<section id="HE31CE6BABA4C42A48CD027032F31400D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Utility Lobbying Ban Act</short-title></quote>.</text></section> <section id="HFEB5152FC1224A43AB5AF3FD572860CB"><enum>2.</enum><header>Condition on granting State energy program financial assistance</header> <subsection id="H6F69BB3346F143E18A7E286F18226A77"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding part D of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>), beginning with the first full fiscal year following the date of enactment of this section, the Secretary shall withhold 10 percent of the amount of State energy program financial assistance to be granted to a State in a fiscal year unless the Secretary determines the State—</text> 
<paragraph id="H9E4F4CF9C6D94EF9B6DCF08DBE98C528"><enum>(1)</enum><text display-inline="yes-display-inline">prohibits any person who is a former officer or employee of a State regulatory authority from, after the termination of his or her service or employment with such State regulatory authority, making an appearance or advocating before any officer or employee of such State regulatory authority on behalf of any electric utility with respect to which such State regulatory authority has ratemaking authority in connection with a particular matter in which the electric utility is a party or has a direct and substantial interest and in which the person participated personally and substantially during his or her service or employment with the State regulatory authority;</text></paragraph> <paragraph id="H48A68482E40C44AE8A08FD7BB3B4480F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">prohibits any person described in paragraph (1) from, within 2 years after the termination of his or her service or employment with such State regulatory authority, making an appearance or advocating before any officer or employee of such State regulatory authority on behalf of any electric utility with respect to which such State regulatory authority has ratemaking authority in connection with a particular matter in which the electric utility is a party or has a direct and substantial interest and which such person knows or reasonably should know was actually pending under his or her official responsibility within a period of 1 year before such termination; and</text></paragraph> 
<paragraph id="H0BA50EC5364F4F4CAC616206DC8789E1"><enum>(3)</enum><text display-inline="yes-display-inline">enforces the prohibitions required under paragraphs (1) and (2), including by investigating complaints, imposing penalties for noncompliance, and allowing affected parties to seek recovery of damages arising from violations.</text></paragraph></subsection> <subsection id="HEDCB0A0C9DC9497CB6BFACEB8D1FC67E"><enum>(b)</enum><header>Determination of compliance</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, and annually thereafter, the Secretary shall determine, based on a review of applicable State law, whether each State has in effect the lobbying restrictions described in subsection (a).</text></subsection> 
<subsection id="H63528BBEE5794342A277A2A116E006D5"><enum>(c)</enum><header>Restoration</header><text>If the Secretary withholds from a State financial assistance under subsection (a), the Secretary shall grant to the State the withheld financial assistance in the following fiscal year if the State is in compliance for that fiscal year.</text></subsection> <subsection id="H66165A4277B842B6A88950FCD74CA269"><enum>(d)</enum><header>Cure period</header><text>If the Secretary determines a State does not comply with subsection (a) for a fiscal year, the State shall have 90 days to remedy the noncompliance before the Secretary withholds financial assistance from the State under subsection (a).</text></subsection> 
<subsection id="H2FC02831A87F4E6F9DEB3096F85E9A8C"><enum>(e)</enum><header>Methods of compliance</header><text>A State may comply with subsection (a) through any legally binding mechanism under State law, including legislation, administrative rulemaking, or binding orders of a State regulatory authority, provided such mechanism achieves the lobbying restrictions required under such subsection.</text></subsection> <subsection id="HF1500574DB644BD6A9D303B355D8B679"><enum>(f)</enum><header>Administration</header> <paragraph id="H796FC6ED3F2D4ADB84AC1540BEA432EB"><enum>(1)</enum><header>In general</header><text>For purposes of carrying out this section, the Secretary shall—</text> 
<subparagraph id="H3C65F135DA1D45F99144C464C4484CBA"><enum>(A)</enum><text>establish procedures for conducting the annual compliance review under subsection (b);</text></subparagraph> <subparagraph id="H15130DF9F4CD42948D6C145794930C55"><enum>(B)</enum><text>maintain a public database that identifies the status of each State’s compliance with subsection (a);</text></subparagraph> 
<subparagraph id="H0FD76CB033F84593866AB74AFE5CD7E6"><enum>(C)</enum><text>provide technical assistance to States to comply with subsection (a);</text></subparagraph> <subparagraph id="H70EBB817EB364ED1B67FACD676EE28E1"><enum>(D)</enum><text>issue guidance interpreting this section;</text></subparagraph> 
<subparagraph id="HE0622E78D0B34428A6B6E8F056012A3A"><enum>(E)</enum><text>establish a process to appeal a determination by the Secretary that a State does not comply with subsection (a); and</text></subparagraph> <subparagraph id="H04C7C81A15324BB9AA9B25AE7D16B991"><enum>(F)</enum><text>annually report to Congress on State compliance rates.</text></subparagraph></paragraph> 
<paragraph id="HD8039FF2A7C748B08976A2355B3D5B87"><enum>(2)</enum><header>Deadline for initial regulations</header><text>The Secretary shall promulgate regulations to carry out this section not later than 9 months after the date of enactment of this section.</text></paragraph></subsection> <subsection id="H818C7D68586A49338DBEBA582D5C82A0"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HC9728FFFAE2C4E4FA6AD74F3DA622644" commented="no"><enum>(1)</enum><header>Ratemaking authority</header><text display-inline="yes-display-inline">The term <term>ratemaking authority</term> has the meaning given such term in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>).</text></paragraph> <paragraph id="HFAAC1ED8F668425685169D23B6BD6549"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph> 
<paragraph id="HAD10FF47CBB649198AEB798BE97732FE"><enum>(3)</enum><header>State</header><text>The term <term>State</term> has the meaning given such term in section 3 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6202">42 U.S.C. 6202</external-xref>).</text></paragraph> <paragraph id="HF3B126B63A49431386ABD89514FB3D5E"><enum>(4)</enum><header>State energy program financial assistance</header><text>The term <term>State energy program financial assistance</term> means the financial assistance granted to a State under section 363 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6323">42 U.S.C. 6323</external-xref>).</text></paragraph> 
<paragraph id="H6BC7C4377C5D4151BA45697BE7B4A550"><enum>(5)</enum><header>State regulatory authority</header><text>The term <term>State regulatory authority</term> has the meaning given such term in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>).</text></paragraph></subsection></section> </legis-body></bill>
