<section id="HF5F4DF6970894AC694D7FC5FA6F9763C" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Service Homeownership Assistance Act</short-title></quote>.</text></section> 
<section id="H991DE06D2D474FFDA089A42E7EA1A4D5"><enum>2.</enum><header>Downpayment assistance program for certain public employees</header> 
<subsection id="HA53A929CD3AC455ABF3277C66716954E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning January 1, 2027, the Secretary of Housing and Urban Development may, subject to appropriations made available to carry out this section, issue to covered public employees loans that are secured by an eligible property purchased by such employee.</text></subsection> <subsection id="HC9037E9B482E4B4F96AFE0C895049C86"><enum>(b)</enum><header>Subordinate lien</header><text display-inline="yes-display-inline">The lien held by the Secretary against an eligible property as part of a loan under this section shall be subordinate to any first mortgage against such property.</text></subsection> 
<subsection id="HE97DA3C1298846FD81034DD0EA994905"><enum>(c)</enum><header>Loan amount</header><text display-inline="yes-display-inline">A loan issued to a covered public employee under this section may not be in an amount that is—</text> <paragraph id="HA6AD1908533D4E3B924B51E70E92D25F"><enum>(1)</enum><text>less than $10,000; or</text></paragraph> 
<paragraph id="H3376D7C88C8B4498BB5B874372BB5656"><enum>(2)</enum><text display-inline="yes-display-inline">more than $20,000.</text></paragraph></subsection> <subsection id="HB552346A00C2470EAB3BBFFCEE82A271" display-inline="no-display-inline"><enum>(d)</enum><header>Use of amounts</header><text display-inline="yes-display-inline">A covered public employee who receives a loan under this section may only use loan amounts for the payment of a downpayment, or any closing costs, with respect to the purchase of an eligible property by such employee.</text></subsection> 
<subsection id="HDBA84ECBDFCD438B9C12FF2D72FE63A8"><enum>(e)</enum><header>Requirement</header><text display-inline="yes-display-inline">A covered public employee that receives a loan under this section shall occupy the eligible property that secures such loan not later than 60 days after the date of the issuance of such loan.</text> </subsection> <subsection id="HA9152FB0E6594D15A8C7FCD5526D751F" commented="no"><enum>(f)</enum><header>Loan repayment</header><text>A covered public employee who receives a loan under this section shall begin repayment of such loan, amortized over 10 years, upon the earliest of the following:</text> 
<paragraph id="HB975808D9B8148408724F9041BC32568" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The date on which such employee sells or transfers to another person the eligible property that secures such loan.</text></paragraph> <paragraph id="H9BDE744AB025451980E983AF8AFCF325" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">January 1 of any year following a year during which such employee did not occupy the eligible property that secures such loan for at least 182 calendar days.</text></paragraph> 
<paragraph id="H023B4BCCB24C4DBEBA89907BA269A2B0" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The date of the closing of a cash out refinance initiated by such employee with respect to the eligible property that secures such loan.</text></paragraph></subsection> <subsection id="H5870C6C7C771432C9B8C6180F7B27F2A"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to prohibit a covered public employee from using any other source of Federal or State assistance, including any other loan program, in conjunction with a loan issued under this section.</text></subsection> 
<subsection id="H089CF239CE5E43A1B51056D740A3ED31"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H992C98D724C44952A560E46574BB35BA"><enum>(1)</enum><header>Cash out refinance</header><text display-inline="yes-display-inline">The term <quote>cash out refinance</quote> means a financial transaction in which a covered public employee—</text> 
<subparagraph id="H97E24B2D973448BDB0E1DC0077F1DA21"><enum>(A)</enum><text>refinances the first mortgage against an eligible property; and</text></subparagraph> <subparagraph id="H35F15537C3DE4F36B1FF12F3BA3656DC"><enum>(B)</enum><text>receives an excess balance in cash as a result of the new mortgage resulting from such refinancing.</text></subparagraph></paragraph> 
<paragraph id="HBFFAF87E8303404FA7A3473012CEBEE9"><enum>(2)</enum><header>Closing cost</header><text display-inline="yes-display-inline">The term <quote>closing cost</quote> means any fee, charge, or prepaid item required to originate, process, or complete a mortgage or real estate settlement with respect to an eligible property, exclusive of the purchase price of the eligible property.</text></paragraph> <paragraph id="HFC29E66E17C84C3EB04052C342B40D43" commented="no"><enum>(3)</enum><header>Covered public employee</header><text display-inline="yes-display-inline">The term <quote>covered public employee</quote> means an individual who is employed by an agency or department of Federal, State, Tribal, or local government.</text> </paragraph> 
<paragraph id="HEA104064BC874D3D92B202C37A795A49"><enum>(4)</enum><header>Eligible property</header><text display-inline="yes-display-inline">The term <quote>eligible property</quote> means a residential property that—</text> <subparagraph id="H21C31DA95A6F400A80054C33D10701DA"><enum>(A)</enum><text>consists of 1 to 4 dwelling units;</text></subparagraph> 
<subparagraph id="H56482941C23744A7B1EBF5E72C3AEDDA"><enum>(B)</enum><text>meets any standards required by the Secretary;</text></subparagraph> <subparagraph id="HA8981B7B505F4EB999CE6D9101097265"><enum>(C)</enum><text>is located in the United States or a territory thereof; and</text></subparagraph> 
<subparagraph id="H48C5FCAFD8724FEE8A0E09168A4EBBB3"><enum>(D)</enum><text display-inline="yes-display-inline">will be occupied by the covered public employee for not less than 182 days each calendar year.</text></subparagraph> </paragraph> </subsection> </section> </legis-body></bill>
