<section commented="no" section-type="section-one" id="H5725E4C4B0D44C4989946FF171163FC1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Labeling Act of 2026</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H7323A6AE2A2342909830722B34429A1F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H063271D982474434A419B49693C1741C"><enum>(1)</enum><text display-inline="yes-display-inline">there is significant consumer confusion about which covered materials are recyclable, compostable, reusable, or refillable;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1DD243967C604BD897115A78F3700CF0"><enum>(2)</enum><text>nationwide definitions of the terms <quote>recyclable</quote>, <quote>compostable</quote>, <quote>reusable</quote>, and <quote>refillable</quote> would provide—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H5A4D2842482B4314BE3A41059DACEA2B"><enum>(A)</enum><text display-inline="yes-display-inline">producers and consumers clarity in how to recycle, compost, reuse, or refill labeled products; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H103D0C4A66F240CBA0A32DEAFEFD78DA"><enum>(B)</enum><text>consumers confidence that covered materials that have a chasing arrows symbol, or an equivalent symbol for recyclable, compostable, reusable, or refillable, are properly labeled;</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8E8F7CBE03E54E15A9ED132C2DDE14AF"><enum>(3)</enum><text>the improper use of the chasing arrows symbol, or an equivalent symbol indicating that a covered material is recyclable, compostable, reuseable, or refillable, leads to confusion and qualifies as a deceptive practice under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC3A6B960392F4DF3964DAA9447CC8B9F"><enum>(4)</enum><text>encouraging producers to design their covered materials to be recyclable, compostable, reusable, or refillable would reduce waste and emissions, help the environment, protect resources, lower expenses for businesses, communities, and consumers, and diminish the need for virgin raw materials;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H64D581BC1D704124B8A5A8D2B10D23F4"><enum>(5)</enum><text>proper labeling of covered materials would encourage end-use consumers to properly recycle, compost, reuse, and refill covered materials, including packaging, food service products, and beverage containers;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD6013B2C6F074497B172D49A56565CC8"><enum>(6)</enum><text>understanding what does not qualify as recyclable, compostable, reusable, or refillable is critical for producers, State and local governments, and consumers;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8105C5724BFE4F2EA157EFD28A56EC5C"><enum>(7)</enum><text>standardized labeling provides producers with clear enforceable criteria they can follow to ensure that their covered materials meet applicable requirements if the producers choose to use a label;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H699FAF913AF9471783450DED212A53AD"><enum>(8)</enum><text display-inline="yes-display-inline">establishing definitions of the terms <quote>recyclable</quote>, <quote>compostable</quote>, <quote>reusable</quote>, and <quote>refillable</quote> that can be updated as technology and systems advance would benefit consumers, producers, State and local governments, and waste management facilities;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBAF7E0929D3041A0950641327A1A63E0"><enum>(9)</enum><text>having clear, consistent labels would—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF32B2B3A9B204383AA9099609583907B"><enum>(A)</enum><text display-inline="yes-display-inline">assist material recovery facilities and municipalities in their efforts to recycle and compost covered materials;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0C342AB7CCF34CF5AD93A4DB1B8A20CF"><enum>(B)</enum><text display-inline="yes-display-inline">assist in educating the public about those efforts; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC4937252EED7466BB95032C8C894EEE4"><enum>(C)</enum><text display-inline="yes-display-inline">reduce costs and waste; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE4287F3648584246B6D7E6CF9EF6CF7E"><enum>(10)</enum><text>part 260 of title 16, Code of Federal Regulations (commonly referred to as the <quote>Green Guides</quote>), provides rules for marketing claims that are outdated and do not provide sufficient information to establish labeling criteria at the national level.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="HC0C2BE694A314380AE24A9AFACBB38F4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H62FF853B030647D2AFCE2CFC6526C26E"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H715C25141830468E80CAF56E9689FEA4"><enum>(2)</enum><header>Advisory Committee</header><text>The term <term>Advisory Committee</term> means the advisory committee established under section 9.</text></paragraph>
<paragraph id="HA80B58D147FC41E7893083388C9D9AE0"><enum>(3)</enum><header>Beverage container</header><text>The term <term>beverage container</term> means a consumer prepackaged container that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC144F7264CE84175B8A4C34B583A8D7D"><enum>(A)</enum><text display-inline="yes-display-inline">is designed to hold a beverage;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE3356C13D72743D8909EADFB5C46A3B6"><enum>(B)</enum><text display-inline="yes-display-inline">is made of any material, including glass, plastic, fiber, paper, and metal, or a combination thereof; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1DAF07FFC6BF4887971EBE1211280FCA"><enum>(C)</enum><text display-inline="yes-display-inline">has a volume of not less than 50 milliliters and not more than 3 liters.</text></subparagraph></paragraph>
<paragraph id="HA344CF6BF9384234BFDA7F7C2440FA52"><enum>(4)</enum><header>Chasing arrows symbol</header><text>The term <term>chasing arrows symbol</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H02F54A4142694C72A0AC8ED8C20BB1DF"><enum>(A)</enum><text display-inline="yes-display-inline">an equilateral triangle, formed by 3 arrows curved at their midpoints, depicting a clockwise path, with a short gap separating the apex of each arrow from the base of the adjacent arrow; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBE20C751F44F4DD6B437AFCF4F550C47"><enum>(B)</enum><text display-inline="yes-display-inline">any variant of the symbol described in subparagraph (A) that is likely to be reasonably interpreted by an ordinary consumer as indicating that a covered material is recyclable, including one or more arrows arranged in a circular pattern or around a globe.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC4A06439EF574D71B9693B6E238E6B26"><enum>(5)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H04C407028B514D88BD13564BB59A677F"><enum>(6)</enum><header>Compost</header><text>The term <term>compost</term> means a product—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H6548099F4A7B4F8FB3ED65AACC6E8699"><enum>(A)</enum><text display-inline="yes-display-inline">manufactured through the controlled aerobic, biological decomposition of biodegradable materials;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA8B29F68BC704990AE3D0E48ADABFD40"><enum>(B)</enum><text>that has undergone treatment at mesophilic and thermophilic temperatures; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2D23574C7ED343B98FE5DD41F1BF8645"><enum>(C)</enum><text>that is beneficial to plant growth.</text></subparagraph></paragraph>
<paragraph id="H67DEEF1761974F5C8A79F8A183D350F3"><enum>(7)</enum><header>Compostable</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HD200804AB84E4B25BA983404A8EF3B3D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>compostable</term>, with respect to a covered material, means that the covered material—</text> <clause commented="no" display-inline="no-display-inline" id="HA17054AD87AA48EFA45084E8C0DC353F"><enum>(i)</enum><text display-inline="yes-display-inline">is capable of undergoing aerobic biological decomposition in a compost system, such that the covered material becomes visually indistinguishable from the rest of the material and breaks down into carbon dioxide, water, inorganic compounds, and biomass; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA8B802766ACB4C648EE9BDAA60137A78"><enum>(ii)</enum><text>otherwise meets the criteria described in section 6(b).</text></clause></subparagraph></paragraph> <paragraph id="HCA840FAB27654E07A532CE000C0F2A9F"><enum>(8)</enum><header>Covered material</header><text>The term <term>covered material</term> means, regardless of whether the material is recyclable, compostable, reusable, or refillable, and regardless of the material type, a material that is—</text>
<subparagraph id="H27C189C1BBFE4A3B8D6D498DD233379B"><enum>(A)</enum><text>packaging;</text></subparagraph> <subparagraph id="H149916BC55A045339DCE97AE4790F559"><enum>(B)</enum><text>a food service product; or</text></subparagraph>
<subparagraph commented="no" id="H288E7EA48C9348259FD9FE36B635E320"><enum>(C)</enum><text>a beverage container.</text></subparagraph></paragraph> <paragraph id="HBEC3E2699A194A5F9F37C5534F49E810"><enum>(9)</enum><header>Food service product</header><text>The term <term>food service product</term> means an item associated with a food product provided to a consumer, regardless of whether the item is recyclable, compostable, reusable, or refillable, including—</text>
<subparagraph id="H7843E3346F46423DB5C8E63D8282895B"><enum>(A)</enum><text>a drink cup;</text></subparagraph> <subparagraph id="H443023BEBC9A4DFDB4FF06D02485E7AE"><enum>(B)</enum><text>a drink lid;</text></subparagraph>
<subparagraph id="H32F4C38D23C142A998BC0376825B46FE"><enum>(C)</enum><text>a food package;</text></subparagraph> <subparagraph id="HCD37478B2A454BD994684407625643ED"><enum>(D)</enum><text>a food container;</text></subparagraph>
<subparagraph id="H0285C3BE783F4F5CA80B10C11CFD4D08"><enum>(E)</enum><text>a plate;</text></subparagraph> <subparagraph id="H91E311830C3848FEAE406C28B8332E60"><enum>(F)</enum><text>a bowl;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA46C18F647944B92BD133F8B908A9299"><enum>(G)</enum><text>a sleeve;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3DA6424D4DC54E1989838E53658E35AC"><enum>(H)</enum><text>a straw;</text></subparagraph>
<subparagraph id="HD0BB22FBC146421E905018C6118CC7F1"><enum>(I)</enum><text>a tray;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF3BC6DC859C546FE99F72663C36B252E"><enum>(J)</enum><text display-inline="yes-display-inline">a utensil;</text></subparagraph>
<subparagraph id="H908719CE2918423CBA926B1AF2CB39EF"><enum>(K)</enum><text>a food wrap; and</text></subparagraph> <subparagraph id="H2C1761A4321B4FEEB55ECCC768E9B543"><enum>(L)</enum><text>such other items as the Administrator, in coordination with the Commission, determines to be appropriate.</text></subparagraph></paragraph>
<paragraph id="H1A0916AFB10F482386B7F0CA37C23497"><enum>(10)</enum><header>Packaging</header>
<subparagraph id="HCCDBFD0EAA19413BB2941646D480BACA"><enum>(A)</enum><header>In general</header><text>The term <term>packaging</term> means any separable and distinct material piece, regardless of whether the material piece is recyclable, compostable, reusable, or refillable, used for the containment, protection, handling, delivery, and presentation of goods that are sold, offered for sale, or distributed to consumers in the United States, including through an internet transaction.</text></subparagraph> <subparagraph id="H1CB7EA0681A84809A2B3190FBE59E274"><enum>(B)</enum><header>Inclusions</header><text>The term <term>packaging</term> includes an item described in subparagraph (A) that is—</text>
<clause id="HEA3CA892BF8B4A8E9EFB7AFCC828E2E9"><enum>(i)</enum><text>sales packaging or primary packaging intended for the consumer market;</text></clause> <clause id="HE95EA060FEE14F5783678DD8B9CC7951"><enum>(ii)</enum><text>service packaging designed and intended to be used or filled at the point of sale, such as carry-out bags, bulk good bags, take-out bags, and home delivery food service products;</text></clause>
<clause id="HCA54FE665B314EAE91795A8949A1C28C"><enum>(iii)</enum><text>secondary packaging used to group products for multiunit sale; or</text></clause> <clause id="HB8007482720A43AE86D0845CD46B36E5"><enum>(iv)</enum><text>a packaging component or ancillary element integrated into packaging, including an ancillary element directly hung onto or attached to a product and that performs a packaging function, except—</text>
<subclause id="HB292641260F947958D6762F094C962FA"><enum>(I)</enum><text>an element of the packaging with a de minimis weight or volume, as determined by the Administrator; and</text></subclause> <subclause id="H9FFDDA7EC5CF40289FD16602584D6D82"><enum>(II)</enum><text>a component or element that is an integral part of the product, if all components or elements of the product are intended to be consumed or disposed of together.</text></subclause></clause></subparagraph>
<subparagraph id="HD96ACAC70946408483F962110A80918D"><enum>(C)</enum><header>Exclusions</header><text>The Administrator may exempt from the term <term>packaging</term> under this paragraph a material that the Administrator determines—</text> <clause commented="no" display-inline="no-display-inline" id="HE78928D0AC144A3AADF5E067EBB1E132"><enum>(i)</enum><text display-inline="yes-display-inline">is de minimis; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H479AAD787F164883B359B7EA71466103"><enum>(ii)</enum><text display-inline="yes-display-inline">does not impact the recyclability, compostability, reusability, or refillability of the package.</text></clause></subparagraph></paragraph> <paragraph id="HEBAE2B2C2C7D4AB3A487779712C04B20"><enum>(11)</enum><header>Person</header> <subparagraph commented="no" display-inline="no-display-inline" id="HC8A13675CA8E42BFB70D4F24F2B122FA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>person</term> means an individual or entity described in subparagraph (B) that sells, offers for sale, or distributes a covered material in the United States—</text>
<clause commented="no" display-inline="no-display-inline" id="HB7B02D6B55DA4083BA9509275CE479E2"><enum>(i)</enum><text display-inline="yes-display-inline">directly to consumers; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H055715EFAE51447B83762F66D366E494"><enum>(ii)</enum><text display-inline="yes-display-inline">to an individual or entity described in subparagraph (B) that sells, offers for sale, or distributes the covered material in the United States to consumers.</text></clause></subparagraph>
<subparagraph id="H4759C77ED64646828B0D37724C8A4679" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Entities described</header><text display-inline="yes-display-inline">An entity referred to in subparagraph (A) is a corporation, company, partnership, joint venture, association, joint-stock company, trust, estate of a deceased individual, foundation, fund, institution, society, union, or club, regardless of whether such entity is incorporated.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5AF7E72E25294A449E8BF82F4DCE5232"><enum>(12)</enum><header>Plastic</header> <subparagraph commented="no" display-inline="no-display-inline" id="HB76EC260A0A04D0E92FB8ACB50EAE760"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>plastic</term> means a synthetic or semisynthetic material that is—</text>
<clause id="H435647C5CD414D47AEB85AC1B1F9D1BE"><enum>(i)</enum><text>synthesized by the polymerization of organic substances; and</text></clause> <clause id="H21B72F33E89C4ADAB3AECBE0FA6AB68E"><enum>(ii)</enum><text>capable of being shaped into various rigid or flexible forms.</text></clause></subparagraph>
<subparagraph id="H3C1756B5E2D14DB7B43A9C44C451A595"><enum>(B)</enum><header>Inclusions</header><text>The term <term>plastic</term> includes any coating or adhesive material described in subparagraph (A).</text></subparagraph> <subparagraph id="HE0FB1441DF73423F86F32ED6B15BBD03"><enum>(C)</enum><header>Exclusions</header><text>The term <term>plastic</term> does not include—</text>
<clause commented="no" display-inline="no-display-inline" id="H55AFEB5864ED41C9B0E3E3AE218C8E88"><enum>(i)</enum><text display-inline="yes-display-inline">natural rubber; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HE1988812D6C3423B817ADDB0EAEB4494"><enum>(ii)</enum><text display-inline="yes-display-inline">material containing only naturally occurring polymers, such as proteins and starches.</text></clause></subparagraph></paragraph>
<paragraph id="HB23222FBD0994260A841CDEAF29A2BF7"><enum>(13)</enum><header>Producer</header><text>The term <term>producer</term>, with respect to a covered material, means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H976CBFDE084048569B1D3F531359A3F6"><enum>(A)</enum><text display-inline="yes-display-inline">the person that affixes, or directs to affix, to the covered material a chasing arrows symbol, a label, or any other marking that indicates that the covered material is recyclable, compostable, reusable, or refillable; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDD7C4AEDEFE84FDD8E287FC530215DCC"><enum>(B)</enum><text>if the covered material was labeled as recyclable, compostable, reusable, or refillable in accordance with this Act and has subsequently been modified such that the covered material is not recyclable, compostable, reusable, or refillable, respectively, the person that so modified the covered material.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H9E33AC8F6824446382F918585DDE394A"><enum>(14)</enum><header>Qualified claim of compostability</header><text>The term <term>qualified claim of compostability</term> means a qualified claim of compostability described in section 6(a)(2).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1E28326FCB6949D0B10291C5031E67B7"><enum>(15)</enum><header>Qualified claim of recyclability</header><text>The term <term>qualified claim of recyclability</term> means a qualified claim of recyclability described in section 5(a)(2).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H23F6889FAC4E433FB6CFD4FC6EDBBC5A"><enum>(16)</enum><header>Recyclable</header><text display-inline="yes-display-inline">The term <term>recyclable</term>, with respect to a covered material, means that the covered material meets the criteria described in section 5(b).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8A6FF0D9744341AF84315787CD1730D9"><enum>(17)</enum><header>Refillable</header><text>The term <term>refillable</term>, with respect to a covered material, means that the covered material—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H32528BB3D2B745A6A86112E91B9B2894"><enum>(A)</enum><text display-inline="yes-display-inline">is designed to be—</text>
<clause commented="no" display-inline="no-display-inline" id="HE2F2C93310C3431E817014F3F1B7F6F0"><enum>(i)</enum><text display-inline="yes-display-inline">refilled by consumers multiple times for the same or a similar purpose and in the original format of the covered material; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H674D348ACE0A493BACD7843915EC7DD5"><enum>(ii)</enum><text display-inline="yes-display-inline">sold or provided to consumers once for the duration of the usable life of the covered material; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1AB3CAFB5EE747489009A9DF71502D6E"><enum>(B)</enum><text>otherwise meets the criteria described in section 7(b).</text></subparagraph></paragraph> <paragraph id="H6E858B7FA4E04587879C7B1835FF06F5"><enum>(18)</enum><header>Resin identification code</header><text>The term <term>resin identification code</term> means a code that indicates the resin used to produce a plastic covered material that meets the requirements of ASTM International Standard D7611/D7611M–21—</text>
<subparagraph id="HAAD016574EB34195B07AEECCB3558BFB"><enum>(A)</enum><text>as in effect on the date of enactment of this Act; or</text></subparagraph> <subparagraph id="H2D9EF70DBAA4469E9CAFAE2D19AC6948"><enum>(B)</enum><text>as revised after the date of enactment of this Act, if the revision is approved by the Administrator.</text></subparagraph></paragraph>
<paragraph id="HFF80A8E8F610467A9A035F3F617C91DD"><enum>(19)</enum><header>Responsible end market</header><text>The term <term>responsible end market</term> means a material market, and intermediate supply chain entities, that—</text> <subparagraph id="H84E5E680BF334E41B821CF99278EFE07"><enum>(A)</enum><text>is where collected, processed, and separated covered materials are purchased and manufactured into new, saleable products or feedstock;</text></subparagraph>
<subparagraph id="H316CDFD1D8B54EACB058CFFAFF40FACE"><enum>(B)</enum><text>has sufficient capacity to handle the quantity of covered materials collected; and</text></subparagraph> <subparagraph id="H852F7DECD6824FADB6C14D835D08F756"><enum>(C)</enum><text>recovers covered materials and disposes of contaminants in a manner that minimizes environmental harm and risks to public health and worker health and safety.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB855EDC1409241BEB47212379802C9C6"><enum>(20)</enum><header>Reusable</header><text>The term <term>reusable</term>, with respect to a covered material, means that the covered material—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H3D7C3D7772304FF28AA3717AE12CFDE6"><enum>(A)</enum><text display-inline="yes-display-inline">is intentionally designed and marketed to be recovered, inspected, repaired (if necessary), and reissued by producers into the supply chain for convenient and safe reuse for multiple cycles; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H243E4324D3EE4D8B8A5FCA006389ED23"><enum>(B)</enum><text>otherwise meets the criteria described in section 7(b).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H356453CB9D134C6CA1CC00D2004AA278"><enum>(21)</enum><header>United States</header><text>The term <term>United States</term> means the 50 States, the District of Columbia, and the territories and possessions of the United States.</text></paragraph></section>
<section id="H7CAB53F13BC049E087E3CDB8480DA0BB"><enum>4.</enum><header>Covered material labeling</header>
<subsection id="H2B64B1758C8E40A4B602C8C34834FD91"><enum>(a)</enum><header>In general</header><text>If a producer affixes a label or marking on a covered material, on the volition of the producer or by contractual obligation, that states, or that an ordinary consumer would reasonably interpret to indicate, that the covered material is recyclable, compostable, reusable, or refillable, the label or marking shall—</text> <paragraph id="H40ECAFA86DB04B1FA3767E6CB52C8356"><enum>(1)</enum><text>be legible, clear, and on the appropriate side of the covered material, such that the ordinary consumer can easily read and understand the label or marking;</text></paragraph>
<paragraph id="H180C4F4DCD194A9D90D6B47054090426"><enum>(2)</enum><text>be consistent with the standardized on-package label established under section 8(a);</text></paragraph> <paragraph id="H901CAB7E615F41808B0E4728046DCAA6"><enum>(3)</enum><text>indicate whether the covered material is—</text>
<subparagraph id="H5056C644159948ECA40596D4E7A837A0"><enum>(A)</enum><text>recyclable;</text></subparagraph> <subparagraph id="H42EEA492751E40E3A0602E77984ABE16"><enum>(B)</enum><text>compostable;</text></subparagraph>
<subparagraph id="HA74BDD7A56D24C04BEE98E530411EA98"><enum>(C)</enum><text>reusable; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB5BE88A85E834473AB26532A2F0FA899"><enum>(D)</enum><text>refillable;</text></subparagraph></paragraph>
<paragraph id="H65054ADE398F402FBC2B37B0ED6E7577"><enum>(4)</enum><text>be compatible with the intended method of discard for the covered material, including any shrink sleeve;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC7C5C1CCC1DE4E8299C3DF29B08A7DD0"><enum>(5)</enum><text>not require removal by consumers to be compatible with the intended method of discard; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE9B1D23E63EB4CF58F82080729F7380F"><enum>(6)</enum><text>be in accordance with section 5, 6, or 7, as applicable.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HFAC33CD3155E4677B89D3BD4D78EC4AA"><enum>(b)</enum><header>Requirement</header><text>If a covered material is not recyclable, eligible for a qualified claim of recyclability, compostable, eligible for a qualified claim of compostability, reusable, or refillable, the producer of the covered material shall ensure that the covered material does not include any label or marking, including the chasing arrows symbol or any equivalent, that would—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HC432ABCC60B84F979DE34FA911D2CF64"><enum>(1)</enum><text display-inline="yes-display-inline">lead an ordinary consumer to believe that the item is recyclable, compostable, reusable, or refillable, respectively; or</text></paragraph> <paragraph id="H8ED6B39C90D94E3F86B0BFBDB926E821"><enum>(2)</enum><text>direct a consumer to recycle, compost, reuse, or refill, respectively, the covered material.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5116CDDC29AB427192DC876846E4B3D5"><enum>(c)</enum><header>Resin identification code</header>
<paragraph commented="no" display-inline="no-display-inline" id="H7824B3F6A89E4D2C88FC7B4C000304C0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">All plastic covered materials sold, offered for sale, distributed, or imported into the United States shall be labeled with a resin identification code, which may not be placed inside a chasing arrows symbol, unless—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF1F414F502324AF5AC4D6840E5EADFA9"><enum>(A)</enum><text display-inline="yes-display-inline">the plastic covered material meets the criteria described in section 5; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H24774B7BC5AC41DAAB8DA0884DB3518A"><enum>(B)</enum><text display-inline="yes-display-inline">placement inside a chasing arrows symbol is the only physically feasible placement, as determined by the Administrator.</text></subparagraph></paragraph> <paragraph id="H19558FD91680452EA3EAA5504FED2B21" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Preemption</header><text>No State may impose any requirement that conflicts with the requirement under paragraph (1).</text></paragraph></subsection>
<subsection id="H438C97DAD3194999A93FCCB1FB11CEDD"><enum>(d)</enum><header>Nationwide analysis</header><text>For purposes of developing the standardized on-package label required under section 8(a), the Administrator, in coordination with the Commission and with consideration of the findings and recommendations of the Advisory Committee, shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H093575F37E5C4C6DB5863BA455D2C9A1"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a nationwide analysis of covered material recycling, composting, reuse, and refill facilities to identify which covered materials are commonly collected, sorted, sold, or transferred for recycling, composting, reuse, and refill in the United States that meet the requirements of this Act; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA798779B21B745429550744772C4729F"><enum>(2)</enum><text display-inline="yes-display-inline">publish a list of categories of covered material identified under paragraph (1).</text></paragraph></subsection> <subsection id="H17FC55107B574CA38ED9D3E3833ABAB1"><enum>(e)</enum><header>Submission of supporting evidence</header> <paragraph commented="no" display-inline="no-display-inline" id="HA0516D39E1734439B2E338DAB392F151"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Producers, individually or collectively, may submit to the Administrator technical studies, sorting and processing trials, material flow analyses, end-market assessments, or other evidence to support the classification of a covered material as recyclable, compostable, reusable, or refillable.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2940FABFF0384A5BB92F861F01DEC3EB"><enum>(2)</enum><header>Consideration</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Commission, and with consideration of the findings and recommendations of the Advisory Committee, shall review any evidence submitted under paragraph (1) when establishing or revising determinations for recyclable, compostable, reusable, and refillable classifications.</text></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="H8B6DE61F89AE450FA1D850D9722F05CB"><enum>5.</enum><header>Recyclable criteria</header> <subsection commented="no" display-inline="no-display-inline" id="H295E8D40895F45AB873C220D3EA766D6"><enum>(a)</enum><header>In general</header><text>The producer of a covered material shall not include—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H254DBDEFCBF0446F88EE15DDB58F7B4F"><enum>(1)</enum><text display-inline="yes-display-inline">a claim that the covered material is recyclable unless the covered material is considered recyclable under this Act; or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H99A5ED9934AC4F9AAA8EF3F1BB79235D"><enum>(2)</enum><text>a qualified claim of recyclability unless the covered material meets the requirements under subsection (c).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCDA33A9881DC4892A9B29CAB2E25B00B"><enum>(b)</enum><header>Criteria</header><text display-inline="yes-display-inline">A covered material shall be considered recyclable if—</text> <paragraph commented="no" display-inline="no-display-inline" id="H14A03F15D0654B129D2319A0DA7EBDAE"><enum>(1)</enum><text display-inline="yes-display-inline">the covered material is made in accordance with the design guidelines of the industry of the covered material, if approved by the Administrator, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HE76350E513E040C2A16C6AD53C7F30FA"><enum>(A)</enum><text display-inline="yes-display-inline">the Association of Plastic Recyclers Design Guide;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HCCF0A206FED043E58CF49FABB161F5D6"><enum>(B)</enum><text display-inline="yes-display-inline">the Recycled Materials Association Fiber Recycling Readiness Tool;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD5B0E495055E45E689379996D4A67A66"><enum>(C)</enum><text display-inline="yes-display-inline">the Can Manufacturers Institute Steel Container Design Guide for Recyclability;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3F291C48B8ED443390608718D6982BAC"><enum>(D)</enum><text display-inline="yes-display-inline">the American Forest and Paper Association Design Guidance for Recyclability;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H166CE1C41EF0407387FCBED1CEC94B90"><enum>(E)</enum><text display-inline="yes-display-inline">the Glass Guide on Recycling; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H93D08EE85F1049E6BB3DD31F930DFA64"><enum>(F)</enum><text display-inline="yes-display-inline">the Recycling Partnership Circular Packaging Assessment;</text></subparagraph></paragraph>
<paragraph id="H850F158E9C4340D292323F21BF141AB9"><enum>(2)</enum><text>the covered material does not include any component, including inks and adhesives, that prevents the product from being recycled, unless the covered material includes clear, on-package instructions that describe how to remove and properly dispose of a separable component that is not recyclable;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD359D60AD9694566973C439DA50A6A23"><enum>(3)</enum><text>the covered material is collected, separated, or otherwise recovered from the waste stream through an established recycling program for which a responsible end market exists that covers at least 60 percent of consumers or communities where the item is sold; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0D44E693AF4D4981BFC039B5CA6A230F"><enum>(4)</enum><text>the covered material has a commercial value for recycling and a responsible end market.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HA93BA819E5704E67B633C27D632269A1"><enum>(c)</enum><header>Qualified claims of recyclability</header><text display-inline="yes-display-inline">A covered material shall be eligible for a qualified claim of recyclability if—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H8366EAF015854C32B3259EB76D5D7B9B"><enum>(1)</enum><text display-inline="yes-display-inline">the covered material is collected, separated, or otherwise recovered from the waste stream through an established recycling program for which a responsible end market exists that covers at least 40 percent of consumers or communities where the item is sold;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H64FCC924E671497DA002B49BCEB76142"><enum>(2)</enum><text>the covered material meets the requirements described in paragraphs (1), (2), and (4) of subsection (b);</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDBA26E4B2D4E49028D9C3704B1F1F228"><enum>(3)</enum><text>the qualified claim of recyclability is consistent with the standardized on-package label established under section 8(a);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1BFC0193772A43938668A6F03771BDFE"><enum>(4)</enum><text display-inline="yes-display-inline">except as provided in this subsection, the qualified claim of recyclability is made in accordance with any other requirements under this Act relating to recyclable covered materials; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF44456F5852E44DD8072055EB9EA8CAE"><enum>(5)</enum><text>the Administrator has approved a plan demonstrating a reasonable and time-bound pathway for the covered material to be considered recyclable under this Act, including compliance with subsection (b)(3), not later than 2 years after the date of approval of the plan.</text></paragraph></subsection> <subsection id="HD6E087BBA2C244D39BB13A02705285D4"><enum>(d)</enum><header>Regulations</header> <paragraph commented="no" display-inline="no-display-inline" id="HA87FB771585148FA8FF916CCB28A6595"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Commission, and with consideration of the findings and recommendations of the Advisory Committee, shall issue regulations for—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF9097C71B3F54F9FBC055A38B5ED1E4D"><enum>(A)</enum><text display-inline="yes-display-inline">determining whether a covered material meets the criteria described in subsection (b) or (c); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H72B257A988274EA9AA1151AAACFBE386"><enum>(B)</enum><text>describing acceptable qualified claims of recyclability that will provide clear and standardized information to consumers to allow them to determine whether the covered material is recyclable in their jurisdiction and how to recycle the covered material.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDDB95F38F7D74AD6A8F32CA92A6706B7"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Administrator, in coordination with the Commission, shall strive to issue regulations that reduce the amount of recyclable goods that are not accepted at a responsible end market.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H441F5712B2F44A44BD5B7A966AF3C223"><enum>(e)</enum><header>Publication of covered materials</header><text>Not later than 18 months after the date of enactment of this Act, and every 2 years thereafter, the Administrator shall publish a list of covered materials that meet the requirements of this section.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCB4616CC5E2641A49F8BF1D925A7BAFF"><enum>(f)</enum><header>Exclusion</header><text>For purposes of this Act, the conversion of a covered material into fuel, fuel ingredients, or fuel substitutes or the use of a covered material for the generation of electricity, heat, or steam shall not—</text> <paragraph commented="no" display-inline="no-display-inline" id="H405A329A4E8D4ED1A2C3BD38539BAEBF"><enum>(1)</enum><text display-inline="yes-display-inline">be considered recycling;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE54CF58366C24705B56B2C6EFC41C95A"><enum>(2)</enum><text display-inline="yes-display-inline">count towards the 60 percent threshold, or be considered a responsible end market, described in subsection (b)(3); or</text></paragraph> <paragraph id="H00BEF022C88644AC9EF2217FEDF7915D"><enum>(3)</enum><text>count towards the 40 percent threshold, or be considered a responsible end market, described in subsection (c)(1).</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H8D80E34BA95F4DEF8F50FF5167D64F86"><enum>6.</enum><header>Compostable criteria</header>
<subsection commented="no" display-inline="no-display-inline" id="H674A627AB93449BCB9766CCD8DF2ED3D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The producer of a covered material shall not include—</text> <paragraph commented="no" display-inline="no-display-inline" id="H15CD187F499D495A874DC1A28EFCFFD5"><enum>(1)</enum><text display-inline="yes-display-inline">a claim that the covered material is compostable unless the covered material is considered compostable under this Act; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1D6DDFCB504D4F28A4C7ECB0EEB6E072"><enum>(2)</enum><text>a qualified claim of compostability unless the covered material meets the requirements under subsection (c).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6BE48E4B16FA4CFD9829F9D245F434A4"><enum>(b)</enum><header>Criteria</header><text>A covered material shall be considered compostable if the covered material—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HD8D82A5819BF4B6DA8A2E9CCE4D5312B"><enum>(1)</enum><text>is designed to be compostable in accordance with the design standards and guidelines of the industry of the covered material;</text></paragraph> <paragraph id="H644C815C041E43CBAC2518AA6F204406"><enum>(2)</enum><text>at a minimum—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H42EB74CA4E6E4B6592EE2A6C6FC266AB"><enum>(A)</enum><text>adheres to ASTM International 6640, 6868, or equivalent standard specifications that test the ability of the covered material to break down into compost; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE6634F52AEC5468F89D83D65A3BFDC4B"><enum>(B)</enum><text>does not contain intentionally added perfluoroalkyl or polyfluoroalkyl substances or heavy metals that are incompatible with compost;</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H52E0EE6AB94846C58D3BD731B0530A34"><enum>(3)</enum><text>is capable of being collected and accepted by at least 50 percent of the established composting programs in the United States; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF90A26E816254450BEF447F7CCE90DE7"><enum>(4)</enum><text>is processed by itself or with other covered material categories through controlled biological degradation to make compost or a substantially similar soil amendment.</text></paragraph></subsection>
<subsection id="H9E2D14F3B74C47AAA8AFAF60F1E1FF85"><enum>(c)</enum><header>Qualified claims of compostability</header><text>A covered material shall be eligible for a qualified claim of compostability if—</text> <paragraph id="HB89A8785C191473BBD61535669CE0495"><enum>(1)</enum><text>the covered material is capable of being collected and accepted by at least 30 percent of the established composting programs in the United States;</text></paragraph>
<paragraph id="HC48367B9EF914C7ABE2081E9BF052B3E"><enum>(2)</enum><text>the covered material meets the requirements described in paragraphs (1), (2), and (4) of subsection (b);</text></paragraph> <paragraph id="H769F8996B9624AC79C762D6C21432361"><enum>(3)</enum><text>the qualified claim of compostability is consistent with the standardized on-package label established under section 8(a); and</text></paragraph>
<paragraph id="H5C9DB5166E964210AA44643637C99A4B"><enum>(4)</enum><text>except as provided in this subsection, the qualified claim of compostability is made in accordance with any other requirements under this Act relating to compostable covered materials.</text></paragraph></subsection> <subsection id="HBBF9A6AE067A4EB6BB74D9E6491B221C"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Commission, and with consideration of the recommendations of the Advisory Committee, shall issue guidance or regulations for—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H297830BA90784171A58D1F6855C3F4B5"><enum>(1)</enum><text display-inline="yes-display-inline">determining whether a covered material meets the criteria described in subsection (b) or (c); and</text></paragraph> <paragraph id="H1DAFEE520BD54E20B463B203D251A95D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>describing acceptable qualified claims of compostability that will provide clear and standardized information to consumers to allow them to determine whether the covered material is compostable in their jurisdiction and how to compost the covered material.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H1BF499E8A38B4520BAB300771E82D236">
        <enum>(e)</enum>
        <header>Limitation for plastic or plastic-Lined covered materials</header>
 <text>If a plastic or plastic-lined covered material is not compostable, the producer of the plastic covered material shall ensure that the plastic covered material does not include a marking that would intentionally or unintentionally mislead the public to believe that the covered material is compostable, such as—</text>
        <paragraph commented="no" display-inline="no-display-inline"
          id="HA257F2AEC82C42C89B23D1E0954B0573">
          <enum>(1)</enum>
 <text>green or brown tinting, coloring, or striping;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H14F5A00A162349C1B970B426729F2073"> <enum>(2)</enum> <text>a green or brown certification logo, unless approved by the Administrator; or</text>
        </paragraph>
        <paragraph id="HCCA4D50C43F74418BF5C2DF053473E26">
          <enum>(3)</enum>
 <text>any other design, logo, or similar marking that the Administrator determines is deceptive or misleading.</text>
        </paragraph>
      </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H629B01AD7AB4431AA59ADC8711DF6165"><enum>(f)</enum><header>Publication of covered materials</header><text>Not later than 270 days after the date of enactment of this Act, and every 2 years thereafter, the Administrator shall publish a list of covered materials that meet the requirements of this section.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="H84D2F2E9BB474C799A1D48000D1F4CA4"><enum>7.</enum><header>Reusable and refillable criteria</header> <subsection commented="no" display-inline="no-display-inline" id="H45CDF2920A6F4937B179BAD5E94D871D"><enum>(a)</enum><header>In general</header><text>The producer of a covered material shall not include a claim that the covered material is reusable or refillable unless the covered material is considered reusable or refillable under this Act.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0D524181374A49B28D8BB38EF4CC04F2"><enum>(b)</enum><header>Criteria</header><text>A covered material shall be considered reusable or refillable if the covered material—</text> <paragraph commented="no" display-inline="no-display-inline" id="HBA522F38CA26424987A911BD4FA77533"><enum>(1)</enum><text>is designed to be reusable or refillable in accordance with the design standards and guidelines relating to reusability and refillability of the industry of the covered material, such as the American National Standards Institute;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6D18F0CA975440C698D48EDBD9864332"><enum>(2)</enum><text>is designed for durability and maintenance to extend the useful life of the covered material and to reduce demand for new production of the covered material;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA994E12F696640C2AAEB0E1C686A56DD"> <enum>(3)</enum> <text>at a minimum, can be recirculated or refilled multiple times, as determined by the Administrator, for the same or a similar purpose in the original format of the covered material;</text>
                </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF888F5C31176484BB393B7C65CFC3E79"><enum>(4)</enum><text>is supported by a system or physical infrastructure that is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC1D86FD848824F88BFC4B1C50B2CF95E"><enum>(A)</enum><text display-inline="yes-display-inline">in place to ensure the possibility and likelihood of reuse or refill;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1B8DD25292B443A1AE554C22011DD1FE"><enum>(B)</enum><text display-inline="yes-display-inline">provided by a producer or a third party; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB9A6CB1B24604E2980969410CA06764A"><enum>(C)</enum><text display-inline="yes-display-inline">designed for convenient reuse or refill; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H35FB5D17B0CC401B86F34F1399284FD0"><enum>(5)</enum><text>is not intended for single use by a consumer.</text></paragraph></subsection> <subsection id="HE29A6ED2067A4EC19FAFBA3619CC0963"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Commission, and with consideration of the findings and recommendations of the Advisory Committee, shall issue regulations for determining whether a covered material meets the criteria described in subsection (b).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HC3CAC33F20F64FAB84D9FD4BB0FF4174"><enum>(d)</enum><header>Publication of covered materials</header><text>Not later than 270 days after the date of enactment of this Act, and every 2 years thereafter, the Administrator shall publish a list of covered materials that meet the requirements of this section.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="HA86AD2F1733E423DA66850E16B03ABCB"><enum>8.</enum><header>Development of and changes to standardized labels</header> <subsection commented="no" display-inline="no-display-inline" id="HB598D4EEFAE14419BB5232D9CF23657A"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in coordination with the Commission, and with consideration of the findings and recommendations of the Advisory Committee, shall establish or approve standardized on-package labels that a producer of a covered material shall use if the producer chooses to use an on-package label to indicate that the covered material is recyclable, compostable, reusable, or refillable in accordance with this Act, including—</text>
<paragraph id="H89BE48E91BCD4FB1921BC33F57CD329B"><enum>(1)</enum><text>harmonized iconography to demonstrate the proper disposal pathway;</text></paragraph> <paragraph id="H3F08F7351D064338BD10E460DD6BC3A0"><enum>(2)</enum><text>harmonized terminology and descriptions, including, as necessary, instructions for—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HD0F9ADF75D294C989BDE622FB9BE0BF0"><enum>(A)</enum><text display-inline="yes-display-inline">qualified claims of recyclability;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9F66C16950164BCD873968C9620C00BB"><enum>(B)</enum><text display-inline="yes-display-inline">qualified claims of compostability; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H88127A55F0D3425289E6089CC5B287BD"><enum>(C)</enum><text display-inline="yes-display-inline">preparing covered materials for disposal; and</text></subparagraph></paragraph> <paragraph id="H43925045683A4EBCAE7055368D7C01E4"><enum>(3)</enum><text>recommended on-package placements, size, and typography to ensure legibility and accessibility.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H8A2851FFAC574E158A83B797FC0BE77F"><enum>(b)</enum><header>Digital labeling</header><text>The Administrator, in coordination with the Commission, may, for the purpose of providing additional information to the on-package label standardized under subsection (a), establish or approve a standardized digital label, which may include a Quick Response code or a similar technology, for any covered material that may be used by producers in addition to the standardized on-package label described in that subsection.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H05976781D60E41AC829F99B5C511E9F7"><enum>(c)</enum><header>Review and revisions</header><text>Not less frequently than once every 5 years after the date of enactment of this Act, the Administrator, in coordination with the Commission, and with consideration of the findings and recommendations of the Advisory Committee, after providing notice and an opportunity for public comment, shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HD2857EDC1DE3407E88589B2C59E80A8A"><enum>(1)</enum><text>review the label standards established under subsections (a) and (b), including a review of ongoing label compatibility challenges and best practices; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA6425F257370481ABAAB733CAFBF2EF2"><enum>(2)</enum><text>as necessary, revise the label standards under subsections (a) and (b) based on the review under paragraph (1).</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HCE3DEC7DE9AB4AAEA45988C039176CC2"><enum>9.</enum><header>Advisory Committee</header>
<subsection commented="no" display-inline="no-display-inline" id="HED87779CEB474D6CB435F843D39B53A9"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator and the Commission shall jointly establish an advisory committee to enhance public engagement and provide advice to the Administrator and the Commission with respect to—</text> <paragraph commented="no" display-inline="no-display-inline" id="H3B72ACD56BB848638C8F0632EA9348C7"><enum>(1)</enum><text display-inline="yes-display-inline">standards that should apply to the criteria for the terms <quote>recyclable</quote>, <quote>compostable</quote>, <quote>reusable</quote>, and <quote>refillable</quote> under sections 5(b), 6(b), and 7(b);</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HEAE75BBC72A64A0782E82CA703224A44"><enum>(2)</enum><text display-inline="yes-display-inline">standards that should apply for qualified claims of recyclability and qualified claims of compostability; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H915E3C5E94B645A8A1D6FA714723F4D9"><enum>(3)</enum><text>standardized labeling and guidelines for recyclable, compostable, reusable, and refillable covered materials.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H2AE1BCEC65FF4BE288D3FA379A102410"><enum>(b)</enum><header>Membership</header>
<paragraph id="HD6A96949211A4D7A938BC9E5D392CEA2"><enum>(1)</enum><header>Ex officio members</header><text>The Administrator (or an appointee of the Administrator) and a representative appointed by the Commission shall serve as ex officio members of the Advisory Committee.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H06E41DDC93B54F48BBFB996CF81C3CB2"><enum>(2)</enum><header>Composition</header><text>In addition to the ex officio members of the Advisory Committee described in paragraph (1), the Advisory Committee shall be composed of the following members, who shall be selected by the ex officio members:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H25DB25B4D3774F0799E360A85245F9DC"><enum>(A)</enum><text>8 representatives of relevant industries, including consumer brands, the recycled materials industry, the composting industry, the reuse industry, the refill industry, and packaging manufacturers, including 1 representative each from paper mills and aluminum smelters;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF162B106DA2549278C14C081530FBAFA"><enum>(B)</enum><text>5 representatives of material recovery facilities, including—</text>
<clause commented="no" display-inline="no-display-inline" id="H3342B67358F34009BF8F62D8F7906F88"><enum>(i)</enum><text display-inline="yes-display-inline">3 representatives of material recovery facilities serving urban or suburban communities; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HF4DA1328DEC84195821D3CF022523B92"><enum>(ii)</enum><text display-inline="yes-display-inline">2 representatives of material recovery facilities serving rural or disadvantaged communities;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H5CF0CE0F5A03436CA7C27EF31FB7EC68"><enum>(C)</enum><text>4 representatives of environmental or sustainability organizations;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0A630732F7D04BC6800A610E64466E59"><enum>(D)</enum><text>2 representatives from other relevant nonprofit organizations;</text></subparagraph>
<subparagraph id="H106898CD56844C9C8C499CA21CAE2B75"><enum>(E)</enum><text>2 representatives of other technical experts;</text></subparagraph> <subparagraph id="H5B167EB42AC44123BD5C372E73495040"><enum>(F)</enum><text>3 representatives from State governments; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7C249C07780A4A6DAE3DE1598FCFC72B"><enum>(G)</enum><text>3 representatives from local governments.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HBE98450BEE4F43E6BF87B6C37B34F2FF"><enum>(c)</enum><header>Meetings</header><text display-inline="yes-display-inline">After selection of the members of the Advisory Committee, the ex officio members shall convene the Advisory Committee—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H501C83F7A4624669900DC1DC78B52281"><enum>(1)</enum><text>regularly until the date on which the criteria standards and labeling standards described in paragraphs (1) through (3) of subsection (a) are initially established; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDE18B2DE958B48919F4824C92033BE53"><enum>(2)</enum><text>after the date described in paragraph (1), not less frequently than annually.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H925FC669D815477F8E6638E16D95852E"><enum>(d)</enum><header>Public participation</header>
<paragraph commented="no" display-inline="no-display-inline" id="H4EAD7DCA09CB45F49EA1CB455B284103"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Each meeting of the Advisory Committee shall be open to the public.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD33143F3693C466889CB93019EE936A8"><enum>(2)</enum><header>Public comment</header><text>The Advisory Committee shall solicit public comment with respect to the establishment of the criteria standards and labeling standards described in paragraphs (1) through (3) of subsection (a).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCE9FA6F328A24605BA7937B94F7B9B7E"><enum>(e)</enum><header>Exemption from Administrative Procedure Act</header><text>Subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), shall not apply to the Advisory Committee.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="H912FDA1A91FB439C90AA142620A38067"><enum>10.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and on an annual basis thereafter, the Administrator and the Commission shall submit to Congress a report that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H0AFD482707A844A4A6E1849D61DCF29D"><enum>(1)</enum><text display-inline="yes-display-inline">provides—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4F5AF7F695D142EDB6F05E73A13E4013"><enum>(A)</enum><text>updates on the implementation of this Act, including educational and outreach efforts;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA742B632A7B349CABE9492B037A4F3F5"><enum>(B)</enum><text>obstacles to the implementation of this Act;</text></subparagraph> <subparagraph id="HA9283E051F8E461599925288B0B198C9"><enum>(C)</enum><text>updates on changes to available technologies that would impact the criteria for the terms <quote>recyclable</quote>, <quote>compostable</quote>, <quote>reusable</quote>, and <quote>refillable</quote> under sections 5(b), 6(b), and 7(b); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFDBA03CA425046E997477A055690AB30"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H05C79382E4A24E52B585BFD49A9401FC"><enum>(i)</enum><text>a list of covered materials that are, and covered materials that are not, considered recyclable, compostable, reusable, or refillable under this Act, as determined under sections 4 through 7; and</text></clause> <clause indent="up1" commented="no" display-inline="no-display-inline" id="HF004DF6146C34740BEEA5352495C1F59"><enum>(ii)</enum><text>a description of any barriers that inhibit covered materials from being considered recyclable, compostable, reusable, or refillable under this Act;</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1DF638C41BDB4CC5A309C9B8CC4CA5BF"><enum>(2)</enum><text>evaluates and assesses the implementation of this Act with respect to the criteria described in paragraph (1)(C), as aggregated by covered material and geographic area; and</text></paragraph> <paragraph id="HEBBB54A2C1CF46F0BBC61E23F4F20C55"><enum>(3)</enum><text>evaluates and assesses consumer understanding of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HEEBD7B87180943598AF940C473B482BD"><enum>(A)</enum><text display-inline="yes-display-inline">the terms <quote>recyclable</quote>, <quote>compostable</quote>, <quote>reusable</quote>, and <quote>refillable</quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF5813A4D201749F0808A3DA1E7226996"><enum>(B)</enum><text>the chasing arrows symbol and similar labels used for recyclable, compostable, reusable, and refillable covered materials; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H28D1C61A53F4428288EC12D9E83B4422"><enum>(C)</enum><text>resin identification codes.</text></subparagraph></paragraph></section> <section commented="no" display-inline="no-display-inline" id="HA7D8167E4C454F1CBBBFFB889EA5ED74"><enum>11.</enum><header>Enforcement</header> <subsection commented="no" display-inline="no-display-inline" id="H18BB1BA6CF744372BD20197132977601"><enum>(a)</enum><header>General prohibition</header><text>Beginning on the date that is 2 years after the date on which the Administrator, in coordination with the Commission, establishes or approves standardized on-package labels under section 8(a), it shall be considered a deceptive practice under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) for any producer of a covered material to sell, use, distribute, or import in commerce any covered material, except in compliance with this Act.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HBDCFC8641D5545C781697CFBD9391A3E"><enum>(b)</enum><header>Recyclable criteria</header>
<paragraph id="H9E90102DF8C74D6F9EDBEFA6A008606F"><enum>(1)</enum><header>In general</header><text>Beginning on the date that is 2 years after the date on which the Administrator, in coordination with the Commission, establishes or approves standardized on-package labels under section 8(a) but subject to paragraph (2), it shall be considered a deceptive practice and unlawful under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) for any producer of a covered material to sell, use, distribute, or import in commerce any covered material that displays—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H39E770398FBB462C9C8CA8C93F5A59ED"><enum>(A)</enum><text display-inline="yes-display-inline">a chasing arrows symbol or any other symbol or statement indicating the covered material is recyclable or otherwise directing the consumer to recycle the covered material unless the covered material is considered recyclable under this Act; or</text></subparagraph>
<subparagraph id="H6505890F103F43E4B4F9BCB57294113C" commented="no"><enum>(B)</enum><text>a chasing arrows symbol surrounding a resin identification code, as prohibited by section 4(c).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1250757022A44C98B240032224A617F8"><enum>(2)</enum><header>Exceptions</header> <subparagraph commented="no" display-inline="no-display-inline" id="H04F077286D2E40409B5A5430DD646535"><enum>(A)</enum><header>Establishment or revision of standards</header><text display-inline="yes-display-inline">Paragraph (1) does not apply to a covered material—</text>
<clause commented="no" display-inline="no-display-inline" id="H9518BEB697824295AD92AD56BCE1126C"><enum>(i)</enum><text>if the covered material is manufactured before the date that is 18 months after the date on which the Administrator, in consultation with the Commission, publishes the standardized on-package labels under section 8(a), including any revisions; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H5B2EE71448864B03BA17E61A179060CE"><enum>(ii)</enum><text display-inline="yes-display-inline">if—</text>
<subclause commented="no" display-inline="no-display-inline" id="HF7C4AB85C6154F06A96F57599CEAE7FD"><enum>(I)</enum><text display-inline="yes-display-inline">the Administrator revises the criteria standards for recyclability;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H3145599E6ECC4A3CAB68346BA1FC383C"><enum>(II)</enum><text>the covered material met the criteria standards before the revision but no longer meets the criteria standards after that revision; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H3ABCBA0F99F74241BC43E5E4DEA3E186"><enum>(III)</enum><text>the covered material is manufactured before the date that is 18 months after the date of the revision.</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7B3FB84046EA4584893F0504EA6EC1E0"><enum>(B)</enum><header>Other exceptions</header><text>For purposes of this subsection, none of the following constitutes a deceptive or misleading claim about the recyclability of a covered material:</text>
<clause commented="no" display-inline="no-display-inline" id="HAEFFE0A8123A4FE0A2B9D6D4628D4503"><enum>(i)</enum><header>Symbology</header><text>A person using a chasing arrows symbol in combination with a clearly visible line placed at a 45-degree angle over the chasing arrows symbol to convey that an item is not recyclable.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HE0F6F1D100934985BAA22AD69CBE3317"><enum>(ii)</enum><header>Resin identification codes</header><text>A resin identification code placed inside a solid equilateral triangle.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H8FCD968D22B94D3D994130BB6B9DFB75"><enum>(iii)</enum><header>Qualified claim</header><text>A qualified claim of recyclability.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H89FC63AF3D02482CA895F9ED212A88F0"><enum>(3)</enum><header>Use on nonrecyclable products</header><text display-inline="yes-display-inline">Subject to paragraph (2), if the entirety of a covered material is not recyclable but components of the covered material are recyclable, a chasing arrows symbol or statement indicating that a covered material is recyclable may be displayed on the external packaging that is considered to be recyclable if the chasing arrows symbol or statement clearly describes in the same or greater font, font size, or symbol size—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H2A0E9E18CA2746CDBC6C1C98735ABFD9"><enum>(A)</enum><text display-inline="yes-display-inline">which components of the covered material are not recyclable; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE9A5FDE792084EEABC8843247987D563"><enum>(B)</enum><text>how to properly remove those components.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7101571097C1462799889237C9951DB2"><enum>(4)</enum><header>Applicability to consumable products</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H6544C4B0BAF74984A0AA5A260587EBF9"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of consumable product</header><text>In this paragraph, the term <term>consumable product</term> means a commodity that is intended to be used and not disposed of.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H434786F819084924946722FAD7274C40"><enum>(B)</enum><header>Rule</header><text>For purposes of this subsection, the display of a chasing arrows symbol or any other statement of recyclability on packaging containing a consumable product shall be deemed to only refer to the packaging.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H31F0404572D544E9BF69722519F97421"><enum>(c)</enum><header>Compostable criteria</header>
<paragraph commented="no" display-inline="no-display-inline" id="H9FF06C153BE347C1BD2199B2A6CD177D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date that is 2 years after the date on which the Administrator, in coordination with the Commission, establishes or approves standardized on-package labels under section 8(a) but subject to paragraph (2), it shall be considered a deceptive practice and unlawful under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) for any producer of a covered material to sell, use, distribute, or import in commerce any covered material that displays a symbol approved to indicate that a product is compostable, any statement indicating that the covered material is compostable, or otherwise directing the consumer to compost the covered material unless the covered material is considered compostable under this Act.</text></paragraph> <paragraph id="H98B1DF16007D468C88B94216CD786914"><enum>(2)</enum><header>Exceptions</header> <subparagraph commented="no" display-inline="no-display-inline" id="H35B9314429D94900916A4A9343839BD3"><enum>(A)</enum><header>Establishment or revision of standards</header><text display-inline="yes-display-inline">Paragraph (1) does not apply to a covered material—</text>
<clause commented="no" display-inline="no-display-inline" id="HE95A8F2D9B6C405B8BD182EB8B201A32"><enum>(i)</enum><text>if the covered material is manufactured before the date that is 18 months after the date on which the Administrator, in consultation with the Commission, publishes the standardized on-package labels under section 8(a), including any revisions; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HBA7E82E5688E4145AA707BE5E2C14C5F"><enum>(ii)</enum><text display-inline="yes-display-inline">if—</text>
<subclause commented="no" display-inline="no-display-inline" id="H1D2C9C2B7C9443BD82C0C70ECB800303"><enum>(I)</enum><text display-inline="yes-display-inline">the Administrator, in consultation with the Commission, revises the criteria standards for compostable;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H878B3AE80D3F47BFB63F91B42A46034C"><enum>(II)</enum><text>the covered material met the criteria standards before the revision but no longer meets the criteria standards after that revision; and</text></subclause>
<subclause id="H34B75ADF3BB84EC1838CA6FBA99C5011" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>the covered material is manufactured before the date that is 18 months after the date of the revision.</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H77B9EAAE32B64AE5A1144D0962303AEA"><enum>(B)</enum><header>Other exceptions</header><text>For purposes of this subsection, none of the following constitutes a deceptive or misleading claim about a covered material as being compostable:</text>
<clause id="H6CA22BDAD99F4B1AB8768CFFDAA10CF2" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header>Symbology</header><text>A person using a compostable symbol in combination with a clearly visible line placed at a 45-degree angle over the compostable symbol to convey that an item is not compostable.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H43A7BD700B15412882475AED1CF9DDF4"><enum>(ii)</enum><header>Noncompostable packaging</header><text>Directing a consumer to compost a product inside of a covered material through a composting program if the product inside the covered material is compostable but the covered material is not compostable.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HFDE2B48751724445AF718DACB01A5599"><enum>(iii)</enum><header>Qualified claim</header><text>A qualified claim of compostability.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCDFAA2F6083A4A50BF56E9334E6B5420"><enum>(3)</enum><header>Use on noncompostable products</header><text display-inline="yes-display-inline">Subject to paragraph (2), if the entirety of a covered material is not compostable but components of the covered material are compostable, a compostable symbol or statement indicating a product is compostable may be displayed on the external packaging that is considered to be compostable if the symbol or statement clearly describes in the same or greater font, font size, or symbol size—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H8CE384A5B7D74A7680CE233B7D9AD8E4"><enum>(A)</enum><text display-inline="yes-display-inline">which components of the covered material are not compostable; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H63575B26372A4C1882350E91873F78CE"><enum>(B)</enum><text>how to remove and dispose of those components.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4324479BB6C545D1975AF78A86039DAD"><enum>(4)</enum><header>Applicability to consumable products</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H9E7D823E3BA94252AF56FD3000057C28"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of consumable product</header><text>In this paragraph, the term <term>consumable product</term> means a commodity that is intended to be used and not disposed of.</text></subparagraph> <subparagraph id="H29338D4120984419840757A723A600A2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Rule</header><text>For purposes of this subsection, the display of a compostable symbol or any other statement that a covered material is compostable on packaging containing a consumable product shall be deemed to only refer to the packaging.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE26F076F40244E12BADF3B154AD64171"><enum>(d)</enum><header>Reusable and refillable criteria</header>
<paragraph commented="no" display-inline="no-display-inline" id="H5240C8B173774295B4CDE4D94EA2EF2A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date that is 2 years after the date on which the Administrator, in coordination with the Commission, establishes or approves standardized on-package labels under section 8(a) but subject to paragraph (2), it shall be considered a deceptive practice and unlawful under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) for any producer of a covered material to sell, use, distribute, or import in commerce any covered material that displays a symbol approved to indicate that a product is reusable or refillable, any statement indicating that the product or packaging is reusable or refillable, or otherwise directing the consumer to reuse or refill the covered material unless the covered material is considered reusable or refillable under this Act.</text></paragraph> <paragraph id="H53F5503A71AE4DD8A5512A6848CE2F70"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) does not apply to a covered material—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF3874D8E1DD541B58F406EF7BA9281B7"><enum>(A)</enum><text>if the covered material is manufactured before the date that is 18 months after the date on which the Administrator, in consultation with the Commission, publishes the standardized on-package labels under section 8(a), including any revisions; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA3F4A18CF2F345B688D7B96E527C06BF"><enum>(B)</enum><text display-inline="yes-display-inline">if—</text>
<clause commented="no" display-inline="no-display-inline" id="H0EC8C9DD2CBD4693BD224D81EF649D3D"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator, in consultation with the Commission, revises the criteria standards for reusable or refillable;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H3E6E8201DA474DBF9A8D9E5D313910F1"><enum>(ii)</enum><text>the covered material met the criteria standards before the revision but no longer meets the criteria standards after that revision; and</text></clause>
<clause id="H00A0E66327A54D4485427A55CFC21E8F" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>the covered material is manufactured before the date that is 18 months after the date of the revision.</text></clause></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H3DE40D9A8066485EB7EEF885A897C396"><enum>(e)</enum><header>Safe harbor</header> <paragraph commented="no" display-inline="no-display-inline" id="HA1508B0190FA412A9A34320AAB9788E3"><enum>(1)</enum><header>In general</header><text>A covered material included on a list published under section 5(e), 6(f), or 7(d) shall be considered recyclable, compostable, or reusable or refillable, respectively, for purposes of subsection (b)(1)(A), (c)(1), or (d)(1), respectively.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAA03129FA0D844EBB93BA5FFFD3469B7"><enum>(2)</enum><header>Grace period</header><text display-inline="yes-display-inline">If a covered material is removed from a list published under section 5(e), 6(f), or 7(d), for the 1-year period beginning on the date of removal, the covered material shall be considered recyclable, compostable, or reusable or refillable, respectively, for purposes of subsection (b)(1)(A), (c)(1), or (d)(1), respectively.</text></paragraph></subsection> <subsection id="HCD3BED2AD9E94F86920AFE483FB446FE"><enum>(f)</enum><header>Penalties</header> <paragraph commented="no" display-inline="no-display-inline" id="H60D0B3EE9D7946BCAAC658531A60E067"><enum>(1)</enum><header display-inline="yes-display-inline">Civil penalty</header> <subparagraph commented="no" display-inline="no-display-inline" id="HE6102DB137824914B43055DC3DA793A8"><enum>(A)</enum><header display-inline="yes-display-inline">Notification</header><text>In the case of a violation of this section, not later than 30 days after the date of a finding of the Commission of that violation, the Commission shall provide the person that violated this section notice of the violation and a 180-day period to rectify the violation.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H658F10FB28594B7195848ED8FE84FEEA"><enum>(B)</enum><header display-inline="yes-display-inline">Fines</header><text>Any person that violates this section, is provided notice under subparagraph (A), and does not rectify the violation by the end of the period described in that subparagraph shall be fined for each violation and for each day that the violation occurs under section 5(m)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(m)(1)(B)</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD0566D152227446EAF72540D972E84DA"><enum>(C)</enum><header>Use of funds</header> <clause commented="no" display-inline="no-display-inline" id="H0274CFF7CF3B4905A908F4BF0C101D77"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Any fines collected under subparagraph (B) shall be available to and used by the Administrator, without further appropriations, to carry out—</text>
<subclause commented="no" display-inline="no-display-inline" id="H0FA04CF41AF84BB7AC18DB4FDD86A52E">
                <enum>(I)</enum>
 <text display-inline="yes-display-inline">the Solid Waste Infrastructure for Recycling Grant Program authorized by section 302(a) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4282">33 U.S.C. 4282(a)</external-xref>);</text>
              </subclause>
<subclause commented="no" display-inline="no-display-inline" id="HE7DB078690C64BB79F9FFEEEDA769C45"><enum>(II)</enum><text>the Consumer Recycling Education and Outreach Grant Program established under section 70402(b) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6966d">42 U.S.C. 6966d(b)</external-xref>) to enhance recycling, composting, reuse, and refill infrastructure and education; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HE9DA38D9E8DC435693E0E2F743723EE7"><enum>(III)</enum><text>any educational or outreach program authorized by this Act.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H2C79F8389D754FBBB8C8B334100CE4B9"><enum>(ii)</enum><header>Supplement; not supplant</header><text>Any amounts made available by clause (i) shall supplement, and not supplant, any other amounts made available to carry out the programs described in subclauses (I) and (II) of that clause.</text></clause></subparagraph></paragraph> <paragraph id="H5A9B8113F94E46ADACCA63D32DDF9ABB"><enum>(2)</enum><header>Injunctive relief</header><text>The Commission may bring a civil action to enjoin the sale, distribution, or importation into the United States of a covered material in violation of this Act.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H289B7246F99343A4AAAEA955B7D1619A"><enum>(3)</enum><header>State enforcement</header><text>The Commission may permit a State to carry out enforcement under paragraph (1)(A) or (2) if the Commission determines that the State meets such requirements as the Commission may establish.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H9C5F67DEA5C04489B09CDF30A92F8A6E"><enum>(4)</enum><header>No preemption</header><text>Except as provided in section 4(c), nothing in this Act shall preempt any State law.</text></paragraph></subsection>
<subsection id="HD5D1C178DC814D45979A20E0B7A1E196"><enum>(g)</enum><header>Green guides</header><text>In the case of a conflict between any provision of this Act and part 260 of title 16, Code of Federal Regulations, the provision of this Act shall control.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H3D0034ECDA33411C822B9D2298A6F127"><enum>(h)</enum><header>Commission regulations</header><text>The Commission may promulgate such regulations as the Commission determines are necessary to carry out this Act.</text></subsection></section>
<section id="H41840B7E69064A208247650233671CAD"><enum>12.</enum><header>Education campaign</header>
<subsection commented="no" display-inline="no-display-inline" id="HF5913A5E7C484D52BD46A62D0FC32A8B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Commission, States, units of local government, Indian Tribes, material recovery facilities, impacted industries, nonprofit organizations, institutions of higher education, and other relevant stakeholders, shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H6E201B9863294B7B98ACD4B2B0939489"><enum>(1)</enum><text display-inline="yes-display-inline">develop, based on the results of studies, reports, inventory, and data collected under the nationwide analysis required under section 4(d), best practices that States, units of local government, nonprofit organizations, and Indian Tribes may use to educate consumers on the labels established pursuant to this Act; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD3FC84EB7E07434F9B96673292982088"><enum>(2)</enum><text>provide the best practices developed under paragraph (1) to States, units of local governments, and Indian Tribes through the Model Recycling Program Toolkit, or a similar resource.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H484D3697A6904652847B29F7E6A142CF"><enum>(b)</enum><header>Multiple recovery methods</header><text>The Administrator shall prepare and distribute consumer educational materials relating to the preferred recovery method for covered materials that are considered recyclable and compostable, based on the recovery method that creates the highest value for post-consumer use.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HBD48D42AAEF344669A4B24B3372E6AA4"><enum>13.</enum><header>Compatibility</header><text display-inline="no-display-inline">In carrying out this Act, the Administrator shall encourage producers, in coordination with the supply chains for the production of labels, including substrate suppliers, converters, and ink suppliers, to work with the recycling, composting, reuse, and refill industries to address label compatibility challenges.</text></section> <section id="HADCD72DBFFF84004A7D2109BCAECD040"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of that provision to any person or circumstance is held to be unconstitutional, the remaining provisions of this Act and the application of those provisions to any person or circumstance shall not be affected.</text></section>
