<section id="H2CF34CC2CF9B407E94C65F2AE4DC1DBE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visa Improvement, Streamlined Investment, and Tourism Optimization Reform Act</short-title></quote> or the <quote><short-title>VISITOR Act</short-title></quote>.</text></section> <section id="HC798299A45E342868333B4A402727EC7"><enum>2.</enum><header>Authority to use collected fees to reduce visa wait times</header> <subsection id="H4ACEE35A165B44E6BD795583CE37D048"> <enum>(a)</enum> <header>Amendment to the Passport Act</header> <text display-inline="yes-display-inline">Section 1(b) of the Passport Act of June 4, 1920 (<external-xref legal-doc="usc" parsable-cite="usc/22/214">22 U.S.C. 214(b)</external-xref>), is amended—</text>

          <enum>(1)</enum>
 <text>in paragraph (1), by striking <quote>such costs</quote> and inserting <quote>the costs of providing consular services</quote>;</text>
        </paragraph>
        <paragraph id="HEFB6BA8E7CCE443B827BD89E9F8FFB55">
          <enum>(2)</enum>
 <text display-inline="yes-display-inline">by striking paragraph (2); and</text> </paragraph> <paragraph id="H907D42DC9B6044D0801490F3C5AA0658"> <enum>(3)</enum> <text>by redesignating paragraph (3) as paragraph (2).</text>
        </paragraph>
      </subsection> 
<subsection id="H39668B13A5084486BF60DDD6163E03E2"><enum>(b)</enum><header>Authority To use collected fees for the purposes of reducing visa wait times</header> 
<paragraph id="H7AD0E218E7A948179CA3DF3274FB4E7B"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the following passport and immigrant visa surcharges collected in any fiscal year are authorized to be made available for the costs of providing general consular services, including the consular protection of United States citizens and their interests overseas:</text> <subparagraph id="H6D24EA141D634FFAACABB11F1050DE7C"><enum>(A)</enum><text display-inline="yes-display-inline">Surcharges collected pursuant to the fourth paragraph under the heading <quote>Diplomatic and Consular Programs</quote> in the Department of State and Related Agency Appropriations Act, 2005 (title IV of division B of <external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1714">8 U.S.C. 1714</external-xref>).</text></subparagraph> 
<subparagraph id="HD392C8FF8E43475CACF3E04ADFC17713"><enum>(B)</enum><text display-inline="yes-display-inline">Fees deposited into the Fraud Prevention and Detection Account and made available for the purposes described in section 286(v)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(v)(2)(A)</external-xref>).</text></subparagraph></paragraph> <paragraph id="H15804A0922FB4B518D93B6EB7A80531B"><enum>(2)</enum><header>Authority to transfer unobligated fee balances</header> <subparagraph id="H4B917F6B37684FC7A32A687357606CE4"><enum>(A)</enum><header>Transfer of existing fee collection</header><text>The unobligated balances of each amount available from fees listed in section 7081(h) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2017 (division J of <external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref>) are authorized to be transferred to the Consular and Border Security Programs account and between accounts of the Department of State under the heading <quote>Administration of Foreign Affairs</quote> for the purposes described in paragraph (1) of this subsection.</text></subparagraph> 
<subparagraph id="HC1CCBD5FF5D543B694123E95F8ABFC0E"><enum>(B)</enum><header>Transfer of other amounts made available for administration of foreign affairs</header><text display-inline="yes-display-inline">The unobligated balances of any amounts made available to the Department of State under the heading <quote>Administration of Foreign Affairs</quote> by any Act are authorized to be transferred to the Consular and Border Security Programs Account if the Secretary of State determines and reports to the Committees on Appropriations of the House of Representatives and the Senate that to do so is necessary to sustain consular operations, following consultation with such Committees.</text></subparagraph></paragraph> <paragraph id="H31887641E6BD473C8CB0A4D69A2EE78E"><enum>(3)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 6 of the Department of State Authorities Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1714">8 U.S.C. 1714</external-xref> note) is amended by inserting <quote>and the provision of other general consular services</quote> after <quote>in support of enhanced border security</quote> each place it appears.</text></paragraph></subsection> 
<subsection id="H34B85BE5B5C44E8EA875CCFF66B7EC52"><enum>(c)</enum><header>Goal of reduced visa wait time</header><text display-inline="yes-display-inline">The Secretary of State is authorized to take such steps as may be necessary for the goal of ensuring that 80 percent of nonimmigrant visa applicants are interviewed within 3 weeks of receipt and application, recognizing that resource and security considerations and the need to ensure provision of consular services to United States citizens may dictate specific exceptions to this goal.</text></subsection></section> </legis-body></bill>
