279D5915A4CBFB"><enum>(3)</enum><header>Affidavits</header> 
<subparagraph id="HE02913EDDBD44A2D976701654115BAB2"><enum>(A)</enum><header>Employment history</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate the employment of an individual as a miner, miller, core driller, or ore transporter if the affidavit—</text> <clause id="H48A16454CB80481E9D7C8803A4852ECB"><enum>(i)</enum><text>is provided in addition to the other material that may be used to substantiate the employment history of the individual;</text></clause> 
<clause id="HF8133AB7293E4EBB898904FD9189A371"><enum>(ii)</enum><text>attests to the employment history of the individual;</text></clause> <clause id="HD372B1D049BB4D33A6BA3BB34B5B876D"><enum>(iii)</enum><text>is made subject to the penalty for perjury; and</text></clause> 
<clause id="H6FF8B1DA52104BBC816CAFC18B45766D"><enum>(iv)</enum><text>is made by a person other than the individual filing the claim.</text></clause></subparagraph> <subparagraph id="HF8C1249827D142AABE903A9B754F1AAF"><enum>(B)</enum><header>Physical presence in affected area</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s physical presence in an affected area during a period described in section 4(a)(1)(A)(i) or section 4(a)(2) if the affidavit—</text> 
<clause id="HF4171F7AE7FC4C89B5D62CD9A6930E53"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s presence in an affected area during that time period;</text></clause> <clause id="HDAB2CA4D5C12415D89964212FC247674"><enum>(ii)</enum><text>attests to the individual’s presence in an affected area during that period;</text></clause>

<subparagraph id="HC99DB047809141838F45273E3F9DAD9F"><enum>(C)</enum><header>Participation at testing site</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device if the affidavit—</text> <clause id="H455C3104A3164A50BDDE20103CF31B8D"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause> 
<clause id="H21B935648AFA45F4AB35B9FA9E84677F"><enum>(ii)</enum><text>attests to the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause> <clause id="H9F2AEFEE34BF43CCA69CC139A69F9370"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause> 
<clause id="H431A86FFA8BF4990A1C78F4B3702A329"><enum>(iv)</enum><text>is made by a person other than the individual filing the claim.</text></clause></subparagraph> <subparagraph id="HC30FBA54D669442A9F8A8BC119AA9B2A"><enum>(D)</enum><header>Participation in cleanup</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in the cleanup of Enewetak Atoll during the period beginning on January 1, 1977, and ending on December 31, 1980, if the affidavit—</text> 
<clause id="HD331C35CD11C40BEB208A141C839540D"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s participation onsite in the cleanup of Enewetak Atoll during such period;</text></clause> <clause id="H4C874F7AE65F4ACA8B3C624E4AABD72F"><enum>(ii)</enum><text>attests to the individual’s participation onsite in the cleanup of Enewetak Atoll during such period;</text></clause> 
<clause id="HA3C5ED482D634FE697A387BD7D277E64"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause> <clause id="HA9A6F5F74F9249A3AC3CE6BD203C13E0"><enum>(iv)</enum><text>is made by a person other than the individual filing the claim.</text></clause></subparagraph> 
<subparagraph id="HD43123B94DDC4863B7C3FEB75A31A22A" commented="no">
                        <enum>(E)</enum>
                        <header>Participation in palomares response effort</header>
 <text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in the response effort following the collision of a United States Air Force B–52 bomber and refueling aircraft that caused the release of four thermonuclear weapons in the vicinity of Palomares, Spain, during the period beginning January 17, 1966, and ending March 31, 1967, if the affidavit—</text>
                        <clause id="H4FF9B6AC3A71451BB4A0E0FC811DF252" commented="no">
                            <enum>(i)</enum>
 <text>is provided in addition to other material that may be used to substantiate the individual’s participation onsite in such response effort during such period;</text>
                        </clause>
                        <clause id="H90D4540FACE34DE48C30D26FC7FAAEE4" commented="no">
                            <enum>(ii)</enum>
 <text>attests to the individual’s participation onsite in such response effort during such period;</text>
                        </clause>
                        <clause id="H0501E5350B004860A2710E74C6557A5F" commented="no">
                            <enum>(iii)</enum>
 <text>is made subject to penalty for perjury; and</text> </clause> <clause id="HE69669BD23AF47DBB2AC5A6F7BEF7AFF" commented="no"> <enum>(iv)</enum> <text>is made by a person other than the individual filing the claim.</text>
                        </clause>
                    </subparagraph>

                        <enum>(F)</enum>
                        <header>Participation in thule response effort</header>
 <text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in the response effort following the on-board fire and crash of a United States Air Force B–52 bomber that caused the release of four thermonuclear weapons in the vicinity of Thule, Greenland, during the period beginning January 21, 1968, and ending September 25, 1968, if the affidavit—</text>
                        <clause id="H5A8A5D7ADB13497B9B4565C697A1AC71" commented="no">
                            <enum>(i)</enum>
 <text>is provided in addition to other material that may be used to substantiate the individual’s participation onsite in such response effort during such period;</text>
                        </clause>
                        <clause id="H817BFFA412AA41C399E5EBD960BA2C0C" commented="no">
                            <enum>(ii)</enum>
 <text>attests to the individual’s participation onsite in such response effort during such period;</text>
                        </clause>
                        <clause id="H6F4168E7B77347DC9954EC68D7C185C1" commented="no">
                            <enum>(iii)</enum>
 <text>is made subject to penalty for perjury; and</text> </clause> <clause id="HCBE35FA8B2904E61ACCCF54CF4FBCD5D" commented="no"> <enum>(iv)</enum> <text>is made by a person other than the individual filing the claim.</text>
                        </clause>
                    </subparagraph> 
<subparagraph id="HC3E1B794BE1A48E9AF964D9367273056"><enum>(G)</enum><header>Compensable diseases</header><text>For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s contraction of one of the cancers and diseases enumerated in section 4(b)(2), section 5(a)(1)(A)(ii), section 5(b)(3), section 5(b)(6), or section 5A(e), if the affidavit—</text> <clause id="H25E75BFD416F455697069C7D0A93D842"><enum>(i)</enum><text>is provided in addition to other material that may be used to substantiate the individual’s contraction of such cancer or diseases;</text></clause> 
<clause id="HC14ABC19174744DEA53004B4D8B74B68"><enum>(ii)</enum><text>attests to the individual’s contraction of such cancer or diseases;</text></clause> <clause id="H1A2C0E5E045C4576AEE4FAE4DCCE2267"><enum>(iii)</enum><text>is made subject to penalty for perjury; and</text></clause>

<subsection id="H407E04A26F98479097C14D611E76981D"><enum>(c)</enum><header>Establishing filing procedures</header><text display-inline="yes-display-inline">Section 6(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended to read as follows:</text> <quoted-block id="HEE1436EC86FB4A87878B66A2711A6328" style="OLC"> <subsection id="HD33579B37C2A47C189C52A8AD349BFC0"><enum>(a)</enum><header>Establishment of filing procedures</header><text>The Attorney General shall establish procedures whereby individuals may submit claims for payments under this Act. In establishing procedures under this subsection, the Attorney General shall—</text> 
<paragraph id="HD73019C5A56143DEB7B5590AD2600541"><enum>(1)</enum><text>take into account and make allowances for the law, tradition, and customs of Indian Tribes (as that term is defined in section 5(b)) and members of Indian Tribes, to the maximum extent practicable; and</text></paragraph> <paragraph id="HE1148017941B495EA29E6D2F1F3262EC" commented="no"><enum>(2)</enum><text>accept claims filed by—</text> 
<subparagraph id="H106B9AFE8A8344BF8FD07FD4647328E7"><enum>(A)</enum><text>an exposed individual;</text></subparagraph> <subparagraph id="HDFB1E11775194A0A83DA76CE398805B6"><enum>(B)</enum><text>survivors of such an individual as set forth in section 6(c)(4)(A); or</text></subparagraph>

<subclause id="HF1CE69F27C314757B3E97CD1485EBC10"><enum>(III)</enum><text>a personal representative or a conservator of a legal guardian of the individual; or</text></subclause> <subclause id="HE279B266B3014110B4F7FB3899B1090D"><enum>(IV)</enum><text>a person that the Attorney General determines is similarly situated to a person described in subclauses (I) through (III).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>

<paragraph id="HD204EB2BD2694A20AA1559409F521FDA"><enum>(2)</enum><text><quote>specified disease</quote> means leukemia (including chronic lymphocytic leukemia), provided the onset of the disease was at least 2 years after first exposure, and the following diseases, provided onset was at least 2 years after first exposure: multiple myeloma, lymphomas (other than Hodgkin’s disease), renal disease, thyroid diseases, and primary cancer of the: thyroid, male or female breast, esophagus, stomach, pharynx, small intestine, pancreas, bile ducts, gall bladder, salivary gland, urinary bladder, brain, colon, ovary, liver (except if cirrhosis or hepatitis B is indicated), bone, renal, rectal, prostate, uterine, cervical, skin, or lung.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HA767FE5031DA4E339174BC5A4B721750"><enum>(2)</enum><text>in section 5A(e)(2)—</text> 
<subparagraph id="H60C5C73FC50C499C8CE050891B1A35A1"><enum>(A)</enum><text>by redesignating subparagraph (C) as subparagraph (E);</text></subparagraph> <subparagraph id="HC764DC228C974E59933D1886385B9C25"><enum>(B)</enum><text>by inserting after subparagraph (B) the following:</text>

<subsection id="H580C35D696F940DEA9BA5EE987B4458C"><enum>(b)</enum><header>Extension of limitation on claims</header><text>Section 9(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (as redesignated by section 10 of this Act) is amended by striking <quote>2027</quote> and inserting <quote>2042</quote>.</text></subsection></section> <section id="H9E7A3B1267AA4B27BFE1F9CC1849A6A9"><enum>9.</enum><header>Previously successful claims</header> <subsection id="H9561867A6D194C8290E1E56240EF9CC1"><enum>(a)</enum><header>In general</header><text>After the date of enactment of this Act, any claimant who received compensation under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) may submit a request to the Attorney General for additional compensation and benefits. Such request shall contain—</text> 
<paragraph id="H4E5F93A54EEA4EA2B8DDEC51DC354E85"><enum>(1)</enum><text>the claimant’s name, social security number, and date of birth;</text></paragraph> <paragraph id="H66B24FE405F848E0B96D7B23FF492B69"><enum>(2)</enum><text>the amount of award received under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) before the date of enactment of this Act;</text></paragraph> 
<paragraph id="H7C42B1481A274ABAB4ECA39F5594E036"><enum>(3)</enum><text>any additional benefits and compensation sought through such request; and</text></paragraph> <paragraph id="H41EDE60E04AC40678C096EA818CBDB4F"><enum>(4)</enum><text>any additional information required by the Attorney General.</text></paragraph></subsection> 
<subsection id="H2C7F505B4CA34E7287C69362BDA0AD90"><enum>(b)</enum><header>Additional compensation</header><text>If the claimant received compensation under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) before the date of enactment of this Act and submits a request described in subsection (a), the Attorney General shall—</text> <paragraph id="H3EEB365DAAD143A68105DC5A2B7F93E3"><enum>(1)</enum><text>pay the claimant the amount that is equal to any excess of—</text>
                    <subparagraph id="HFC18853FD01D4A7FAEB81B2F67B0E3E6">
                        <enum>(A)</enum>
 <text>the amount the claimant is eligible to receive under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) as amended by this Act; minus</text>
                    </subparagraph> 
<subparagraph id="HA35946B3E8D34BA18A9D61459E2EAD11"><enum>(B)</enum><text>the aggregate amount paid to the claimant under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) before the date of enactment of this Act; and</text></subparagraph></paragraph> <paragraph id="HE6AC6D3FA5244508A2171866BB776571"><enum>(2)</enum><text>in any case in which the claimant was compensated under section 4 of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note), provide the claimant with medical benefits under section 4(a)(5) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note).</text></paragraph></subsection></section>

<subsection id="HFC70E84B80A74BF6B02B4F5816F47E82"><enum>(c)</enum><header>Authority</header><text>The Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended—</text> <paragraph id="H40B53567A26C408C951C9BC8B0976A8E"><enum>(1)</enum><text>by redesignating sections 7 through 13 as sections 8 through 14, respectively; and</text></paragraph> 
<paragraph id="H7D26B87AA4834BCAA4844E55307F30B3"><enum>(2)</enum><text>by inserting after section 6 the following:</text> <quoted-block id="H9E2E2065A6F6421CAD02FA8175AE763A" style="OLC"> <section id="HC873E7DA25B349118B21945146DAADFB"><enum>7.</enum><header>Designation of additional classes of individuals</header> <subsection id="HAF2DF72CD88F451D9A73977B16A53DB2"><enum>(a)</enum><header>Advice on additional individuals</header> <paragraph id="HD6DA86566311406096E0331EB7F38E6C"><enum>(1)</enum><text display-inline="yes-display-inline">The Attorney General shall advise the President whether there is a class of individuals who likely were exposed to radiation as a result of atmospheric nuclear testing, uranium mining, uranium milling, uranium core drilling, or Manhattan Project waste disposal but who are not currently eligible for compensation under this Act.</text></paragraph> 
<paragraph id="H6486BB4C5B074CF898B83C0E606C5BED"><enum>(2)</enum><text>The advice of the Attorney General under paragraph (1) shall be based on exposure assessments by radiation health professionals, information provided by the Department of Energy, the Department of Defense, and the Department of Health and Human Services and such other information as the Attorney General considers appropriate.</text></paragraph> <paragraph id="H6071260772C64D22944412C1AC384D81"><enum>(3)</enum><text>The President shall request advice under paragraph (1) after consideration of petitions by classes of individuals described in that paragraph for such advice. The President shall consider such petitions pursuant to procedures established by the President.</text></paragraph></subsection> 
<subsection id="HF9F9B55968A549DDAE19E3326EA39EE2"><enum>(b)</enum><header>Designation of additional individuals</header><text display-inline="yes-display-inline">Subject to the provisions of this Act, the members of a class of individuals who likely were exposed to radiation as a result of atmospheric nuclear testing, uranium mining, uranium milling, uranium core drilling, or Manhattan Project waste disposal, may be treated as members of the petitioner cohort eligible under an existing claimant category, or if needed, a new claimant category for purposes of the compensation program if the President, upon recommendation of the Attorney General, determines that—</text> <paragraph id="HCBD98CA3797F4DD38EAE34985C845C19"><enum>(1)</enum><text display-inline="yes-display-inline">such class of individuals are not currently covered under this Act;</text></paragraph> 
<paragraph id="H1ADE91D40A044AE3AF0118A6328CA4A1"><enum>(2)</enum><text>there is a reasonable likelihood that such radiation dose may have endangered the health of members of the class; and</text></paragraph> <paragraph id="H65F96457370546C598F667F71ABB6308"><enum>(3)</enum><text>such a determination is aligned with the purposes of this Act.</text></paragraph></subsection> 
<subsection id="H8C3474A949154CABA6ECBB449B53A771"><enum>(c)</enum><header>Deadlines</header> 
<paragraph id="HA4E7BEDB689F48FF87D2F0AD813BB7F1"><enum>(1)</enum><text>Not later than 180 days after the date on which the President receives a petition for designation as members of the petitioner cohort, the Secretary of Energy and the Secretary of Health and Human Services shall submit to the Attorney General a recommendation on that petition, including all supporting documentation.</text></paragraph> <paragraph id="HB242624A90D54F33B732F9BEA1B205D5"><enum>(2)</enum><text>Upon receipt by the President of a recommendation of the Attorney General that the President should determine in the affirmative that paragraphs (1) and (2) of subsection (b) apply to a class, the President shall have a period of 30 days in which to determine whether such paragraphs apply to the class and to submit that determination (whether affirmative or negative) to Congress.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H765CD30BC4764958B5DF691861EADA61"><enum>11.</enum><header>Study of radiological fallout impacts in the commonwealth of the northern mariana islands</header> 
<subsection id="H531CAD0AE9804AF59C582F1BDAC6DE52"><enum>(a)</enum><header>Study required</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of Energy, in consultation with the Administrator of the National Nuclear Security Administration, the Secretary of Health and Human Services, the heads of other relevant Federal departments and agencies, and the National Academies of Sciences, Engineering, and Medicine, shall conduct a study to determine the extent to which radioactive fallout resulting from atmospheric nuclear weapons testing conducted by the United States in the Pacific Proving Grounds, including the Marshall Islands, during the period beginning in 1946 and ending in 1962 (in this section referred to as <quote>covered testing</quote>) may have affected residents of the Commonwealth of the Northern Mariana Islands.</text></subsection> <subsection id="H4B3547553452467A852CF17F9132C11D"><enum>(b)</enum><header>Elements</header><text>The study under subsection (a) shall include—</text> 
<paragraph id="HF24920B887D84202A62043BCB413FBF6"><enum>(1)</enum><text>a review of historical records, meteorological data, environmental monitoring data, fallout modeling, declassified documents, and other relevant information relating to covered testing;</text></paragraph> <paragraph id="HEDA1B48B8109480CBE609A97844EF99D"><enum>(2)</enum><text>an assessment of the extent to which radioactive fallout resulting from covered testing reached inhabited areas of the Commonwealth of the Northern Mariana Islands, including Saipan, Tinian, and Rota;</text></paragraph> 
<paragraph id="HB8E39BCE057542C4B39AD707551FD15D"><enum>(3)</enum><text>an evaluation of potential radiation doses received by individuals residing in the Commonwealth of the Northern Mariana Islands during the period specified in subsection (a) as a result of covered testing, and any associated health risks;</text></paragraph> <paragraph id="H1F264224BCEC4F92B00092EB308D6062"><enum>(4)</enum><text>an identification of any gaps in available data necessary to assess historical radiation exposure experienced by such individuals, and recommendations for additional research necessary to address such gaps;</text></paragraph> 
<paragraph id="H06915ACE6A0345B68BE8CAF55911E513"><enum>(5)</enum><text>an assessment of whether the levels of radiation exposure identified pursuant to paragraph (3) would be comparable to radiation exposure levels experienced by populations eligible, or previously eligible, for compensation under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note); and</text></paragraph> <paragraph id="H7DA3386671594230A092A7C7D13C7CD2"><enum>(6)</enum><text>a determination of whether the available evidence supports extending eligibility for compensation under such Act, or any successor compensation program, to individuals who resided in the Commonwealth of the Northern Mariana Islands during the period specified in subsection (a).</text></paragraph></subsection> 
<subsection id="H3AA2DCE923D941BEA8B097E640589E91"><enum>(c)</enum><header>Report</header> 
<paragraph id="H0A2D1CFF97194D5E9AE5ED6FB31C8661"><enum>(1)</enum><header>Submission to congress</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of Energy shall submit to the appropriate congressional committees a report containing the findings and recommendations of the study under subsection (a).</text></paragraph> <paragraph id="HEC6F676A8F784F4A8811D101952CB57E"><enum>(2)</enum><header>Form</header><text>The report under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph> 
<paragraph id="H75D8BD2896CE4D3896E04C406738C221"><enum>(3)</enum><header>Public availability</header><text>The Secretary of Energy shall make the unclassified portion of the report under paragraph (1) publicly available on a website of the Department of Energy.</text></paragraph></subsection> <subsection id="H663F1373318845A4A4B238FE87E6382B"><enum>(d)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> 
<paragraph id="H7BFB32444C0D4F17A155F51AE434C160"><enum>(1)</enum><text>the Committee on Armed Services, the Committee on the Judiciary, the Committee on Energy and Commerce, and the Committee on Natural Resources of the House of Representatives; and</text></paragraph> <paragraph id="H6841848177964B12831201B9EC37C275"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on the Judiciary, and the Committee on Energy and Natural Resources of the Senate.</text></paragraph></subsection></section> 
<section id="H34F9FBBE907A4E6882DD2A236AC493A6"><enum>12.</enum><header>Studies and information on health of RECA claimants and descendants</header> 
<subsection id="H411EB8281F894BE18F56FC8D2A0EE162"><enum>(a)</enum><header>National institutes of health study on qualified cancers</header> 
<paragraph id="H4AE635304D4941FF98063724E6C6C416"><enum>(1)</enum><header>Study</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of the National Institutes of Health shall conduct a study to evaluate the health, specifically with respect to qualified cancer incident rates, among covered descendants.</text></paragraph> <paragraph id="H8127F40D0332478C8C0F224728126123"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the study under paragraph (1) is completed, the Director of the National Institutes of Health shall submit to the Congress a report on such study.</text></paragraph></subsection> 
<subsection id="HAE38395972C84A9BA503FB60C5B406AD"><enum>(b)</enum><header>National institutes of health study on qualified thyroid illness</header> 
<paragraph id="H3349F9D26DB744768FEC01EE1F367EBE">
                    <enum>(1)</enum>
                    <header>Study</header>
 <text>Not Later than 90 days after the date of the enactment of this act, the Director of the National Institutes of Health shall conduct a study to evaluate the health, specifically with respect to qualified thyroid illness, among—</text>
                    <subparagraph id="H4AFCB9E52EF145AA947FCF28ABF08329">
                        <enum>(A)</enum>
 <text>qualified individuals and covered descendants; and</text> </subparagraph> <subparagraph id="HAFF2F1BE902D419F9280B0DCC9B6D303"> <enum>(B)</enum> <text>qualified individuals who participated in any study for which a Federal agency was the sponsor, relating to radiation exposure and related illness.</text>
                    </subparagraph>
                </paragraph> 
<paragraph id="H8080DF5D748D41E09FBB883B14B2EFFC">
                    <enum>(2)</enum>
                    <header>Report</header>
 <text>Not later than 90 days after the date on which the study under paragraph (1) is completed, the Director of the National Institutes of Health shall submit to the Congress a report on such study.</text>
                </paragraph></subsection> 
<subsection id="HFF584E6938AF418DA011CD7AB1CCE163"><enum>(c)</enum><header>Collaboration with other entities</header><text>In carrying out the studies described in subsection (a) and subsection (b), the Director of the National Institutes of Health may enter into agreements with the Secretary of Defense, the Secretary of Energy, the heads of other relevant Federal departments and agencies, and the National Academies of Science, Engineering, and Medicine.</text></subsection> <subsection id="H98AC8D607F5A4347A0B11CFFD36485C3"> <enum>(d)</enum> <header>Database on international radiation exposure</header> <text>Not later than 1 year after the date of the enactment of this Act, the Director of the National Institutes of Health, in consultation with the Secretary of State, shall seek to enter into a partnership or partnerships with relevant foreign health ministries and organizations under which such the Director and such ministries and organizations will establish an international information system tracking the various studies on international radiation exposure and identifying populations of interest for additional study.</text>
            </subsection> 
<subsection id="H0F3A0F91D9EE499EB1C186948040EB47">
                <enum>(e)</enum>
                <header>Authorization of appropriations</header>
 <text>There are authorized to be appropriated such funds as are needed to carry out this section, for the period of fiscal years 2027 through 2032, to remain available until expended.</text>
            </subsection> 
<subsection id="H16B6E098562246C193A20EE7F04F24D1">
                <enum>(f)</enum>
                <header>Definitions</header>
 <text>In this Act:</text> <paragraph id="H214D3A4018224BCDB4761BC5E15B66BD"> <enum>(1)</enum> <header>Qualified individual</header> <text>The term <term>qualified individual</term> means an individual who—</text>

                        <enum>(A)</enum>
 <text>is described in—</text> <clause id="HB2B8B7AE24DC424395EEDF533C67C44C"> <enum>(i)</enum> <text>subsection (a)(1)(A)(i) of section 4 of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note);</text>
                        </clause>
                        <clause id="HBB52F00167C74574B93ACE8F9F4F09DA">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">subsection (a) of section 5 of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note); or</text>
                        </clause>
                        <clause id="HC9FF7499B315407C9D15060F8640DB15">
                            <enum>(iii)</enum>
 <text display-inline="yes-display-inline">section 5A of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note); and</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="HC1A0C9975FE24A9A8B90769FC7EF5F64">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">has received payment pursuant to a claim submitted under the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note).</text>
                    </subparagraph>
                </paragraph>

                    <enum>(2)</enum>
                    <header>Covered descendant</header>
 <text>The term <term>covered descendant</term> means a direct descendant of an individual described in paragraph (1).</text>
                </paragraph>
                <paragraph id="H0F11284BD6F64D0F8446B6FDE5AB84DD">
                    <enum>(3)</enum>
                    <header>Qualified cancer</header>
 <text display-inline="yes-display-inline">The term qualified cancer means any cancer that is listed as a specified diseases under section 4(b), section 5(a)(ii), or section 5A(e) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) and such other cancer as may be specified by the Secretary of Health and Human Services.</text>
                </paragraph>
                <paragraph id="HD9B04FAD371349D0B16E68E16593487E">
                    <enum>(4)</enum>
                    <header>Qualified thyroid illnesses</header>
 <text display-inline="yes-display-inline">The term <term>qualified thyroid illness</term> means any illness relating to the thyroid that is listed as a specified diseases under section 4(b) or section 5A(e) of the Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) and such other illness relating to the thyroid as may be specified by the Secretary of Health and Human Services.</text>
                </paragraph>
            </subsection> 
<subsection id="HAC6210FF974D4A53A54BF9E1D88A3DC1">
                <enum>(g)</enum>
                <header>National radiation exposure screening and education program</header>
 <text>Section 527C(b)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285a-9">42 U.S.C. 285a–9(b)(1)</external-xref>) is amended by inserting <quote>or a covered descendent (as defined in section 12(e) of the Radiation Exposure Compensation Reauthorization Act of 2026</quote> after <quote>note)</quote>.</text>
            </subsection></section> 
<section id="H653F468A1C98411B9441D8F07678B4AB"><enum>13.</enum><header>RESEP clinics; additional funds</header> 
<subsection id="H98E61111E0FC493297252E9E5E38ED19">
                <enum>(a)</enum>
                <header>Geographical distribution of awards</header>
 <text>The Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, shall, to the extent practicable, take the steps necessary to ensure that grants awarded under section 527C(b)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285a-9">42 U.S.C. 285a–9(b)(1)</external-xref>) are distributed to applicants as follows:</text>

<subsection id="H31455D1C9955448CA50CB8EF9C67574A"><enum>(b)</enum><header>Mobile clinics</header><text>In addition to the requirements under subsection (a), the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, shall, to the extent practicable, ensure that no less than four awards are made to applicants who propose the operation of mobile units in rural areas located in one of the States or U.S. territories listed in subsection (a).</text></subsection> <subsection id="HAA2EC49B43E8471FAFA1C425D6EBF772"><enum>(c)</enum><header>Appropriations</header><text>There is hereby appropriated the following amounts to carry out this section:</text>
